CARRIED MINUTES 3.0 Approval of the Council Meeting minutes 570/05 Councillor Calhoun moved approval of the October 11, 2005 Regular Council Meeting minutes. CARRIED 571/05 Councillor Holsworth moved approval of the October 11, 2005 Public Hearing minutes. CARRIED KRWSC Presentation: John Van Doesburg - Kneehill Regional Water PRESENTATION Services Commission (KRWSC) Mr. Van Doesburg provided an update on the status of the Kneehill Regional Water Services Commission project, distributing and detailing the terms of the Operating Agreement with Kneehill County, as well as summarizing the Road Right of Way Occupancy Agreement and the Road Crossing Agreements. 572/05 Councillor Crawford moved to receive the KRWSC report, as presented. ' KNEEHILL COUNTY COUNCIL MEETING MINUTES October 25, 2005 4.0 Accounts Payable ACCTS PAYABLE Councillor Calhoun moved approval of the accounts presented for 573/05 payment. CARRIED LJ OLD BUSINESS 5.0 Financial Statements (reports attached and forming part of the minutes) 574/05 Councillor Calhoun moved to receive the Financial Reports, as presented. CARRIED OLD BUSINESS 6.0 Business from Previous Meeting COMM SUMMIT 6.1 Community Summit Report Councillor Crawford presented a verbal report of the October 18, 2005 Community Summit meeting, noting all the municipalities were represented, and a Protocol for Regional Cooperation had been developed for review and signing by all the municipalities within Kneehill County. 575/05 Councillor Hoppins moved to receive the Community Summit Report, as presented. CARRIED The meeting recessed from 10:05 A.M. until 10:15 A.M. 7.0 New Business 7.1 Donation Policy #16-11 (report attached and forming part 576/05 of the minutes) Councillor Hoppins moved to receive the draft Donation Policy #16-11. CARRIED 7.2 Bylaw #1511 Water Utility Bylaw (report attached and forming part of the minutes) BYLAW 1511 Councillor Crawford moved first reading of Bylaw #1511. 577/05 CARRIED Bylaw #1511 to be placed on November 8th Council Meeting Agenda for further readings. LJ C PROTOCOL 7.3 Community Summit Protocol for Regional Cooperation COMM SUMMIT (attached and forming part of the minutes) 578/05 Councillor Calhoun moved that Council receive the Community Summit Protocol for Regional Cooperation. CARRIED This issue to be placed on November 8th Council Meeting Agenda, for approval and signing. BYLAW 1526 7.4 Bylaw #1526 - Load Limit on Bridge File #9735 (SSE 2-30- 26-W4) (report attached and forming part of the minutes) 579/05 Councillor Holsworth moved first reading of Bylaw #1526, this being a bylaw to amend Bylaw #1271 by imposing a 20 Tonne Load Limit on Bridge File #9735. CARRIED 580/05 Councillor Wittstock moved second reading of Bylaw # 1526. CARRIED 2 Reeve CA KNEEHILL COUNTY COUNCIL MEETING MINUTES October 25, 2005 581/05 Councillor Hoppins moved consideration be given for third reading of Bylaw # 1526. CARRIED UNANIMOUSLY • 582/05 Councillor Hoppins moved third reading of Bylaw # 1526. CARRIED The issue of maintenance and replacement of bridges within the County referred to Administration and Strategic Planning. Entering the meeting to hear the E911 Dispatch presentations were: Trevor Gardner, Dick Gust, Tammie Dick, Len Schafer, Greg Skotheim, Debra Grosfield, Maureen Malaka, and Ed Guenette. Ms. Coghill entered the meeting at 10:40 A.M. 0 911 PRESENTATIONS Presentation - Linda Coghill - Dispatch 911 Rocky Mountain House A power point presentation on the E911 package being offered to provide Call Answer and Dispatch services to Kneehill County was given by Linda Coghill, owner of the Rocky Mountain House 911 service. Ms. Coghill left the meeting at 11:05 A.M. The meeting recessed from 11:05 A.M. until 11:15 A.M. Mr. Hickey was present when the meeting reconvened. Presentation - Ted Hickey/ Bart Rowland - City of Red Deer E911 Dispatch Mr. Ted Hickey from the Red Deer Emergency Communications Branch, current provider of E91 1 service to Kneehill County, presented information on the 911 Regional Call Answer and Dispatch services they would offer to Kneehill County for the next three years. 0 Mr. Hickey, Mr. Rowland and those present to hear the E911 presentations left the meeting at 11:45 A.M. CORR REPORT 7.0 Correspondence Report (attached and forming part of the minutes) Councillor Knievel moved that Council receive the 583/05 Correspondence Report. CARRIED 587/05 Councillor Holsworth moved that Council approve the recommendation of staff regarding the selection of the E911 Dispatch Provider for Kneehill County, and that the towns and villages within Kneehill County be notified of this decision. Since late 2003 there have been five instances, I am aware of, where donations have been made or offered to the County. Income Tax receipts have not been traditionally issued but have been requested. Some examples are: A small cash donation was made by a company related to the oil and gas industry to go toward any Torrington project. Last year an oil company donated coveralls to for the County for the Torrington Fire Department, but did not request a receipt. Receipts may be issued for cash or goods, however specific guidelines pursuant to the Income Tax Act and Regulations should be followed. 0 Discussion: A policy should be in place so that any donation considered for acceptance is appropriate to the operation of the municipality and a process is in place for approval. A copy of the proposed policy is attached to this recommendation for Council's perusal. Financial Implications: Nil. Any appraisals required would be the responsibility of the donor. POLICY STATEMENT The Council recognizes the importance donations of cash and goods in kind from third parties in support of approved municipal programs. The County will manage third party donations in a manner that: a) Establishes the criteria for accepting any cash donation or donation in kind, whether a receipt is required or not, as follows: i) must fall within the scope of operations of the County ii) is of benefit to the County iii) is in good condition, if it is a good iv) an appraisal to establish the value is obtained on the good or service v) Canada Revenue Agency guidelines for donations are met. b) Ensures the CAO establishes the procedures necessary for implementation of this policy. PROCEDURES: 1. Staff make written recommendations to the CAO to accept any donation of cash, goods or services in kind using the criteria as established in this policy. a) Donations of $ 10,000.00 or more must be accompanied by at least two written appraisals from independent third parties who have knowledge of the value of the particular good or service. The valuation will be filed with the copy of the receipt. b) Staff may use one independent third party, catalogues or other rate schedules to establish fair market value for the good or service for donations of less than $ 10,000.00. The valuation will be filed with the copy of the receipt. 