HomeMy WebLinkAbout1997-05-08 Council Minutes0 0 EXECUTIVE COMMITTEE REPORT - May 8th, 1997 The Executive Committee of Otto Hoff and Rick Vickery met on Thursday, May 8"', 1997 at the M.D of Kneehill office in Three Hills commencing at 9 00 A.M Mr John Jeffery, Administrator and Mr Lonnie McCook, Public Works Superintendent were present Mrs Jennifer Deak, Assistant Administrator was also present and recorded the minutes The following items were reviewed 1. AB Community Development ARPA Conference and Energize Workshop AB Community Development and the Alberta Recreation and Parks Association (ARPA) are jointly sponsoring the above noted recreation conference and workshop, at the Jasper Park Lodge from Nov 6 8/97 Executive Committee recommends to accept rind file. 2. CAMA 1997 Annual Conference Registration information has been received for the Canadian Association of Municipal Administrators (CAMA) 1997 conference scheduled for June 4 6/97 in Ottawa Executive Committee recommends to accept and file. 3 Former Armien Toews property Pt. NE 19 -30 25 W4 Further to the April 17/97 Executive Committee recommendation to advertise this building for sale, Mr Brian Penner, Lin View Agencies Linden has inspected the house and advises there are no proper foundations under the building, it is in very poor condition, and is recommending the house not be moved Mr Penner recommends the Linden fire department hold a fire practice on the building Mr Penner also advises the former resident still has property in the house r . F� Executive Committee recommends Tainsh Howard be requested to send a letter to the former resident of the house (Mr Larry Toeivs) giving 48 hours notice to remove his property from these prenuses and following this time period, the Public Works Superintendent arrange, with the local fire department, the destruction and removal of this building 4 M D Golf Tournament The M.D Employee Golf Tournament has been scheduled for Friday, June 20/97 at the Three Hills Golf Course commencing at 9 00 A.M with breaks for lunch and supper Executive Committee recommends Mrs Jean Wilkinson be lured to look after the Zoe, P) 7 office operations on this day Zvx 5. Alberta Pipeline Protect The Alberta Pipeline Project (APP) is being developed through a partnership of ATCO Gas Pipelines and Shell Canada Ltd and is an interprovincial pipeline consisting of three lines a north line originating near Rimbey, a west line originating near Caroline which will transport gas to a location near Carbon and an east line that will ship gas from Carbon to existing pipelines in Saskatchewan Following regulatory approval, start up is targeted for November 1999 with the majority of construction taking place in the spring and summer of 1999 Executive Committee recommends the project be provided with Mr Cunningham's ` �T name as a contact person and also be requested to keep the M D. of Kneehill updated Co.»aavy on information about the project as it beconies available. ve. Aem, CHID /Minute /EC.doc w Page 1 • EXECUTIVE COMMITTEE REPORT - May 8th, 1997 G W►mborne Proiect - Backsloping Borrow Pit Agreements Norma Hastie SW 25 33 25 W4 Mrs Hastie has added the following condition to her agreement `if need to borrow dirt on pasture owner wants 3 years compensation as it is prairie wood and temporary fence for 3 years on borrow' Evecutive Conunrttee reconunenls no borrow on this pasture Roberta Bauer - SW 27 33 -25 -W4 Mrs Bauer has added the following condition to her agreement `compensation for replacements of fence and compensation for loss of trees It was noted there is' /4 mile of fence that the owner would like the M.D to take out and pay compensation along with either compensation or new trees planted to replaced any removed It was further noted the trees were close to road allowance any new trees would have to meet set back requirements and there was an existing abandoned house located close to the road Executive Committee recommends Mr McCook and Mr Vickery arrange to meet Mrs. Bauer and Mr Jeff Carlson, the land renter, on site, to discuss these conditions 7. Report in Three Hills Capital re Town /municipality talk services An article in the April 30/97 Three Hills Capital reports `the town (Three Hills) requested the M.D consider maintaining and repairing town vehicles and equipment " It was noted this meeting, between the administrators and public works personnel had not yet been reported to the M.D council Ve . q# 4.4 7'a-r G.4 Executive Committee recommends a letter be sent to Mr Ramsden requesting any 4dwr negotiations behveen the