Division Six Division Seven Jennifer Deak Municipal Administrator, and Lonnie McCook Assistant Administrator, were present along with Barb Long who recorded the minutes CALL TO ORDER Reeve Otto Hoff called the meeting to order at 8 35 A.M Requests were made to add the following to the agenda Under agenda item 10(a) add Torrington Village Office Lease Under agenda item 15(a) add Trochu Yard AGENDA Under agenda item 15(b) add Torrington Sewage Lagoon ADDITIONS AND Under agenda item 15(c) add Rural Road Study APPROVAL Under agenda item 23 add Carbon Recreation Board Under Late Items add the following Three Hills Rodeo Committee Neil Silver Presentation Mr Wagstaff moved approval of the agenda, with the above additions CARRIED APPROVAL OF MINUTES Mrs. I oven moved approval of the March 7, 2000 minutes, including the Public Hearing minutes, as presentee CARRIED The Administrator's Report and Pending Report were reviewed Item #7 Hamlet Grass Cutting, was discussed and Council recommended Kneehill County policy remain the same and this item be filed APPROVAL OF ADMIN. & Mr Hanger moved approval of the Administrator's Report and Pending Report, PENDING REPORT including recommendations CARRIED APPROVAL OF EXECUTIVE The March 16 2000 Executive Committee report was presented by Mrs Deak COMMITTEE REPORT i Mr Vickery moved approval of the Executive Committee report, as presented CARRIED Mr Vickery moved approval of the accounts presented for payment today, subject to APPROVAL OF revieiv by the Finance Committee of Councillors Hoff, Ickery, Lowen and Vetter ACOUNTS PAYABLE CARRIED The Transportation and Utilities Report was presented Under report item # 1(a), Dust Control, Mr McCook presented the two methods previously T &U REPORT offered, blade mix and a spray method and the time and cost factors to the County for road II JD/AHN I KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 preparation prior to the application It was noted that the weather and soil type, more than DUST CONTROL the method determined the length of time the dust control was effective It was decided; r t that the dust control program remain 100% user pay with only one spray application method being allowed, and not the blade mix procedure The County will continue to provide grading prior to application at no cost to the ratepayer Mr. Hanger moved Kneehill County Policy 13 -4 be amended to reflect only one type of spray application method for dust control, not a blade mix, to be allowed on County roads and further this to be advertised in the Three Hills Capital. CARRIED Under report item #I (b) Mr McCook requested clarification of the policy regarding Hamlet approaches Current Policy 13 15 1 states the County will supply culverts and gravel if required but is not responsible for building the approach Mr Hanger moved to reconfirm current Policy 13 -15 -1, Approaches in Hamlet Areas Under Report Item #1 c Hamlet Water Connections, Mr McCook reported the fee calculated according to Policy 9 5, for installation of a service line from the main to the property line, does not cover the costs involved in providing this service HAMLET APPROACHES HAMLET WATER & SEWER LINE HOOKUPS Mrs I Owen moved Policy 9 -5, Hamlet Water and Server Line Hookups, be amended to reflect the landowner be responsible for the actual costs (minimum $400.00) involved for , d installing a service line from the main line to the property line with the property owner being responsible for full costs from property line to residence%service hook up CARRIED Under report item #2 Wednesday April 12 2000 was set for a Road Committee date, ROAD commencing at 1 00 P M Mrs Vetter will attend as an alternate, as Mr Wagstaff has a COMMITTEE prior commitment -f'b nt2ma Under report item #3, Mr McCook reported a request had been received to purchase an old Kneehill County tumble bug that has been left in a ditch at Hesketh for several years TUMBLE BUG Mr Hanger moved the tumble hug he restored and displayed at the Kneehill County j U yard CARRIED Under report item #5, Mr McCook advised he had set the water rate for Torrington at TORRINGTON $3 50 per 1000 gallons so the rate would equal that charged for the Hamlets within H2O RATES Kneehill County Mrs Vetter moved the water rate for Torrington beset at $3 50 per 1000 gallons CARRIED Under report item #6 a Fire & Capital Committee meeting was set for 8 30 AN on FIRE & CAP Monday, April 17 2000 MEETING DATE Underreport