3. The County will issue Tax Receipts for donations in kind for goods and services as set out in this policy and the Income Tax Act. 4. From: Barb Long Date: October 20, 2005 Issue: Water Utility Bylaw #1511 Backgrounds At the request of Council, and due to the progression of the Linden North Water Project, Al Kostrosky has developed Water Utility Bylaw #1511 for consideration by Council. Further utility service bylaws will be developed as needed and once accepted will be combined into one bylaw. Discussion: Attached is the draft Bylaw # 1511. Recommendation: That Council give first reading to Bylaw # 1511. B - ?Vnq- B. Long 28 of 97 BYLAW NO. 1511 C-7 BEING A BYLAW OF THE COUNTY OF KNEEHILL, IN THE PROVINCE OF ALBERTA, TO REGULATE AND PROVIDE FOR THE SUPPLY AND USE OF WATER, IN KNEEHILL COUNTY. PART 1 ENACTMENT WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000, Chapter M-26, as amended, a Municipal Council may pass bylaws for municipal purposes respecting public utilities; AND WHEREAS, Kneehill County has constructed and maintains utility systems and related facilities for the purpose of providing water utility services; WHEREAS Kneehill County deems it appropriate and necessary to levy rates and charges on all persons to whom such utility services are provided and to set forth the terms and conditions under which such utility service will be provided. 0 NOW THEREFORE THE MUNICIPAL COUNCIL OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED, ENACTS AS FOLLOWS: This bylaw may be called "The Water Utility Bylaw" PART 2 DEFINITIONS 2 In this Bylaw and in the Schedules attached hereto: a) "Application" means the application made by the customer to the County for the supply of utility services; b) "Billing Period" means the calendar month for which the County assesses its Utility Services, and for greater certainty, the following are Billing Periods: February; April; June; August; October; and December • c) "Building" means any structure used or intended for supporting or sheltering any use or occupancy; d) "Building Code" means the Alberta Building Code 1997 and amendments thereto or replacements thereof; 29 of 97 0 e) "Chief Administrative Officer or CAO" means the Chief Administrative Officer appointed by Council, or the Chief Administrative Officer's designate. f) "Council" means the Council of Kneehill County. 0 • g) "County" means the municipal boundaries outlined and designated as Kneehill County h) "Customer" means any Person to whom the County supplies Utility Services, and shall be deemed to be in a situation where the occupant is the registered owner or purchaser or a Building or lot or part of a lot, the occupant. i) "Due Date" means the date set out in the invoice of the County by which a Utility Charge shall be paid. The Due Date will ordinarily be the fifteenth of the second month following the Billing Period, or if that day falls on a day other than a business day, the prior business day. j) "Financial institution" means a bank, a trust company, or a credit union, located in the County; k) "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, Lane, alley, square, bridge, causeway, trestle way or other place, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of Vehicles and (i) includes: a) a sidewalk (including the boulevard portion of the sidewalk); b) if a ditch lies adjacent to and parallel with the roadway, the ditch; and c) if a Highway right of way is contained between fences or between a fence and one side of the roadway, all the land between the fences, or all the land between the fence and the edge or the roadway, as the case may be, but (ii) does not include a place declared by the Lieutenant Governor in Council not to be a Highway; LJ 30 of 97 1) "Matter" means any solid, liquid or gas. m) "Meter" means an apparatus used for measuring a supply of water delivered to or received by a customer; n) "Metering equipment" means the devices used to control pressure and regulate flow at the service connection; 0 o) "Outstanding Account" means any Utility Charges (or any portion of) for which the County has not received payment on or before the Due Date. 0 C7 0 31 of 97 p) "Owner" means the registered owner of any Premises; q) "Person" means a natural Person, body corporate, proprietor, association, society or partnership. r) "Premises" means any land or Building or both or any part thereof located within the County. s) "Release" means to directly or indirectly spill, discharge, spray, inject, inoculate, abandon, deposit, leak, seep, pour, drain, emit, empty, throw, dump, place or exhaust either intentionally or unintentionally t) "Residential Customer" means those persons who occupy a building used exclusively for residential purposes and connected to or provided with utility services. u) "Service Connection" means that portion of the Water System works located on the property line which connects the main lines of the Water System with the service lines located on private property. v) "Utility" means the Water System. w) "Utility Charges" means the fees imposed by the County for Utility Services pursuant to this Bylaw. x) "Utility Contract" means the agreement between the County and the Customer for the supply of Utility Services in the form set out in Schedule "B" to this Bylaw. y) "Utilities Officer" means the CAO or designate authorized to act on behalf of Kneehill County; z) "Utility Service" means the supply of water delivered via the Water System. aa) "Water System" means any of the County's works for the collection, transmission, treatment and distribution of water including all lines, equipment and apparatus on the County side of the Service Connection, the Service Connection, Meters and Metering Equipment; • PART 3 • GENERAL PROVISION Supervision 3.1 The Utilities Officer has the general supervision and control of the Utility Services. 3.2 The Utilities Officer is hereby authorized to do all things necessary in order fulfill the Utilities Officer's authority under this Bylaw. 