EXECUTIVE COMMITTEE REPORT - DECEMBER 141 It, 1995
Th" Executive Committee of Richard A Marz and Otto Hof f met on
Thursday, December 14th, 1995 at the M.D of Kneehill office in
Three Hills, commencing at 9:00 A M Also present were John C
Jeffery, Administrator and Lonnie McCook, Public Works
Superintendent Jennifer Deak, Assistant Administrator recorded
thy: minutes.
Mr Marz requested a Christmas greeting be placed in the
newspaper along with a photo of council members.
Mr Dave Tetz did not attend the M D. Christmas party and has
not yet received his 15 year plaque or pin It was agreed by
the Executive Committee that Mr. Wagstaff ensure Mr Tetz
receives these items
The following items were reviewed
i Letter from Torchinsky I'ngineerinq re. A & A Pavia
A copy of a letter from Torchinsky Engineering to Mr Bob Eden,
Ballem McDill MacInnes Eden, has been received. The letter
refers to the SH 575:04 project ( from Carbon to Iiesketh corner)
and the 31,300 tonnes of aggregate at $4.35 per for
total of $136,155 00 that A & A Paving was supposed to Supply
y
fair this project, as per atjreement. A total of 28,360 tonnes
w:ts supplied by A & A, total $123,366 00. The difference for
this shortage is $12,789.00 A & A was unable to supply the
lAend sand for this project; it was supplied by South Rock Ltd
at. an agreed price of $16,581 60 Torchinsky has requested this
amount be deducted from the trust monies owed to A & A
Torchinsky also mentions A & A still owes $4,295 00 to Maynard
Fitzgerald (Beiseker Aggregate Products) and requests this
amount also be rectified for releasing of funds
zir Jeffery reported a letter had been sent by the M D. to Mr.
Ellen regarding this matter

WX B has advised on the current status of this claim, noting
too additional benefits have been received by the claimant since
the pension was paid as a lump sum on June 3/94

7. Letter to the town of Three Bills re. Airport Commission
lir Jeffery read a letter, to the town of Three dills, stating
the M D.'s understanding of their proposal to restructure the
Airport Commission. This includes two members from the M D ,
two from the town with the ability to appoint two more members
at large; costs shared 1/3 M D. and 2/3 town, all capital and
operating budgets to be approved by both the town and M D
c..ouncils
Mr. Marz agreed this was the concept the M D approved at the
iov 21/95 council meeting

8 Letter to Tom Thurber re- well site assessment
At the Dec 5/95 council meeting Mr Dunay reported on changes to
o.he assessment of non farmland, particularly the well sites. A
letter was prepared to be sent to Mr Thurber voicing opposition
to the new legislation Mr Dunay will be attending a meeting
In Edmonton on Monday, Dec 18/95 to further clarify and discuss
this issue.

The AMSCSC has forwarded a listing of members and their elected
representatives, a financial report, as at Nov 30/95 and a
member municipality monthly permit report.

10 Federation of Canadian Municipalities Membershi
The Federation of Canadian Municipalities has invoiced the M D
for membership fees from Apr 1/96 - Mar 31/97, a total of
$452.35 Membership fees are $0 096 per capita Approval to
join this organization was ajiven at the October organizational
meeting
Executive Committee recommend this invoice be paid. 7A,'zsPI
11 1996 Employee Day
A suggestion has been received to have Dorian Frere attend the
1996 Employee Day and make a presentation about "AIDS and HIV
Positive in the Community and Workplace "
Three Hills is currently forming a committee to promote
awareness of these issues. Mrs Lori Wildeman is a member of
this committee.
Executive Committee recommend a memo be sent to all foremen
requesting suggestions and input for topics to be addressed at
the 1996 employee day and this matter be re- addressed at the
next- meeting
12. Dube Property - Lot 9 -12, Block 1, 7015EF, Waimborne
This buildings on this property have now been demolished and
removed from the site An offer had been received from Wade and
Nancy Lillico to purchase this property for $1,400 00 This
offer was below the market value placed on the property of
$3,000.00 by the assessor. Under the Municipal Government Act,
section 70, a transfer of land at less than market value
requires the proposal to be advertised The legal
recommendation in this matter is to have a tender advertising
the property for sale

Mr Jeffery reported his progress, to date, in negotiating the I
required land purchases for t;he realignment of C,II 806 south of
Linden. It appears some land owners will not be satisfied with
the policy sates for land buying Mr. Jeffery has recommended,
after consultation with legal opinion, the M D hire an
expropriation appraiser to appraise the land prior to
negotiations A discussion followed on the policy rates and the
need to be consistent-, especially since the Si( 583 was just
completed. and land purchasing and other compensations on this
secondary road was paid at policy rates.
Executive Committee recommend when negotiating the land buying
requirements for this project, the M D obtain, in writing, from

