HomeMy WebLinkAboutBylaw 1747 - Election Bylaw* Oil nit" BYLAW NO 1747 ELECTION BYLAW A BYLAW OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, TO PROVIDE FOR MUNICIPAL ELECTIONS IN KNEEHILL COUNTY. WHEREAS, pursuant to the Local Authorities Election Act, Section 29, an elected authority may require that every nomination be accompanied by a deposit in the amount specified by bylaw; AND WHEREAS, pursuant to the Local Authorities Election Act, Section 33(1), an elected authority may provide for events in circumstances of a death of a candidate. NOW THEREFORE, the Council of Kneehill County, duly assembled, enacts as follows: PART ONE TITLE 1. This Bylaw shall be known as the "Election Bylaw". PART TWO NOMINATION DEPOSIT 2. Kneehill County Council hereby enacts that every nomination for the office of Councillor for Kneehill County must be accompanied by a cash deposit as provided in Kneehill County's Master Rates Bylaw. PART THREE DEATH OF A CANDIDATE 3. If a candidate for any position dies after being nominated but before 9:00 a.m. on Election Day, the election for that position will be discontinued, and the appropriate elected authority will arrange a new election for the position as soon as practicable. 4. The appropriate Elected Authority will arrange a new election for the position as soon as practicable. PART THREE TRANSITION 5. SEVERABILITY If a portion of this bylaw is found by a court of competent jurisdiction to be invalid, the invalid portion will be voided, and the rest of the bylaw remains valid and effective. 6. EFFECTIVE DATE This bylaw comes into effect upon third reading of this bylaw. 7. BYLAW REPEAL Bylaw 1259 and Bylaw 1106 are hereby repealed. aw No. 1747, Election Bylaw Page 2 of 2 READ a first time on this 13th day of June, 2017.
