Title- 100 YEAR FARM and RANCH AWARD Policy No
Category Financial Policies
Purpose.
To recognize the achievement of century family farms and ranches within Kneehill
County's boundaries and to honor such an achievement by the presentation of a plaque
Policy Guidelines.
1) The land must be continuously owned and actively farmed or ranched by the same
family having controlling interest for 100 or more years
The 100 years starts from the time the land was occupied for farming or
ranching, which in many cases was before the homestead title was
issued
Deeded land that has been rented to persons outside of the family during
the 100 years ineligible for an award Rental property is also ineligible
2) The applicant must provide evidence clearly demonstrating the kinship ties
between the applicant and the founder of the farm, ranch or homestead
3) The current size of the original homestead must be at least 160 acres of land (a
farm not an acreage)
4) The applicant must provide the following information
Date of the homestead establishment
Land location
Copy of the current land title
5) A bronze plaque measuring 15" x12" with the following inscription will be
presented to the family being honoured at a regular Council meeting

Background
Employee Computer Purchase Plan Policy was presented to Council at the March 11,
2003 Council meeting for review and consideration Members of Council requested
further information regarding tax implications for interest free loans, and goods and
service tax rebates
Discussion
The difference between the amount of interest charged and the prescribed rate determined
by Revenue Canada is deemed to be a taxable benefit At present this rate is 3%
quarterly
The GST rebate received by the municipality is not to be passed along to employees on
purchases
Recommendation
1) Recommend that Council approve the Employee Computer Purchase Plan Policy
and determine the rate of interest to be charged

Bylaw 41479 has been prepared reflecting the changes made in Council Motion #146/02
Recommendation
1 Bylaw #1479, being a bylaw to establish the imposition of penalties for the non
payment of taxes be given three readings

Issue. Addition to current development control policy — Fee Schedule
Background The current policy has not been amended since June 1998 Since then the
Natural Resources Conservation Board (NRCB) has taken over the siting of Confined
Feeding Operations (CFO's) In speaking with Sandi Roberts, Approval Officer for
NRCB Red Deer Region if they are made aware of municipal setbacks, they will try and
adhere to these setbacks when approving a site
Discussion Due to the fact that the County has very little control over where these
operations are sited, an amendment should be made to the current policy as to the fee the
County will charge
As per Section 619(1) of the Municipal Government Act (MGA)
A licence, permit, approval or other authorization granted by the NRCB, ERCB or AEUB
prevails, in accordance with this section, over any statutory plan land use bylaw
subdivision decision or development decision by a subdivision authority, development
authority, subdivision and development appeal board, or the Municipal Government
Board or any other authorization under this Part
Due to the above clause in the MGA, the County does not require development permits
from oil companies for wells or compressor buildings which often become quite
permanent Similarly, permits should not be required for buildings or manure storage
facilities, which have already been approved by the NRCB

Issue Amendment to Existing Policy — Requests from Ratepayers to Build Roads
on Undeveloped Road Allowances
Background Current Policy
The County of Kneehill will pay fifty percent (50%) of the costs to a maximum of
$15, 000.00 to build a road, to County standards on undeveloped road allowance for a
ratepayer requesting a road to access a residence and/or development, providing these
road construction costs are included in the County budget and the work will be
undertaken by a bid contractor This policy will be included as an addendum to the
planning and development process (July 98 — County s contribution includes gravel
costs.)
Discussion 3 Problems present themselves
1 The wording suggests that should the road construction costs not be
included in the budget, the County will not cost share
2 Often a blade grade may be sufficient on short pieces of road (% 1
mile) If this is the case is it necessary for a developer to hire a
contractor for something the County could do?
3 Other areas that need to be addressed include
a) The expected timeline the ratepayer can expect the County to
do work in i.e should they do a bladegrade
b) What are the County's road guidelines/requirements?
The current policy also assumes that every request is for the same type of development
and similar road conditions and distances The attached policy addresses different
scenarios including residential development vs intensive agricultural & industrial, as
well as different road conditions
Financial Implication
It is hard to budget for the number of developers requesting to cost share with the County
for the upgrade of a road, however there seems to be at least 3 or 4 inquiries per year
Recommendation.

