HomeMy WebLinkAboutBylaw 1570 - Clubroot Control BylawKNEEHILL COUNTY BYLAW #1570 A BYLAW OF THE MUNICIPALITY OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, TO PREVENT THE ESTABLISHMENT OF OR TO CONTROL OR DESTROY, THE DISEASE KNOWN AS CLUBROOT ON COUNTY ROAD ALLOWANCES WHEREAS, pursuant to the Agricultural Pests Act, RSA 2000, Chapter A 8, as amended A local authority may, with respect to a highway that is subject to the direction, management and control of the local authority may by bylaw provide that an owner or occupant of land is for the purposes of this Act the occupant of that portion of a highway that lies between the boundary of the land the owner owns or occupier occupies and the centre line of the highway, NOW THEREFORE the Council of the municipality of Kneehill County, in the Province of Alberta, duly assembled hereby enacts as follows 1 Effective upon this Bylaw receiving three readings, the owner s) or occupant(s) of lands, shall for the purpose of this bylaw be deemed to be the occupant of that portion of any highway (road allowance) in the control of the municipality which adjoins his/their land and lies between the boundary of his/their land and the center line of the highway (road allowance), 2 That the Agricultural Pests Act, Chapter A-8 2000 will apply to the said land in the same manner that it applies to privately owned land, 3 That the Council of the municipality of Kneehill County shall make provision and be responsible for the control of Clubroot on said land where established grass growth has been disrupted for the construction of new roads, installation of culverts or any road repairs, until new grass has been re-established, 4 That the Council of the municipality of Kneehill County may make provision to assist owners or occupants in the control of Clubroot on the said road allowances, COUNCILLOR HOPPINS moved first reading to Bylaw 1570 on March 11, 2008 COUNCILLOR LONG moved second reading to Bylaw 1570 on March 11, 2008 COUNCILLOR HOPPINS moved third reading be given to Bylaw 1570 on March 11, 2008 COUNCILLOR LONG moved third reading to Bylaw 1570 on March 11, 2008 Reeve CAO
