HomeMy WebLinkAbout1997-06-18 Council Minutesi tl L LJ EXECUTIVE COMMITTEE REPORT - June 18th, 1997 The Executive Committee of Richard M Vickery and Marjorie D Vetter (after 9.20 A.M.) met on Thursday, June 5th, 1997 at the M.D of Kneehill office in Three Hills, commencing at 9 10 A.M Mr John Jeffery Administrator and Mr Lonnie McCook Public Works Superintendent, were also present along with Mrs Jennifer Deak, Assistant Administrator, who recorded the minutes The following items were reviewed 1. June 1997 Municipal World magazine article re. municipal restructuring The June 1997 Municipal World magazine includes two articles regarding municipal restructuring In Ontario, there are currently 815 municipalities of which are 202 involved in restructuring which will result in 68 redefined municipalities a total of 134 fewer municipalities by January 1, 1999 (net 681 municipalities) This will result in a reduction of elected officials in such municipalities from 1 138 to 515 The areas under consideration include 9 in northern Ontario 10 in south western Ontario, 4 in central Ontario and 27 in eastern Ontario In 1996 the province of New Brunswick appointed an eighteen member consultative committee to study local government in the Greater Saint John Region (population 101 665) The recommendations of this committee include the notion that a "multiplicity of individual municipalities' functioning together for mutual benefit should be embraced to guarantee the best possible delivery of services to the residents of Saint John and surrounding area and also to present a strong unified approach to economic development opportunities Do not disturb the existing structure of municipal government Rather, encourage all of the municipalities involved to improve existing efficiencies, while at the same time creating a common strategic plan for the development of the entire region Executive Committee reconmends to accept and file. 2 May 26/97 M D Water Truck Accident (T 45 80) The insurance adjuster for this accident (Highway 21 & SH 575 roll over ) has advised the vehicle is not economically viable to repair and have offered a fair market value price of $17 000 00 for the vehicle less the $250 00 deductible The M.D also has first option for salvage which is 15% of fair market value Executive Comnuttee recommends the M D accept the $17, 000. 00, less the $250.00 deductible, for this vehicle and not exercise their salvage option 3. SH 836.02 Paving Proiect from SH 575 south to village of Carbon The tenders for the above noted project were opened June 17/97 Two tenders we received South Rock Ltd Pro Con Road Works $189,58400 $231 246 00 Executive Comnuttee recommends the M D accept the loin tender received fron Rock Ltd and a letter he sent to Alberta Transportation and Utilities requesting acceptance of same. 4. AB Wheat Pool Subdivision Development Agreement with M D of Kneehill AB Wheat Pool has signed the Subdivision Development Agreement prepared by t. M.D Council approved the Road Committee recommendation that the entire mile gravel road be built to a 10 metre top the M.D purchase one rod of land on both t north and south side of the road, if possible, to facilitate the grain facility, if the prc development is approved Should the development not be approved, the road widt built to an 8 6 metre top Mrs Vetter entered the meeting time 9 20 A.M C: /MD /Minute /EC.doc I y ,GJ/YIov ;;r/lWC r*] L 0 E EXECUTIVE COMMITTEE REPORT -June 18th, 1997 The developers will be responsible for the cost of the turn off lanes from the north and south on Highway 21 and for providing permanent dust control in the form of SP 90 or similar product to Pt NE 12 32 24 W4 and Pt SW 18 32 23 W4 AB Wheat Pool has also added the M.D be responsible for all construction costs of the 10 metre road width and they will be responsible for the construction of the turn off lanes from highway 21 and providing the dust control costs It was noted any conditions imposed by the Subdivision and Development Appeal Board regarding this development will require another agreement between the developer and the Subdivision and Development Appeal Board Executive Committee recommends this agreement be signed by the M D. of Kneehill 5 Swalwell Community Association June 10/97 letter re. hamlet concerns Tamara Penner, of behalf of the Swalwell Community Association, has inquired about the mowing schedule of the Swalwell cemetery- advised a hamlet resident has three goats within the hamlet boundaries, reports the dumping station has not been used and could be full of rocks and unusable A response to these concerns has been requested prior to the community association s next meeting, scheduled for June 21 1997 Mr McCook advised the cemetery has been mowed once and will be getting mowed to day and thereafter on a rotational basis, along with the other cemeteries the M.D maintains Executive Committee recommends a letter be sent to the community association 6.Q�If17/� advising of the cemetery grass mowing schedule, enclosing a copy of that portion of i the M D. of Kneehill Land Use Bylaw that addresses livestock