CARRIED UNANIMOUSLY 5.2.2 Bylaw #1871- Prohibited Animal Bylaw 398/22 Councillor Penner moved that Council move that first reading be given to Bylaw 1871 that being a bylaw to regulate prohibited animals within the municipal boundaries of Kneehill County. STRATEGIC PLAN ALIGNMENT: (Check all that apply) ☐ ☐ ☐ ☐ ☒ High Quality Infrastructure Economic Resilience Quality of Life Effective Leadership Level of Service RELEVANT LEGISLATION: Provincial (cite)- N/A, Council Bylaw/Policy (cite)- N/A BACKGROUND/PROPOSAL: Kneehill County has 5 RCMP detachments serving our area; Three Hills, Innisfail, Drumheller, Beiseker, and Olds. Four detachments provide Quarterly Reports that they have based on in relation to Council’s priorities for our community. Innisfail provides reporting, however is not applicable to Kneehill County as theirs is a very small area. Kneehill County Council’s priorities were set in January 2022 as: • Rural Crime Prevention – enforcement and education • Community safety through programs and workshops • Presence in Rural Communities, building relationships and partnerships • Road Safety • Working with Kneehill’s CPO’s in delivery of enforcement and education 9 2022.11.29 Adopted Council Package REQUEST FOR DECISION AGENDA ITEM # 5.3.1 Page 2 of 2 Version: 2022-02 DISCUSSION/OPTIONS/BENEFITS/DISADVANTAGES/OTHER CONSIDERATIONS: RCMP Reporting July 1 to September 30, 2022: • As part of their accountability to our community, RCMP are providing Council’s with reporting on statistics, community engagement, and community priorities, as attached. Kneehill County Enforcement Statistics for August 1 to October 31, 2022: • 32 Citations under Traffic Safety Act: (23 Warnings, 9 Tickets) • 12 Animal Control files in Kneehill County • 13 Animal and General bylaw files in Acme, Carbon, Linden, Trochu and Three Hills. • 1 Suspicious vehicle, 2 assist Fire/RCMP • Assist internal department (planning) calls in Kneehill County • 2 School visits (Halloween Safety) • Targeted Education and Patrols – stop sign initiative, hamlet patrols • Targeted Patrols in Kneehill County only – over 102 hours • We are down 1 staff member from beginning of August to current FINANCIAL & STAFFING IMPLICATIONS: Kneehill County has Enforcement Services Contracts with Three Hills that includes patrol hours, and contracts with Acme, Carbon, Linden, and Trochu that are on-call basis. These quarterly reports contribute greatly to ensuring that the police services provided by the Alberta Royal Canadian Mounted Police (RCMP) to you, and the citizens you represent, are meeting your needs on an ongoing basis. This quarter I want to update you on the status of Body Worn Cameras (BWC), which are set to be field tested early in 2023 at three different pilot locations in Alberta. A total of 191 cameras will be distributed amongst front line officers in Grand Prairie, Parkland, and St. Paul Detachments respectively; the objectives of this Field Test will be as follows: • Confirm the Contractor is able to deliver the required services as defined within the SOW (Statement of Work) and Request for Proposal (RFP). • Provide an early opportunity to get cameras in the hands of 191 frontline officers who will be the primary users of the BWC and the accompanying Digital Evidence Management System (DEMS) Service. • Capture preliminary “lessons-learned” to help refine service delivery processes for full implementation in Alberta. Should the top vendor demonstrate they can meet our requirements, the next step will be full implementation later in 2023. The introduction of body-worn cameras and digital evidence management service will become a new national standard to enhance public trust, confidence and public safety. Although preliminary estimates were provided within the 2023/24 to 2027/28 Multi-Year Financial Plan for your community, the field test results may impact the estimated costs. The Distinguished Budget Presentation Award is designed to encourage and assist local governments to prepare budget documents of the highest quality that reflect best practice of budgeting, and to recognize those governments for achieving that goal. There are over 1,700 participants in the Budget Awards Program throughout North America, and approximately 15 recipients within Alberta in any given year. DISCUSSION/OPTIONS/BENEFITS/DISADVANTAGES/OTHER CONSIDERATIONS: The Distinguished Budget Presentation Award was received by the County for the first time for the 2021 Budget document and has been received for a second time for the 2022 Budget document. The distinguished budget presentation award represents a significant achievement by the County. It reflects the commitment of Council and administration to meet the highest principles of governmental