3.3 The Utilities Officer or any municipal employee or agent requested by the Utilities Officer may: a) enter at all reasonable times to a Premises on which the Customer was or is supplied with Utility Services, for the purpose of installing, maintaining, removing or replacing any fittings, wires, machines, apparatus, meters, pipes or other things that are the property of the County; and 0 b) otherwise inspect, construct and maintain all works, wells, pipes, poles, erections and machinery requisite for any Utility Service vested in the County. 3.4 Any Person who considers themselves to be aggrieved by a decision of the Utilities Officer may appeal the decision to Council; a) An appeal shall be made within thirty (30) days of receipt of the Utility Officer's decision; b) All appeals shall be in writing addressed to the Utilities Officer; and c) The Council's decision respecting an appeal shall be final and binding. r1 LJ 3.5 The Utilities Officer or any municipal employee or agent requested by the Utilities Officer, may perform all construction, maintenance, sampling tests, inspections, repairs, placement settings, or alterations with respect to water meters, or any utility, pipe, wire connection or tap within the County's authority. 32 of 97 0 Supply and Ownership of Facilities and Equipment C7 4 Unless otherwise provided in this Bylaw, the County shall own, supply,' and maintain all elements of the Water System including Meters and Metering Equipment. County Responsibility and Liability > The County does not guarantee the continuous or uninterrupted supply of Utility Services. The County reserves the right to, at any time and without notice to the Customer, shut off the supply of the Utility Services where shut off is required in the maintenance or operation of the Utility or in an emergency situation. The County, its officers, employees and agents shall not be liable for any damages of any kind arising directly or indirectly out of a failure to supply Utility Services. PART 4 APPLICATION FOR AND CONDITIONS OF SERVICE Application 6.1 Any Person who wants to be supplied with Utility Services must submit a completed Utility Application in the form attached as Schedule "A" to this Bylaw. Once the Application has been approved by the Utilities Officer, the Person must comply with the rules outlined in the Water Service Standards, Schedule B, of this Bylaw prior to being supplied with Utility Services. 6.2 The application fee shall be waived in the following circumstances: a) Registered owners of residential properties who are making Application for Utility Services supplied to the residential properties which are registered in their name; b) Building contractors who are making Application for Utility Services for properties under construction until such time as the property has been issued an Occupancy Permit; c) Financial institutions which are making Application for Utility Services to be supplied to residential properties which are the subject of foreclosure proceedings and where legal title to the property has passed to the financial institution pending the sale of the property. 0 33 of 97 LJ Assignment of Contract • 7. The Customer may not assign nor transfer the Utility Contract to another Person. Conditions of Service 8. The County shall not provide Utility Services to any Premises until the County has been provided access to the Premises for the purpose of obtaining an initial Meter reading. Termination of Utility Contract 9. The Utility Contract remains in full force and effect until the Utility Contract is terminated in accordance with Part 10 of this Bylaw. PART 5 METERS Measurement by Meter 10. All water supplied by the County to a customer shall be measured by a meter unless otherwise provided for in this bylaw. Protection of Meter 11.1 Each customer shall provide adequate protection for the meter supplied by the County against freezing, heat or any other internal or external damage, failing which the customer shall pay to the County all costs associated with the repair of such meter which amount shall be recoverable in the same manner as all other costs and charges provided for under this bylaw. • 11.2 Only County authorized personnel shall install, inspect, maintain, remove, disconnect or reconnect a Meter or Metering Equipment Meter Installation 12 Every customer who requires the installation of more than one meter for each metered utility, shall pay a fee, as set out in the Annual Fee Bylaw. 34 of 97 C. Non-Registering Meter .7 L' LJ 13.1 If, upon the reading of a meter, it is determined that the meter has failed to record the consumption of the utility supplied then the consumption will be estimated, by averaging all billing cycles in the 12 months preceding this bill. 13.2 Where it has been determined by the County that the meter is not recording the consumption of a utility, the County, with reasonable notice to the customer, must be allowed to enter the premises to replace the meter. Testing or Calibration of Disputed Meters 14.1 A customer who disputes a meter reading shall give written notice to the County. Following receipt of written notice: (a) a water meter situated on the customer's premises shall be tested or calibrated by a qualified person designated by the Utility Officer. In the event that the meter is found to accurate within 98.5% to 101.5% of the water passing through the same, the expense of such test or calibration shall be borne by the customer in the amount designated in the Annual Fee Bylaw. 14.2 In the event that the said meter is found not accurate within the said limits as outlined in 14.1, it shall forthwith be repaired or be replaced by one that is accurate and the expense thereof shall be borne by the County. 14.3 In the event that a meter is found not to be accurate within the limits, as outlined in 14.1, then any meter handling and testing fees paid by the customer shall be refunded, and the billings adjusted to fully take into account such error. Unless an examination of past readings or other information discloses the time at which such error commenced, then such error shall be deemed to have commenced three months prior to such testing of the meter or from the date upon which the meter was installed, whichever is the lesser. The amount so determined shall be deemed accepted by the customer and the County as settlement in full of all claims on account of the inaccuracy of such meter. PART 7 METER READING Meter Reads 35 of 97 0 15.1 The County shall perform Meter reading using automated monitoring equipment where the County deems it appropriate to do so. 0 15.2 The County will endeavor to read the meters of customers once every two months, or at such other intervals as are reasonable and practicable under the circumstances. If the County cannot gain access safely to read the meter as aforesaid, the consumption of the utility shall be estimated upon as outlined in Paragraph 13.1, Non -Registering Meter, and the account rendered in accordance with such estimate. Each meter shall be read at least once per year and if such reading cannot be obtained, the County may discontinue any or all utility services supplied to the premises until such time as the County is able to obtain an actual meter reading. 