town and the MD. that are "in progress'; not be publicized until both Councils are aware of these negotiations and discussions 8 Keivers Park Agreement Mr Allan Mills has reviewed the parks agreement with Mr McCook and Mr Jeffery and the request to include the Swalwell park in this contract (Braconnier park was included last year to contract) Mr Mills has advised he removes garbage from Keivers park once a week and transports same to the transfer site and has requested the park attendant duties list reflect this Mr Mills is agreeable to include Swalwell park in the contract and has requested an additional $500 00 for a total contract of $7,000 00 plus 5% (less GST) of the 1997 gate receipts The Contract runs from May to Sept 5/97 Executive Committee recommends this contract be remised to reflect Swalwell park and the addition requested by Mr Mills along with the contract price to be amended to reflect $7,000.00 plus S% (less GST) of the 1997gate receipts 9. Kneehill Creek Bridge on Highway 27, 1 km west of Torrington Reid Crowther, on behalf of Alberta Transportation and Utilities, has advised reconstruction work on the above noted bridge is scheduled to occur during the months of May June, July and August 1997 The work will consist of the replacement of the existing bridge girders and repair to the stream bed armoring Traffic restrictions will be in effect during the course of the construction Executive Committee recommends to accept and file C: /MD /Minute /EC.doc Page 2 440411 F",- E EXECUTIVE COMMITTEE REPORT - May 8th, 1997 10 AAMD&C letter re. New Form of Equalized Funding for Municipalities The AAMD &C has met with the Hon Iris Evans, Minister of Municipal Affairs and the Hon Ed Stelmach, Minister of Agriculture to present a preliminary proposal for a new form of equalized funding for municipalities Special district meetings are being planned to outline the preliminary proposal for a new form of equalized funding for municipalities The AAMD &C has requested a survey on the status of reserves and operating budgets be completed and returned to the association This survey includes the amount of municipal reserves whether any are dedicated whether operating budgets have decreased over the past 4 years and, if so, by how much Mr Jeffery noted the actual M.D budget has increased due to increased requisitions and secondary road projects when these items are removed, the operating budget for the M.D has actually decreased over the past 4 years from $6 418 494 13 in 1993 to $5,296,236 50 in 1996 a 21 19% decrease Mr Jeffery noted he had provided this information on the survey Executive Committee recoinniends this survey be returned, as completed by Mr Jeffery 11. GiS /GPS Conference and Exposition Rose Country Communications has organized a conference on GIS and GPS entitled High on Energy GIS & GPS Global Innovative Solutions 1997 to be held Oct 1 4/97 at the Convention Centre, Calgary Executive Committee recommends to accept and file 12. GPS Presentation Further to the April 8/97 GPS presentation to council by Mr Dale Moran et al and the motion to have Mr Vickery discuss same at the next Kneehill Ambulance meeting Mr Vickery advised he had received little response from the ambulance board on this issue The group that did the GPS presentation to the M.D council had recommended the M.D use the CASCI / CAECI funds ($30 184 00) to implement the GPS and the M.D radio towers be utilized for this system Executive Committee recommends a letter be sent to Mr Moran advising the MD. is willing to allow space on its radio towers for GPS eiduipnient, providing it does not interfere nor effect the M D. rarho tower operations 13 Discussion Paper Regulating the Water Well Drilling Industry in Alberta AB Environmental Protection is reviewing the feasibility of establishing a delegated regulatory body for the water well industry and has retained Tom Forgrave Consulting to facilitate the consultation A discussion paper, providing basic information, has been provided along with a comment form Executive Committee recommends to accept and file 14. Procedures for Municipal Proiects with Funding Assistance by Alberta Transportation and Utilities Alberta Transportation and Utilities has forwarded a revised procedures for projects that receive funding assistance from their department Executive Coninuttee recommends copies of these procedures be given to Mr McCook and Mrs. Deak in addition to a copy remaining in the council basket. Encroachment Agreement Lot 29, Block 4, Plan 6680, AP Huxley The legal firm of German Fong Albus Lam