HomeMy WebLinkAboutBylaw 1876 - - Grainger Hesketh Water Local Improvement,rlCneehill COUNTY BYLAW NO 1876 GRAINGER-HESKETH WATER LOCAL IMPROVEMENT BYLAW AMENDMENT A BYLAW OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, FOR THE AMENDMENT OF BYLAW 1601, 1692 AND 1696, BYLAWS AUTHORIZING THE COUNCIL OF THE MUNICIPALITY TO IMPOSE A LOCAL IMPROVEMENT TAX IN RESPECT OF ALL LANDS THAT DIRECTLY BENEFIT FROM THE GRAINGER-HESKETH WATER SERVICE AREA PROJECT WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000 Chapter M-26 as amended, Section 402, if, after a local improvement tax has been imposed, there is (a) a subdivision affecting a parcel of land, or (b) a consolidation of 2 or more parcels of land, in respect of which a local improvement tax is payable, the council, with respect to future years, must revise the local improvement tax bylaw so that each of the new parcels of land bears an appropriate share of the local improvement tax; AND WHEREAS Kneehill County Council wishes to amend Bylaw 1696 to implement revisions required by subdivision activity; NOW THEREFORE, the Council of Kneehill County, duly assembled, enacts as follows: PART ONE INTRODUCTION 1. TITLE This Bylaw shall be known as the "Grainger-Hesketh Water Local Improvement Bylaw Amendment". 2. CONDITIONS (1) Schedule "B" of Bylaw 1696 is hereby amended and replaced by Schedule "B" attached hereto. PART TWO TRANSITION 3. SEVERABILITY (1) If a portion of this bylaw is found by a court of competent jurisdiction to be invalid, the invalid portion will be voided, and the rest of the bylaw remains valid and effective. 4. EFFECTIVE DATE (1) This bylaw comes into effect upon third reading of this bylaw. 5. BYLAW REPEAL (1) Bylaw No. 1850 is hereby repealed.