DEVELOPMENT AGREEMENT
Road Construction
This Agreement entered into this day of
BETWEEN
Kneehill County
A Municipal Corporation in the Province of Alberta
(hereinafter referred to as `the County")
2003
OF THE FIRST PART
(hereinafter referred to as "the Developer")
OF THE SECOND PART
WHEREAS the Developer is the registered owner of an estate in fee simple and legally
described as follows
(hereinafter referred to as `the said lands")
AND WHEREAS the County has agreed to the establishment of a subdivision on the lands and
provisions herein contained relative to the establishment of the subdivision
AND WHEREAS the issuance of a Development Permit from the County is a prerequisite to the
construction, placement or erection of any improvements within upon or under said lands,
AND WHEREAS the County requires certain agreements and assurances prior to the issuing of
a Development Permit in respect to the said lands
NOW THEREFORE IN CONSIDERATION OF THE TERMS AND COVENANTS HEREIN
CONTAINED AND THE OTHER GOOD AND VALUABLE CONSIDERATION HEREINAFTER
SET FORTH THE PARTIES MUTUALLY COVENANT AND AGREE THE ONE WITH THE
OTHER AS FOLLOWS
1 In this Agreement
1 1 "Agreement" shall mean this Agreement

12 `Completion Date' shall mean one year from the date of issuance of the permit,
13 "The Subdivision" shall mean the lands outlined in proposed plan of subdivision,
14 "Final Acceptance Certificate" shall mean a certificate issued pursuant of this agreement,
as set out in the form attached as Schedule `B' to this agreement which represents the
final acceptance by the County of the road from the Developer,
15 "Municipal Development Officer" shall mean the person appointed by the Municipal
Council from time to time as Development Officer for the Municipality pursuant to any
Land Use or Development Control By Law in force within the Municipality,
16 `Plan" shall mean the Plan of Subdivision, a copy of which is attached hereto and
marked as Schedule "A 1" and forming part of this Agreement
17 "Public Works Superintendent" shall mean the person appointed by the Municipality to
advise and control the work to be performed by the Developer pursuant to this
Agreement,
18 "Regulations" shall mean and refer to those portions of the County's Planning By laws
and Regulations relating to subdivisions such as are in existence and/or in effect at any
material time hereto,
19 "Road" shall mean that portion of the subject road allowance outlined and described as
the Range Road 261 along the entire east boundary of the NE 26 37 26 W4M and set
forth on the Plan listed as Schedule A 1 ',
1 10 `Specifications' shall mean the specifications set forth in Schedule "A attached hereto
and forming part of this Agreement
1 11 "Title" shall mean a copy of the Land Title confirming ownership of the subject property,
listed as Schedule "A 2"
2 Upon execution of this Agreement the Developer shall
21 Deliver in cash or in a form acceptable to the County's solicitors in favour of the County
in an amount equal to and representing $100 per linear foot of the estimated distance of
road to be constructed, as security for the construction and completion by the Developer
of the Road in accordance with the terms of this Agreement and shall not be refunded
until the County has confirmed, in writing, to the Developer that the Road has been
satisfactorily completed in accordance with the terms of this Agreement
3 The Developer covenants and agrees to construct the road at its sole cost and expense, in a good
and workmanlike manner, in strict conformity with the Plan and with those requirements of
Schedule A on or before the Completion Date
4 The Developer shall cause all work to be conducted diligently, with reasonable dispatch in a
good and workmanlike manner, according to the requirements and specifications of the
Municipality's Public Works Superintendent and so as to not cause more inconvenience to the
other residents of the County than is necessary in the circumstances
5 The Developer, its servants, agents and contractors shall do as little damage as possible in the
construction of the improvements and shall cause as little obstruction as possible to the
movement of traffic and other works within the County during the progress of the construction
and at all times shall restore the existing roads, lanes and public areas to a state of repair as
nearly as possible equal to their state of repair existing at the commencement of construction,