acting on behalf of Mrs Sonia Kennedy, has forwarded an encroachment agreement between the M.D and Mrs Kennedy for a garage and shed that abuts onto M.D property (back alley) The documentation does not include the real property report that would show the exact location and encroachment of these buildings Executive Committee recommends the legal firm be contacted to provide the real gr property report and this matter be tabled until receipt of this document. Additional Services Torchinsky Engineering Ltd has announced two new services Land Services and Construction Safety Land Services will be available to assist with property acquisitions, right of ways, easements, etc and Construction Safety services will offer safety training of personnel and /or updating of safety manuals Executive Committee recommends to accept and file. 17. Equity Water Concerns Further to the April 17/97 Executive Committee recommendation to have Mr McCook investigate Mr Dau's water line manhole to determine whether it is located on M.D road allowance, Mr McCook reported upon visual inspection, it appears close to the property line Executive Committee recommends a letter be sent to the town requesting the exact location of this manhole and further informing the town of the M.D 's concerns should the road by this manhole require construction 18. Letter from Hon. Walter Paszkowski re Linden West Brid a and SH 806 The Hon Walter Paszkowski, Minister of Transportation, has responded to the M.D 's Mar 31/96 letter regarding the Linden West bridge and SH 806 from SH 583 south to Linden Based on the traffic volumes and the low level crossing adjacent to the bridge, the Minister concurs with the department's 1996 assessment that bridge replacement is not warranted at this time Regarding SH 806 Alberta Transportation and Utilities will conduct strength tests in the spring of 1997 to determine structural condition and will advise the M.D of these results The Minister has extended the offer made by the former Minister Butch Fischer, to include 100% department funding of the pavement overlay on the widened only portions of the project Executive Committee recommends a copy of this letter be forwarded to MLA, Richard Marz, and further a copy of this letter be kept on file for the 1998 divisional meetings. 19. AB Wheat Pool New Grain Facility Mr Ron Simmons AB Wheat Pool (AWP), has advised AWP is proceeding to put approvals together in order to purchase the lands for the new AWP grain facility between Three Hills and Trochu The company is awaiting the development agreement from the M.D before sending the plan for M.D endorsement along with the required cash in lieu AWP has already applied for a development permit for the project Executive Committee recommends to accept and file and, upon request from a councillor, provide copies of this documentation C: /MD /Minute /EC.doc � W Page 4 `� L-� "a= i q9a Ak 17774 f;� 7�is�xr, l©�1 0 0 0 EXECUTIVE COMMITTEE REPORT - May 8th, 1997 20. Fax from Mr Clayton Lobe re. Road Widening and Land Redesignation (Trentham Pro ect Mr Clayton Lobe has advised he will not allow any access onto his property in respect to any road widening on the grounds the M.D did not provide full disclosure as to any anticipated development when this agreement was signed Mr Lobe further comments that he feels the appeal hearing process to be flawed and shall be seeking legal opinion on this Mr Lobe states he does have confirmation that the M.D contacted AB Wheat Pool officials during the interim of the hearing process and concludes his fax with " so let's get this charade over with Mr Alex Cunningham entered the meeting time 10 15 A.M Mr Jeffery reviewed the file, noting the Backsloping/Borrow Pit Agreement was signed by Mr Lobe on April 3/96, June 17/96 Mr Jeffery spoke with Mr Ron Simmons, AWP, June 4/96 Torchinsky engineering was dealing with the environmental assessment re railroad and no mention of AWP is included in this assessment Mr Cunningham reported AWP took out an application for redesignation on Nov 8/96 It was noted the application for redesignation would be the first involvement of the AWP with the M.D Executwe Connnittee reconiniends to ftle this matter as information at this tune. 21. Torrington Lutheran Zion ( Rempfer) Cemetery Pt NW 13 32 26 -W4 (0.5 acres) Mrs Irene Wilson, secretary Trinity Lutheran Church, has advised an unanimous motion has been passed by the church voters to transfer the church and grounds, known as the Rempfer Cemetery, to the M D of Kneehill Executive Committee recommends the M D proceed wall