To- Council
From Terry Nash
Date. February 19 2004
Issue
Tax Forfeiture Swalwell Contaminated Site
Council Agenda Item # 7(a)
Background
Property went to Public Tax Sale in 1994 In 2002 Keystone Environmental was
appointed by Municipal Affairs to do a site assessment Safety Codes Council required a
commitment from Kneehill County February 2003 to continue with the testing Safety
Codes Council is currently waiting for Remedial Plan from Consultant with final costs
Discussion
Section 434 1 relieves a municipality of their potential liability provided that the
municipality did not cause the contamination, that the municipality does not release any
additional or new substance onto the parcel of land, or that the municipality does not
aggravate the adverse effect of the contaminant that already exists on the parcel of land
Once a new title is issued, all responsibilities to the previous owner of the parcel cease
This would expedite the process considerably, and allow our employees to enter upon the
property to do the cleanup
Recommendation
1 Recommend Council cancel taxes and penalties in the amount of $6,863.22 on
Roll#7363000
2 Recommend Council request the Registrar at Land Titles to remove the tax
forfeiture on Lots 1 2, Block 2, Plan 5050AK and take clear title
Terry Nash, Assistant CAO
