Marz Division Four Councillors• Marylea Lowen Division One Otto Hoff Division Two Robert E Boake Division Three James Hanger Division Five Richard M Vickery Division Six Glen Wagstaff Division Seven Municipal Administrator. John C Jeffery Jennifer Deak, Assistant Administrator, was present a recorded the minutes. The joint services principles were again reviewed a discussed, including per capita funding for fire and t capping and approving of recreation facility deficits. At 9.00 A M the following representatives from the town of Three Hills entered the meeting- Mayor, Bob Robertson Councillors, John Boxma, Myrna Bauman, Kevin Edwards and Dan Shea Administrator, Jack Ramsden On behalf of council, Mr Marz welcomed these representatives to the scheduled joint services meeting and congratulated the councillors on their successful appointments Mr Marz proceeded to review the M D-'s principles regarding joint services, noting these principles are based on a formula of per capita funding and representation; principles the M D. considers fair and equitable for everyone Council's desire to discuss principles only and not the financial aspect of joint services was expressed by Mr Marz. Mrs Bauman requested clarification on the M D 's position regarding a regional recreation board Mr Marz noted the concept of a regional board would be to avoid duplications and it was council's long term goal to have a regional recreation board, serving the entire municipality A discussion followed on separate recreation boards, accounting for recreational deficits and the setting of uniform fees for the same recreational facilities throughout the municipality Mr Marz thanked the town for their support in the housing issue The town reported Mrs. Bauman and Mr Boxma would be representing the town on this regional board, one as an observer until a final decision is received from the Minister regarding representation It was agreed a second M D councillor should attend these meetings, also as an observer, so that he /she can become familiar with the business of this board The town also reported Mrs Bauman would be their representative on the Kneehill Ambulance board with Mr Kevin Edwards as alternate Mr Marz inquired if the town's position on joint services remained the same or had been revised Mr. Robertson advised the town was concerned when the M D 's recreation grant would be paid to them Mr Marz noted this issue was 1 PRINCIPLES TOWN OF THREE HILLS INTO N IW-, REVIEW OF M.D IS JOINT SERVICES PRINCIPLES C7 G L' F] �F COUNCIL MEETING OCTOBER 25th 1995 currently under review and would be discussed later in the council meeting Mr Arlin Koch, Three Hills councillor entered the meeting - time 9:30 A M Mr Marz welcomed Mr Koch and extended congratulations to him on his election success. Mr Ramsden noted the town's position on joint services was that an initial agreement could probably be drafted as only minor problems in the recreation joint services remained to be resolved Mr Jeffery recapped the M D 's first choice joint services Position scenario, that being for all jurisdictions to participate and have all the ambulance, housing and recreation costs accumulated together as one total and distributed on a per capita basis Mrs. Bauman questioned the rural population distribution, as indicated on the second choice position, which included only Three Hills, Trochu and a corresponding portion of the M D population, noting, in her opinion, all the M D 's rural population should be included in this calculation A discussion followed on the allocation of the population in the second choice scenario Mrs. Bauman noted the recreation agreements fund facility losses and suggested efficiencies should be rewarded. It was noted a regional recreation board could monitor expenditures throughout the area and control capital spending The town briefly discussed the proposed airport restructure including representation and financing. The town of Trochu Mayor Jean Ashcroft, Councillor Phil Frere and Administrator Maureen Malaka entered the meeting - time 9.55 A M Mr. Marz extended a welcome to the Trochu representatives along with congratulations to the elected officials A short recess was held from 10.00 - 10.15 A M Mr Marz extended his apologies to Trochu on the appointment mix up, noting it was the M D 's intention to have both towns meet with the M D council at the same time The joint services discussions continued and Mr Marz gave the Trochu representatives a brief recap of the meeting The recreation joint services were again reviewed and the problems of allocating the rural population and the urban population from the non participating urban centres was discussed Mr Frere suggested if recreation costs from all urban centres were accumulated together then costs for using facilities should be consistent Mr. Marz noted a regionalized board would need empowerment to control expenditures, stabilize costs and share ideas and resources The operating costs of various facilities, including Torrington, was discussed and it was recognized costs could vary substantially if a facility required major renovations Mrs. Bauman proposed the M D include all the rural population in the second joint service scenario and the town would look after and address the non participating urban centres The previous recreation agreements of 1968 and 1967 were briefly discussed Mr Jeffery noted these agreements were originally implemented to allocate the rural population to the urban centres for provincial grant purposes These grants no longer exist It was agreed any new agreements should include a regular review process Mr Shea, noting he was a new councillor and not familiar with the town of Three Hills joint services position, expressed his personal opinion and concerns about a regional recreation board, the sharing of facility deficits 2 JOINT SERVICES SCENARIOS TOWN OF TRTW REPS INTO NFFTTW, RECREATIONAL JOINT ' SERVICES DISCUSSION CON'T LI • H 0 B COUNCIL MEETING OCTOBER 25th, 