HomeMy WebLinkAbout1996-07-04 Council MinutesEXECUTIVE COMMITTEE REPORT - July 4th, 1996 The Executive Committee of Richard M Vickery and Marylea Lowen met on Tuesday, July 41', 1996 at the M.D of Kneehill office in Three Hills, commencing at 9.05 A.M Also present were John C Jeffery Administrator, Lonnie D McCook Public Works Superintendent and Jennifer Deak Assistant Administrator who recorded the minutes The following items were reviewed 1. Prosperity South Conference Information and registration forms have been received for the Prosperity South Fall Conference to be held September 12 & 13/96 in Drumheller Executive Committee recommends to accept and file 2 Marigold Library System An information letter has been received from the Marigold Library System outlining the benefits of participation in this system along with the costs Executive Committee recommends to accept and file. 3 AAMD &C Survey on Cemetery Charges The AAMD &C has requested information regarding cemetery plot and maintenance charges The M.D currently charges $100 00 per plot, plus GST and charges $200 00 per annum maintenance fee to private cemeteries Executive Committee recommends to return the survey as completed 4 AAMD &C Survey on Bylaw Enforcement Officers The AA D &C has requested information regarding bylaw enforcement services and revenues Executive Committee recommends to return the survey as not applicable to the MD. of Kneehill 5 Letter from Hon. Tom Thurber re Costs for Partnership Program The Hon Tom Thurber Minister of Municipal Affairs has sent a letter acknowledging the AD 's May 31/96 letter outlining the costs incurred by the M.D as a result of provincial down loading of services This information was requested by the Minister at the Beiseker constituency meeting Executive Committee recommends to accept and file 6 Western Road Management Complimentary Tickets Mr Lonnie McCook advised Mr Lorne Read, Western Road Management (formerly Alberta Road Management) had delivered to the office four complimentary tickets for the Stampede rodeo show on Saturday, July 6/96 It was agreed to give the tickets to Mrs Lowen, who indicated she had no conflicting engagements and would be able to use the tickets Executive Committee recommends Mrs Lowen accept these tickets CIMD /Minute /EC.doc Page 1 r ,ems A� 7 f►-l�+rfpw� 'SCOA✓Ey EXECUTIVE COMMITTEE REPORT - July 4th, 1996 7. Access to SE 16 29 23 -W4 Mr McCook reviewed the access problems of Mr Dave Steward to a portion of his land north of the creek in SE 16 -29 23 W4 Previously, Mr Steward accessed this parcel from a • private road in the NE 16 29 23 W4 The new owner of this land, High Calibre Ranching Mr Bert Dyck, has locked the gate to the private road and is denying Mr Stewart access, Mr Steward has cattle on this land and no means to access the land Mr McCook reviewed options for accessing the land It was noted there is an old road diversion running through section 16 north of the creek, which abuts Mr Dyck's private road in the NE 16 Mr McCook advised he had inspected the site with Mr Steward and discussed options Mr Dyck has apparently fenced the south side of this old road diversion It was agreed the easiest option would be to obtain a key for the gate on Mr Dyck's private road as other alternatives would include low level creek crossings Executive Committee recommend letters be sent to both Mr Dyck, High Caliber Ranching and Mr Dave Steward advising neither land owner can use road allowance and requesting the north side of the road allowance be fencer, J l� 8 Wa�ax/Champion Facility Tour Mr McCook advised Wajax Industries has extended an invitation for council to tour the Champion motor grader plant in Ontario Executive Committee recommends Mr McCook obtain more information and details Mr McCook left the meeting time 10 00 A.M 9 Rosebud River Valley Conservation Symposium An invitation has been extended by Mr Peter Kilsdonk to Mr Alex Cunningham and also to Mr Bill Clark, Development Officer, County of Wheatland and numerous other people involved with the environment (lawyers conservationists, local residents) ) to attend the Rosebud River Valley Conservation Symposium to be held Sept 20 & 21/96 at Rosebud The purpose of the symposium is to provide the latest information about private land conservation in Alberta, to benefit local land owners in the Rosebud river valley area and to discuss what options are available to an already existing "private" ecological preserve nearby, in the Rosebud River valley Executive Committee recommends should Mr Alex Cunningham wish to attend this symposium, he be reimbursed for costs by the M.D 10. Reauest for tax cancellation SE 30 -32 -23 W4 S Luoma Roll #3601000 Mr Luoma has advised Mr Ed Dunay, assessor, he is the sole owner of three quarters of land in the name of Luoma Seeds Inc and therefore these lands should be included in the farm unit calculation for his home quarter the SE 30 32 23 W4, on which there are two houses Mr Luoma will be