Signing of Agreements April 14, 2015 139/15
PURPOSE:
To ensure proper controls and awareness is made when entering into formal agreements.Section 213(4) of
the MGA states"Agreements and cheques and other negotiable instruments must be signed and authorized
(a) by the chief elected official or another person authorized by council to sign them, and (b) by a designated
officer,or, by a designated officer acting alone if authorized by council."
POLICY STATEMENT/GUIDELINES:
1. The Chief Administrative Officer(CAO),or designate, shall have the authority to enter into operational
agreements of any amount so long as the operational service or provision of goods covered in the
operational agreement was approved in the Operating Budget by Council.
2. Operational agreements are agreements that directly relate to the delivery of the County's operation
and/or program areas. They include but are not limited to:
a. janitorial agreements
b. equipment rentals
c. maintenance agreements
d. professional services agreements—renewals or extensions
e. service agreements
3. There maybe a requirement in some operational agreements to have the chief elected official or other
authorized by Council(Deputy Reeve),to countersign the agreement with the Chief Administrative
Officer(CAO) or designate.
4. Non-operational agreements shall include but are not limited to:
a. joint agreements with municipalities
b. construction and capital project agreements
c. cost sharing agreements
d. awarding of grants
e. professional services agreements
5. Non-operational agreements shall include signatures of the Reeve or Deputy Reeve,and the CAO or
Director of Corporate Services. The corporate seal shall be affixed if required.
6. Council shall at all times pass a motion (or bylaw if necessary)when entering into non-operational
agreements.
7. Council may direct administration to have agreements reviewed by County's solicitor for opinion.
8. All operational agreements shall be identified in the annual budget.
