COUNCIL MEETING JUNE 13TH, 1995
A regular meeting of council was held in the M D of
Kneehill Office, 232 Main Street, Three Hills, Alberta on
Tuesday, June 13th, 1995, commencing at 8.50 A.M
The following were present for the meeting-

Mr. Hoff moved approval of the agenda with addition of the

cameras and also the uses for this equipment.

Environment has scheduled a demonstration and public
hearing on June 23/95 to discuss the possibility of

Mr Lonnie McCook, Public Works Superintendent, entered the
meeting - time 9.00 A M
Mr Vickery moved approval of Mr Jeffery's report AppRMAL XJ REPO<7
The Executive Report was presented Mr Marz reported he
had received a letter addressed to "elected officials only, DEC Cow RERW
confidential" from Ms Leigh Boake Mr Boake declared a
family interest in this matter. Council agreed that since
the relationship between Mr Boake and Ms Boake was not an E BM LETTER
immediate family relationship he could participate in this
matter Mr Marz reported Ms Boake's letter requests a
response to various M D. policies and practices Mr Marz
read a letter he had prepared in response to Ms Boake's
letter
Executive Report item #1, gravel crew report, and item #2,
Guzoo Road sign theft and vandalism were also discussed GRAVEL. M ROT
Mr. Marz read a letter he had prepared for publication in
the Three Hills Capital, addressing the issues of vandalism
and sign theft
Mr Boake moved approval of the two letters prepared by Mr

A discussion followed on complaints received regarding M D
vehicles, broken windshields and speeding. Mr McCook
discussed the use of VDO electronic tachographs in gravel
trucks Installation of these devices would provide

recommended a policy be adopted to publish, on a quarterly
basis, all ratepayer complaints along with the actions
taken to resolve these issues. It was also recommended the
purchase of the tachographs be included in Mr Marz' s

report to the newspaper
Under Executive Report #30, Gerald Dube - Wimborne
property, Mr Jeffery reported Mr. Glen Scott, Brownlee

Fryett, had recommended the removal of the building be by
tender with a release included in the tender absolving the
M D from any liability incurred with the removal of the
building The M D has clear title to this property
Mr Hoff moved a tender be advertised in the newspaper for
the removal of the building located on Lots 9 -12, Block 11 REMOVAL. OF BUILDING
Plan 7015EF, Wimborne, and also that Mr Dube be contacted, WIME30RPE OLD LUMBER
prior to the demolition of the building, to remove any of BUILD
his property from this location
Under Executive Report #32, Mr Hoff confirmed he would
attend, on behalf of the M D the Stettler & District
Fair Parade on July 24/95
Under Executive Report #35, request from Eva Jensen for
water hook up to Huxley water system, it was agreed council E JENSEN REQUEST FOR

importance of councillors attending committee meetings, or
if unable to do so, ensuring an alternate member attends

It was agreed to prepare a press release reporting the
substantial mutual economic benefit that the towns and the PRESS

Under report item #12, Mr. McCook discussed the request to wawa:
purchase a 10 1/2 ft. heavy duty rotary cutter. The old A-1
John Deere mower would be traded in and this cutter could

Mr Vickery moved approval to purchase a 10 1/2 ft Schulte
rotary cutter, model XH1000, series 2 for a price, net of APPROVAL- TO PlA2CHASE

The May 26/95 Road Committee report was reviewed The
recommendation regarding the access to the Gaetz cemetery ROAD C" REPORT
was discussed The cemetery is located in the middle of
section 12- 33 -27 -W4 The M D has an easement across the
S W 12- 33 -27 -W4 This access route is 14 ft and is
located on the north boundary of the S W quarter
Mr Wagstaff moved the M D negotiate the purchase of land,
a rod length in width, from the owners of the N W GAEfZ CWRY ROAD
12- 33- 27 -W4, to widen the road into the Gaetz cemetery

Mr McCook elaborated on an alternate solution to deter
erosion on steep grades Because of the increasing cost of
large rocks, old tires are being used as rip rap and then PROPOSAL RE GREADE
filled part way with cement, which is poured on site This EROSI ON
procedure has been used successfully in B C Mr Vickery

noted the road down to the Bleriot Ferry requires shrubs,
not grass, on the grade This should prevent further
erosion
Under item #8, SH 583 - Marz coulee, a discussion followed
on the grade, erosion and timeliness of roadside seeding on
the SH 583 project It was noted that since the road
committee recommendation, there had been a large amount of
rainfall resulting in increased dirt washing down the grade
Mr Vickery moved the Public Works Superintendent proceed
to address this problem with whatever was required to
rectify the matter and the Road Committee follow up with an
inspection