item #7, the three year bridge request was reviewed prior to submitting to Alberta Infrastructure. THREE YEAR BRIDGE REQUEST_ Mr. Vickery moved approval of the three-year bridge request list, as presented LIST CARRIED II I I, wIMIN 2 i i I� KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 Under report item #8, Highway Signs Quote, Mr McCook presented quotes received for supplying four large (365cm x 120 cm) and twenty four smaller (60cm x 80cm) highway signs, with the County being responsible for backing, posts and installation Tenders were HIGHWAY SIGNS received from five bidders TENDER Mrs. Allan moved Kneehill County award the contract to supply the County highway signs to the lowest bidder, Hi Signs Ltd CARRIED Under item #10 Agricore railway crossing concern Mr McCook reported a letter had been AGRICORE sent, in response to a letter received from Transport Canada advising there is no problem CONCERN with the County site lines however Kneehill County has installed warning and speed limit J'; b Mp m+ 50 km per hours signs APPROVAL OF Mr Vickery moved approval of the letter sent to Transport Canada regarding the railway T &U REPORT crossing at the Agricore site and the Transportation and Utility report. CARRIED Mr McCook proceeded to open the tender documents received for Divisions 1,3 & 5 grader contracts to be in effect May 1, 2000 to April 30, 2001 GRADER Mr Vickery moved Kneehill County award the grader contract for Divisions I & S to the CONTRACT DIV low tender bidder Mr Bill Evert and the Division 3 grader contract be awarded to the 1,3 & 5 low tender bidder Mr Robert Cranston "-D rn k rvWOws CARRIED ft) wMAL-- Mr Hanger suggested a letter be forwarded to Alberta Infrastructure advising Kneehill LETTER TO AB County would be willing to maintain the secondary highways on a contract basis, if in the INFRASTRUCTUR future the province is unable to maintain the level of service on the secondary roads E RE OFFER TO MAINTAIN SH'S Mr Vickery moved a letter to Alberta Infrastructure, offering to maintain the secondary highways on a contract basis in the future should the province be unable to maintain the �lj ►twi level of service, be drafted and brought back to Council for approval. CARRIED DUST CONTROL In response to an inquiry by Mrs Allan, Mr McCook reported advertisement for dust ADVERTISEMENT control services will be done around the first of May Mrs Allan moved Kneehill County advertise dust control services, in the local newspaper the beginning of May 2000. CARRIED Mr Wagstaff advised Agricore and AgPro had questioned whether the new Schmautz Pit could accommodate the dumping of grain dust Mr McCook reported Alberta Environment determines what is acceptable and grain dust would have to be taken to a landfill site for disposal The Schmautz Pit is a rubble pit and as such would not be allowed to accept grain dust Mr Hanger moved Agricore and AgPro be advised grain dust would not be accepted at the Schmautz Pit however the Drumheller District Solid Waste Facility is equipped to dispose of grain dust. 0 CARRIED SCHMAUTZ PIT Mrs Deak reported notification had been received from Alberta Infrastructure regarding the sale of the Trochu Highway Maintenance Yard advising the adjustment and possession date AT &U SURPLUS would be April 25, 2000 and requesting completion of the Affidavit of Transferee and YARD Assignment of Lease To complete the sales transaction a payment of $210,869 32, JDI' 1!N KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 representing the balance of the purchase price, (total purchase price $236,500 00) must be �p received in their office on or before April 25 2000 Copies of the lease and the letter amending agreement with Ledcor Industries were also enclosed Mr Vickery moved Kneehill County accept the statement of adjustments, and sign the Affidavit of Transferee and the Assignment of Lease. CARRIED Mrs Deak reported a letter had been received from Frank Lotz Alberta Environment regarding the drainage of the Torrington Sewage Lagoon, advising it is up to Kneehill County to negotiate drainage easements with the landowner Mr Almer Weisenberger ( NE 27 32 26 W4) He also advised the County must ensure that the lagoon operates in TORR SEWAGE accordance with the requirements of the Alberta Environmental Protection and LAGOON NE 27- Enhancement Act 32 -26 -W4 'T D Mr Hoff moved County staff approach the adjacent landowner, Mr Almer Dw Weisenhurger, to