A regular meeting of Council was held in the Kneehill County office 232 Main Street, PRESENT
Three Hills Alberta on Tuesday, November 21 2000 commencing at 8 30 A.M
The following were present for the meeting

present along with Barb Long who recorded the minutes. AGENDA

Mr Hoff presented Mrs Deak with her fifteen year pin received from the AAMD &C
It was noted the November 8 "', 2000 Council minutes would be edited by a committee
comprised of Councillors Vickery Vetter and Lowen KRWC Men IyW arty
Prior to the 9 00 A M appointment with representatives of the Kneehill Regional Water APPOINTMENT
Committee (KRWC) and Gerry Guy District Engineer for Prairie Farm Rehabilitation
Administration (PFRA) the history of this Committee as well as Kneehill County s Joint
Services Position were briefly reviewed
Bert Jackson Bob Boake, John Van Doesburg and Gerry Guy entered the meeting at 9 10
A.M
On behalf of Council Reeve Hoff welcomed the delegation to Council and introductions
were made Mr Jackson advised the KRWC is currently in the process of obtaining grant
money and the results to date are very encouraging The Committee has met with Ed
Stelmach Minister of Alberta Infrastructure who was quite positive towards this project
and recommended they be sure to request enough funding to cover all the costs of the water
project The federal government Caucus Chairperson, also spoke favorably of the project
and has forwarded the project to the Minister of the Environment but advised nothing will
be done until after the November election Mr Jackson also reported the other water
projects in the province are only in the formative stages therefore KRWC will have a good
chance of being first in line for any available grant money Mr Van Doesburg advised the
Committee should have a good idea by the end of January how they stand regarding grant
money in response to a question regarding water licensing, Mr Van Doesburg reported
the KRWC has water available from the Red Deer River through the town of Drumheller s
water license Mr Van Does Berg explained that in order to control the amount of water
removed from the Red Deer River each water treatment plant has been allocated so many
gallons based on projected population growth and Drumheller has enough water volume
allocated for at least 20 years possibly 40 years
Council expressed their concern that the Municipal District of Rocky View has not been
involved in this project as the lines will be running through their county to reach the
interested towns of Irricana and Beiseker The misunderstandings regarding
communications were discussed and Mr Van Doesburg noted he will ensure that in future

both the municipalities of Rocky View and Mountain View are invited to all meetings so
that everyone is informed
Mrs Lowen questioned whether the water supply to the rural users would be a "trickle
system'? Mr Van Doesburg explained that designing a line to provide a demand system for
all the rural users would be too costly With a trickle system the rural user would need a
reservoir, with the allocated water volume being filled during less demand times Mr Gerry
Guy reported that a 300 gallon fiberglass tank would be adequate for most residential water
supplies He also reported that if a 2 3 day supply were stored in a reservoir or cistern it
would operate like a demand system Mr Jackson advised each town on this project would
also have a reservoir that will be pumped at night to decrease electrical costs and use of the
water system during peak times Mr Guy advised the PFRA would assist rural water
cooperatives or societies with the cost of hookups from the waterline into the residences,
including installation of the reservoir or cistern However the farmer s individual pressure
pump systems would not be covered The PFRA funding would be up front money with the
loan to be paid back by the water co op Mr Guy advised that in 98% of the regional water
systems the PFRA are involved with a trickle system is used He further suggested if a
cooperative of rural residents wanted to pay the extra money it would be possible to have a
demand system with water being pumped into one large reservoir on a controlled basis and
having a demand system to the farmers from there Mr Guy noted the general cost for
constructing a reservoir would be approximately $1 00 per cubic gallon Mr Boake
reported he believed the rural residents of Kneehill County preferred a demand system for
water delivery
In reference to costs Mr Van Doesburg advised the cost for the transmission line alone
would be approximately $27 million and it is difficult to determine specific user costs as it
will depend on the number of cooperatives formed and the distance the water needs to be
transported Mr Guy advised the costs on other lines have been averaging between
$12 000 $15,000 00 per hook up One person per mile of line is considered economical
and should the line travel through heavily populated areas, this would help average costs
He further advised the 20 years amortization would also help reduce the costs incurred
Mrs Deak left the meeting at 9 55 A M
The following information regarding the line was provided
Water lines running into the rural residences will use a 2 inch tap off and a 1
inch line, depending on amount of water needed Pressure on line all the
time
Most economical system 'trickle', 2 gallons per minute over a 24 hour limit
(stored in a cistern or reservoir)
Line should be designed to mirror the developments in the area and that has
not yet been determined if the intensive operators want additional volume
perhaps shares will be sold
Have projected over 20 years that users of this line will be 50% urban and
50% rural
Use of a steel main line so that pressure can be increased or decreased when
needed
The option of using the Three Hills Treatment Plant, if necessary in the
future, is being considered
Mrs Deak returned to the meeting at 1005 A.M
It was reported the large installation cost of the regional line will be paid by the Commission
through grants and then the urban and rural areas will buy in at a fee established to cover
costs However the Commission cannot be established until funding is in place Mr Van
Doesburg reported this water system is being approached as regional with no differentiation
between rural and urban areas The Commission will work out prices, set the standards to
ensure fairness and handle the user water groups In January the KRWC will organize a
rural meeting to determine how many are interested Mr Boake reported at this time he has
approximately 127 rural residents interested in signing up and he has been using the estimate
of $15,000 00 per user connection Mr Van Doesburg reported the KRWC is not sure of
the exact route of the water line until it is determined where the interested rural users are
located Council advised groups interested in forming water cooperatives should go to the
Kneehill Regional Water Committee first and the Committee can report back to Council
regarding the applicants

