motion #360/04 was made by Councillor Knievel.
Councillor Crawford moved approval of the July 20,
2004 Regular Council Meeting minutes, as amended.

374/04 Councillor Calhoun moved approval of the accounts presented for
payment today subject to review by the Finance Committee.

distributed to Council.

Reeve Hoppins reported a successful open house in honour of the
County's 60th anniversary was held on August 11th, and Council
expressed thanks to the staff for organizing this event.
Note: a more detailed report will be presented by Mrs. Yvonne
Evans at the September 14th Council meeting

376/04 Councillor Wittstock moved that Council accept this verbal report.

Mr. Castonguay entered the meeting at 9:05 A.M.
•
Presentation: Joe Castonguay - Request for Reimbursement of
Groundwater Report Costs
Mr. Castonguay requested Council consideration be given to
reimbursing him the amount of $1,930.74, the costs he had
incurred for a groundwater report requested by the Municipal
Planning Commission. The request was based on the Municipal
Planning decision with respect to the flooding and groundwater
studies. Mr. Castonguay reported he was led to believe, at the first
MPC meeting, that flooding was not a major issue, and that the
only issue to be resolved was groundwater potential. However, at
the second MPC meeting his application was refused, due to
flooding issues not water considerations. Therefore, Mr.
Castonguay claimed the water study done in the interim was
unnecessary. Mr. Castonguay advised that it was his intent to
build the lot up the 2 or 3 meters necessary to make it above the
flood levels, and he was appealing the MPC decision with the
Municipal Government Board.

presented and refer this issue to Administration for direction and
advice.

Councillor Crawford moved that Council table this item until later
in the meeting to allow time for Administration to obtain
378/04 information on the possibility of extending the deadlines for the
Community Lottery Board and Municipal Sponsorship funding
received for this project.

SHILLS H2O WEST c) Three Hills West Water Proiect (report attached and
forming part of the minutes)
Council requested Administration obtain information from Stantec
Consulting on the boundaries of the water project, the direction the
water is feeding from, and the estimated costs prior to proceeding
with a preliminary detailed design.
Councillor Calhoun moved that Stantec Consulting be invited to
379/04 the September 14, 2004 Council meeting to address Council's
questions and concerns.

Councillor Wittstock moved that Council approve a contribution of
384/04 $500.00 to the 2004 ARMAA Conference, with a letter expressing
the County's concern that the costs for conferences be built into
the ARMAA budget.

There was no business arising from the Council and Committee

6(b) Trochu Fire Hall Addition (report attached and forming
TROCHU FIRE HALL part of the minutes) - tabled from earlier in the meeting.
Councillor Woods moved that Council delay the expansion of the
389/04 Trochu Fire Hall facility project until 2005, referring it to the 2005
budget deliberations, and assign the previously budgeted
$45,660.00 to fire reserves earmarked for this project.
MOTION DEFEATED
The meeting recessed for lunch from 12:05 P.M. to 1:10 P.M.
Council reconfirmed Motion # 359/04 and 360/04, from the July
20, 2004 Council meeting.

Background:
At the July 20th Council meeting, Council reconfirmed the budgeted expenditure of
$100,000.00 for development of the Trochu Fire Hall addition. On August 16th it was
also brought to my attention that the existing facility needs roof repair.
Discussion:
A cost estimate has been received from a local contractor to construct a wood frame
0 rather than a steel frame building, using the original plans. This cost estimate came in at
$155,000.00.
Financial Implications:
This leaves a shortfall of $33,000.00. However, should the Municipal Sponsorship
grant money not be used by October 2004, a request will need to be made to Alberta
Municipal Affairs for an extension.
Unknown amount required for general maintenance and repairs
Options:
1) Proceed with the expansion to the facility, at ac cost of $155,000.00
2) Proceed with the expansion and general maintenance requirements - cost unknown
3) Proceed with the general maintenance - cost unknown
4) Delay entire project until 2005
Recommendation:
That Council delay this project until 2005, to allow the County to budget for the entire
project, incl ding maintenance.

