Issue Cancellation of tax penalties
Background The only assessment in Kneehill County for Rapidfire Resources Ltd for
the last two taxation years has been pipeline There has also been pipeline assessment
reported for the 2004 taxation year The taxes for 2002 and 2003 remain unpaid with
accumulated penalties The pipeline runs from a well at LSD14 Sec 36 Twp 32 Rge 23 to
a pipeline at LSD 11 Sec 35 Twp 32 Rge 23
December 19, 2003 the Assessment Department received a letter from Cord Oil & Gas
Management Ltd as agent for KMPG Inc in response to the annual request for
information per Section 295(1) of the MGA There was no discussion of the outstanding
taxes
February 27, 2004 Kneehill County received the request from KPMG Inc as Receiver
and Manager requesting that the penalties of $263 78 be waived on the outstanding taxes
of $1,673 66
Previous Decisions of Council. July 16, 2002 Council dealt with a request from Koch
Exploration via Deloitte and Touche to forgive the municipal portion and penalties on an
outstanding bill of $10,878 18 Council did not forgive the taxes or penalties and full
payment was received approximately one month later
November 26, 2002 Council once again dealt with a request to waive tax penalties in the
amount of $161 20 Council denied the request and the account was paid in full within a
month.
Legal Authority of Council Section 347 of the MGA states
(1) If a council considers it equitable to do so it may, generally or with respect to
a particular taxable property or business or a class of taxable property or
business, do one or more of the following with or without conditions
(a) cancel or reduce tax arrears,
(b) cancel or refund all or part of a tax
(c) defer the collection of a tax
As per the MGA Council has the authority to grant the request made by KPMG Inc
Council however, may wish to consider the impact if any on the whole of Kneehill
County
Recommendation. That Council deny the request, in keeping with past practice

The subject property is the CBC facility in SE — 7 — 29 — 20 — 4 This property is a
communication property with a tower small building and security fence The Federal
Grant in Lieu of Taxes act excludes fencing from being subject to grant payments
June 13, 2003 a fax was received by Kneehill County from CBC Radio Canada
supporting the position that a grant will not be paid on the fencing assessment It appears
from the file that Steve Nedoshytko had processed an assessment adjustment, but the
adjustment was not made to the tax account
July 22 2003 a payment was made on the account to cover everything but the fence The
account is now in arrears in the amount of $111 77, which is made up of a levy of
$101 38 and arrear penalties of $10.39
Recommendation That Council write off the grant and penalties on this account in the
total amount of $111 77

Request for Funding
Background
A copy of the Eltrohills Dats Society January 13t' letter requesting financial support was
provided to Council in the February 20t' Council Information Package The Eltrohills
Dats Society originally purchased vans for handicapped and seniors through grants
contributed by municipalities In the following years the Society contacted the
surrounding towns in the municipality, on an annual basis, requesting continued support
to provide this service
Discussion -
The following is a history of the amount of funding allocated by Kneehill County to this

Re Kneehill Pee Wee A Provincials
Recently our local Pee Wee A team won their zone 6 hockey division finals in Chestermere
This is a great accomplishment for the kids, ages 12 and 13 Our team has children from Trochu,
Three Hills Linden and the surrounding county They will be attending provincials to represent
our communities in Lac La Biche on March 18 19 20 and 212004 It is our understanding that
the towns and villages have funds set aside that they donate when local teams make it to
Provincials The costs for this event will be great for each family member involved and some
people are experiencing financial difficulty in sending their child We would greatly appreciate
any monetary support you could give our team. Please let me know at your earliest convenience
if this is possible so that we may plan, as we only have 2 weeks to get everything in order
Also at the tournament it is customary to exchange pins with your fellow competitors, could you
please provide us with 20 pins?