discuss options and find a solution to allow drainage of the Torrington Sewage Lagoon across his land. CARRIED Mrs Deak reported information had been received from Alberta Infrastructure advising RURAL ROAD there is additional money available for a supplementary Rural Roads Study STUDY Mr Hanger moved Kneehill County not pursue the supplementary Rural Roads Study CARRIED Mrs Deak presented some Agricultural Service Board Issues that needed Council clarification • Water Shed Group Coordinator Mr Sommerville has advised the duties of the WATERSHED Coordinator would consist of conducting an inventory of agriculture and industry COORDINATOR along the Kneehills Three Hills and Ghost Pine Creeks, organizing a tour and riparian workshop promotion of the Advisory group, acting as the liaise with towns�i and finding partners for the Water Shed Group The ASB suggested hiring one employee to start on May 1 2000, who would assist Mr Sommerville as weed spray applicator when needed and the balance of the time work as Coordinator for the Water Shed Group with the position to be reviewed December 1,2000 Mrs Vetter reported this group is a producer driven group and appears to want independence once up and running but could use some County support in the initial stages Council was of the opinion that this position would not require a full time employee hence a per diem method of payment would be most efficient Mr Hanger recommended the Water Shed Group be a separate entity, hiring its own Coordinator from within the group and should not be politically driven Further discussion was tabled until after Council's 11 00 A.M appointment Reeve Otto Hoff welcomed Mr Willie Moran to the meeting at 11 05 A.M and introductions were made Mr Moran as a member of the Trochu Agricultural Society, was requesting financial support from Kneehill County to assist with the replacement of the TROCHU ARENA Trochu Arena and Curling Rink roof A financial break down of the costs involved, ROOF FUNDING totaling $139 295 00 was distributed Mr Moran reported that 34 5 % of the roof surface REQUEST belongs to the Arena The Trochu Agricultural Society is willing to contribute $35 000 00 and would apply for $70 000 00 from the Agriculture Initiatives Grant however needs to �b / --ea have matching funds in place It was suggested Mr Moran lobby the other urban E' jurisdictions to see if the Trochu Arena could take precedence and obtain the majority of the j yearly Kneehill County Recreational grant of $100,000 00 Mr Moran was requested to let Kneehill County know the amount the Town of Trochu would be contributing towards this project, so that an actual amount needed was available A decision was deferred to the next JUMIN 4 r. KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 Council meeting on April 25, 2000 Mr Wagstaff suggested to Council the possibility of establishing a capital expenses fund, with a yearly budget, that groups and associations LUNCH RECESS could apply to for help with capital projects. Mr Moran left the meeting at 11 30 A.M Mrs Allan left the meeting at 11 40 A.M and reentered at 11 44 A.M Council recessed for lunch from 11 45 A.M until 12 50 P M Mr Wagstaff was not present when the meeting reconvened as he had another appointment UNDERGROUND Mr McCook requested a policy be drafted regarding the installation of underground power POWER ON ROAD lines in Kneehill County right of ways ALLOWANCES Mrs Vetter moved a policy be drafted stating Kneehill County will not allow J b mQmpd�. underground power lines in rural road allowances CARRIED Mrs Vetter moved the meeting go "in camera" CARRIED Time 12 55 P M All the non elected persons left the room IN CAMERA Time 1 00 P M WATERSHED All the non elected persons who had previously left the room, reentered at this time VOLUNTEER GROUP Mrs Deak presented a letter from Ed Stelmach, Minister of Alberta Infrastructure acknowledging Kneehill County s comments regarding the lack of disclosure for the lease of ED STELMACH the Trochu yard and offering the option of proceeding or cancelling LETTER A concern was expressed regarding statements expressed by an employee of Kneehill fz mafro') S County Council decided Mrs Vetter, Mr Vickery and Mr McCook meet with the EMPLOYEE employee to settle any problems CONCERN Discussion continued regarding the hiring of a Water Shed Group Coordinator and a part time weed spray applicator It was felt due to the narrow window