Issue:
Three Hills West Water Project
Background:
The last report to Council included the submission of an Environmental Screening Report
from Stantec Engineering to ICAP for their review and this was done in June 2004. At
this time, in discussions with ICAP, it was noted that it would to take up to two months to
review this report.
Discussion:
In recent phone conversations with Andrew Cathcart and Corrine Miller of ICAP, it was
noted that the Environmental Screening Report is currently being reviewed and they are
waiting for a response from Environment Canada and the D.F.O. Andrew Cathcart
• advised that once the Environmental Screening report review is completed it will be sent
to Ottawa for final approval. As it is an election year, final approval could take up to 3
months as it requires the signatures of two Ministers. Mr. Cathcart stressed that they
have never had a project turned down, but would not make a definite commitment
regarding funding approval. As the project must be completed by March 2006 to be
eligible for the ICAP funding, consideration should be given to beginning the preliminary
work.
Financial Implications:
The estimate for the preliminary work, as submitted by Stantec Engineering, is
$275,000.00. If successful in obtaining ICAP funding, two thirds of this cost would be
recovered leaving the County's portion at $92,000.00. This cost was not budgeted for in
the 2004 Budget.
Recommendations:
1) That Council approve Kneehill County proceeding with the preliminary design.
2) That Council approve the allotment of funds from reserves
3) That Council approve the cancellation of the project should ICAP funding not be
received.

Issue: Railway Crossing - North of Three Hills
Background An on site inspection at the above crossing for the purpose of conducting a
safety review was held Wednesday, June 30, 2004 with representatives
from Canadian National Railway, Kneehill County and Transport Canada.
This review was held as a result of concerns regarding a recent train-
vehicle collision resulting in a fatality.
Discussion This single track crossing is currently equipped with standard reflectorized
crossing signs and stop signs - installed by Kneehill County. At the time
of the inspection, Canadian National provided rail traffic details (speed
and volume) and the County representative provided road traffic details.
Both railway and road authority representatives indicated the installation
of a warning system would be the appropriate solution to improve the
level of safety at the crossing. Transport Canada advised that the Grade
• Crossing Improvement Program required a base cross product of 1000 as
one warrant to consider funding support towards the installation of a
warning system at the crossing. Transport Canada following further
review, advises an application for funding assistance towards the
installation of either a new or cascaded warning system would not be
considered at this time. Transport Canada would however support an
application from the road authority for funding assistance towards the
installation of "luminaire" lighting at the crossing. As an additional
alternative, consideration may be given to installing street lightning. This
lighting as utilized at highway intersections may provide a similar level of
visibility and be more cost effective than the installation of luminaire
lighting.
Financial Implications
Unknown at this time.
Recommendation °
That Council receive this report as information. I will be investigating
these two options further and will bring this issue back to Council with
information on applying for assistance/funding required.

Background
Council has established strategic planning as the first step in the budget process and held
a strategic planning session in Red Deer on June 17, 2004 that was not completed due to
time restraints. Council is requested to consider selecting a date to finalize the strategic
priorities so that Administration can prepare the 2005 budget for Council deliberation.
Discussion
Due to the harvest season and municipal election, Council might consider delaying final
determination of the strategic priorities until after the September 20 Nomination Day.

Background:
On January 22, 2001, Policy # 16-4, established a Kneehill County Scholarship Program,
committing $1,000.00 per year supporting rural students attending an Alberta university,
college, or trade school. The application deadline for this program is July 3l st of the year
of application.
Discussion:
An advertisement was placed in the June 30th, and July 7th, 14th, and 21St editions of The
Three Hills Capital. On June 22nd a request was also sent to the Golden Hills School
Division to circulate this information.
• To date the County has not received any applications for this grant, and Council direction
is requested.

• Issue
The 2004 Municipal Election Nomination Paper and Candidates Acceptance
Background
Val Kopjar, Returning Officer, is preparing for the October 18, 2004 Municipal Election
and will present a report at the September 14th Council Meeting.
September 20th is Nomination Day for the municipal election and Val has prepared the
Nomination Paper and Candidate's Acceptance Forms. The Forms are now available for
pick up at the County Office during normal business hours and are also available on the
County website.
In accordance with Section 27 (1) of the Local Authorities Election Act:
"Every nomination of a candidate shall be in the prescribed form and signed
by at least 5 electors eligible to vote in that election and resident in the local
jurisdiction on the date of signing the nomination, and shall be accompanied
with a written acceptance signed in the prescribed form by the person nominated,
• stating
a) That the person is eligible to be elected to the office, and
b) That the person will accept the office if elected,
and if required by bylaw, it must be accompanied with a deposit in the
required amount."
Bylaw #1259 requires that "any nomination filed .... for the office of Councillor must be
accompanied by a deposit of One Hundred Dollars."
The Returning Officer shall receive nominations at the County Office between 10:00 a.m.
and 12:00 noon on Nomination Day, September 20, 2004.
Notice of Nomination Day will be advertised in the Three Hills Capital on September 8
and September 15, 2004.