sending Mr Dunay a letter informing of this ownership Mr Dunay is recommending an assessment adjustment to reflect the three quarters owned by Luoma Seeds Inc This would calculate to a $56,550 assessment adjustment and tax adjustment of $906 61 ($56 550 X 16 032 mills = $906.61) Executive Committee recommends to concur with Mr Dunay's recommendation and taxes on the SE 30- 32- 23 -W4, Roll #3601000, be reduced $906 61 C: /MD /Minute /EC.doc Page 2 c�eBP.3 of Z--7'7arz .t'*„7 c/d �camE.,b 7 Pws �.? /yle�.10 7 A-sy z� EXECUTIVE COMMITTEE REPORT - July 4th, 1996 11 1996/97 Rural Transportation Grant On June 18/96 the Hon Robert "Butch" Fischer Minister of Transportation & Utilities sent a letter announcing 50% payment of the 1996/97 Rural Transportation Grant, in the amount of $187 188 00 The cheque was not enclosed with this letter but was forwarded to the Hon • Stan Schumacher, MLA Mr Schumacher, under date of June 20/96, forwarded the cheque to the M.D This cheque, which was issued under date June 5/96 was not received by the M.D until June 25/96 Mr Jeffery has raised concerns over the time it has taken to receive this cheque and why it was not directly deposited thus accruing interest to the M.D 's account Executive Committee recommends a letter of thanks be sent to the Minister along with a /,S"�r 4 r request all future cheques be electronically transferred to the M D 's account. 12. Use of Potable Water for Oilfield Infection The AAMD &C has forwarded a copy of the County of Grande Prairie s letter, to the Hon Ty Lund Minister of Environmental Protection expressing their opposition to the practice of using potable water for oilfield infection purposes Executive Committee recommends to accept and file and copies of this documentation be available, upon request, to any councillor 13 Request for tax cancellation SE 4 29 25 W4 Roll #1250000 Mr Wayne Balderson has written a letter stating the house on the above referenced property has been vacant for over two years and is requesting the three acre site value assessment be cancelled Mr Dunay is recommending this cancellation three acre site vale assessment is $16 200 at 15 639 mills = $253 35 tax reduction L_E >'ae .aev w Executive Committee recommends to concur with the assessor's recommendation for a $253 35 tax reduction on SE 4- 29- 25 -W4, Roll #1250000 14. Letter from town of Trochu re, Agri Plex The town of Trochu has approved a motion Mrs Maureen Malaka contiunue to attend the Steering Committee meetings and expresses their thanks for being kept updated on this project and receiving copies of the committee s minutes Executive Committee recommends to accept and file and a copy of this letter be given to � 4- Py vei Lisa Paget, secretary to the Steering Committee. Z-- 1'5 15 1995/96 AB Boundaries Commission Report The proposals for the 1995/96 provincial electoral boundaries has been received The majority of the M.D of Kneehill will now be in the Olds (R Brossard MLA) constituency and part in the Drumheller constituency (S Schumacher, MLA) There appears to be a discrepancy with the boundary descriptions and it is unclear which constituency a portion of the south east part of the M.D lies within Mr Jeffery is currently investigating this matter Executive Committee recommends to accept and file until further information is received 16. Municipal Government Board (MGB) decision re Newell Smelski /Stake Energy appeal and Strike Energy letter to the MGB C: /MD /Minute /EC.doc Page 3 EXECUTIVE COMMITTEE REPORT -July 4th, 1996 The Municipal Government Board has rendered its decision in the Strike Energy appeal regarding the three phase separators being used as two phase separators The board has reduced the assessments of the seperators an average of $568 00 per vessel Total assessment has been reduced $77,880 00 It should be noted Mr Dunay originally proposed a $500 00 vessel reduction but Strike did not accept and felt $3,500 00 was more appropriate The • appellant also requested costs in the amount of $16,544 63 The Board denied this request Strike Energy sent a Mar 26/96 letter to the MGB requesting compensation for the costs incurred to bring this matter to the MGB The letter expresses frustrations Strike has encountered when dealing with the M.D and our assessor Mr Jeffery noted Strike Energy has now been taken over by Tarragon Oil & Gas Ltd E Executive Committee recommends a letter be sent to Tarragon Oil & Gas Ltd 'with a copy to the Municipal Government board, outlining the M D 's position and emphasizing the 40� costs incurred by their agent, Newell Smelski, for the appeal to the MGB, could have been alleviated had their agent accepted the reduction proposed by the M D. assessor and this reduction was in keeping with the interpretation of the applicable legislature and also to indicate the M D is willing to sit down with its ratepayers and amicably try to resolve issues to the mutual benefit of all parties Mrs Deak left the meeting time 10 30 A.M 17.
