Jennifer Deak Administrator, Lonnie McCook Assistant Administrator, was present along with Barb Long who recorded the minutes CALL TO ORDER Reeve Otto Hoff called the meeting to order at 8 28 A.M Requests were made to add the following to the agenda Under Committee Reports Agenda Item 15 September 22/00 ASB Minutes Under Late Items Agenda Item 16, Council Appointment Request AGENDA Under Late Items Agenda Item 17 ASB Regional Conference ADDITIONS AND APPROVAL Moved approval of the agenda, with the above additions. C ::.71117 Council requested the September 12 2000 minutes that are sent to the Three Hills Capital yno t�L for printing in the paper be edited in order to remove the names of the Councillors making motions at that meeting APPROVAL OF Moved approval of the September 12, 2000 minutes MINUTES CARRIED The Administrator's report was presented 0 0V APPROVAL OF Moved approval of the Administrator's report, as presented r ADMINISTRATOR REPORT CARRIED The September 21 2000 Executive Committee report was presented Under Item # 18 Above Ground Storage for Manure, Mr Hoff reported he had read an ABOVE GROUND article in last week s Strathmore Standard reporting Wheatland County will not allow any MANURE <Z underground manure storage all must be above ground manure storage facilities. REPORT The Bank Reconciliation report as at August 31 2000 was presented BANK REC. REPORT Moved approval of the Bank Reconciliation report, as presented CARRIED APPR OF ACCTS PAYABLE Moved approval of the accounts presented for payment today, subject to review by the Finance Committee of Councillors Vetter, Lowen and Hoff CARRIED Mr McCook reported the County has received a request from the Trochu Lions Club to TROCHU LIONS store their `Port a potties" for the winter months at the County Maintenance yard in PORTA -POTTY .10 /ARN KNEEHILL COUNTY COUNCIL MINUTES September 26, 2000 Trochu as the town of Trochu and the Golden Hills Regional School Division were unable STORAGE to provide storage space Moved the Trochu Lions Club be given permission to store their "port -a potties'; at the County maintenance yard in Trochu, at no cost. v CARRIED A suggestion was made that Kneehill County consider implementing a noise bylaw, as some NOISE BYLAW complaints had been received from residents of Torrington regarding noise from a late night party Council felt the issue of enforcement could be a concern if a noise bylaw was developed MCPEEK GRAVEL The Transportation and Utility report was presented SOURCE Under item #3 McPeek gravel source, Mr McCook reported on a telephone call received from Gary McPeek, reminding the County of the September 30, 2000 deadline to have an t offer in place or he would look elsewhere for a prospective buyer Mr McCook explained / �a «� this would not provide the County with enough time to properly test or assess the quality `��� and quantity of gravel, much less make a fair offer Council approved the letter to be sent S 5 t to Mr McPeek reconfirming this information and offering him the best of luck in his TRAILNET /K.0 dealings LAND PURCHASE Under item #7 TrailNet Land Purchasing Agreement for S H. 806 Mr McCook reported AGREEMENT the Executive Director of TrailNet has called to arrange an appointment with Mrs Deak and himself, to discuss the County's Right of Entry and Land Purchase Agreement Council J A 4P agreed there would be no purpose in this meeting as the County considers fairness and D equity in negotiations must be maintained and in order for this to happen the same land purchase agreement with the same terms and conditions should be signed by all involved parties of this road project Moved approval of the Transportation and Utihty report, as presentecb KWAC CARRIED PRESENTATION Ryan Cox and Bruce Sommerville entered the meeting at 9.01 A.M. for their appointment regarding the Kneehill Water Advisory Committee (KWAC) Mr Hoff welcomed them to Council and Ryan Cox KWAC Coordinator was introduced Mr Sommerville advised this appointment with Council was to hopefully get approval for the AESA 2001 funding to be used for continuation of the watershed project and to present information on the current and future projects of the KWAC Mr Cox distributed copies to the Councillors of the water testing results obtained from Madawaska Consulting, that he had put in chart form for easier reference The KWAC organization is comprised of the Chairman, Coordinator, Steering Committee and 4 Priority Group Sub Committees The Steering Committee is made up of the heads of the four priority sub committees which are L Riparian management — loss of vegetation in riparian areas and restricted weed populations (0� Creek inventory (survey) what are