• Request for an extension to the endorsement period for subdivision file # KNE03101 - SW 33 30

BACKGROUND
In March of 2003, the County MPC approved a subdivision application submitted by Mr. Charles
Schartner (Applicant). The Applicant is now applying for an extension to that period in which
the plan of subdivision must be submitted, as it is stated within Section 657(1) of the MGA that
the "applicant for subdivision approval" must submit to the "subdivision authority" the plan or
instrument that effects the subdivision within one year following the date on which the decision
was given to the Applicant. As the Applicant has not yet provided the requisite instruments
relating to the approved subdivision, an extension is necessary. Section 657(6) grants Municipal
Councils the right to grant extensions.
DISCUSSION
The Applicant has submitted all required information to complete the application and all
• conditions, and has paid the requisite extension fee. Staff are in favor of an extension, and are
sympathetic with the Applicant's claim that development of the road allowance adjacent to the
subject property obstructed surveying efforts.
RECOMMENDATION
That Council, following Section 657 (6)(a) of the MGA, grant an extension to the one-year time
period in which the Applicant must submit the requisite instrument to effect the subdivision.
Extension should expire on October 1S`22004.

PENDING BUSINESS ITEMS FROM 2002 - August 18, 2004
Mountain View Emergency Service (56-02) - Sept 24/02 - Gene and Mac will meet
with Mountain View County to discuss this outstanding item.
Mutual Aid Agreement (52-02) - Oct 8/02 - Administration currently reviewing. April
8/03 Mutual Aid agreements mailed to adjacent municipalities for signature. June/03
Referred to Mac deBeaudrap for review and follow up. Sept. 03, Gene advised he would
contact all applicable municipalities, and would then discuss with Mac the best means of
obtaining signature. Dec 10/03 Mac mailing new agreements to each of the
municipalities. Jan 6/04 Mac will follow up by phone to check the status of the
agreements. County of Stettler and Starland County have signed and returned the
agreements. Mar/04 Mac reported that Mountain View, Rocky View, and Red Deer
agreements are pending. Apr 13/04 Council approved new agreement where all
municipalities sign one agreement (noted it was excluding fire)
Water Policy (16-02)
Equity Water - The Water Policy is on hold until current developments have been
resolved.
Water Policy: A policy to encompass the costs of lowering any water lines will be
presented to Council in Fall 2004.
PENDING BUSINESS ITEMS FROM 2003 - August 18, 2004
Fire Agreements (73-03)
A tentative Fire Agreement was reached with Three Hills in December 2003. Gene and
Mac met with Acme and Linden on May 19, 2004 to review the Fire Agreements. The
Agreements will be presented to their respective Councils the week of May 24th. June 22
Council Meeting - to be discussed in camera.
Trochu Fire Hall Station Addition Proposal (81-03)
June 24/03 Council approved the request from Trochu Fire Dept for support in principle
to obtain architectural drawings in order to get process moving. Jan 6/04 Municipal
Sponsorship Funding ( $17,940.00) extension approved until October 2004 for
completion of this project. Mac deBeaudrap provided a report in the January 9th Council
Information Package. Feb 5/04 Mac advised they will be meeting with the architect soon.
Mar/04 engineering drawings expected within a week to ten days. Mar 17/04 Mac has
blueprints, will present a proposed construction plan to Council in April 2004. Council
approval to tender construction(blue prints available should anyone wish to see them).
June 22/04 Council Meeting tabled until July 20 meeting for further information. July
20/04 Council meeting motion # 359/04 that $120,000.00 be allotted for the facility, net
GST ($100,000 County, $10,000 Lottery, $10,000 Sweat equity). On Aug 18th C.M.