for weed spraying, and in oar an attempt to decrease overtime hours that it would be more advantageous to hire a ! contractor who would have spray equipment J q l'r Mr Hanger moved Mr .Sommerville hire a weedspraying contractor to assist with the WEED SPRAY blanket spraying of the 113 of Kneehill County, to a maximum budgeted amount of CONTRACTOR $15,000.00 CARRIED Mrs Vetter moved a budget of $15 000.00, as obtained from AESA, be approved to cover jj") M--m0 a•S the salary and other incidental expenses, such as office expenses and mileage, of a WATERSHED Water .Shed Coordinator The County's preference is to have a Coordinator chosen COORDINATOR from the Water Shed Group with the Water Shed Group to handle the hiring and the County to administer the accounting CARRIED The composition of the ASB was discussed Council decided that representation remain the same with Mr McCook presenting any ASB issues or concerns, as reported to him by Mr ;,b mEvha I 7-0 g S Sommerville to the Executive Committee or to Council Mrs Deak reviewed the Kneehill Community Lottery Board guidelines and distributed a list COMM LOTTERY showing the dispersal of the last term's grant money which has been placed in the Three BOARD Ji) "AfIN 5 KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 Hills Capital Mrs Deak reported the March 21, 2000 Public Hearing for the redesignation of the NE 22 31 24 W4 had no motion forthcoming and needed closure Mrs Allan moved no bylaw he forthcoming for the redesignation of a portion of NE 22- 31-24-W4. CARRIED Mrs Deak reported at the last Council meeting a motion was passed stating Kneehill County would hire its own Planner She inquired whether Council would be interested in having a full time Development Officer and bringing in a Planner when necessary Mrs Deak advised she had talked to Alberta Municipal Affairs and this situation meets approval Mrs Deak also reported a letter has been received from Mountain View advising Mr Rusling will help as long as he is needed Ms Barb Reimer has also expressed interest in the position of Development Officer for Kneehill County Mrs. Allan moved her March 21, 2000 motion be amended to read the County proceed to hire its own Development Officer or Planner CARRIED Mrs Deak reported on the Kneehill Housing Corporation Finance Committee report that was tabled from the March 7, 2000 Council meeting to obtain more information on the reason for a $50 000 00 requisition to Kneehill County while showing a surplus on the financial statement Mr Hanger had made a motion at the last Kneehill Housing Authority board meeting that the "status quo' remain regarding the requisition as the Kneehill Housing Corporation is looking at adding an additional wing comprised of 15 new rooms by 2003 and will need funding at this time Mr Vickery moved the Kneehill Housing Corporation budgeted requisition amount of $50,000 00 from Kneehill County for 2000, be approved CARRIED Mrs Deak presented the following requests from Donna Manion and Brenda Albrecht regarding leasing the Torrington Village Office the possibility of a five year lease, a request to use or purchase the existing furniture and fixtures, and the possibility of cost sharing to change the entrance door to open outwards for use as a wheelchair access Mrs Deak also reported a letter had been sent to Torrington Tourism and Action Society giving them 90 days notice to vacate the property effective July 15 2000 Dianne and Laurel Kurta will be attending the April 25 2000 Council Meeting to voice their concern regarding this decision Mr Vickery advised he will check into the rental possibilities at the Silver Willows, Torrington Arena and Community Hall as well as how often they are rented and the amount charged Mrs. Allan moved approval of a five year term lease, to be reviewed yearly, and that permission be granted for the renters to use the existing furniture and fixtures in the facility, and. further the County to cost share the changing of the entrance doors CARRIED (� Mrs Deak reported on a road closure request received from the Planning department, to sell the 1 54 acre road diversion back into the Denver Eitzen quarter located at NW 9 3C 25 W4 for a cost of $511 62 Dale Seiler's portion would then be surveyed into his subdivision Mr Vickery moved Kneehill County offer for sale, as per policy price, the] 54 acre road diversion at the NW 9- 30- 25 -W4, to Denver Eitzen JINUIN REDESIGNATION NE 