HomeMy WebLinkAbout2000-11-22 Council MinutesKNEEHiLL COUNTY COUNCIL RESTRUCTURING OF THE LAND USE BYLAW MINUTES November 22, 2000 A meeting of the Kneehill County Council was held on Wednesday November 22 2000 commencing at 9 10 A M The following were present at the meeting Marylea Lowen Councillor Division One Otto Hoff Councillor Division Two Marl Vetter Councillor Division Four James Hanger Councillor Division Five Richard Vickery Councillor Division Six Jennifer Deak Administrator Lonnie McCook Assistant Administrator Barb Reimer Development Officer Barb Long Recorded the minutes Glen Wagstaff was not present for the meeting Reeve Hoff called the meeting to order at 9 10 A M The review of the Land Use Bylaw Draft 1, continued from the October 31, 2000 meeting with the following changes and amendments noted as well as areas identified for further discussion Part Vii — General Land Use Regulations Page 56 — Intensive Livestock Operations —Item 48(7) — Chip seal or paving as methods of dust control were discussed The following options were discussed a condition of the developer to look after dust abatement /road maintenance increase of tax base to help cover cost or livestock "head' tax be implemented It was agreed that individual dust control doesn't solve the problem Will further discuss the suggestion of a `head' tax further in order to present at the Divisional meetings as a possible method of providing chip /seal coats on the busy roads to intensive operations A copy of the Alberta Agriculture news article, printed in the November 7 2000 issue of the Strathmore Standard was distributed to all present This article suggested the use of independent consultants rather than Alberta Agriculture for technical advice on intensive developments as Alberta Agriculture was believed to be biased as they have a mandate to meet the provincial production limits. Council suggested the cost for independent consultants could be absorbed by the applicant Page 57 — item 48(10d) Remove this section regarding vegetative screening around lagoons Discussion ensued on whether the County should ever approve lagoons for manure storage A suggestion was made that manure storage should be in above ground storage tanks only as they could be visually monitored allowing for early easy detection of leakage Consensus of Council was the possible danger of a rupture of overhead storage tanks was not as serious as that of a lagoon seeping into the aquifer, and the expense of monitoring wells The possibility of environmental damage occurring in case of the rupture of an overhead tank could be controlled by the installation of a plastic lined berm that would be sized to contain the spill It was noted Wheatland County has Just implemented only above ground storage for intensive operations Page 57 — Item 48 (10) add a condition that in some areas above ground storage would be required (site specific) depending upon soil testing and hydro geological results Environmental conditions need to be addressed and a standard set i The meeting recessed from 10 15 A M until 10 30 A M Planning 1 0 O is r#.. KNEEHILL COUNTY COUNCIL RESTRUCTURING OF THE LAND USE BYLAW MINUTES November 22, 2000 The cost of manure storage was discussed with Ms Reimer supplying figures obtained from the Elite Swine newsletter These costs indicated 2 cents /gallon for earthen storage, 8 cents /gallon for concrete above ground storage 15 cents /gallon for steel above ground storage Page 58 — item 48(13a) change to read within one mile of a hamlet Page 58 — Item 48 (13c) change to read " this bylaw limits the maximum on site capacity size at any given time of extensive operations as follows Page 58 — Item 48 (13b)(iv) and (I3c)(iv) change both to read other operations — site specific and subject to MPC approval Page 58 — Item 48(14) Add from the old bylaw(page 54), Intensive Livestock Operations that have not been in operation for a period of 2 years or more require a development permit prior to re commencing operations Note In the case of non conforming uses or buildings if the use is discontinued for a period of six consecutive months or more any future use of the land outbuildings shall conform with the provisions of this Bylaw — Section 643 of the Municipal Government Act Page 58 — Item 51(1) Local Rural Commercial Development remove, "shall not be located on better agricultural lands Barb Long left the meeting at 10 50 A M Page 59 — Item 51(c) discussed when an area structure plan would be needed Needs to be clarified in the Land Use