Mr Vickery moved approval of the Road Committee Report

Mr. Jeffery reported Mrs Joan Tullikopf and Mrs Delores
Braconnier had requested dust control because of the detour
traffic from the Strike Energy plant at the airport using
the road past their residences, located SSW 29- 31- 23 -W4.
Six hundred feet of dust control would be required from
Highway #21 east past these residences. Mr McCook
reported, to date, only fourteen requests had been received
from M D residents for dust control application at user
pay costs A June 15/95 deadline has been set and
advertised for these requests

Mr Boake moved the dust control policy not be waived and LET�s

Mr. McCook reported the dust control on the Guzoo Road has
been scheduled for June 19/95 The first two miles north
of SH 583 will not be done at this time because of the G= ROAD DUST
detour route for the SH 583 project. The contractor rates Mffr-
for base and chip seal on this road was also discussed�,���
Mr Marz noted, because of the closure of rail lines and
the CROW rate, the M D would have to address the use of
heavier volumes of traffic loads accessing local roads and
approaches
Mr Jeffery reviewed the Petroleum Product Purchase Agency
Agreement proposed by the AAMD &C to establish baselines for
the volumes of petroleum products purchased by the
associations members Concerns were raised about using a
broker to purchase fuel, the quality of fuel, the effect on
the local dealers and the local economy, and the lack of
information received from the AAMD &C regarding this matter
Mr Vickery moved to table this matter due to the unknown PERTROLEIM PRODU
effect this agreement may have on the local economy, local —
employment, fuel delivery and distribution. A�fTTABLm

Mrs Deak read a letter received from Steve West, Minister
of Transportation regarding the de- designation of several
sections of primary highways and approach roads across the
province There are 197 kilometres of primary highway and
159 kilometres of approach roads being proposed to revert
to local responsibility. The department is willing to
establish a reasonable level of assistance to reach a fair
solution to assist local municipalities with the transfer AB )ESIG OTION ON RE
It was noted, under Executive Committee item #14, a DE- DESIGNATION OF
response to an earlier letter, dated May 23/95, regarding PRIM4RY HIG—M
this matter, had been prepared and approved to be sent to
Mr. West It was agreed to revise this letter by changing
the third and fourth paragraphs to reflect the M D 's
willingness to work closely with AB Transportation to
negotiate a fair arrangement for the level of assistance to
maintain these de- designated roads It was also agreed the
M D 's concern over this down loading be reinforced.
Mr. Vickery moved a revised letter, reflecting the
revisions agreed by council, be forwarded to Mr Steve
West, Minister of Transportation

Mr Wagstaff reported Mr Keith Doerksen had requested the
M.D consider purchasing sand from him and also that no
price had been discussed Mr. McCook reported the M D KEITH DOERKSE7d SANQ
currently purchases its sand requirements, which are LY
approximately 1,600 yards, from Sundre
Mr. Jeffery re- entered the meeting - time 1.05 P M
It was agreed Mr Wagstaff and Mr McCook meet with Mr --fe-:rmw"o Peas
Doerksen to further discuss this matter and report back to
council
Mr. Marz reported he had received a request from the
Hutterian Brethren of Valleyview to use the Schmautz Pit, REQUEST FROM TORRINGTON
S W 20- 32- 26 -W4, to access their gravel pit, located N aMITES RE GRAVEL
north of the Schmautz Pit Border Paving will be crushing pIT ACCESS
gravel at the Hutterite pit and trucking it off site It
was noted Mr Don Kimmel leases the east side of the
Schmautz Pit but access could be gained from the west side
of the area onto Highway #27
Mr Hanger moved permission be given to the Hutterian
Brethren of Valleyview to use the west side of the Schmautz
Pit or, if the lease permits, the east side of the Schmautz
pit, to access their gravel pit

Mr Jeffery read a letter from AB Transportation advising
there is no longer sufficient funds in their budget to
undertake the proposed overlay and repaint at the Three AB TREWSpORTATION
Hills Airport An inspection had been made of the airport ��T-
by the department and deterioration had been noted along A hairline cracking along the centre line of runway,
rutting and some low spots on the taxiway approaches Core
testing and investigative work is scheduled for this year
and a plan for overlay in 1996/97, subject to the
availability of funds The Airport authority remains
responsible for routine maintenance.
Mr Boake moved to accept and file this report.

Mr Jeffery reviewed the updated 1995/96 Construction
Program as prepared by AB Transportation, noting all the
projects scheduled for the municipality
Mr Hanger moved to accept and file this report
carried
Mr Jeffery requested direction from council regarding the
purchase of land from Mr Gerald Leonhardt and Mr. Jack
Vickers to access the west of 26 and through 35 in
28 -21 -W4 A revised agreement has been drawn up amending
the land purchase price to be at the policy price at the
time of acquisition, not at current policy price A
portion of the land required is currently under a lease
agreement with Pan Canadian
It was agreed to approve the revised agreement regarding
purchase price of land to be set at the policy price at
time of acquisition and it was further agreed to proceed
with the survey after the agreement was signed
Mr Jeffery reported Mr Lawrence Leischner has requested
reimbursement for the damages to his truck when it collided
with a dirt pile on the Guzoo Road on June 4/95 The road
signs and lights indicating the dirt pile had been
vandalized and stolen Mr Mike Priddle, Baldwin &
Associates Adjusters Ltd have advised, under section
532(8) of the M G A the M D is not liable because of the
vandalism to the road signs
Mr Vickery moved a letter be sent to Mr Leischner sating
this is an insurance matter and should be referred to the
insurance company

