COUNCIL RESTRUCTURING OF THE LAND USE BYLAW
MINUTES
October 11, 2000
A meeting of the Kneehill County Council was held on Wednesday October 11, 2000,
commencing at 8 30 A.M
The following were present at the meeting

Otto Hoff called the meeting to order at 8 40 A.M
The Land Use Bylaw Draft 1 was i eviewed with the following changes and amendments
noted as well as areas identified for further discussion
PART i — PURPOSE & DEFINITIONS
Page 1 Definition needed for "Agriculture"
Page 5 — Under the definition for Campground — need to define "temporary"
Page 5 — Under the definition for Dwelling — should this include mobile homes?
If so, mobile homes need to be removed from the definitions of farm residence
and farmstead separation
Page 6 — Under the definition for Extensive Agriculture — need to define "large"
Page 6 — Under the definition of Farm Residence — need to define `agricultural
pursuit'
Page 6 — Under the definition of Fence — add plastic as another type of material
used
Page 6 — Under the definition of Flood Plain — add `based on Alberta
Environment studies"
Page 7 — Under the definition of Golf Course — should this include campgrounds
located at golf courses?
Page 7 — Under the definition of Home Occupation — change "not exceeding 2
sq ft (0 18 sq m) in area to read signs exceeding 2 sq ft.(0 18 sq m.) will require a
development permit'
Page 8 — Under the definition for Livestock Facility — ( c ) Intensive Livestock
Facility (i) seasonal feeding site add the definition from the Code of Practice
Table 1 intensive Livestock Operations — Minimum Size remove PW from
Horses category
Page 10 — Under the definition for Recreational Trails — change to Recreational
Area defined simply as' an area of land used by the public for recreational
purposes' Remove examples of recreation but need a definition of `recreation'
Page 11 — Delete `Secondary Roads' from definitions
Page 11 — Under the definition for Sign ( e ) Projecting Sign need to add "so that
part of the sign projects more than one foot from the face of the building or
structure "
Page 1 i — Need to add `Site' to definition list
Page 12 — Specify the Municipal Government Act (not just Act) in the closing
paragraph
Should Penalties be added to the definitions?

PART ii — ADMINISTRATIVE AGENCIES
Page 14 Under Subdivision and Development Appeal Board Change to read
"The Subdivision and Development Appeal Board established by Bylaw of the
municipality of Kneehill County shall perform all duties so specified in that
Bylaw'
Page 14 — Under Municipal Planning Commission — Change to read, "The
Municipal Planning Commission established by Bylaw of the municipality of
Kneehill County shall perform all duties as specified in that Bylaw "
PART IiI — DEVELOPMENT PERMIT APPLICATION
Under Development Permit Not Required — Page 14 (7) Change to read, "The
construction, maintenance and repair of private walkways, pathways, driveways
and similar works ( A permit is required for access onto a municipal road) "
Under Application For A Development Permit — Page 15 (3d) "land title "should
be added in parentheses
Under Deciding On Development Permit Applications — Page 16 (3a) ) spelling
correction should read `would'
Page 16 (7) Add "The 40 day time period begins when the application is deemed
complete by the Development Officer
Page 17 (10) Spelling correction should read `by'
Page 17(1 1) Add number 11 a March 11/97 amendment which states, "The
Municipal Planning Commission may approve an application for a development
permit notwithstanding that the proposed development does not comply with this
Bylaw or is a non conforming building if in the opinion of the Municipal
Planning Commission
(A) the proposed development would not
(i) unduly interfere with the amenities of the neighborhood, or
(ii) materially interfere with or affect the use enjoyment or value of
neighboring parcels of land and
(B) the proposed development conforms with the use prescribed for that land
or building in this Bylaw
Under Development Permits and Notices — Page 17 (3c) Add " a notice shall be
immediately mailed to all registered owners of land who in the opinion of the
Development Officer may be affected
Page 17 (4) Correct to read, "If the Development authorized by permit is not
commenced within the 12 months from the date of its issue, the permit is deemed
to be void unless an extension to this period has previously been granted by the
Development Officer
PART iV — APPEALS
Under Appeal Procedure Page 11 (1 a) Change to read, "refuses or fails to issue
a development permit to a person within 40 days of receipt of the completed
application (or when deemed complete by the Development Officer) "