thus matter and request the records, plans, title change and stake the area. Mr Cunningham left the meeting time 10 30 A.M 22. CAAMD &C Notice of Meeting The AAMD &C has arranged a special meeting to present an equalized proposal that would replace the Municipal Assistance Grant A meeting has been scheduled for Tuesday, June 24/97 at the Three Hills Community Centre, commencing at 9 30 A.M. See Executive Committee item #10 for further details It was noted this date falls on a Council meeting day Executive Committee reconiniends to accept as information and further someone attend this meeting 23. M 583 from Highway 21 to SH 836 (North) Final Paving 13.0 kms Mr Mc''ook reported Alberta Transportation and Utilities has advised the M.D to proceed wi ', the tendering of this project It was noted Mr Colin Stroeder, Torchinsky Engineering, would be meeting with Mr McCook and Mr Jeffery later to day to discuss this tender along with the possible tender of the SH 836 Canada Alberta Infrastructure project Executive Committee recommends to accept and file as inforntatton. 24 Letter from Marigold library system The Marigold Library System has forwarded information on their library system noting the cost for library service for residents is $6 50 per capita, paid by the municipality and residents of non participating municipalities pay $60 00 per annum to purchase a library card Mr Jeffery noted a $6 50 per capita levy would total $30 643 50 C:/MD /Minute /GC.doc 1 y Page 5 616— �,CENTih9r/ G/e F� • 0 L3 EXECUTIVE COMMITTEE REPORT - May 8th, 1997 Executive Conun itlee recommends to accept and file. �� 25 M D Postage Costs The office staff has recommended receipts for taxes only be mailed to ratepayers All other receipts not be mailed as it seems to be a waste of postage and confusing as some people think the receipt is an invoice and pay again Executive Committee reconunends tax receipts only be inadetL 26 Letter from Society of Local Government Managers (SLGM) The SLGM has advised Jennifer Deak has been successful in her application for designation as a Certified Local Government Manager (CLGM) Executive Coninuttee extends its congratulations and recommends to accept and file 27. Letter from Sherry Siewert re Dog Control Bylaw 1368 Ms Sherry Siewert, Huxley has sent Council a letter regarding this bylaw, noting it should be an "Animal Control' bylaw and address the many cats that run loose in the hamlets and tear into garbage bags dig up flower beds, etc She also notes other animals, such as horses donkeys llamas, sheep and goats are kept within the hamlet boundaries and should be addressed as their noise and smell gets out of hand Also mentioned is problems with skunks invading the hamlet Executive Committee recommends a letter of response he sent to Ms Seiwert thanking S�P,Qof her for her comments and explaining the (log hylaiv was enacted to address animals that were ferocious and causing a threat to other residents, cats do not generally chase���T or bite people like some (logs do and should more concerns he expressed, the matter will be re- addressetL 28. Regional FCSS Program The town of Three Hills has reported the group of representatives that met on May 5/97 to discuss the possible development of a regional FCSS program unanimously approved a motion that each municipality be asked to appoint a member to sit on a Steering Committee to develop a regional FOSS program within the M D of Kneehill This group has suggested each municipality fax their decision to all other municipalities Mr Hoff noted he was of the opinion another board need not be created as the Kneehill Community Resource Board (KCRB) was a regional board m94o -� Executive Coinmittee recommends Mrs Marylea Lowen and Mr Otto Hoff, the KCRB InA,0Y4,9P7 representatmes, both facilitate the regional FOSS meetings as MD representatives " 6AXW ,4, -;O�a 29 FCM letter re. Letter from town of Three Hills re. Possibility of Forming a Regional Water Commission The town of Three Hills has extended an invitation to the M.D and all urban municipalities to attend a meeting to discuss the possibility of forming a regional water commission PFRA and Alberta Transportation and Utilities have also been asked to attend the meeting and inform the group what assistance they could provide This meeting has been scheduled for Thursday, June 5/97 at the Trochu town office commencing at 730PM Executive Committee recommends the Water Conunittee members (Councillors /now > Lowen, Vickery and Boake) attend this meeting 35 Letter from M.D of Smoky River to AB Municipal Affairs