Council noted that as the municipality has money invested in the Three Hills Water
Treatment Plant and it is located within the County it should be considered to this water
project It was also noted that Trochu should be invited to join the KRWC to determine a
method of water delivery in order to obtain provincial and federal funding the Kneehill
Regional Water Committee requested a letter of support from the County stating that the
County is in favor in principal of the regional water line project Mr Jackson reported
concern that funding will not be granted without the County s support Council
recommended that it would like all its concerns addressed prior to the County being
involved with a letter of support however they will discuss this further and advise the
Committee of their decision
Mr Van Doesburg advised letters would be sent to each Jurisdiction asking for motions
supporting the signing of the agreement with the town of Drumheller to secure water
delivery He provided a copy of this agreement for Council to review
The delegation consisting of Messrs Jackson Boake Guy and Van Doesburg left the AB TRAIL

Mr Colin Stroeder and Mr Gord Caldwell from Agra Torchinsky Engineering were present RE SH806
when the meeting reconvened
Mr Theo VanEvlingen Agra Torchinsky Engineering and Mr Scott Richardson, President
of Alberta Trail Net entered the meeting at 10 50 A.M
Mr McCook reported this meeting had been arranged to discuss the refusal of the Trans
Canada Trail Foundation (TCTF) to sign Kneehill County s land purchase agreement for the
Secondary Highway 806 road rebuild project Mr VanEvlingen reported he has been
handling the land purchasing agreements for Kneehill County and negotiations between
Trans Canada Trail Net and Kneehill County noting both parties are reluctant to take the
responsibility for any environmental issues
Mr Scott Richardson advised that the land in question is owned by the Trans Canada Trail
Foundation with Alberta Trail Net acting as its agent He further advised that while he is
not legally a representative of TCTF he would attempt to present and recommend
information to the TCTF Mr Richardson reported that when Trans Canada Trail
Foundation purchased the abandoned rail lines from the CPR it was with the agreement that
if there were any environmental contamination the CPR would take the land back, reclaim it
and then return it to the TCTF Mr Richardson advised that once the TCTF sells land to
Kneehill County they would no longer be able to return it to CPR for reclamation, as per
the agreement The lawyers representing TCTF felt Kneehill County s land agreements left J D
TCTF unprotected and responsible for any contamination In an effort to expedite matters
TCTF designed the following 3 options to allow Kneehill County to have their own land
agreement signed
Limit the amount of environmental responsibility to the purchase price
Agree to expropriation
Do an easement to allow the road construction go ahead
When asked if TCTF could request the CPR to certify this portion of land benign of any
contamination Mr Richardson advised he was unsure of the costs involved or the time
limits necessary to do this type of certification?
It was argued that if Alberta Law specifies that he who contaminates the land is responsible
for the costs of reclamation why would TCTF be concerned as it would ultimately be
CPR s responsibility Mr Richardson replied that signing the County's agreement
accepting liability for any environmental issues was felt by TCTF to weaken their position
in regard to this law Mrs Lowen advised the County is not just this one small land holding
that is the issue but the precedent that will be set in dealing with TCTF property in future
dealings Mr Richardson recommended compromise and common sense be used on both
sides to settle this matter Mr Richardson suggested a Joint venture of Kneehill County,
AB Trail Net and TCTF hiring an independent environmental consultant to look at this

section of land conduct soil samples and see if there are contaminates as it was felt a
reclamation certificate through Alberta Environment would be very time consuming Mr
Richardson advised that if the study came back clean and Kneehill County felt the
environment issues were addressed and would be willing to write a letter to the effect that
the County would not hold TCTF responsible Mr Richardson would present this option to
TCTF to see if they would sign the County s land agreement Mr Richardson also felt there
was merit in the easement option and suggested it be considered as it would provide
protection to TCTF
Council advised Mr Richardson they will further consider this issue and advise him of their
decision
Mr Richardson and Mr McCook left the meeting at 11 40 A M

Mr Stroeder advised it is not possible to move the road to resolve the issue Mr Van
Evlingen reported AB Infrastructure would not likely recognize an easement and neither
Kneehill County not TCTF appear willing to move from their positions due to the precedent
being set so he again suggested the County consider the environmental study option as
discussed with Mr Richardson
Mr McCook returned at 11 45 A.M
Council was reminded that Alberta Infrastructure had been willing to sign a separate
agreement with TCTF removing the responsibility of the environmental liabilities from
Kneehill County however Council at that time had taken the position that in order to be fair
and equitable all parties should sign the same land purchasing agreement It was also noted
that due to the lateness of the season, construction will not be undertaken this year The
consensus of Council was to reaffirm its previous decision
Messrs Stroeder VanEvlingen and Caldwell left the meeting at 11 50 A.M with Mr
McCook

