Issue
Proposed redesignation of the NE '/4 of Sec 11; 29-25-W4
From: AC - Agricultural Conservation District
To: A - Agricultural District
Background
The County has received a subdivision application to create a 26 acre +/- parcel within
the NE %4 of Sec 11; 29-25-W4 (Muchka). The proposed undeveloped parcel is cut-off
from the balance of the land by a railway plan (see attached sketch). The current land
use designation, AC - Agricultural Conservation District, limits parcel size for
subdivisions to a maximum of 20 acres. Subdivisions to create larger parcels require
redesignation to the A - Agricultural District.
Discussion
The public hearing has been advertised twice in the Capital newspaper. The proposed
amendment has also been circulated to adjacent landowners within a 1.5 mile radius
and to date no responses have been received.
Recommendation
Subject to any relevant issues being raised at the public hearing, planning staff
respectfully recommends that Council adopt Bylaw 1522.

Issue Burning without a Permit / Extinguishing the fire
Background
From April 1 to Oct. 31 every year the residents of Kneehill County are required to have
a Fire Burn Permit completed and approved before disposing of any material by this
method. To apply for a permit it is no cost to them but they must contact the area Fire
• Chief where the fire is too be located at or the EMSC can fill the permit out also. There
are some conditions that the residents must meet in order to burn as stated in the Alberta
FOREST AND PRAIRIE PROTECTION ACT OF ALBERTA 2000 and in regards to
any stubble burning the person must contact the Kneehill County Field Agriculturist and
get approval from them before a Permit is issued. Fire Permit information has been put in
the Kneehill County news bulletin & "Did You Know" column of the Three Hills
Capital. This past year it was included in the news letter sent out with each tax notice.
Discussion
Pat VanCauwenberge received an Invoice / Letter from the EMSC on July 7, 2005. The
letter stated that he would be fined $100.00 for Burning without a permit. He was cited
for the following infractions from Bylaw 1482:
Section 5 subsection 5.1 - No person shall burn or cause to be burned any prohibited
debris.
Section 5 subsection 5.2 - No person shall set, cause to be set or maintain any Outdoor
Fire except in accordance with the provisions of this Bylaw.
Section 5 subsection 5.5 - An application for a Fire Permit for an Outdoor Fire or a
structure fire shall be made to a Fire Guardian in writing and the Fire Guardian may, with
absolute discretion, issue the applicant a Fire Permit.
Section 9 Subsection 9.1 - Where the Service has taken any action whatsoever for the
purpose of extinguishing a fire or responding to a fire call or Incident in the County or for
the purpose of preserving life or property from injury or destruction by fire or any other
Incident on land within the County, including any action taken by the Service on a false
alarm, the County Administration may in respect of any costs incurred by the Service in
taking such action, charge any costs incurred by the County to the owner or occupant of
the land or to any other person responsible for the fire or Incident in respect of which the
action was taken.
Sub Section 9.2 - Notwithstanding section 9.1 above, the County may charge fees on a
cost recovery basis for any other service provided by the Fire Protection and Emergency
Management Services Department in accordance with any policy Council may from time
to time make.
• Pat VanCauwenberge was verbally warned personally on in May 17 / 2005 at SE
26-31-24 W4 by the EMSC of needing an Approved Fire Permit / Warning that he
must contact the Kneehill County Field Agriculturist / present weather conditions.
He complained that the straw was too wet to burn anyway.
• Pat contacted Bruce Somerville at the Kneehill County office and was denied
approval to burn the stubble.
Three Hills fire department responded to a 911 call of a out of control field fire at
SE 26-31-24 W4 atl924hrs on May 17 / 2005. Chief Art Creaser learned that Pat
VanCauwenberg had been the one who had phoned 911. Chief Creaser
determined that the fire had began from possible re-ignition started earlier in the
day.
• • After discussion with Chief Creaser the fire was determined as accidental fire and
re-ignition as the possible source of the fire.
• On the evening of July 7 / 2005 I received an anomalous phone call at 1800hrs
stating that there was a field fire at SE 26-31-24 W4. I then left my office and
investigated the complaint. I found that there were 3 different fires going in the
field and due to the wind conditions it was not an acceptable thing to be doing. I
spotted a farm tractor exiting the field on the south end. I drove my vehicle over
to it. In the tractor Pat VanCauwenberg was the operator and would not get out of
the cab to come speak with me. I crawled up the ladder and opened the door to the
cab and asked him if he had a fire permit. He did answer "No I don't" I exited the
cab and dialed 911 Dispatch to send fire trucks out to extinguish the fires.
• Pat VanCauwenberg stopped by the north entrance to the field where I was
located awaiting the fire trucks. He wanted to talk to me about the situation and
• claimed at that time that he had forgot that a permit was required in order to burn.
I told him that this was not the time but I may be willing to talk to him at a later
date and he could make an appointment to come see me. This did not happen. I
then completed an invoice for services and the Fine for Burning without a permit.
Recommendation
1) That Council supports the Decision of the EMSC in regards to Kneehill County
By-Law #1482.