in hamlets (Section 40(2)) and advising, to thte MD 's knowledge, the dumping station is in working order 0 and requesting, if this is not so, to advise accordingly inA"4,00 (Note letter faxed to Tamara Penner June 18, 1997) 6 June 11, 1997 Letter from Leah Uffelman re. Laree Rocks Flyine Off M D Gravel Truck A letter has been received from Leah Uffelman, Beiseker, advising when she was driving on Highway 9, about one mile west of "That's Crafty ", several large rocks flew off a M.D gravel truck Her passenger had cuts on her arms and face from the fine glass from the windshield She stopped the gravel truck at the turn off before Dalum and spoke to the driver in addition to another M.D truck driver, who also stopped Mrs Uffelman advises the RCMP are in favour of having these trucks tarped and requests a response to this matter Mr McCook advised he received a call from Mr Uffelman regarding this matter, contacted Mr Miles Maerz, the gravel foreman, who advised Mr Ed McNair was also hauling along this route and the truck end gate on one of his trucks popped spilling gravel on the highway It was noted the Dalum corner turn off is not in the M D of Kneehill fks and the M.D trucks do not leave the M.D area Executive Committee recommends a letter be sent to Mrs Uffelman advising her the M D trucks were hauling along this road, as were thie McNair trucks and informing her of the McNair gravel spill, requesting more information (date, time, whether the rock hitting the windshield was from the tires or the truck box), advising the M.D trucks do not leave the M 1). area and Dalum is out of the M D, advising the M.D. does not accept liability, and advising rocks hitting windshields are part of the hazards of driving 0 I 7. Doe Attack Mrs Vetter reported the Health Authority has advised the dog at the Ken Kraft residence, which attacked and bit her did not have rabies Further, this attack was the second on record with the Health Authority, the first attack reported was more severe as the victim was on foot, approaching the yard when the dog attacked Mrs Kraft is unable to control CIMD /Minute /EC.doe Page 2 L��rae. Ssi7 �a N E#* EXECUTIVE COMMITTEE REPORT - June 18th, 1997 this dog The Health Authority has advised this dog will be destroyed should another attack occur The safety concerns of others, especially children, entering this property and being exposed to this animal which cannot be controlled by Mrs Kraft, was discussed 6�p,a2oF Executive Committee recommends a letter be sent to Mr Ken Kraft requesting this dog be destroyed Mrs. Vetter was on M D. business when this dog attacked and it appears ILLomff ;-W'a�1 { the dog cannot be controlled by Mrs. Kraft Further, Mr Kraft he requested to confirm the destruction of this animal and ad1 sed, should the (log not be destroyed, the M D ivill consider seeking legal action 8. AAMD &C Survey Results re Environmental Screening Requirements The AAMD &C has forwarded their survey results on Environmental Screening Executive Committee recommends to accept and file and, upon request from a councillor, provide copies of this documentation. 9 AAMD &C letter re Alberta Transportation and Utilities Regulatory Review The AAMD &C has advised Alberta Transportation and Utilities has released a discussion paper outlining the proposed changes to the local Government Control of Secondary and Rural Roads Regulation and the Irrigation Districts Bridge Structures and Culvert Regulation and inviting key stakeholders to review the proposed changes and provide any comments to the AAMD &C by June 27, 1997 This regulation currently authorizes municipal districts and counties to restrict use by "traction engine or public vehicle" for a period or periods, limit or restrict the speed of `traction engine or public vehicle" and increase limit or restrict maximum gross vehicle weights Alberta Transportation and Utilities is proposing the reference to `traction engines' be deleted and the elimination of the authority for local governments to increase maximum gross vehicle weights (only allow local governments to limit or restrict, not increase) Executive Committee recommends to accept and file and, upon request from a r r councillor, provide copies of this documentation 10. AAMD &C Letter re. Alberta Transportation and Utilities Regulatory Review The AAMD &C has provided a summary of the above review Of note, under the Highway Development Control Regulation, Alberta Transportation and Utilities is proposing to change signage requirements on primary highways (favour community based signs) and clarify permit requirements for electrical distribution lines Executive Conunittee recommends to accept and file and, upon request front a councillor, provide copies of this documentation. `a 11. AAMD &C Letter re. Review of Seismic Exploration Regulation The AAMD &C advises AB Environmental Protection has initiated a review of the above noted regulation which is scheduled to expire on Octoberl, 1998 The AAMD &C has requested all members complete a short survey on this regulation and offer comments regarding problems encountered with