22- 31 -24 -w4 PH ,) MA-,M0 DEV OFFICER OR PLANNER KHC REQUISITION ,i b P� jj ,magl TORRINGTON OFFICE LEASE .O"t , . ,sir EITZEN /SEILER ROAD DIVERSION 6 KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 CARRIED The following Committee Reports were reviewed Kneehill Ambulance Service — Minutes of the April 5 2000 meeting were reviewed At KAS MINUTES this meeting Kneehill County s point service position was reconfirmed regarding the Proposed Operating Agreement between Kneehill County and Kneehill Ambulance Service Kneehill Ambulance Service Board Members will be meeting April 11, 2000 and will inform Kneehill County of their decision regarding the operating agreement on April 12 2000 Mr Randy Tiller entered the meeting at 2 15 P M Mr Otto Hoff welcomed Mr Randy Tiller, newly appointed Kneehill/Wheatland Regional Fire & Disaster Coordinator and introductions were made Mr Tiller proceeded to give a personal history including his experience and education He also advised he needs to spend some time assessing what is currently in place and what is needed to provide good fire and disaster coverage Mr Tiller is very supportive of volunteers and advised he will focus on a R. TILLER certified training program risk management and assessment, prevention and emergency REGIONAL FIRE planning Mr Tiller reported he will be acting as a resource person for the Fire Chiefs, & DISASTER providing them with any information they require He will be meeting with the Fire Chiefs COORDINATOR and will be setting up committees to obtain feedback from the departments Mr Tiller left the meeting at 2 32 P M The review of the Committee reports continued • Kneehill Regional Water Committee — a copy of the water survey prepared at the April 6, 2000 meeting for printing in The Capital, Drumheller Mail and Five Village Weekly was reviewed and edited Mrs Vetter reported the Committee will be meeting with Drumheller later in May to further investigate possibilities for the supply of water, as the group is not interested in dealing with Three Hills Mrs Vetter will be the spokesperson KNEEHILL for this group with Mr Hanger helping with the press releases Mr Hanger REGIONAL H2O recommended Kneehill County s deadline for the Committee to have something definite rr in place by April 30, 2000 be extended until the first part of May to allow time for residents to respond to the water survey At that time Kneehill County will decide if they will continue to support the Kneehill Water Committee Mrs Deak provided a partial breakdown of expenses and advised she will present a full report at the next i Council meeting WildRose Economic Development — minutes of the March 2, 2000 meeting were reviewed Red Deer River Corridor Integrated Management Plan — the draft meeting summary COMMITTEE from the March 2 2000 Local Authorities Committee meeting was reviewed REPORTS Red Deer River Basin Advisory Committee — a letter from Maurice Lewis summarizing the January 13`h & March 30`h, 2000 meeting and advising the next meeting is scheduled for May 18,2000 in Drumheller He requested any concerns be directed to the Committee prior to this meeting as the Committee will be fine tuning the Committee s terms of reference. A general information sheet on the Year 000 Review of Water Management in the South Saskatchewan River Basin was received from Alberta Environment Health Authority #5 — minutes of the February 23, 2000 meeting Carbon Recreation Board — Mrs Lowen highlighted the minutes of the March 6, 2000 meeting Mr Hanger reported he had received a request from Bob Long, representative of the Three i Hills Rodeo Association, asking if the County would be willing to donate grader work to re THREE HILLS slope the grounds to allow proper drainage He also inquired into the possibility of RODEO REQUEST purchasing gravel screenings from the County for use at the rodeo grounds Upon viewing 'A 01 L: 007 0 the site Mr Hanger felt the grader work could be completed in a couple of hours Mr PW5 McCook volunteered his time to operate the County grader at the Rodeo Grounds site XX 41N 7 • r KNEEHILL COUNTY COUNCIL MINUTES April 11, 2000 however advised the County does not have excess screenings to sell to the Rodeo Committee Mr Hanger moved Mr McCook be given permission to use the County grader, on his own time, to provide the grading necessary at the Three Hills Rodeo grounds as decided between Mr McCook and the Three Hills Rodeo Association.