and shall be responsible for any maintenance to the improvements on the subject road allowance
during the construction
6 The Developer's Contractor who has been hired to carry out the construction of the said Road
shall carry comprehensive liability insurance in such form and amount as shall meet the
requirements of the County This will include an amount of not less than Two Million Dollars
($2,000,000) for bodily injury, death and property damage and name the County as an insured
party The Contractor shall not be at liberty to cancel liability insurance upon the issuance of a
Final Acceptance Certificate by the Municipality's Public Works Superintendent for the Road
7 The Developer shall at all times ensure that any work to be performed or carried out by the
Developer pursuant to this Agreement is properly marked with such warning signs and devices
as shall be necessary to alert the public that the said work is taking place The Developer, if
requested by the Public Works Superintendent, shall supply and put up such additional warning
signs and devices, as the Public Works Superintendent shall deem necessary
8 At all times during the performance of the work relative to the Road, the Public Works
Superintendent shall be at liberty to
8 1 Carry out such inspections of the works to be performed or carried out by the Developer,
its engineers, contractors servants agents or employees pursuant to this Agreement as
the Public Works Superintendent shall deem necessary or advisable to ensure full and
proper compliance by the Developer with the Developer's undertakings to the County
contained in this Agreement, and to ensure the proper performance of any work to be
performed pursuant to this Agreement,
8.2 Reject any unsatisfactory design, material or work
8.3 Order that any unsatisfactory work and the replacement of any unsatisfactory material, at
the Developer's cost
84 Order the Developer to bring on the fob and use additional labour, machinery and
equipment at the Developer's cost, as the Public Works Superintendent may deem
necessary to ensure performance of the work,
8.5 Order the performance of the work or part thereof be stopped until his said orders can be
obeyed,
9 The County shall have the right to issue a Stop Order in the event that any work to be performed
or carried out by the Developer under this Agreement contravenes the provisions of any federal,
provincial or municipal statute, regulation or bylaw or if the system of work is dangerous or
inimical to public safety or is likely to damage some existing public work in a manner not
contemplated by this Agreement The County shall be at liberty to maintain the Stop Order until
the contravention is corrected Without restricting the generality of this Agreement and in
addition to any other charges or sums for which the Developer is responsible as provided
elsewhere in this Agreement the costs to be borne and paid by the Developer shall include
9 1 Costs of all work and materials required for work repaired or redone by reason of orders or
directions of the Public Works Superintendent
9 2 All legal fees and disbursements incurred by the County in the preparation of this
Agreement and in the enforcement of its terms and conditions
9 3 All charges and accounts rendered to the County by the Public Works Superintendent with
respect to inspection of the plans and specifications and inspection of the Road during the
construction

10 If, upon inspection, it is certified by the Public Works Superintendent that the road complies with
the specifications, the plan, or that the construction of the road has been properly completed, the
Public Works Superintendent shall issue to the Developer a Construction Completion Certificate for
the road
11 If, upon inspection, it is certified by the Public Works Superintendent that the Road does not
comply with the Specifications, the Plan or that the construction of the Road has not been properly
completed the Public Works Superintendent, with a notice in writing specify in detail the defects
and deficiencies in the Road and the Developer shall thereupon correct all the said defects and
deficiencies in the said notice
12 In the event that the Public Works Superintendent shall not be satisfied with the correction by the
Developer of the said defects and deficiencies the Public Works Superintendent shall serve notice
upon the Developer describing the defects and deficiencies which have not been corrected to the
satisfaction of the Public Works Superintendent whereupon the process set out in Paragraph 11 and
this paragraph shall apply mutatis mutandis
13 The Developer shall indemnify and save harmless the County from any and all losses, costs,
damages actions causes of action, suits, claims and demands resulting from anything done or
omitted to be done by the Developer in pursuance or purported pursuance of this Agreement
14 Whenever under the provisions of this Agreement any notice, demand or request is required to be
given by either party to the other, such notice, demand or request may be given by delivery by and
to or by registered mail set to the respective addresses of the parties being

15 Any notice, demand or request mailed by prepaid registered mail shall be deemed to have been
received five (5) business days after the posting thereof
16 This Agreement shall ensure to the benefit of and be binding upon the County and its successors and
assigns and upon the Developer and his heirs, executors, administrators successors and assigns and,
in this Agreement the singular and body corporate shall be deemed to include the masculine and
feminine and plural where the context so requires