the problems along the creek The survey introduces the group and determines what the concerns along the creek are in a non threatening manner Manure management — manure runoff, wintering sites and intensive livestock RYAN COX, operations WATER Urban issues — housing, acreage development and town lagoons This is to include COORDINATOR the urbans and has two representatives from both the towns of Trochu and Three KWAC Hills PRESENTATION Mr Cox summarized the projects undertaken to date as well as his plans for the future, which include investigating alternate funding possibilities obtaining more public interest in the watershed group Winter Watering project, Riparian Regeneration project more demonstrations of pump systems, Community /Individual Assessments to be done by Cows and Fish, November Watershed Conference, printing of brochures, and a winter workshop on forage with Starland County Mr Cox also presented a comparison of the Madawaska Consulting water testing results for the years 1999 and 2000 as well as projected figures for JD/AHN 2 KNEEHILL COUNTY COUNCIL MINUTES September 26, 2000 2001 and suggested water testing be done for at least one more year in order to provide a more accurate historical base in order to do future projections Council inquired as to the steps this Committee would undertake to enforce cleanup if a problem area or source of blatant contamination is found? Mr Cox explained the purpose of the KWAC is that of education and awareness not a regulatory body and the group should not be perceived as being a policing or reporting body He advised he would personally report any blatant contamination to Alberta Environment however he would not want the group image to become that of enforcement or a regulatory body Mr Cox believes the steps that KWAC B SOMMERVILLE should follow are awareness, education and finally if no changes or improvements are WATER TESTING made Alberta Environment should be contacted DATA REQUEST Mr Sommerville then distributed the budget for water testing for 2000 as well as a cost estimate from Madawaska Consulting of $21,400 00 including GST for the year 2001 Mr Sommerville felt there should be three years water quality testing obtained in order to have sufficient historical data in order to see if any definite trends emerge Mr Sommerville questioned the validity of interpretations based on these figures as the data is dependent upon varying conditions such as the amount of runoff and water flow Mr Cox left the meeting at 9 50 AN Mr Sommerville also advised that Alberta Agriculture do the full gambit of testing at five creeks within the province one being located within Kneehill County (the Three Hills creek) including monitoring of water flow volume of runoff etc Council reconfirmed that the KWAC should be stakeholder driven, with no government intervention and to this effect the municipality should remove themselves from this group Mr Sommerville advised there is AESA dollars available for manpower which would cover 100% of the salary for the Watershed Coordinator, however $20,000 00 plus GST would be needed from the '�i irYZO County in order to continue the water testing with Madawaska Consulting for 2001 —, Council reconfirmed its earlier motion that a budget of $15 000.00 of AESA funding for L the year 200D be used to cover the salary of a Water Shed Coordinator and that this contract expire December 31, 2000 or when the money has been spent, whichever comes P, first Council further requested a letter be sent to KWAC explaining they would be able to �`� 0 ri access AESA dollars directly, to cover Mr Cox's salary upon the group forming a society Moved that one more year of testing data be obtained from Madawaska Consulting, to a maximum amount of $21,400 00 including GST, on the three creeks within Kneehill County to order to provide three years of historical data Further that the testing results he supplied to Council and that Patsy Cross of Madawaska Consulting attend a future Council meeting to explain this data CARRIED Mrs Vetter advised she would provide the Kneehill Water Advisory Committee with information on how to form a society Mr Sommerville left the meeting at 10 15 A.M RCMP VISIT — LARGE RCMP Officer Gene Kowalczyk of the Three Hills Detachment entered the meeting at DEVELOPMENTS 10 16 AN EFFECT ON Mr Hoff welcomed Officer Kowalczyk to the meeting and thanked him for coming Officer CRIME RATE Kowalczyk advised he had been invited by Mrs Deak to meet with Council to provide crime statistics for the County however as he was unsure of what areas the County would be interested in, he would open it up for questions Officer Kowalczyk was questioned as to Ur) the effect the