January 12, 2000
Anoint meeting of Council/Planning was held in the Kneehill County office 232 Main
Street Three Hills, Alberta, on January 12, 2000 commencing at 8 30 A.M
The following were present at the meeting

Barb Long recorded the minutes Mrs Vetter was not present for the meeting
Reeve Otto Hoff called the meeting to order at 8 46 A.M
A A request was made to add the following to the agenda
Under agenda item 4(a), add MSCIA Update
Mr Wagstaff moved approval of the agenda, with the above noted addition.

Mr Rusling presented an overview of the purpose of the point meetings to completely
review the Land Use Bylaw and set County policy, by asking some general fundamental
questions to help determine the long term direction of planning within Kneehill County
Mr Rusling explained the two ways of setting County policy were through the Land Use
Bylaw and the Municipal Development Plan He distributed a report containing the Land
Use Bylaw Districts, Section 36 of the Land Use Bylaw, which outlines the present
policy on rural subdivisions and the Intensive Livestock policies Mr Rusling suggested
Council begin with general fundamental questions and work down to specifics and at the
end of the process make changes to the Land Use Bylaws (including plugging any
loopholes) The first two topics to be covered would be subdivisions and intensive
livestock policies
�~ 0 As the focus of Kneehill County is to maintain and further agriculture while making the
decision making process as simple and consistent as possible, there was a lengthy
discussion on the amount of rural subdivision that should be allowed
The following recommendations were made regarding rural subdivisions
1 A maximum of one subdrnision per quarter, with the acreage being kept as
small as possible along with recognizing the natural lay of the land
2 The Bylaw should have stronger statements if there is not an existing developed
site or if the subdivision request is located on prime agricultural land
3 A notice be put on title respecting the protection of agricultural operations
regarding the noise, dust, and odor produced by that agricultural operation.
Mr Rushng will obtain a legal opinion on this recommendation
4 .Sewer and water must be contained within the subdivision.
A recess was held from 9 50 A.M until 10.00 A.M

The County Residential District was discussed in some length
Council recommended that an area structure plan designation shall be necessary for
new Country Residential subdivisions The only two currently in Kneehill County are

the Three Hills Creek Area Structure Plan and Kneehill Creek Area Structure Plan
which are located in the poorer agricultural land near the Drumheller Valley
Under Section 36, Rural DevelopmendSubdivision, Item 2(b), Country Residential, the
wording be changed back to read, "Grouped County residential parcels shall not be
permitted except for those lands designated on Figure 6 in Bylaw 1289 known as the
Three Hills Creek Area Structure Plan and on Figure 7 in Bylaw 1263 known as the
Kneehill Creek Area Structure Plan (Appendix D)
Discussion ensued regarding the purposes and intents of the Agricultural Conservation
District (AC) and Agricultural District (A) Mr Rusling advised an Agricultural District
allows for more discretionary uses than Agricultural Conservation Districts including
non agricultural uses such as industrial plants rural industry and recreational centers He
also reminded Council that the Municipal Planning Commission makes decisions on
Development Permits while Council decides on any re zoning requests
Council recommended an Industrial District and Recreational District be created Mr
Rusling will draft, making the appropriate changes to both the Agricultural and
Agricultural Conservation Districts and present at the next meeting
The re zoning of areas with the creation of an Industrial and Recreational District, was
discussed Mr Rusling advised zoning is based on the primary use of the area being
developed, not the total quarter section thus the bylaw will specify what zoning the area
• will take on Proper advertisement and a Public Hearing process would be necessary to
change zoning back to a previous zoning
Penalties assessed for not applying for Development Permits prior to building were
briefly discussed with Mr Rusling reporting Mountain View charges five times the
Development Permit fee and Rocky View three times the permit amounts charged by the
Safety Code Inspection staff
Mr Rusling advised he will present a draft of the above recommendations at the Feb 9,
2000 Joint Council/Planning meeting
An update regarding the status of the Municipal Safety Codes Inspection Agency was
provided by Mrs Deak and Mr Rusling Mrs Deak reported Mr Bill Simpson of
MSCIA had phoned questioning Kneehill County's course of action in withdrawing from
the MSCIA as the agency had an A+ ranking and asking to meet with Council to discuss
the options and the process to follow Mrs Deak advised Mr Simpson the concerns were
I with the Municipal Safety Codes Committee(Commission) and the Agency relationship
with same Mrs Deak requested he send a letter stating these options and processes to be
taken to the Executive Committee To date, nothing has been received from Mr
Simpson
Council recommended the Planning Department handle the transition to Alberta
Municipal Affairs fir inspection services and any dealings with MSCIA and Mr Bill
Simpson
Upon direction from Council, Planning will advise any new Development Permit
applicants to postpone having any inspections done during this transition period but to
have a final inspection completed after the fact when all this is settled
The meeting adjourned at 11 20 A.M