This Agreement entered into this day of 12003
BETWEEN
Kneehill County
A Municipal Corporation in the Province of Alberta
(hereinafter referred to as `the County")
OF THE FIRST PART
(hereinafter referred to as "the Developer")
OF THE SECOND PART
WHEREAS the Developer is the registered owner of an estate in fee simple and legally
described as follows
(hereinafter referred to as "the said lands")
AND WHEREAS the County has agreed to the establishment of a subdivision on the lands, and
provisions herein contained relative to the establishment of the subdivision
AND WHEREAS the issuance of a Development Permit from the County is a prerequisite to the
construction placement or erection of any improvements within upon or under said lands,
AND WHEREAS the County requires certain agreements and assurances prior to the issuing of
a Development Permit in respect to the said lands,
NOW THEREFORE IN CONSIDERATION OF THE TERMS AND COVENANTS HEREIN
CONTAINED AND THE OTHER GOOD AND VALUABLE CONSIDERATION HEREINAFTER
SET FORTH THE PARTIES MUTUALLY COVENANT AND AGREE THE ONE WITH THE
OTHER AS FOLLOWS

1 I "Agreement" shall mean this Agreement

13 `The Subdivision" shall mean the lands outlined in proposed plan of subdivision,
14 "Final Acceptance Certificate" shall mean a certificate issued pursuant of this agreement
as set out in the form attached as Schedule "B" to this agreement which represents the
final acceptance by the County of the road from the Developer,
15 "Municipal Development Officer" shall mean the person appointed by the Municipal
Council from time to time as Development Officer for the Municipality pursuant to any
Land Use or Development Control By Law in force within the Municipality,
16 "Plan" shall mean the Plan of Subdivision, a copy of which is attached hereto and
marked as Schedule `A-1 , and forming part of this Agreement,
17 "Public Works Superintendent" shall mean the person appointed by the Municipality to
advise and control the work to be performed by the Developer pursuant to this
Agreement,
18 "Regulations" shall mean and refer to those portions of the County's Planning By laws
and Regulations relating to subdivisions such as are in existence and/or in effect at any
material time hereto,
19 "Road" shall mean that portion of the subject road allowance outlined and described as
the Range Road 261 along the entire east boundary of the NE 26 37 26 W4M and set
forth on the Plan listed as Schedule' A 1"
1 10 "Specifications" shall mean the specifications set forth in Schedule "A" attached hereto
and forming part of this Agreement
1 11 "Title" shall mean a copy of the Land Title confirming ownership of the subject property
listed as Schedule "A 2"
2 Upon execution of this Agreement the Developer shall
21 Deliver in cash or in a form acceptable to the County's solicitors in favour of the County
in an amount equal to and representing $100 per linear foot of the estimated distance of
road to be constructed as security for the construction and completion by the Developer
of the Road in accordance with the terms of this Agreement and shall not be refunded
until the County has confirmed, in writing, to the Developer that the Road has been
satisfactorily completed in accordance with the terms of this Agreement
3 The Developer covenants and agrees to construct the road, in a good and workmanlike manner
in strict conformity with the Plan and with those requirements of Schedule A on or before the
Completion Date
4 The County agrees to pay fifty percent (50%) of the costs, to a maximum of $15 000 00
including gravel costs
5 The cost share of the developer shall be paid to the County preceding the work based on the
estimated cost of the project Any excess in the deposit will be refunded on completion and
approval of the road construction
6 The Developer shall cause all work to be conducted diligently, with reasonable dispatch in a
good and workmanlike manner according to the requirements and specifications of the
Municipality's Public Works Superintendent and so as to not cause more inconvenience to the
other residents of the County than is necessary in the circumstances
7 The Developer, its servants, agents and contractors shall do as little damage as possible in the