budgeting. In order to receive the budget award, the County had to satisfy internationally recognized guidelines for effective budget presentation. When a Distinguished Budget Presentation Award is granted to an entity, a Certificate of Recognition for Budget Presentation is also presented to the individual(s) or department designated as being primarily responsible for having achieved the award. This has been presented to Marika von Mirbach. FINANCIAL & STAFFING IMPLICATIONS: There are no staffing implications of receiving this award. Kneehill County’s Bylaw database consist of 1958 Bylaws. Upon comprehensive review of the bylaw database it has been discovered that more than 90 bylaws are obsolete or redundant. Theses bylaws largely fall into one of four categories: 1. Bylaws that were created for a very specific purpose and once acted upon, have no further effect or are no longer required; 2. Bylaws that have been superceded by a change in overarching legislation or by another bylaw; 3. Bylaws that were created for a specific purpose or situation that no longer exists; or 4. Bylaws that were created for a specified time period, which has now elapsed. WHEREAS the following rate of Special Assessment has been established by Schedule attached and forming a part of Local Improvement Debenture By-law 861 . 1 . Schedule A to by-law 861 setting an annual rate of assessment of $2. 12 per front foot. Total Debenture Debt is $175,915.00 at an annual rate of interest of 12%. The purpose of the debenture by-law is to provide for a sewage collection and treatment system for the hamlet of Swalwell . AND WHEREAS debenture cancellation authorized by The Municipal Debt Reduction Act, reduced the debenture debt incurred by by-law number 861 to $17,327.63. AND WHEREAS the annual rate of Special Assessment as established by by-law 861 will accumulate revenues in excess of the total annual installment payments of the remaining debenture debt incurred. AND WHEREAS The Alberta Municipal Financing Corporation has issued a new debenture debt repayment schedule in keeping with the reduced debenture debt as authorized by by-law 861 . NOW THEREFORE THE COUNCIL OF THE MUNICIPAL DISTRICT OF KNEEHILL #48 pursuant to Section 18 of the Municipal Debt Reduction Act, hereby enacts as follows: 1 . AND WHEREAS under the authority of by-law 917, the frontage of an irregular shaped parcel - Lots 11 to 26 in Block 7 Swalwell 5050 A.K. , against which the special levy was to be charged was reduced from 413.6 feet to 242 feet. AND WHEREAS as a result of the levy in the year 1979 at $2.12 per front foot and the levy of 28 per front foot in the year 1980, an excess of funds will be raised if the frontage tax continues to be levied at the rate of 28 per front foot for the remaining 23 years of the debenture. The M.D. of Kneehill #48 shall be advised of the names of those appointed to the Drumheller and District Recreation Board and of any changes thereto. 5. Under section 116 of the Municipal Government Act, the Local Authority is authorized under By-law No.dated 1988, to enter into this Agreement. THE PARTIES AGREE THAT: 1. The Financial Assistance Chart - Appendix A is incorporated into and forms part of this Agreement. 71 2022.11.29 Adopted Council Package 2 - 2. In consideration of the Minister paying to the Local Authority the financial assistance and performing the obligations provided in the Agreement, the Local Authority, while this Agreement is in effect, will undertake its obligations in accordance with the provisions stated in this Agreement. Definitions 3. In this Agreement, a) "Local Authority" means the corporation of the Municipal District of Kneehill No. 48, b) "Municipality" means the area of the Hamlet of Swalwell, c) "population count", means the population of the municipality as approved by the Minister, d) "Project" means constructing a new well and supply line, a reservoir and pump station and a water distribution system in the Hamlet of Swalwell. Terms and Conditions 4. The Local Authority hereby agrees to: a) finance the entire cost of the project, b) undertake to acquire all necessary permits, licences, authorities, property easements and lands required to allow the implementation of the Project, c) construct the Project at its sole risk in a proper and workmanlike manner, complete in all respects in accordance with the plans and specifications for the Project and shall pay all costs and expenses relating thereto, d) assume all liability for all damages of any nature whatsoever caused by the Local Authority, its servants, workmen, or agents, in the construction, use, operation, maintenance, repair and replacement of the Project, or any part thereof, and will indemnify and save harmless the Minister in respect