15.3 The customer shall ensure that access to the meter is safe, well lit, and free of hazards to the person reading the meter. If guard dogs are on the premises, the owner may be requested to have them put in a kennel or restrained prior to the meter reading. Additional Meter Reads 16. When a customer requests a meter reading at a time other than the regular scheduled time for meter reading, the customer, at the discretion of the Utility Officer, may be assessed a fee, as stated in the Annual Fee Bylaw. PART 8 SERVICE CALLS Service Charge 17. When a customer requests that the County attend their premises with respect to any matter relating to the supply of utility services or the servicing of the same, and for any reason whatsoever the County is unable to enter the said premises, or if the call is for failure of service not attributable to the County utility service, the customer shall pay a fee, as stated in the Annual Fee Bylaw. After Hours Calls 18. Notwithstanding anything herein provided, if a meter is ordered to be installed or connected, or should a utility service be required to be disconnected or reconnected, or should a service call requested, be required after 4:00 p.m. or before 7:00 a.m., Monday through Friday, or on a Saturday, Sunday, or general or civic holiday, a fee, as stated in the Annual Fee Schedule, Bylaw, shall be paid by the customer. 36 of 97 0 0 0 Disconnection 19. Where a service call is made at the Customer's request, for whatever reason, for the purpose of discontinuing a utility service, a disconnection service charge, as stated in the Annual Fee Bylaw, will be assessed and added to the owner's account. Reconnection 20. Where a service call is made for the purpose of restoring services to the customer's account where utility services were previously discontinued, a reconnection service charge as stated in the Annual Fee Bylaw, will be assessed at the discretion of the Utility Officer and added to the customer's account. PART 9 UTILITY ACCOUNTS Payment of Utility Accounts 21.1 The County shall levy Utility Charges on all Premises in accordance with the Utility Charges set by the Annual Fee Bylaw. 21.2 The County shall levy Utility Charges for all Premises on a monthly basis, unless otherwise agreed in writing. 21.3 A Customer is not relieved from paying Utility Charges by reason of non-receipt of a Utility Account, whatever the reason for non-receipt. 21.4 A Customer shall pay the applicable Utility Charges on or before the Due Date at the County's administration building. Utility Charges may also be paid at a Chartered Bank within the County provided that lending institution agrees to accept payment. 21.5 Any Customer to whom Utility Services have been shut off or discontinued at the request of the Customer or for committing a breach of this Bylaw shall, upon having paid any Utility Charges owing, and upon requesting the County to restore Utility Services, pay to the County a reconnection charge set by the Annual Fee Bylaw. 21.6 Outstanding Accounts for current Utility Charges will be assessed a one time interest charge of three and one half per cent (3.5)% and any interest charge is deemed to be a Utility Charge. 37 of 97 0 Late Payment Penalty 0 22.1 When the customer pays the utility account as rendered after the due date stated in the account, or such due date as may be approved by the Utility Officer, such customer shall pay a penalty, as stated in the Annual Fee Bylaw. Payments made at a financial institution must be received by the County on or before the due date in order for the customer to avoid the penalty. 0 22.2 For greater certainty, a customer is obliged to pay for utilities when the bill is rendered and it is a breach of the agreement to supply utilities for the customer to pay late. The late payment penalty is not to be construed as permission for the customer to pay late but is rather a penalty for breaching the terms of the utility service agreement. Novelty Payment Methods 23. The County may refuse to accept payment on a customer's account when payment by cheques is drawn on a form other than a bank cheque form. In the event the County accepts payment by a cheque drawn on any other form, the customer shall be liable for and pay the County all charges and costs incurred to process the cheque. The County may follow the Bank of Canada rules and regulations of currency acceptance limitations. Interim Account 24.1 In any case in which the County has rendered an account based upon an estimate of utility consumption, the County shall, upon reading the meter in respect of which the estimate was made, render an account for such utility service since the time the meter was last read by the County, after crediting all amounts received from the customer in respect of such estimated accounts. 24.2 Where any service rate or charge is designated by reference to a time certain, the charge for a lesser period of time shall be calculated on a proportionate basis. Enforcement 25.1 Compliance with this Bylaw is a condition of providing services to a Premises; if the use of Utility Services at a Premises does not comply with this Bylaw, the County may pursue its enforcement options. 38 of 97 ?:J 0 Enforcement of rectification of breaches of this Bylaw, including enforcement of payment of Outstanding Accounts may be undertaken by the County by any or all of the following methods: may add a) action in the court of competent jurisdiction; b) shutting off any or all of the Utility Services being supplied to the Customer as the Premises or otherwise discontinuing the service thereof, provided that the County has attempted to provide the Customer with at least seven (7) days notice by mail (including a notice in the monthly account), or at least a twenty-four (24) hour notice posted at the Premises. c) where the owner of a parcel is a Customer, the Utilities Officer any Outstanding Account to the tax roll for the parcel. 0 0 25.2 If payment is remitted for part but not all of the Utility Charges owing, payment shall (unless otherwise agreed to by the Utilities Officer) be applied to that portion of the Utility Charges outstanding the longest, regardless of any wish by the Customer to apply payment to any portion of the Utility Charges owing. 