Issue:
Henry Wiens has requested that Council amend Bylaw 1271, by changing the load limits
on Bridge File #70976 (SW 17-29-22-W4) and Bridge File #1657 (S.E. 3-34-25-W4) in
order to put different weight restrictions on these bridges and post signs to address safety
concerns.
Background:
Bylaw #1271 imposing load limits on certain bridges within Kneehill County stipulates
the following:
Bridge File #1657 - Single Unit 16 Tonne, Semi Trailers 29 Tonne, Truck Trains
43 Tonne
Bridge File #70976 - Single Unit 27 Tonne, Semi Trailer 42 Tonne, Truck Trains
53 Tonne
• This needs to be amended to reflect the following:
Bridge File #1657 - 10 Tonne Limit
Bridge File #70976 - 3 Tonne Limit
Henry Wiens has advised that both these bridges have a low level crossing beside them.
Attached is Bylaw #1521 for Council consideration.
Recommendation:
That Council give first, second and third readings of Bylaw #1521.

Issue: 2005 Tax Sale
Background: Kneehill County each year files tax notification against properties that
have unpaid taxes. After the appropriate waiting period these properties go to tax sale if
the taxes remain in arrears as outlined in Section 418 of the Municipal Government Act.
Under section 419 of the Municipal Government Act council must set a reserve bid at
market value and set the terms of the sale. This year there are eight properties going to
tax sale on October 25, 2005.
The Assessment Department appraisals attached are estimates of the market value for
these properties.
Recommendation:
• 1) Council set the reserve bids for these properties per the appraisals.
2) Council set terms of payment for the sale. (Say 10% day of the sale and balance due in
two weeks)

Background
Discussion
Kneehill County received a verbal request from the Village of Carbon.
They would like to purchase two or three loads of sand and salt for the
winter season.
Policy#13-24 and 13-24-1 (Attached) does not allow us to sell to our
neighbouring municipalities.
Financial Implications
Our 2005 purchase price for salt - $77.67/tonne and sand - $8.90/tonne.
• Cost to Kneehill County for one tandem load of salt/sand mixture is
$175.57 plus GST.
Carbon is asking for two or three loads depending on the winter.
Recommendation
That Council approve the selling of up to three truckloads of sand/salt
mixture to the Village of Carbon for the 2005-2006 winter season with
Kneehill County to load and the Village of Carbon to haul, charging

Background: 2006 budget deliberations should commence soon.
Discussion: Council should meet as soon as possible to commence the initial budget
deliberations for 2006. A Committee of the Whole (COW) meeting is

Mountain View Emergency Service (56-02) - Sept 24/02 - Gene and Greg will meet
• with Mountain View County to discuss this outstanding area service item. Sept 05 -
Contacted but due to office transition having difficulty setting a date to meet.
Mutual Aid Agreement (52-02)-- Oct 8/02 - Mountain View and Wheatland County
still pending. Feb 05 KAS looking into Mountain View agreement, Feb 2/05 Wheatland
County looking into agreement. Sept 05 - Greg waiting to meet with Mountain View and
will contact Wheatland regarding status of agreement.
Water Policy (16-02)
Equity Water - The Water Policy is on hold until current developments have been
resolved. Sept 13/05 Council approved the modified utility rate model proposed by the
Town of Three Hills, in order that bills may be sent to the Equity customers. A letter sent
advising and requesting data used to substantiate model.
Water Policy: A policy to encompass the costs of lowering any water lines deferred to
August Council Meeting.