of all claims or demands or actions of whatever kind and nature that may be made against the Minister or his employees, workmen, or agents by reason of the financial assistance given to the Local Authority for the construction of the Project under this Agreement, e) invest all funds (in excess of current expenditures) advanced from this grant, or received from the Alberta Municipal Finance Corporation with respect to this Project. The interest earned therefrom shall be applied to reduce the costs of the Project, 72 2022.11.29 Adopted Council Package 3 - f) provide to the Minister, copies, certified in a manner satisfactory to the Minister, of any documents that the Minister may deem necessary for the purpose of this Agreement. 5. The Minister hereby agrees: a) that the Local Authority is eligible for a grant as provided by the Minister under this Agreement with respect to that portion of the total cost of the Project that is determined eligible by the Minister, b) to calculate the amount of the total financial assistance to which the Local Authority is eligible for the Project and shall complete Appendix A by inserting the amounts calculated. 6. The Local Authority and the Minister hereby jointly agree that: a) the population count of the Municipality shown in Appendix A is correct, b) the amounts and percentages calculated or fixed by the Minister in Appendix A are mutually acceptable, c) notwithstanding (a) or (b), if at any time during, or at the time of completion of, the Project i) the population count differs from that first indicated in Appendix A, or i i) the actual cost differs from that first estimated in Appendix A, the Minister, in his discretion, may recalculate the amount of the total financial assistance to which the Local Authority is eligible and may complete a new Appendix A, d) if the Minister recalculates the total amount of grant money under the provisions of this Agreement, and if the recalculated amount of grant money is less than the amount of grant monies previously paid to the Local Authority in accordance with this Agreement, the Local Authority shall repay to the Minister the amount calculated to be an overpayment within ninety days after the Local Authority received the revised Appendix A from the Minister. e) the Minister appoints the Director, Municipal Services Branch, or his representative to communicate with the Local Authority and to administer the provisions of this Agreement. 73 2022.11.29 Adopted Council Package 4 - Payments 7. The Local Authority shall : a) submit to a professional accountant, authorized by the Local Authority, a statement of costs incurred and revenues received with respect to the Project, and the professional accountant shall attest in writing that the expenditures and revenues so submitted for the Project are reasonable, are attributable to the Project, and that the accounting of same has been performed in a manner that complies with the intent and meaning of this Agreement. b) agree to allow the Minister or his agents access to the Project site, any engineering drawings or documents, any books of accounts relating to expenditures claimed under this Agreement, and other such project-related documents as deemed necessary by the Minister in performing an audit of the Project. 8. The Minister shall : a) upon receipt of a completed application form and satisfactory documentation that the project has commenced, issue an initial payment, b) upon receipt of the final statement of costs, audited by a professional accountant, together with: i) a certification that the Project is complete and that no additional costs will be submited, and ii) such other documentation as requested by the Minister, make payment of the balance of the grant, c) notwithstanding (a) and (b) above, upon receipt of satisfactory written documentation, issue at his discretion, any payments, including payment in full. 9. Where the Local Authority recommends that any tender other than the lowest be accepted, the Local Authority shall submit a written request for approval of such award, together with details of all tenders received. 10. This Agreement continues in effect from its date of execution until the date of final grant payment or such other date as the Minister may agree to in writing. 11. WHEREAS subsection 205( 1) of the Municipal Government Act, Statutes of Alberta, 1994 c.M-26 . 1 provides that Council must, by bylaw, establish a position of Chief Administrative Officer (CAO) and subsection 205 (4) provides that Council may give the position of Chief Administrative Officer any title Council considers appropriate; and WHEREAS Council now wishes to establish the position of Chief Administrative Officer the title of Administrator. Attend all meetings of council and committees of council and meetings of such boards, authorities and other bodies as are required by council. 