re Loss of Municipal Assistance Grant (MAG) Reeve Donald Dumont M.D of Smoky River has forwarded a copy of his letter to the Hon Iris Evans, Minister of Municipal Affairs regarding the loss of the MAG grant The letter notes the M.D has looked at regionalizing with its urban partners but this would worsen their financial situation as they all have higher mill rates and amalgamation with another rural municipality was strongly opposed Smoky River's municipal mill rate is 11 14 Executive Comnuttee recommends to accept and file. r ILZ 36 Letter from county of Mountain View re Intensive Hog Operations The County of Mountain View has forwarded a copy of a general response regarding intensive hog operations The County feels as a controversial intensive hog operation application is within the M.D 's borders, the County should share this response, wluch it provides to all newspapers 'n'N a A� Executive Conunittee recommends to accept and file and, upon request from a eOOAWa-V0 councillor, provide copies of this documentation cIMDrnau,ute/rc.doc . AAMD&C letter re CALL Program The AAMD &C has provided information on the Canadian Agriculture Lifetime Leadership (CALL) Program, a national agricultural leadership program sponsored by the Canadian Farm Business management Council and funded by Agri Food Canada with its mission to develop effective leaders for the Canadian Agri Food Industry Executive Conumttee recommends to accept and file. 38 News Release re. Call for Nominations to AESA Council MLA Richard Marz has faxed a news release from the Minister of Agriculture calling on the agri food industry for nominations to the new Alberta Environmentally Sustainable Agriculture (AESA) Council a long term environmental program for the agn food industry The AESA Council mandate will be to evaluate environmental challenges and opportunities facing the agri food industry in Alberta, encourage the industry to proactively address environmental issues, and to direct the AESA program Executive Comnuttee recommends to accept and file 39 1996 Fall Resolutions Government Response r The AAMD &C has forwarded the official government responses to the resolutions passed at the 1996 Fall Convention Of the 33 resolutions the government has responded negatively to 21, no response required to 2, under review 7, responded affirmatively, with conditions, to 3 The province responded to Kneehill's resolution re secondary highway standards and request to allow municipalities more input in determining road standards by stating although department guidelines are in place, municipalities or their consultants, can provide recorpmendations for changes that are based on sound engineering principles and such recommendations should be brought to the attention of the area regional director Executive Comnuttee recommends to accept and file and, upon request fro"i a councillor, provide copies of this documentation. 40. Brownlee Fryett Law Bulletin re Confidential Legal Opinions mmmmp Brownlee Fryett has provided an article on confidential legal opinions and why it is important to keep legal advice confidential and includes some pointers on how best to deal with a confidential legal opinion Information that is subject to legal professional privilege or any other information the disclosure of which could compromise negotiations must not be disclosed (Sec 217 MGA) Disclosing confidential information may Jeopardize insurance coverage and liability insurance Legal opinion before council should only be discussed "in camera" and kept in confidence If council decides on the basis of the opinion the lawyers should be given certain instructions these details should not be included in any motions as motions must be made in public meetings. If necessary, move to let the CAO handle the dispute Executive Committee recommends a copy of this Imp bulletin he provided to each councillor 41. Memo from town of Three Hills re. E911 Services An April 24/97 memo from Jack Ramsden advises the town of Three Hills has approved a motion to contract the city of Red Deer to provide basic call forward E911 service at the current cost of $0 83 per telephone line to town residents Executive Comnuttee recommends to accept and file. E911 The city of Red Deer has forwarded agreements and contracts for the provision of E911 call answer service to the M D of Kneehill Executive Coni nittee recommends Mr Jeffery review these agreements and contracts ,"Pd2ms and refer wine to the council meeting agenda if reviewed prior to the next council meeting Mrs Deak left the meeting time 11 45 A.M 43.