1995 on a total area basis and suggested user fees should be a percentage of operating costs Mr Edwards, noting he was also a new councillor, expressed his personal opinion that the recreation joint service be separate from the ambulance and housing Mr Marz thanked both Mr Shea and Mr Edwards for their input Mrs Malaka noted very few people from the Linden area use the recreational facilities in the municipality, especially the arenas, yet contribute to recreation through tax dollars. A discussion followed on the possibility of subsidizing or phasing in the recreation dollars Linden would lose in the joint services scenarios. Mr Jeffery requested clarification of Mrs Bauman's earlier proposal regarding population distribution Mr Jeffery noted his understanding was that the M D include all its rural population in the second choice joint service scenario and also include all the urban populations Three Hills would then recoup costs from the non urban users. Mrs Bauman concurred It was agreed to have the administrators of Three Hills, Trochu and the M D draft an agreement, based on including all the rural and urban populations of the municipality in the recreation agreement and this agreement be approved by the Mayors and Reeve of the three jurisdictions and once approved, sent to the remaining urban centres in the M D Mrs Bauman recommended a reserve for capital expenditures should be addressed in the agreement. The week of November 20/95 was proposed for a meeting date to review this draft agreement Mr Koch left the meeting - time 11 20 A M The next Three Hills, Trochu and M D joint services meeting date for was set for Wednesday, Nov 22/95 at the town of Trochu, commencing at 7.00 P.M Mr. Marz thanked all representatives for attending this meeting, noting the meeting was the first step to a good working relationship between the three jurisdictions and expressed his optimism that this draft agreement would meet all expectations. The representatives thanked the M D for hosting the meeting and left - time 11:25 A M It was agreed by council that the joint services meeting had provided a good dialogue Mr. Jeffery reviewed the recreation bylaw, noting the allocation of recreation dollars in Bylaw #1303 was not based on facilities in the urban areas Bylaw #1322 had addressed the payment of recreation grants based on facilities and had eliminated any recreation grant to Linden A discussion followed on whether the recreation grant should be paid this year and notice served to all the urban centres regarding future recreation grants Mr. Vickery moved first reading be given to Bylaw #1345, this being the bylaw to rescind Bylaw #1303 and authorize payment of 1994 recreation grants to certain towns and villages and the city of Drumheller CARRIED Mr Wagstaff moved second reading of this bylaw CARRIED Mr Hanger moved third reading be given to this bylaw at this time CARRIED UNANIMOUSLY Mr Boake moved third reading to Bylaw #1345 CARRIED RECREATIONAL JOINT SERVICES DISCUSSION REQUEST FOR CLARIFICAT ION OF MRS BADMAN'S RECREATION JOINT SERV PROPOSAL AGREEMENT TO HAVE DRAFT A G DRAWV UP NEXT JOINT SERVICES MEETING DATE SET REVIEW OF M.D RECREATION BYLAW BYLAW #1345 RECREATION BYLAW RESCINDING 1303 • 41 COUNCIL MEETING OCTOBER 25th 1995 Mrs Lowen moved a letter be sent to all urban centres notifying them all previous recreation agreements are void and that the M D would not pay any further recreation grants until a new agreement is in place for per capita sharing of housing, ambulance and recreational joint services CARRIED UNANIMOUSLY It was recommended, since there was several new councillors on the urban councils, after the November 20/95 Three Hills, Trochu and M.D. joint services meeting, the rest of the villages in the municipality be contacted and invited to further discuss joint services. The meeting recessed for lunch between 11:45 A M until 12.50 P M Mr Jeffery reviewed the fire protection summary he had prepared Mr. Boake moved to accept and file this report CARRIED The AAMD &C workshop survey was completed with each councillor choosing four workshops to attend during the convention Further to Executive Committee item #2, Alberta Assessment Equalization Consultants, Mr Jeffery reviewed the agreement received from this company to undertake an equalized assessment review and appeal, if necessary, of the M D.'s equalized assessment Mrs Lowen moved Mr Marz and Mr Jeffery be authorized to sign the contract with Alberta Assessment Equalization Consultants to review the M D 's equalized assessment for 1996 CARRIED i Mr. Jeffery reviewed the Oct 11/95 minutes of the Mt Vernon Water Committee The committee's inquiry regarding the possibility of the M D financing or debenturing this project was discussed along with the M D reserve policy it The water committee's suggestion regarding a future water commission was also addressed Mr. Hanger moved to accept, in principle, the possibility of the M D. financing this water project and also the possibility of the formation, at some future time, of a water commission and further that the M.D. make no commitments towards these possibilities at this time but rather wait for further information from the water committee. CARRIED Mr Vickery recommended council meet with P.F R A to further discuss these possibilities The Oct 12/95 Agricultural Service Board minutes were next reviewed. Mr Hoff moved to amend the motion to include the Drumheller R C M P detachment Mr Hoff requested a recorded vote A vote was taken on the amendment to the motion and Mrs Lowen, Messrs Hoff, Wagstaff and Boake voted in favour of the amendment to the motion and Messrs Marz, Wagstaff and Hanger voted against the amendment to the motion The amendment to the motion was declared CARRIED A vote was taken on the original motion, as amended and Mrs Lowen and Messrs. Hoff, Wagstaff and Boake voted in favour of the motion as amended and Messrs. Vickery, Marz and Hanger voted against the motion, as amended The motion, as