25.3 Every Person who contravenes any provision of this Bylaw is guilty of an offence and on conviction, is liable for a fine of not less than two hundred ($200.00) dollars and not more than ten thousand ($10,000.00) dollars. 25.4 If a Person is guilty of a conviction for an offence which offence occurs after the date of a conviction of an earlier offence under this Bylaw, that Person is guilty of an offence and on conviction is liable for every day or part thereof upon which a subsequent offence occurs or continues to a fine of not less than five hundred ($500.00) dollars and not more than ten thousand ($10,000.00) dollars. 25.5 No Person who is convicted for an offence pursuant to this Bylaw is liable to imprisonment. Appeals 26. Notwithstanding any other provision of this bylaw, any customer who feels himself aggrieved in respect of rates charged to him under this bylaw on the grounds that such rates are unfair, unreasonable or discriminatory, may, by notice in writing delivered to the Utility Officer, or a person authorized to act on behalf of the Utility Officer, specifying the grounds of his complaint, appeal such rates. Such appeal shall be heard by the Utility Officer, and if cannot be resolved, an appeal can be made in writing to council. 39 of 97 • PART 10 TERMINATION Termination by Customer ® 27. Upon notification by the customer to the County to terminate the customer's contract, the County shall, when deemed necessary, obtain a final reading of any meter as soon as reasonably practical and the customer shall be liable for and pay all service supplied prior to such reading. The County maa base the final charge for service on an estimated meter reading which will be prorated from the time of an actual meter reading. Termination by County 28.1 When the premises to which utility service is provided become vacant and no new application for service has been made, the County may terminate the contract and, in lieu of disconnecting the service, open a new utility account in the name of the owner. Nothing herein shall prevent the owner from requesting that the County disconnect such utility service provided the owner pays the service charge prescribed herein. 40 28.2 The County may discontinue the supply of all utility services for any of the following reasons: a) non-payment of any utility accounts; or b) inability of the County to obtain access to residential premises to read any meter for a period of six months, or to a non-residential premises to read any meter for a period of three months; or c) failure by, or refusal of, a customer to comply with any provision of the bylaw; or d) failure by, or refusal of, a customer to comply with any provisions outlined in the Water Service Standards, Schedule B; e) at the owner's request to have services discontinued; or f) in any other case provided for in this bylaw. 28.3 The Utility Officer is hereby authorized and directed to enter upon and in any property upon which a meter or shut-off valve is situated for the purpose of terminating the supply of a utility to that property, or for the purpose of supplying a utility to that property. 40 of 97 0 Service Kill 29. No permit for the demolition or removal of a building shall be issued by the County nor shall any person cause, permit or allow to be demolished or removed a building connected to a utility service line or main until there has been paid to the County the cost of disconnecting the utility service in the amount required under this bylaw and such utility services have been disconnected. Notwithstanding the foregoing, the Utility Officer may, in circumstances which the Utility Officer considers appropriate, permit the service to remain connected to the utility service line or main. PART 11 WATER UTILITY Definitions 30. In this part and in the Schedules attached thereto: a) "Bulk Water Station" shall mean a service point to obtain potable water which can be loaded for transport. C] b) "County Service" or "County Service Pipe" shall mean that portion of a pipe used or intended to be used for the supply of water which extends from the water main to the service valve; c) "Combined Service" shall mean the service or service pipe used or intended to be used to supply water for fire protection as well as water for purposes other than fire protection; d) "Fire Line" shall mean a pipe intended solely for the purpose of providing supply of water for fire protection purpose; e) "Private Service" or "Private Service Pipe" shall man that portion of a pipe used or intended to be used for the supply of water which extends from the service valve to the meter; f) "Remote Reading Device" shall mean a device which is connected to a water meter by the County and provides a duplicate reading of the water consumed, which may be monitored from the exterior of a building; LJ g) "Service or Service Pipe" shall mean a pipe used or intended to be used for supplying water which extends from the water main to a meter; h) "Service Valve" shall man the valve on a County Service pipe; 41 of 97 0 i) "Shut Off' shall mean an interruption in, or discontinuance of, the supply of water; j) "Sprinkling" shall mean the distribution to the surface or sub-surface of lawns, gardens, street or other areas situated outside the buildings by pipes, hoses, sprinklers or any other method and includes the washing of motor vehicles and the exterior of buildings; k) "Water main" shall mean those pipes installed by the County for the conveyance of water throughout the County to which service pipes may be connected. 1) "Water Utility" shall mean the system of water works owned and operated by the County and all accessories and appurtenances thereto. C. WATER SERVICE LEVY AND BILLING RATES Rate Payable 31.1 The County hereby levies, and the customer shall pay, for all water supplied or services rendered hereunder the amounts and charges provided for in this bylaw in the Annual Fee Bylaw. 31.2 The Utility Officer shall determine which rate contained in shall apply to any particular customer's service area. 31.3 The rate payable by a customer as set out in Annual Fee Bylaw for all water supplied shall be determined by reference to the reading of the meter supplied to each customer. 31.4 Where a remote reading device is installed in addition to the main water Connection to Public Water Supply 32.1 The owner with land and or property abutting any street / road in which there is a water main, may apply for a water service connection to the Utility Officer where: a) The County will provide or pay for the construction of a water service connection to the customer's property line. b) The connection of a customer's building to a service connection will be at the owner's expense. 