large meat packing facility in Trochu has on the crime rate in that community OFFER TO He explained that with the great influx of people from all over Canada to work at this APPEAR AT MPC facility for $7 to $8 /hour positions there has been extra work created for the RCMP MEETINGS detachment This influx of population has brought in some unsavory characters and more illegal drugs The increase in crime has been mainly in the area of property related crimes J< such as break and enter and thefts as well as an increase in violent assault crimes If these � l JDAIIN 3 KNEEHILL COUNTY COUNCIL MINUTES September 26, 2000 large developments bring in more crime Council questioned how this information could be provided to the Municipal Planning Commission for consideration in the decision making process Officer Kowalczyk suggested the RCMP be invited to the applicable Municipal Planning Commission meetings, to give insight from their perspective as to the effect on the area caused by the quality of individuals moving into the community Officer Kowalczyk summarized by advising there are no mayor fluctuations in the Trochu area, except for the increase in the area of violent assaults He also reported Trochu and Delburne have more criminals as there are no police detachments in these communities and having a detachment in an area acts as a big deterrent to crime He further reported the Three Hills detachment over the last decade, averaged as the 12`h busiest detachment (out of the 103 in Alberta) He further reported they are currently short staffed with government cutbacks on funding effecting their operations At this time the RCMP are training 1200 recruits per year as there are huge vacancies (Alberta is short 200 police officers) and Alberta is placing 5 6 recruits per week In response to questions regarding licensing and registering of firearms he responded that policing would be handled on an incident basis In regard to the RAVE party organized for the Carbon area Officer Kowalczyk advised the County should be getting a report from the Drumheller RCMP He further added it might be timely for the County to review and tighten up regulations to make it more difficult to obtain permits for such events, with an increase in fines to the point that they would offer a deterrent He warned that since Calgary has cracked down on their Bylaws, the rural areas will be seeing a lot more of these types of events Officer Kowalczyk also reported the RCMP have no authority to enforce any requests for individuals to stop making noise, as the County does not have a noise bylaw in place Serious disturbances would fall under the criminal code and would be enforced as such Council recommended bylaw 1291, "To Provide for Licensing and Regulation of Concerts Within the County" be changed, and a Noise Bylaw be drafted Mr Hoff thanked Officer Gene Kowalczyk for meeting with Council and for the suggestions he had made Officer Gene Kowalczyk left the meeting at 10 55 A.M Mrs Deak reported a fax had been received on September 21, 2000, from Normand and Sandra Labreque, expressing dissatisfaction with the lack of consideration given their concerns and direct interests regarding the Secondary Highway 806 road rebuild plans The letter requests written assurance be provided by the County and other interested parties, indicating their concerns will be addressed prior to the commencement of this project, and a meeting be convened between their legal representatives, McCarthy Tetrault and interested parties Mr McCook advised the County had approved AGRA Torchinsky s engineering design specifying a 2 1 slope to provide minimum disturbance at this location (N W 5 30 25 W4) He further reported this proposed development is on County road allowance, not the Labreque property, and he felt it would not be feasible to move the road due to the location of the coulee the need to buy land and the related expenses, however Kneehill County is only the agent for the Alberta government on this project REQUEST TO CHANGE BYLAW It's being taken apart now in the shop and looks like a new radiator and some cowling is needed. , ��.. 3 Letter to McPeak J 0 V0 4 The gravel crew is moved into the Grainger site 5 I have spoken to Frank Lotz with environment about the new dumpsite. He stated in an E -mail that all the paper work etc looks good, but I want to confirm the registration is all in place before any move takes place r 6 As we discussed last meeting I have gave Ledcor the pace of $17 30 /tonne for the sand in the shed. +r� This pace is cost plus 5% and a bit more When Ledcor bills us for the contract work there price J is $17.40 p 7 Had a call September 25 2000 from Eric Simmons, trail net.