construction of the improvements and shall cause as little obstruction as possible to the
movement of traffic and other works within the County during the progress of the construction
and at all times shall restore the existing roads, lanes and public areas to a state of repair as
nearly as possible equal to their state of repair existing at the commencement of construction
and shall be responsible for any maintenance to the improvements on the subject road allowance
during the construction
8 The Developer's Contractor who has been hired to carry out the construction of the said Road
shall carry comprehensive liability insurance in such form and amount as shall meet the
requirements of the County This will include an amount of not less than Two Million Dollars
($2,000,000) for bodily injury, death and property damage and name the County as an insured
party The Contractor shall not be at liberty to cancel liability insurance upon the issuance of a
Final Acceptance Certificate by the Municipality's Public Works Superintendent for the Road
9 The Developer shall at all times ensure that any work to be performed or carried out by the
Developer pursuant to this Agreement is properly marked with such warning signs and devices
as shall be necessary to alert the public that the said work is taking place The Developer, if
requested by the Public Works Superintendent shall supply and put up such additional warning
signs and devices, as the Public Works Superintendent shall deem necessary
10 At all times during the performance of the work relative to the Road, the Public Works
Superintendent shall be at liberty to
101 Carry out such inspections of the works to be performed or carried out by the Developer,
its engineers, contractors, servants, agents or employees pursuant to this Agreement as
the Public Works Superintendent shall deem necessary or advisable to ensure full and
proper compliance by the Developer with the Developer's undertakings to the County
contained in this Agreement, and to ensure the proper performance of any work to be
performed pursuant to this Agreement
10.2 Refect any unsatisfactory design, material or work
10.3 Order that any unsatisfactory work and the replacement of any unsatisfactory material, at
the Developer's cost,
10.4 Order the Developer to bring on the fob and use additional labour, machinery and
equipment at the Developer's cost, as the Public Works Superintendent may deem
necessary to ensure performance of the work,
10.5 Order the performance of the work or part thereof be stopped until his said orders can be
obeyed
11 The County shall have the right to issue a Stop Order in the event that any work to be performed
or carried out by the Developer under this Agreement contravenes the provisions of any federal
provincial or municipal statute, regulation or bylaw, or if the system of work is dangerous or
inimical to public safety or is likely to damage some existing public work in a manner not
contemplated by this Agreement The County shall be at liberty to maintain the Stop Order until
the contravention is corrected Without restricting the generality of this Agreement and in
addition to any other charges or sums for which the Developer is responsible as provided
elsewhere in this Agreement, the costs to be borne and paid by the Developer shall include

113 All charges and accounts rendered to the County by the Public Works Superintendent
with respect to inspection of the plans and specifications and inspection of the Road
during the construction
12 If, upon inspection, it is certified by the Public Works Superintendent that the road complies
with the specifications the plan or that the construction of the road has been properly
completed the Public Works Superintendent shall issue to the Developer a Construction
Completion Certificate for the road
13 If upon inspection, it is certified by the Public Works Superintendent that the Road does not
comply with the Specifications, the Plan or that the construction of the Road has not been
properly completed the Public Works Superintendent with a notice in writing specify in detail
the defects and deficiencies in the Road and the Developer shall thereupon correct all the said
defects and deficiencies in the said notice
14 In the event that the Public Works Superintendent shall not be satisfied with the correction by the
Developer of the said defects and deficiencies, the Public Works Superintendent shall serve
notice upon the Developer describing the defects and deficiencies which have not been corrected
to the satisfaction of the Public Works Superintendent whereupon the process set out in
Paragraph 11 and this paragraph shall apply mutatis mutandis
15 The Developer shall indemnify and save harmless the County from any and all losses, costs,
damages actions, causes of action, suits, claims and demands resulting from anything done or
omitted to be done by the Developer in pursuance or purported pursuance of this Agreement
16 Whenever under the provisions of this Agreement any notice demand or request is required to be
given by either party to the other, such notice, demand or request may be given by delivery by
and to, or by registered mail set to, the respective addresses of the parties being

17 Any notice, demand or request mailed by prepaid registered mail shall be deemed to have been

18 This Agreement shall ensure to the benefit of and be binding upon the County and its successors

assigns and, in this Agreement the singular and body corporate shall be deemed to include the
masculine and feminine and plural where the context so requires