Tax forfeiture properties were advertised for sale. May 25/04 Council refused only offer
as too low. Administration to look at a way of marketing to get the market value for the

12/05. Second offer refused.
Administration recommended to continue with advertising on website. Recommend a
review of other properties that could be put up for sale. Bring listing and
recommendation to September Council.

Kneehill County Water Strategy (#52-04) - May 11/04
Ongoing - Jan 25t C.M. John VanDoesburg presented draft funding package for Council
consideration. Issues being addressed. Council requested administration arrange meeting
within the next 3 or 4 weeks for this committee. Meeting held July 13. Meeting
requested with Minister Oberg on future funding.
Motion (#338/05) - June 14/05 - motion for administration to bring to Council a meeting
date for the Kneehill Water Strategy Committee. Met first part of August 2005 - waiting
for response from Olberg re: funding prior to further discussion. Meeting set for 11:00
a.m on October 26th in Edmonton between Minister Oberg, Murray, Vern and Gene to
discuss funding options.
(Three Hills Water West) Linden North Water Service Area (#53-04) - May 25/04
Jan 25/04 Council approved proceeding with Phase One of the Linden North Water
Service Area. Letters sent to Linden North Phase 1 & 2 residents giving information on
the waterline. Items for discussion on-going, presented at upcoming Council meetings.
Agreement signing Sunnyslope Hall on March 7th - Stantec updated at March 8th C.M.
March 22"d some funding decisions made. Funding Bylaws given third readings on April
26, 2005. Council awarded tender to Neudorf Trenching; construction to begin around
mid August and be completed December. Bylaw 4 1511 reviewed by legal counsel.
Awaiting further decisions by Council. Sept 13/05 Riser fee and use of County Rights of
Way decided by Council. Operations Department working on completion of bylaw to
present to Council.
Recreation Areas/Parks (#82-04) - Sept 14/04
Long term plan requested. Included in 2005 Draft Budget. Will be further developed
and presented to Council during Strategy Planning Session (August 8, 2005) using the
assigned budget dollars.
Community & Cultural Services Summit (#86-04) - Oct 12/04
Nov 13t First meeting with Council and CAO's from urban centres and the County. Feb
1St & 2d follow up meetings with facilitator Gord McIntosh. Working committee of
CAO's established, and Steering Committee comprised of Elected Officials. List of 12
possible issues for sharing. Working committee meetings scheduled March 17th and 29th
at County Office 9:00 a.m. until 11:00 a.m. Working Committee meeting held April 11th
in Carbon and May 3`d in Acme. Steering Committee and CAO Working Committee that
was to meet on June 22, 2005 cancelled due to current local State of Emergency.
Meeting rescheduled for August 30 at 7:00 pm in Linden. Report of Aug 30/05 meeting
on Sept 13th Council agenda. Sept 28/05 CAO meeting at County. Oct 12/05 Steering

Partnering Options of Water Reservoirs (#95-04) - Oct 26/04
Council requested options and possibilities of partnering with urban centres for the
building and shared use of water reservoirs. Under review with water strategy.
Laptop Purchase Policy (#99/04) Nov 9/04
Council approved Option #1 for laptop purchases for Elected Officials, CAO, Recording
Secretary, and Council Chamber. Council moved that administration proceed with the
purchase of tablet style laptops - Motion 180/05 - April 12/05 Need to ensure the
current internet policy #7-25 included Councillors. Laptops ordered week of July 11/05.
Sept 6/05 Jeremy Regehr has laptops, needs a couple of days before delivering them to
the County. Sept 20/05 Most of Council have laptops - Carol and Ken Knievel trained on
Friday, Sept 16th. Lavinia will set up training session for the balance of Council and
Administration.