amended was declared CARRIED Mr Jeffery requested council's clarification regarding the rural population figure to use in the joint services recreation calculations, whether or not to include the rural population within the M.D.'s Drumheller recreation area Total rural population in the M D totalled 4,713 and excluding the Drumheller recreation area, 4,324. The following members of the Assessment Review Board were present: Council Members Richard M Vickery, M Glen Wagstaff and Marylea Lowen John C. Jeffery, Municipal Administrator and Clerk of the Court Edward M Dunay, Assessor Jennifer Deak, Assistant Administrator and recording secretary Also present* Mr Harry Van Hereweghe, Strike Energy Inc (Three Hills) Mr. Barry McConnell, Newell Smelski Mr Wagstaff continued as Chairperson of the meeting and declared the Assessment Review Board reconvened Mr. Dunay reported all the sites under the blanket appeal had been inspected One hundred and thirty one separators had been inspected and of these, thirteen were operating as three phase separators The balance of the sites consist of three phase separators working in the capacity of two phase separators Mr Dunay recommended the assessment on the three phase separators operating as two phase separators be reduced a. base amount of $500.00, factoring into this calculation a reduction for base year modifier and depreciation to year built Mr. Dunay noted he did not agree with Mr McConnell's recommendation for an application of functional obsolescence Mr Dunay also noted the consensus at the recently held provincial assessors conference was if the separator had three phase indicated on its tag, it should be assessed as three phase A discussion followed on the clarification and definition of a two and three phase separator Mr Van Hereweghe noted he had not inspected every site but of those inspected he had found only three sites which had three phase separators. Mr. Van Hereweghe also noted all manufacturers build the separators with the extra nozzle capacity to facilitate future conversion to a three phase Mr McConnell, in response to a question regarding notification of separator changes from two to three phase, advised the board the process is that Strike informs Newell Smelski who, as agent for Strike, informs the municipality. It was noted annual changes must, under the provincial regulations, be reported by the following February 28. Mr Dunay requested this information be reported to the municipality sooner than the regulated deadline as inspections are to be completed by December 31 each year Mr Dunay also noted some oil companies forward this information to the municipality as soon as they receive it Mr Jeffery suggested Newell Smelski could also forward this information as soon as it was received from their client. Mr Jeffery inquired if Mr McConnell agreed with the assessor's recommendations Mr McConnell proceeded to distribute an April 27/95 letter from Strike to Mr Dunay clarifying the two vs. three phase separator issue Mr. Jeffery noted the board should be fully aware the letter distributed by Mr McConnell is information after the fact Mr. McConnell stated this letter was introduced more for information purposes, to help clarify the matter Mr McConnell agreed that information from his client indicates some of the separators in this blanket appeal are indeed three i, 1 �N] E • 1995 ASSESSMENT REVIEW BOARD - October 25th, 1995 phase separators and suggested the initial request, to his client, for this information could have been misunderstood A discussion followed on clarification of a two phase separator housed in a three phase separator shell Mr McConnell advised approximately 95% of separators purchased have the capacity of a three phase separator and can be used either in a two or three phase capacity, adding it is economically viable to purchase a three phase capacity separator than to upgrade a two phase to a three phase. Conversion of a three phase separator from a two phase capacity to a three phase capacity is approximetely $500 00, whereas conversion of a two phase separator to a three phase separator is approximately $3,500 00 A discussion followed on the assessment manual definitions of a two and three phase separators; whether volume or height is a factor in differentiating the separators; the holding capacity of a two phase separator inside a three phase separator shell Mr McConnell noted the County of Ponoka allowed an adjustment, to the assessment of the two phase vs three phase separators, based on functional obsolescence. Mr. McConnell also noted height was ignored in his recommended calculations Mr Dunay noted height of the vessel cannot be ignored The upgrading cost was discussed and references made to parts 2 0 and 4 0 of the April 27/95 letter from Strike Energy to Mr Dunay In response to questions from the board Mr McConnell agreed the cost to Strike Energy to appeal these assessments far exceeded any realizable assessment adjustments Mr McConnell noted the same two phase vs three phase separator argument applied to the three outstanding Beau Canada appeals Mr. Dunay noted Roll #6210300, Beau Canada, was inspected and has facilities for a three phase separator and has two dump valves Mr McConnell agreed to withdraw the appeal on this roll number Mr. Wagstaff inquired if the board had enough information and the members agreed they did have all the information they required Mr Wagstaff called for a short recess - time 2.45 P M Mr McConnell and Mr Van Hereweghe were not present when the Assessment Review Board continued The board reviewed the information presented and the following motions were made 1 Roll 6016000 10- 36- 28 -23 -W4 Strike Energy Inc Mr. Vickery moved to concur with the recommendations of the assessor that the machinery and equipment assessment, in the amount of $13,770, be reduced $130 to $13,640 and the balance of the assessment remain unchanged CARRIED UNANIMOUSLY 2 Roll 6017000 06- 01- 29 -23 -W4 Strike Energy Inc.