Mr & Mrs Gordon Park entered the meeting at 12.00 P M
On behalf of Council Reeve Hoff welcomed Mr & Mrs Park and introductions were made
Mr Park advised that he would like to address Council as Chairman of the Kneehill Water
Advisory Committee He explained the Society had applied for AESA funding however as
they are a new society there would be no money available until April 2001 and they are in
need of funds to continue with their current activities as well as to be able to keep Ryan Cox
as Coordinator Mr Park requested Council bridge the funding surplus left from the 2000
AESA grant which will be lost if not used or consider loaning this organization
approximately $7,500 00 to cover mileage, wages benefits etc for the months of January,
February and March 2001 Council agreed to let Mr Park know their decision by Friday,
November 24 2000
Mr Hoff then presented Mr Park with a plaque in honor of his years of dedicated service to
the Three Hills & District Seed Cleaning Plant and invited Mr & Mrs Park to ,loin Council
for lunch
The meeting recessed at 12 10 P M until 1 40 P M
Mr Tim Shearlaw was present when the meeting reconvened
On behalf of Council Mr Hanger advised Mr Shearlaw of the concerns regarding the
inaccuracies of some of the news articles written and printed in The Capital, in particular
one of two weeks ago and expressing disappointment that the facts weren't investigated or
checked out prior to printing Council further advised that normally the County does not
print rebuttals but due to the misrepresentation of the County facts this step had been
taken Mr Shearlaw advised that in future he would ensure that both sides of a story be

investigated in order to clarify the facts so that accurate information is reported Mr
Shearlaw further stated the provision of factual information from the County is an excellent
idea and recommended that the County provide periodic information on departments
updates etc. not only regarding contentious or controversial issues as he feels this would
eliminate rumours and innuendoes Consensus of Council was that Kneehill County would
send articles to The Capital on an as needed basis" with no definite times set At this time
they reconfirmed the new Media Policy with Mr Shearlaw for his information
Mr Hoff and Mr Hanger left the meeting at 1 55 P M due to a prior commitment
Mr Vickery thanked Mr Shearlaw for coming to Council and for addressing this matter
Mr Shearlaw left the meeting at 1 56 P M
The Administrator's Report for the period November 9 to November 21, 2000 was

Under Correspondence Report Item #9 Town of Trochu Sewer Invert Extensions, Mr
McCook reported these manholes are located in the County road allowance and the
extensions to the manholes would put them flush with the road surface which would be a
dangerous situation unless fill is brought in and the area properly sloped
Moved a letter he sent to the town of Trochu advising Kneehill County will allow
�' extensions to the current lines, in order to raise the manholes a mczrimum of 16" —24"
if properly sloped, to address safety concerns However as per County policy, any future

Full E911 dispatch contract expires November 30 2000 and will renew at a rate of DISPATCH
$1 50 per capita for 2001 and $2 00 per capita for 2002 The City of Red Deer
Emergency services has advised they could provide an interim contract until December
31 2000 if requested Consensus was for the County to continue to pay for the
provision of full E91 I dispatch to the entire county

Mrs Deak presented a request from Steve Nedoshytko Assessor, requesting a change in APPROVAL OFD'

which allows the assessor to correct the assessment as Alberta Municipal Affairs has POLICY —
advised B T Energy Limited no longer has a taxable linear property within Kneehill REVISED

Trochu Fire Hall must be rezoned to `P' Community Service District They also require a
request in writing to allow a fire hall to be permitted in this district While there is no cost
to redesignate, it must go through the normal time frame They are also requesting a
Development Permit accompanied by a site plan that includes the water lines and any APPROVAL OF
changes being made to the building The fee for the Development Permit is $50 00 Mr T &U REPORT
McCook advised he would be obtaining the required permits as they need to be in place
prior to installing the water line There will be a six inch line running from the main water
line into the site with two hydrants being installed in the yard He further reported he has a
couple of County employees cleaning walls and starting the painting in the building. row"
Under item #5 Schmautz Pit, Mr McCook reported he would be hiring a truck and picker ACME /LINDEN /KC
to move the transfer bin to the new site He also advised the hours at the Schmautz pit will FIRE AGRMENT

Mrs Deak reviewed the November 8 2000 letter from the Village of Acme regarding the
Linden/Acme /Kneehill Fire Agreement This letter expressed concern that the County is of

by Mrs Wildeman explaining it is the County s practice to request the lawyers involved
with the subdivision and sale to do the necessary calculations to split up the taxes for the WAIVER OF TAX
current calendar year but advising the County would be willing to waive the penalties if the PENALTY ROLL

A suggestion was made that this could be handled by the Planning Department at the time of

re TrailNet (Board Walks the Trail) She is of the opinion TrailNet trespassed across
her property to access their trail notes this is now considered a Trail and what has the

4 Jerry Fardo, Nichols Applied Management has scheduled a meeting for Monday,
December 4/00 at 1 00 P M at the County office to discuss the questionnaire on the
