WELL DRILLING EQUIPMENT TAX BY-LAW
BEING A BYLAW OF THE COUNCIL OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, TO PROVIDE
FOR THE IMPOSITION OF A TAX ON EQUIPMENT USED IN THE DRILLING OF A WELL FOR WHICH A
LICENSE IS REQUIRED PURSUANT TO THE OIL AND GAS CONSERVATION ACT.
WHEREAS, pursuant to the Municipal Government Act, Chapter M-26, Revised Statutes of Alberta 2000,
as amended, a Municipal Council has authority to govern and the authority to pass Bylaws respecting
the municipality, including services provided by or on behalf of the Municipality; and,
WHEREAS pursuant to Section 388 of the Municipal Government Act, RSA 200, c.M-26, as amended, a
Municipal Council has authority to pass a well drilling equipment tax bylaw,
NOW THEREFORE, The Council of Kneehill County, in the Province of Alberta, duly assembled, enacts as
follows:
1. That the Chief Administrative Officer is hereby authorized and required to levy a tax in respect of
equipment used to drill or deepen and well for which a license is required pursuant to the Oil and
Gas Conservation Act, RSA, c 0-6, as amended.
2. The tax levied under this bylaw is payable by the person who holds the license required under the
Oil and Gas Conservation Act in respect of the well.
3. A tax imposed under this bylaw shall be calculated in accordance with the tax rate prescribed in
the regulation made by the Minister of Municipal Affairs pursuant to s. 390(1) of the Municipal
Government Act, as updated from time to time.
4. Bylaw No. 1327 is hereby repealed.
5. This Bylaw shall come into force when it receives third reading and is signed in accordance with
s. 213 of the Municipal Government Act.
