GRAINGER-HESKETH WATER LOCAL IMPROVEMENT BYLAW AMENDMENT
A BYLAW OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, FOR THE AMENDMENT OF BYLAW 1692,
BYLAWS AUTHORIZING THE COUNCIL OF THE MUNICIPALITY TO IMPOSE A LOCAL IMPROVEMENT TAX IN
RESPECT OF ALL LANDS THAT DIRECTLY BENEFIT FROM THE GRAINGER-HESKETH WATER SERVICE AREA
PROJECT
WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000 Chapter M-26 as amended, Section 397(2),
a local improvement tax bylaw authorizes the Council to impose a local improvement tax in respect of all land
in a particular area of the municipality to raise revenue to pay for the local improvement that benefits that
area of the municipality;
AND WHEREAS Kneehill County Council passed Bylaw 1601 on February 9, 2010 to undertake the local
improvement plan for the Grainger -Hesketh Water Service Area Project and to impose a local improvement
tax on subject parcels benefitting from the water services;
AND WHEREAS pursuant to the Municipal Government Act, R.S.A. 2000 Chapter M-26 as amended, Section
402, if, after a local improvement tax has been imposed, there is (a) a subdivision affecting a parcel of land, or
(b) a consolidation of 2 or more parcels of land, in respect of which a local improvement tax is payable, the
council, with respect to future years, must revise the local improvement tax bylaw so that each of the new
parcels of land bears an appropriate share of the local improvement tax;
AND WHEREAS Kneehill County Council amended Bylaw 1601 to implement revisions required by subdivision
activity, and to provide greater clarity on April 28, 2015 under Bylaw 1692;
AND WHEREAS Kneehill County Council wishes to amend Bylaw 1692 due to an administrative error;
NOW THEREFORE, the Council of Kneehill County, duly assembled, enacts as follows:
PART ONE INTRODUCTION
1. TITLE
This Bylaw shall be known as the "Grainger -Hesketh Water Local Improvement Amendment".
2. CONDITIONS
(1) Schedule "A" of Bylaw 1692 is hereby amended and replaced by Schedule "A" attached
hereto.
(2) Schedule "B" of Bylaw 1692 is hereby amended and replaced by Schedule "B" attached
hereto.

PART TWO TRANSITION
3. SEVERABILITY
(1) If a portion of this bylaw is found by a court of competent jurisdiction to be invalid, the
invalid portion will be voided, and the rest of the bylaw remains valid and effective.
4. EFFECTIVE DATE
(1) This bylaw comes into effect upon third reading of this bylaw.