seismic operations The committee noted this activity helps farmers, causes damages to road allowances by breaking down shoulders and slopes and when drilling creates water holes in the ditch areas The committee also agreed the seismic industry should be required to plug all shotholes and that municipalities should be empowered to charge seismic operators a fee for access to road allowances as a means to offsetting damages done to local roads AAiNll � Pi Executive Contnuttee recommends this surrey be returned, as completed 12. Letter from R. Matz, MLA re: Ae Pro Grain Inc. Facility Mr Richard Marz, MLA has responded to the M.D s letter requesting it be involved in C: /MD /Minute /F.C, doc Page 3 LJ C� U EXECUTIVE COMMITTEE REPORT - June 18th, 1997 discussions with Ag Pro and Alberta Transportation and Utilities regarding highway access to their proposed facility at Trochu Mr Marz has received a letter from the Minister (of Transportation) advising Ag Pro is required to arrange a traffic assessment at the intersection of Highway 21 and the local road leading to this proposed development and would be responsible for all engineering and construction associated with the intersection improvement The Minister has agreed to the involvement of the M.D in any further negotiations Mr Tom Mammen, Operations Manager, Alberta Transportation and Utilities Hanna will advise the M D when further negotiations are scheduled Executive Committee recommends to accept and file. Mr Jeffery then reviewed the Municipal World magazine articles as reported under Executive Committee #1 with Mrs Vetter 13 Town of Three Hills Joint Services Mr Jeffery gave an overview of the transactions and discussions undertaken with the town of Three Hills regarding the sharing of public works staffing and equipment and the M.D s request to have the town provide a proposal to look after the maintenance of the hamlet and Equity water and sewer systems the town's proposal ($3 000 00 per month) for same, their meeting with council to discuss same and request regarding the rescheduling of Phase Il of the arena redevelopment project, the motion to have the city of Drumheller submit a proposal for the M.D hamlet and Equity water and sewer maintenance, the May 22/97 Executive Committee recommendation to write to the town reiterating the M.D 's disappointment with Three Hills proposal the May 22/97 letter from Three Hills clarifying their proposal amount this was reported at the May 27/97 council and a motion approved to table the Executive Committee recommendation Mr Jeffery further reported the city of Drumheller had met with the M.D to discuss providing this service and would be sending their proposal Mr Jeffery noted this proposal would probably be in the $3,000 00 range due to the extra travelling distance required Mr Jeffery further reported on the recent water and sewer problems in the hamlets and the actions taken to resolve these problems Mr McCook confirmed the M.D has hired effective July 2/97, Mr Ian Martens, a former Three Hills employee, as the utility officer for the municipality (see Executive Committee #15) Mr Jeffery noted the M.D has made no commitment regarding the town's request to do the Phase II of the arena project this year (July 1997) instead of next The town of Three Hills has now sent a letter under date of June 10 1997 requesting the M.D to undertake the double chip seal project in the west industrial park area of the town The town notes 2 3 years ago the former town foreman Mr Rinus Onus had discussed this project with Mr McCook and it was the town s understanding Mr McCook had agreed to undertake this project for a cost of $11 000 00 when time became available The town is now requesting whether the M.D is still willing to undertake this project if so could the project be completed during the summer of this year and if the $1 1,000 00 quote still holds Executive Committee recommends a letter be sent to the town of Three Hills, regarding their request for the double chip seal project in their west industrial park, advising, because of the M R's downsizing, it no longer has the manpower to undertake their project at this tinie. Executive Committee reconiniends a letter he sent to all the towns and villages advising, in light of recent happenings, the M D can no longer continue the practice providing pro Bono services to other junsdictions and should any jurisdiction request the M D to provide services such as grading and road maintenance the M.D. will only undertake saute providing the requesting jurisdiction agrees to pay for these services and accept all responsibility for same. 14. Primary Highway Maintenance Concerns It was reported several complaints had been received regarding the maintenance of the primary highways in the municipality, especially at the intersections of primary highways and local roads Mr McCook noted the contractor must obtain approval from Alberta C:/MD /Minute /EC.doc y Page 4 EJ E 0 EXECUTIVE COMMITTEE REPORT - June 18th, 1997 Transportation and Utilities for any maintenance work only those holes circled on the highways will be