Bylaw that if multiple enterprises are included in one site, an Area Structure Plan would be required Barb Long returned to the meeting at 10 53 A.M Page 59 — item 52(1 a) Auto Wreckage Site add, "except the owner s personal residence " Discussion ensued regarding complaints due to unsightliness It was noted that at this time only the hamlets have a bylaw in place to allow the Development Officer to enforce cleanup Ms Reimer was requested to draft a bylaw regarding unsightliness /nuisance and present it to Council for their review and consideration Page 60 — Item 54 Dwelling Units Per Lot needs to be clarified to read that a second dwelling may be permitted for lots less than 80 acres in size Page 60 — item 56(2), Recreational Trails, remove `railway' As the first review of the initial draft of the Land Use Bylaw has been completed Ms Reimer was requested to complete a second draft, including all discussed amendments Ms Reimer will provide copies to all Councillors to allow adequate time for further review and additional changes to be completed prior to presenting it to the ratepayers at a public meeting tentatively planned for January 2001 Ms Reimer noted the following planning issues need to be addressed by Council prior to completion of the revised Land Use Bylaw Need guidelines for the number of animals allowed on acreages Ms Reimer will bring a portion of the Red Deer County Land Use Bylaw for examples, and she was requested to check with Mr Sommerville for additional information and the amount of acres needed per head of livestock Will the County allow the addition of a rental suite to a rural residence? Consensus was to leave this issue alone as it would be a policing nightmare A time line is needed to come up to code regarding winter manure spreading, as many of Kneehill County's grand fathered operations only have one month of storage so need to spread in the winter which is creating an environmental Planning issue Should Kneehill County require a development permit for topsoil or aggregate removal and at what amount of dirt would it be required? Alberta Environment handles any aggregate or soil removed over 12 5 acres Consensus of Council was to leave as is letting Alberta Environment continue to handle these larger developments Need guidelines regarding the need for Development Permits for fencing? Consensus was no permits should be required in the rural areas for fencing or 2 C KNEEHiLL COUNTY COUNCIL RESTRUCTURING OF THE LAND USE BYLAW MINUTES November 22, 2000 corrals however Council felt there should be something in the bylaw offering direction regarding fencing in hamlets Guideline needed for the narrow strips of land located within the hamlets next to the rail lines Currently coded as Permitted Uses often unsightly, and do not meet setbacks for development Guidelines necessary regarding old, `unsafe' buildings located within the hamlets Should the minimum manure storage regulation be changed to reflect 9 -12 months storage due to no spreading allowed in the winter months? Should the Minimum Distance Separation (MDS) be applied to manure spreading as well as the actual agricultural site9 Need to set a `foot /meter" standard that would apply to all farming operations Ms Reimer advised she would amend the draft Land Use Bylaw and distribute it to Council as soon as possible Moved Council arljourn Time 11 55 A M nistrative Officer Fire /Capital Meeting November 22 2000 Present Marj Vetter, Rick Vickery Jim Hanger Otto Hoff Recorder Lonnie McCook Meeting started 100 pm Mr McCook presented the draft fire bylaw to the committee and discussion took place The committee recommended this draft go to council for approval The direction of the county was discussed as to what the feelings are with new sites for shops and ambulance hall Discussion on these sites and locations took place The committee recommends that a new hall for the ambulance remain on hold until the county knows more of the direction it will be taking. The site options for a new yard be investigated by Mr Hanger and discussed in council A general run down of capital requirements for the upcoming year was gone through. It was talked about making sure budgets between capital and operating were broken down carefully with in the fire departments Mr McCook assured that Mr Tiller would be looking into this The committee recommends that Mr McCook puts together the capital requirements and costs, and present these to the committee in the near future Meeting adjourned 2.40 pm iWE LAW] � �bRrs �uPck„urriuD�u�
