THIS BEING A BYLAW OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, TO APPOINT AN
ASSESSOR AS A DESIGNATED OFFICER
WHEREAS section 284 of the Municipal Government Act (Alberta), Chapter M-26, and amendments thereto require that an
Assessor be appointed as a Designated Officer;
AND WHEREAS section 210 of the Municipal Government Act (Alberta), Chapter M-26, describes the appointment of
Designated Officers;
NOW THEREFORE the Council of Kneehill County in the Province of Alberta, duly assembled, enacts as follows
1. In this Bylaw:
1.1. "Assessor" shall mean a person who has the qualifications set out in the Municipal Government Act (Alberta) and:
1.1.1. is designated by the Minister to carry out the duties and responsibilities of an Assessor under the Municipal
Government Act (Alberta);or
1.1.2. is appointed by the municipality to the position of designated officer to carry out the duties and
responsibilities of an Assessor under the Municipal Government Act (Alberta); and includes any person to
whom those duties and responsibilities are delegated by the person referred to in clause (1.1.1.) or (1.1.2);
1.2. "Council" shall mean the Council of Kneehill County;
1.3. "Designated Officer" shall mean the person designated pursuant to section 1.1.1, herein;
1.4. Words importing the masculine gender only include the feminine gender whenever the context so requires and vice
versa.
1.5. Words importing the singular shall include the plural whenever the context so requires and vice versa.
2. APPOINTMENT OF ASSESOR
2.1. Council hereby appoints Troy Birtles with Accurate Assessment Group Ltd. of Sherwood Park, Alberta as Designed
Officer of Kneehill County in pursuant to the provision of the Municipal Government Act (Alberta), Chapter M-26,
as amended.
3. DUTIES OF ASSESOR
3.1, The Designated Officer shall carry out the duties of Assessor as described in Parts 9, 10, 11, and 12 of the Municipal
Government Act (Alberta), Chapter M-26 as amended.
4. CONTRACTOR
4.1. For all purposes, Troy Birtles, and staff of Accurate Assessment Group Ltd. shall be deemed to be an independent
contractor serving under contract to Kneehill County and shall not be deemed to be an employee of Kneehill
County.
5. PREVIOUS APPOINTMENTS RECINDED
5.1. Council hereby rescinds Bylaw 1527 and all previous appointments of Assessor for Kneehill County.
6. SEVERANCE
6.1. If any provision herein is adjudged by a Court of competent jurisdiction to be invalid for any reason, then that
provision shall be severed from the remainder of this Bylaw and all other provisions of this Bylaw shall remain
valid and enforceable.
7. COMING INTO EFFECT
7.1. This Bylaw shall come into force and effect on the final day of passing thereof.