42 of 97 • c) The service connection must meet the requirements outlines in the service area's Water Service Standards in Schedule B. 32.2 At such time as the owner connects to the water main, the owner shall also open a utility account and make payment of all application fees and deposits that may be required under this bylaw. 32.3 The County shall have reasonable access to Premises receiving Utility Services and, without restricting the generality of the foregoing, this access shall include: a) entering the Premises to construct, maintain or repair the Service Connection for if the County is not satisfied with the construction, maintenance or repair of the Service Connection and the Customer has failed to comply with the County's instructions; b) entering the Premises in an emergency situation; c) entering the Premises to construct, maintain or repair any part of the Water System owned by the County, including the Meter, Metering Equipment and the Service Connection; d) entering the Premises to read the Meter; e) entering the Premises to ensure that the provisions of this Bylaw are complied with; f) entering the Premises to deliver a notice pursuant to this Bylaw; and g) entering the Premises where otherwise contemplated by this Bylaw, or the Municipal Government Act R.S.A. 2000, Chapter M-26. • Installation of Water Connections 33.1 The owner of any land abutting on any road or easement wherein a Water Main now exists or is hereafter located shall: a) Install both in any Building and between the Building and the boundary of the road or easement in which the Water Main is located (up to the point of the cc. valve), Private Service connections with the Water System and any other apparatus and appliances required to ensure the proper sanitary conditions of the Building and Premises, including a Meter and, for Meters installed after enactment of this Bylaw, a remote Meter reader. 43 of 97 b) The Private Service shall be installed by a person authorized to do so under the Safety Codes Act. E • c) The Private Service shall be installed to the County's satisfaction and according to all relevant Federal, Provincial and Municipal legislation and regulations. d) The owner shall ensure that the Private Service shall be inspected by the County prior to backfilling of the trench and prior to connection to the Water System. 33.2 The owner, as a term of supplying Water Services to the parcel of land, is responsible for the cost of construction, maintenance and repair of those portions of the Service Connection both above, on, or underneath the parcel to the boundary of the road or easement, but only to the point (but excluding) the cc. valve. 33.3 If the owner fails, neglects or refuses to comply with Paragraph 33.1 within sixty (60) days of the enactment of this Bylaw, or within sixty (60) days of the construction of the Water System within the abutting street, public place, or road, where construction takes place after the enactment of this Bylaw, the County may enter onto the Premises or Building concerned and make the connection or installation, at the expense of the owner. 33.4 The owner shall ensure that for every Private Service connection at a parcel of land there shall be at least one Meter. Any additional Meters shall be at the discretion of the County and if the relocation is requested by the owner the relocation will be at the expense of the owner. Any relocation of Meters shall be at the discretion of the County and at the expense of the owner. Notwithstanding the foregoing the owner of a parcel of land on which a trailer court or manufactured home park exists shall ensure that a Meter shall be installed for each trailer or manufactured home site, unless otherwise agreed by the County. 33.5 Any Meter or Metering Equipment installed pursuant to this section is the property of the County and shall be deemed to be part of the Utility Services. 33.6 The owner of a parcel on land for which a Service Connection for any aspect of the Utility Services is located shall ensure that the works are protected from damage, including freezing. 33.7 Where the owner is required to perform any work within lands owned or controlled by the County (including a road or easement) the owner shall contact the Chief Administrative Officer prior to performing such work, remediate the lands to the satisfaction of the Chief Administrative Officer, and perform the work according to the terms specified by the Chief Administrative Officer. 44 of 97 LI Meter Chamber • 34 When in the opinion of the Utility Officer, the building or other premises intended to be supplied with water are too far from the County service to conveniently install a meter in such building or premises, or if a number of buildings are to be so supplied or for any other reason in the opinion of the Utility Officer, then the customer shall, at the customer's sole cost, construct and maintain a container for a meter and such container shall in all respects including location, construction size, access and otherwise howsoever be satisfactory to the Utility Officer. Number and Depth of Services 35. Unless the Utility Officer otherwise approves, a) there shall not be more than one private service to any building; b) a private service shall be buried to a depth of a least 9 feet (2.7 meters). • 0 Fire Protection Services 36.1 a) A water line which provides combined domestic service and fire line service shall not be installed prior to the approval of Kneehill County Emergency Management Service. b) A fire line shall be used only for fire protection purposes and the Utility Officer shall determine whether or not a meter shall be affixed to such fire line. If the Utility Officer requires such a meter, the same shall be supplied and installed in a manner satisfactory to the Utility Officer at the sole cost and expense of the customer. 36.2 No trees, shrubs or plant material shall be planted within 3 feet (1 meter) of a fire hydrant. In addition, no tree branches or plant material shall be allowed to encroach within 2 feet (0.7 meters) of a hydrant. Releases into the Water System 37. No Person shall Release, discharge or deposit any Matter into the Water System, without the County's written consent. 