reimbursed for repairs Mr McCook noted he was documenting these concerns Executme Committee recommends a letter, expressing these concerns, be sent to Mr Tom Maminen, Operations Manager, Alberta Transportation and Utilities, Hanna with copies to Mr Rob Penny, Regional Director and Mr Richard Marz, MLA (Note letter sent June 18, 1997) 15. Hiring of Mr. Ian Martens Mr McCook advised he had hired Mr Ian Martens to look after the hamlet and Equity water and sewer systems Mr Martens, has water and sewer maintenance experience in addition to three years of university engineering Mr Jeffery noted Mr McCook would be overseeing the utilities department It was further noted Mr McCook would be looking into having the water line locations documented and would be investigating having this documentation on the M.D 's GIS (Geographical Information System) Executwe Committee recommends to accept and file. r,w Mr McCook left the meeting time 10 55 A.M 16 AAMD &C Letter re Statistics Canada Census Data By Township The AAMD &C now has available, for its members, the census data by township for all areas in the province Mr Jeffery noted this information was only available in township and range breakdowns and had been requested S�p.,2 0� �7J�rFs Executive Committee recommends to accept and file. 17 Village of Acme Letter to the Hon. Ed Stelmach The village of Acme has sent a copy of their letter, to the Hon Ed Stelmach, Minister of Agriculture Food and Rural Development, urging the government to take measures to place a restriction in regards to the distance that intensive agricultural developers are allowed to locate their facilities near urban or private water well sources and ensure restrictions are enforced by the authorities issuing the permits The village has also sent copies of this letter to the Hon Ty Lund, AB Environment Protection, Mr Richard Marz, MLA, and the AUMA Executive Committee recommends to accept and file. F� 18. Letter from AAMD &C re. Resolution Guidelines The AAMD &C has forwarded a "Guide to Resolutions" which outlines the AAMD &C resolution process and drafting of the resolutions Executive Committee recommends to accept and file and, upon request from a flLe councillor, provide copies of this documentation. 19. Ater from AAMD &C re. Amendments to Local Authorities Election Act The AAMD &C has provided a brief outline of Bill 10, the Local Authorities Election Amendment Act, 1997, as introduced by Municipal Affairs Minister Iris Evens Key policy changes include allowing for the establishment of permanent voters lists, allowing for nominations to be accepted at more than one location broadening the categories of electors who may vote at advance polls, allowing joint elections with school and health authorities even where boundaries are non contiguous Executive Committee recommends to accept and file F�zl' CJMD /MinuteBC.doc w Page 5 r C u • EXECUTIVE COMMITTEE REPORT - June 18th, 1997 20 AAMD &C Survey Results re. Public Address (PA) Systems The AAMD &C has forwarded the PA survey results Of those municipalities responding to this survey, four currently use a PA system The municipality of Mtnburn has reported the highest satisfaction rate for their PA system, Altec Lansing Model 1674C �G�rlayo 7 Executive Committee recommends Mr Cunningham investigate the PA system used by Minburn. 21. AB Senior Summer Games Mr Jeffery reviewed the AB Senior Summer Games file and advised on June 17, 1997, Mrs Penner, from this committee, had telephoned to invite a M.D representative to attend the June 19 1997 opening ceremony of the Games at 2 00 P M The Executive Committee members noted very little notice had been given for this invitation and very little information provided to the M.D about the Senior Summer Games Committee Mr Jeffery proceeded to telephone Reeve Hoff and Mrs Lowen, the committee representative, who both advised they could not attend Deputy Reeve Vickery indicated he had a prior commitment Mrs Vetter advised she would be in town for a Kneehill Adult Learning Society meeting tomorrow morning and could attend this function. Executive Committee recommends Mrs. Vetter attend these opening ceremonies Mr Jeffery then telephoned Mrs. Penner to advise her Mrs Vetter would be attending this function 22 Trentham Protect Mr Jeffery reviewed the Backsloping Borrow Pit Agreements for the Trentham Project Mr Myles Trentham (SW 18 32 23 W4) wants fence from Mr Clayton Lobe's to the power station (135m) and the ditch sprayed for weeds It was noted Mr Clayton Lobe had verbally given permission to Mr Cunningham at the close of the June 17, 1997, Subdivision and Development Appeal Board, for the M.D to proceed with this project and access his property as per original agreement Executive Committee recommends these agreements be signed and duly processed Mrs Deak then left the meeting time 11 50 AN 23. Council Minutes The Executive Committee edited the June 10'h 1997 council minutes for publication in the newspaper Executive Committee recommends the minutes, as edited, be published to the newspaper The Executive Committee meeting then adjourned i Jery.