PART V — ENFORCEMENT & ADMINISTRATION
Under Enforcement — Page 21 — 15(3) Change the fine amount to "not more than
$10,000 00' and remove the phrase `and in default of payment to imprisonment
for a term not exceeding 30 days." It was felt the amount levied per fine should
be left to the discretion of Council in order that each case could be considered on
an individual basis
Discussion of the Land Use Bylaw ceased for the appointment arranged by Ross
Rawlusyk Administrator of Starland County, to recognize Mrs Terry Nash as a new
member to the Society of Local Government Managers
Mrs Nash and Mr Rawlusyk entered the meeting at 11 10 A.M
Mr Rawlusyk provided an overview of the Society of Local Government commenting
that with the ongoing changes in local government there is a need for progressive,

knowledgeable managers to deal effectively with these changes The Society of Local
Government Managers was incorporated in 1988 and was registered as a descriptive class
of profession in 1991 It is comprised of 6 directors with equal representation from rural
and urban municipalities To date 131 members have received their certificates of Local
Government Managers Mr Rawlusyk highlighted the areas of the Code of Ethics which
sets high standards to guide the designees the quarterly newsletter The Alberta Clarion
which provides local government managers with current information on issues and the
web page (www,clgm _net) which lists members, provides information and also advertises
for positions and equipment for local government During his presentation to Mrs Nash,
he explained that to receive this designation the following four qualifications must be
met a certificate from the University of Alberta in Local Government as well as a Senior
Executive Fellowship Program five years of experience in local government belief and
practice of the Code of Ethics and paid membership to the Society of Local Government
Managers
On behalf of Council, Mr Hoff thanked Mr Rawlusyk for coming to Council and
expressed his appreciation to Mrs Terry Nash for the excellent job she has done as
accountant for Kneehill County
Mr Rawlusyk and Mrs Nash left the meeting at 11 35 A M
PART Vi — LAND USE DISTRICTS
Under Agricultural Conservation District — Page 25 — Discussion regarding the
placement of Hutterite Colonies under this district as there is definitely more than
a one family dwelling Permitted and Discretionary Uses were discussed with the
consensus being to eliminate a lot of the Discretionary Uses by establishing more
Land Use Districts
The meeting recessed for lunch from 12 05 P M until 1 12 P M
Mr Hanger was not present when the meeting reconvened
Agricultural Conservation District discussion continued Page 25 (3)
Discretionary Uses — Only the following to remain
o Additional dwellings for farm help
o One family dwelling within 500 m of a river and /or stream
o Home occupations
o Kennels
o Signs
Page 25 (4) Minimum Requirements — Leave as is for now however discuss a
minimum site area of 160 acres at the Divisional meetings, showing pros and cons
to get input and direction from ratepayers Page 26 (5) Maximum limits — leave
as is for now but again discuss at Divisionals Page 26(6) Special Requirements —
remove this section but add 6b from Agricultural District which states, `All
applications for lots larger than 20 acres in size shall required redesignation to
Agricultural District
Mr Hanger entered the meeting at 1 37 P M
Under Agricultural District — Page 27(3) Discretionary Uses — Only the
following remain
o Additional dwellings for farm help
o One family dwelling within 500 m of a river and /or stream
o Intensive agriculture
o Home occupations
o Kennels
o Signs
Page 27(4a) Minimum Requirements Site Area should be 5 acres
Page 27(5a) Maximum Limits Site area maximum size 20 acres suggested and to
be discussed by Council at a later date
Page 28(6b) Remove in its entirety and add to Agricultural Conservation District
Special Requirements
Under Hamlet Residential District — Page 29(2) Permitted Uses — remove Parks
& Playgrounds and add to (3) Discretionary Uses Page 29 (3)Discretionary Uses

remove Schools and Public & Quasi Public installations and facilities and place
them in Hamlet General Page 30 (6) Parking Minimum Standards remove (b)
churches
Under Hamlet Commercial District — no changes to be made except to clarify
under definitions motels or motor hotels
Under Hamlet Industrial District — Page 34 — Add (7) Industrial Commercial
Use Conditions
Permit based on details provided in application
If expansion — additional permit may be required
Uner Hamlet Mobile Home Park District — Page 35(2) Permitted Uses
Remove Parks & Playgrounds. Page 35(3) Discretionary Uses remove Schools
and Public and Quasi public installations & facilities (Should be only in Hamlet
General) Page 36 Minimum Requirements (4)(e)(i) delete the reference to
Torrington regarding floor area. Page 36 Parking (Minimum Standards) delete
the reference to churches (6b)
Under Hamlet General District — Page 30(3) Discretionary Uses — delete "All
permitted and discretionary uses outlined in the HR, HC and HI districts Add the
following
Schools
Churches
Playgrounds
Public and Quasi public installations and facilities
Community halls
Group Care facility
Campgrounds
Museums
Cemeteries
Horses
Under C -HWY — Highway Commercial District — no changes
Under LRC — Local Rural Commercial District — Page 41 (3) Discretionary
Uses remove Fairgrounds(Rodeo Grounds), Petting Zoo, Museums, Race Track
Page 41 Correct (6) to read "On site parking requirements "
Under R — Recreation District — Page 42 Add under (3) Discretionary Uses add
Race tracks Dude Ranches Petting Zoos, Museums, and Quasi Public Buildings