45 of 97 Any Person who Releases, discharges or deposits or causes or permits the Release, discharge or deposit into the Water System of any Matter without the County's written consent, shall: 0 r 1 a) notify the County immediately upon becoming aware of the Release, discharge or deposit; b) provide information respecting the Release, discharge or deposit to the satisfaction of the County; and c) be liable for all costs incurred by the County with respect to the Release, discharge or deposit for containment, sampling, testing, removal, cleanup disposal and any other related activity. Administration of Water Supply 38.1 The Utility Officer may shut off water for any customer for any reason which, in the opinion of the Utility Officer, necessitates such shutting off, provided that the Utility Officer shall, if in the Utility Officer's opinion it is reasonably practicable to do so, give notice of such shutting off. • r 1 38.2 The County does not guarantee the pressure nor the continuous supply of water and the County reserves the right at any and all times without notice to change operating water pressures and to shut off water and the County, its officers, employees or agents shall not be liable for any damages of any kind due to changes in water pressure, the shutting off of water, or by reason of the water containing sediments, deposits or other foreign matter. 38.3 Customers depending upon a continuous and uninterrupted supply or pressure of water or having processes or equipment that require particularly clear or pure water shall provide such facilities as they consider necessary to ensure a continuous and uninterrupted supply pressure or quality of water required for their use. 38.4 The County may as a condition to the supply of water inspect the premises of a customer who applies to the County for such supply in order to determine if it is advisable to supply water to such customer. 38.5 The County may, with the permission of the customer, inspect the premises of the customer in order to do any tests on water piping or fixtures belonging to such customer so as to determine if this bylaw is being complied with and in the event that such customer fails or refuses to give such permission, the supply of water to that customer may be shut off. 38.6 The Utility Officer may at such times and for such lengths of times as the Utility Officer considers necessary or advisable regulate, restrict or prohibit the use of water for use other than human consumption. The Utility Officer may cause the water supply to any customer who causes, permits or allows consumption or sprinkling in contravention of any such regulation, restriction or prohibition to be shut off until such customer undertakes to abide by and comply with such 46 of 97 0 regulation, restriction and prohibition. • 0 Protection of the Water System 39.1 No Person shall break, damage, destroy, deface, tamper or cause or permit the breaking, damaging, destruction, defacing or tampering with any part of the Water System or any permanent or temporary device installed in the Water System for the purpose of measuring, sampling, or testing of water. Any Person who does perform such acts shall be liable for any damage incurred. 39.2 No customer shall cause, permit or allow any apparatus fitting or fixture to be or remain connected to the customer's water supply or to be operated which causes noise, pressure surges or other disturbances which may in the opinion of the Utility Officer, result in annoyance or damage to other customers or to the water utility. 39.3 The County may discontinue supplying Utility Services to a Premises where: a) the County believes that there is a breach of this Bylaw at that Premises; b) the Customer of the Premises has breached a provision of this Bylaw; c) the Premises is or appears to be abandoned; or d) in emergency situations, or where necessary to protect the integrity of the Water System. 39.4 The County may post a sign on the Premises providing at least twenty-four (24) hours prior notice or, in an emergency situation, without providing any prior notice, of discontinuing the supply of Utility Services or preventing access to the Utility Services on the Premises pursuant to this Bylaw, advising that access to Utility Services may be discontinued or prevented and that there may be a health risk to Persons entering the Premises. 39.5 Whenever the County determines that a Release from a Premise is contrary to this Bylaw, the County, in addition to any other provisions in this Bylaw, require the Customer to: a) install and maintain a device to detect the presence of a Release contrary to this Bylaw; and b) notify the County of a detection of a Release contrary to this Bylaw, and to provide all information to the County's satisfaction. 39.6 No Person shall supply false information or make inaccurate or untrue statements in a document or information required to be supplied to the County pursuant to this Bylaw. 47 of 97 9 r 9 • 0 Wastage 40.1 No customer shall cause, permit or allow the discharge of water so it runs waste or useless, whether by reason of leakage from private service pipe, a faulty plumbing system or otherwise. 40.2 Notwithstanding the foregoing, the Utility Officer may under such condition as the Utility Officer may consider reasonable allow a customer to discharge water so that it runs waste or useless if such customer's water service would otherwise be susceptible to freezing. Use of Water 41.1 No customer shall: a) lend or sell water without written permission from the County; b) give away or permit water to be taken; c) use or supply any water to use or benefit of others or to any other than the customer's own use and benefit; d) increase the usage of water beyond that agreed upon with the County; or e) extract or remove any water from any hydrant within the County without first obtaining written permission from the Utility Officer for such Use of Water. 41.2 Water use priority is established as follows: a) People first; b) Livestock second; c) Irrigation last. 41.3 48 of 97 a) The County at any time limit or control water usage from Bulk Water Stations. b) The County by Notice published in a newspaper, or broadcast on the radio and or television, may restrict customer shall use, permit, suffer or allow to be used, any water supplied to any premises for vehicle washing, lawn watering or other irrigation purposes. • Investigation into Water Supply Service Failure 42.1 Any customer complaining of a failure or interruption of water supply, the investigation of which complaint necessitates the opening up and excavating of a street shall, prior to such opening up and excavating, sign a work order with the Utility Officer, agreeing to pay all costs associated with the investigation. 