the landowner, his proposal price for the said lands, the M D
negotiator not disclose the M.D. policy rates but rather inform
the landowner his written proposal price will be taken to
c; �lxncil for approval and, if not approved, alternate measures
will have to be addressed by council
14 AB News Release re New Directions for Lotteries & Gaming
The AB government has responded to the recommendations of the
Lotteries Review Report and has announced a fundamental change
in the way lotteries operate in Alberta The primary
beneficiaries of lotteries will continue to be charitable
organizations; problem gambling will be a first priority of
government who will provide a solid research base and treatment
programs; for the 1997/98 fiscal year one umbrella foundation
will be formed to distribute lottery funds; C.F.E.P. funding
will continue for the next three years, the number of VLT's in
licensed establishments will be reduced and multiple licensed
facilities will no longer be allowed; if a community decides, by
plebiscite to prohibit VLTs in their community, -the government
will honour the outcome of the vote, professional sports teams
will no longer be eligible for lottery funding

15 Letter from the Federation of Canadian Municipalities
Mr. John Les, President of the Federation of Canadian
Municipalities, has sent a letter welcoming the M D as a new
member into this organization

16 Letter from AB Municipal Affairs re Joint- Service
Agreements
Mr John McGowan, Assistant Deputy Minister, AB Municipal
Affairs, has responded to our letter regarding the joint service
agreement with the towns and villages and the possibility this
agreement may conflict with existing legislation (senior
housing, ambulance and recreation). Mr. McGowan states local
agreements between municipalities can only pertain to matters
within their jurisdiction and recommends this proposed agreement
be reviewed by legal counsel

The AB Liberal Opposition is updating the mailing list for its
newsletter.

18 R C M P Request - Laser Speed Detection System

The Three Hills R C M P. detachment has requested all the
jurisdictions within the Three Hills detachment contribute, on a
per capita basis, towards the purchase of a laser speed
detection system The M D.'s calculated per capita share, as
prepared by Sgt Gene Kowalczyk, would be $2,175 00
A discussion followed on the federal governments downloading
of costs onto local municipalities
Executive Committee recommend, in view of pending negotiations
with the County of Mountain View to contract the services of
their bylaw enforcement officers four times a month, this
request be tabled.
19 AAMD &C 1995 Fall Convention Highlights
The AAMD &C have forwarded the highlights of the 1995 fall
convention.

20 AAMD &C Minutes of Reeve's Meeting - 1995 Fall Convention
The AAMD &C has forwarded the minutes of the Reeve's meeting
which took place Nov 13/95 Mr. Marz was re- elected Chair of
the Reeve's meetings for the upcoming year

21 Federation of Canadian Municipalities - Bylaws (1995)
A copy of the revised bylaws (1995) of the Federation of
Canadian Municipalities has been received

22. Hudson Bay Route Association
Information has been received from the Hudson Bay Route
Association regarding freight route rates and membership fees

23 Marigold Library Report
The November Marigold Library Board report has been received
Business of the meeting included approval of the $60.00 non
resident fee effective Jan 1/96; the board will be looking at
cutting $65,000 00 from its budget should the County of
Wheatland withdraw from the Marigold system.

Mr Berman Martens has offered $50.00 to purchase the old Pentax
K1000 (35 mm) camera and case This camera was purchased in
1978 for $295 00

26. Councillor retreat package course �"' -78
Jeanne Byron and Gwen Harris are offering customized retreat
packages for councillors and administrators with the focus on
long term planning and developing skills

27 Business Tax on AgriculLu.r:al operations
Mr. Marz has reported the AAMD &C has disbanded this committee
because the provincial government has now formed a committee to
look into this issue and it was felt the AAMD &C's committee
would be a duplication

28. Fines Revenue Survey
The following municipalities have responded to the M D 's
request for information regarding the allocation, if any, of
fine revenues.
- Counties of Mountain View and SteLtler - does not share
fines revenue with any urban centres
- M D of Badlands - do not share but has assisted in
contributions for extra equipment for the local detachment
- County of Wheatland - does not share fines revenues;
employs a special constable on a full time basis

29 Fire Meeting Minutes
The June 28/95 fire minutes from the meeting held in Trochu and
the Nov 29/95 fire minutes from the meeting held in Linden were
roviewed It was noted these meetings did not address the
concerns expressed by the M D. fire committee, which was the
reason this committee of fire chiefs was formed - to address
these concerns
The next fire meeting has been scheduled for Feb 22/96 in Three
Hills.
Executive. Committee recommend a copy of the M D 's fire concerns
be given to Fire Chief Martin and Three Hills Administrator,
Jack Ramsden, prior to this meeting

Mr Bob Eden has responded to the M D 's and Torchinsky's letter
(see Executive item #1) regarding A & A's aggregate shortfalls
re. SH 575 project and has sent A & A's lawyer, R Trombinski
Prof. Corp a letter requesting payment for this defic.tency

31. December 5th, 1995 Council Meetinq Minutes
The minutes from the December 5th, 1995 council meeting were
reviewed and edited for publication in the newspaper.
Executive Committee recommend the edited version of the minutes
be submitted to the newspaper for publication.
The Executive meeting then adjourned