10 . Prepare and submit to council such reports and recommendations as may be required by council or council committees . 11. Appoint an acting assistant to act during absences of the Chief Administrative Officer which has all the powers, duties, functions of a designated officer as required under the Municipal Government Act or any other act. 12 . Ensure all minutes of council meetings are recorded in the English language, without note or comment. 13. Ensure the names of councillors present at the council meetings are recorded. 14 . Municipal representative for county for 1 position for 3 years. Nominated: Councilor Charlene , Camrose County; Councilor Michelle , Clearwater County; Councilor Faye McGhee, Kneehill County -Elected Municipal Representative for town or village: 2 positions for 3 years and 1 position for 1 year: Mayor Jean , Town of Innisfail -Elected for 3yr term Councilor Chris Vargus, Town of Sundre -Elected for 3yr term Councilor Joyce mc, Town of Didsbury -Elected for 1yr term The organizational meeting for the board with be December 14 at the Red Deer County Building Guest Speaker, Alexander (Sasha) Sergeev, Supply Chain Management, Latest Trends and Developments. -Reminded us that products have a network of layers of supplies, from raw materials to finished products. The complexity has created problems. -Though there is improvement from pandemic days there are products that will be months or more before we see changes. Shortages of raw products, weaknesses in transportation, the strict restrictions in China are contributors. -“Decoupling Strategies” are resulting as manufactures are experiencing supply issues. Manufacturers are moving towards building in Canada, USA and Europe. This is also happening as consumers are demanding ethical practices to be in all layers of the products for the purchase of the product. - Standards of ethics (child labour, environmental accountability, etc) are going to be recorded and will follow products. There will be digital data attached to the product that the consumer can access the ethnicity of all sourced materials used to manufacture the item. 113 2022.11.29 Adopted Council Package -Digitization will increasingly be utilized in many, many products, ie: fridge will order the food you need, and it will be delivered automatically. -Procurement is briskly moving to planning far ahead and the days of ordering as needed is no longer practical. Treasurer Report, Mayor Jim Wood, (Red Deer County) -In good standing. -Keeping and increasing of memberships. -Highlighted that projects have and will be sourcing grants. -when in conversation with Honorable Brian Jean, he stated that he believes $10.00 is received for every $1.00 invested in to Regional Economic Development Alliances of Alberta (Alberta REDAs) Doing Democracy Better; Challenging the Politics of Fear and Resentment Date: November 18-20, 2022 Overall Highlights: Keynote, Jared Yates Sexton, shared some excellent points around politics of today. Commonly, we see political leaders are replacing the crisis at hand with another crisis and not dealing with the symptoms and the issues. We as voters need to know and demonstrate that we matter and why we matter and vote. We are seeing what he calls “mass politics” where large groups are activating on one issue in highly polarized, strong messaging which results in making democracy challenging. My favorite break out of the weekend was “Rural/Urban Divide and its Impacts on Politics and Democracy” -Jack Lucas shared his research which focused on democracy and representation in Canadian local governments as well as urban-rural divides in Canadian politics. He presented graphs that showed where urban and rural communities sit on the scale measuring right to left values. He notes the gap in differences are much smaller than either urbans or rural peoples would think. -Clark Banack shared excellent insights to rural perspectives on topics including Alberta Policing, erosion of public services, hospital and EMS, property crime etc.; noting that rural communities are very much on the defensive. A large part of his presentation shared insights he gained by going to community gathering spots in Alberta small communities and sit and listen. He suggests that all Albertans need to be careful not to assume what other groups of citizens are about; emphasizing the discontent of rural Albertans needs to be regarded and a rural lens needs to be applied to policies. Democracy need s the people to focus on what the policies are. -I have contacted both presenters for their slides and hope to have them to share with the council at some point.