42.2 In the event that such failure or interruption was caused by the County service, providing that the service is new service or has been used in the preceding twelve (12) months, the customer shall not be liable for such costs. • 42.3 In the event that such failure or interruption was caused by the private service, the actual cost of such work shall be paid by the customer and shall be collected in the same manner as water rates. WATER METERS Installation Responsibility 443.1 All meters used on the Water System will be supplied by the County. 43.2 Water meters supplied by the County being larger than 2 inches (50 millimeters) in size shall be installed by and at the expense of the customer. 43.3 A customer may, for their own benefit, install a water meter between the meter supplied by the County and the point of use of the water supply provided that the County shall not maintain such meter, nor shall such meter be read by the County. Installation 44.1 A customer shall make provision for the installation of a water meter as outlined in the Water Service Standards, Schedule B, and to the satisfaction of the Utility Officer. 49 of 97 0 44.2 Unless the Utility Officer otherwise approves, the County shall not be obligated to supply more than one water meter for any one building. In the event additional water meters are approved, a separate curb stop will be required for each additional water meter. 44.3 Notwithstanding Paragraph 43.4, the County shall supply a separate water meter for each of the two semi-detached dwelling units contained within a duplex residential building. A separate curb stop will be required for each water meter. Temporary Water Service 45 Any persons requiring a temporary water supply in the course of construction shall make application therefore to the Utility Officer and shall pay therefore the sums required by Annual Fee Bylaw. Thawing Services 46.1 The cost of thawing a frozen service shall be borne as follows: a) If the private service or the plumbing system connected is thereto is frozen, as determined by the Utility Officer, by the customer; b) If the County service is frozen as a result of negligence of the customer, as determined by the Utility Officer, by the customer. c) If the County service is frozen for any other reason, as determined by the Utility Officer, by the County. 46.2 If the Utility Officer is of the opinion that a private service or plumbing system has frozen without any negligence on the part of the customer or any other person for whose negligence the customer is responsible, the Utility Officer may waive the cost of one thawing during any one winter season which shall be deemed to run from November 15th to May 15th. 46.3 The County shall not thaw a private service or plumbing system unless the customer shall first have signed an acknowledgment recognizing that thawing may be inherently dangerous to property including private service or plumbing • system and may cause damage to electrical systems or the outbreak of fire and waiving any claim against the County for any such damage whatsoever except damage caused by the negligence of the County. 50 of 97 0 Winter Installation 47 The cost payable by the customer for installing a service between November 15th of any year and May 15th of the following year unless designated otherwise by the Utility Officer shall be borne to the customer at cost. 0 Service Size 48 The size of the service required for residential purposes shall be determined in accordance with the Building Code, provided that the County shall not install a service having a size smaller than 3/4 inch. Boilers C] n 49 In any case where a steam boiler or equipment of a nature similar to that of a steam boiler is supplied directly from a service, such boiler or other equipment shall be equipped with at least one safety valve, vacuum valve or other device sufficient to prevent the collapse or explosion thereof in the event the water supply thereto is shut off. Requested Water Shut Off 50 If a customer requires the supply of water to be shut off for their own purposes, the customer shall pay therefore the amount specified in the Annual Fee Bylaw. Cross Connections and Backflow Prevention 51.1 No customer or other person shall connect, cause to be connected, or allow to remain connected to the water system any piping, fixture, fittings, container or appliance, in a manner which under any circumstances, many allow contaminated or polluted water, wastewater, or any other liquid, chemical or substance to enter the domestic water system. 51.2 If a condition is found to exist which is contrary to Section 75, the Utility Officer may issue such order or orders to the customer as may be required to obtain compliance with Section 75. 51.3 Notwithstanding anything herein contained, where in the opinion of the Utility Officer, the configuration of any water connection which creates a high risk of contamination to the water system, the customer, upon being given notice by the Utility Officer, shall install on their water service an approved cross connection control device, in addition to any cross connection control devices installed in the customer's water system at the source of potential contamination. 51.4 All cross connection control devices shall be inspected and tested at the expense of the customer, upon installation. 51 of 97 0 • 51.5 When the results of a test referred to in Section 78 of this bylaw show that a cross connection device is not in good working condition, the customer shall, when so directed by the Utility Officer, make repairs or replace the device. If the customer fails to comply with the direction given, the County may shut off the water service or water services. 51.6 No person shall turn on a water service valve to provide water to the occupants of any newly renovated, constructed, or reconstructed premises until the plumbing system in such premises has been inspected for cross connections and approved by the Utility Officer. 51.7 If the customer to whom the Utility Officer has issued an order fails to comply with that order, the Utility Officer may: a) Give notice to the customer to correct the fault at the customer's expense within a specified time period and, if the notice is not complied with, the Utility Officer may then shut off the water service or services; or b) Shut off the water service or services without prior notice. • • 52 of 97 11 fl C hilt Utiliti C es onnection Application cqunhj Effective Date: month/day/year ? Kneehill County will assist rural residents / commercial users with the construction of long service lines to a customer's service point.