Mr. McCook left the meeting - time 1.25 P.M.
Mr Jeffery reviewed Cash in Lieu, explaining that under
the provisions of the Planning Act, a condition of
subdivision can be a dedication of 10% of the land as
public reserve land or a cash in lieu of an amount up to
10% of the value of the subdivided parcel. The cash in
lieu can only be used towards public parks, recreation
areas or school purposes A separate accounting of this
monies must be maintained Mr Marz noted surrounding
municipalities use a cash in lieu and have contributed this
monies to various recreation projects Questions were
raised on the method of valuation of a parcel and approved
uses of the monies.
Mr Vickery moved council favour the concept of Cash in
Lieu and Mr Jeffery obtain more information regarding this
procedure, the matter then be referred to the Municipal
Planning Commission to review and report back to council

Mr Jeffery reported on the joint services meeting held
with the village of Linden May 29/95, noting included in
the discussions was the fire department boundaries and
funding The village feels the funding for the Kneehill
Foundation should be on an equalized assessment basis and
ambulance on a per capita basis. The village has no
recreational facilities and therefore receives no

recreation grants Mr Vickery noted the philosophies of LINDEN JOINT SERVICES
Linden were quite similar to those of Trochu and the ING
meeting was conducted in a very non confrontational manner.
Mr Hanger moved to accept this report

Mrs Lowen reported the Hesketh Community Hall have
requested to be included in the M D 's liability insurance
coverage. There was a previous request for this coverage
and the M D sent letters to rural community associations
in the municipality inviting them to join the M D
liability insurance. The consensus of council at the time
was this insurance would only be offered if a majority of
the community associations requested it Very few
community associations responded to this issue and as a
result the insurance was not offered Hesketh Community
let its insurance lapsed under the assumption it would be
included in the M D 's coverage The community now has
closed one of its buildings and is again requesting to be
included in the M.D.Is insurance coverage. A discussion
followed on the viability of rural community associations,
the history of the M D recreation grants, the need for
user pay facilities, the potential liability by including
the community associations in the M D insurance coverage.
Mr Hanger moved to refuse any requests from community
organizations to be involved or included with the M D
insurance coverage

Mr Jeffery read a letter, dated May 31/95 from Shirley
McClellan, Minister of Health, to all municipalities in the
David Thompson Health Region, advising the requisition in
the health region of $67,842.94 is not approved Mr
Jeffery also noted 1995 tax notices did not reflect this
requisition
Mr Wagstaff moved to accept and file as information

Mr. Jeffery proceeded to update council on the current
status of the Swalwell clean up file, noting a response, to
the M D 's May 1/95 letter, had been received from Mr
Richard Rowe This letter has been referred to Mr Glen
Scott, Brownlee Fryett, as this matter is currently under
legal advice If the Clean Up Order is not complied with
by June 15/95 the M.D. can proceed to rectify the problem
charging all costs to the tax roll
Mr Boake moved to table this matter until the next council
meeting.

Mr Hoff moved, should the Swalwell Clean Up Orders issu
to Mr Richard Rowe and Mr Vernon court not be complied
with by June 15/95, the M D follow through with the clean
up orders, including, if necessary, the removal of the
buildings, subject to receiving written legal opinion and
approval of same from Mr Glen Scott.

Mr. Marz presented the Reeve's Report, noting on June 1/95
he attended the AAMD &C Is. Boundary Review Committee meeting
in Edmonton Council had previously made a motion in
favour of boundary proposal "B" and this proposal received
the majority approval The committee is now preparing a
Notice of Motion for presentation at the upcoming
convention
Mr Marz next reported on the Kneehill Community Resource
Board, its proposal for alternate funding with Drumheller
and Wheatland and the regional school funding for the KCRB
of $9,000 00 Since the school receives its funding from
the local tax base concerns were expressed to have this
monies allocated with the municipalities share of funding
and not the provincial F C S S share of funding Mr Marz
also requested board members who are unable to attend
meetings ensure alternates attend these meetings so that
there are sufficient board members present to form a quorum
to conduct business and make decisions
Mr Hanger moved any regional school board funds
contributed to the Kneehill Community Resource program be
considered as local contributions and included as part of
the participating municipalities portion of funding (20 %)
and not as part of the provincial funding (80 %).

water feasibility survey in south east section of the M D
The P F R A is willing to assist with the preparation of WATQZ FEASIBILITY
the survey The costs incurred for this survey will be SURVEYSE SECTION
funded through the CAESA program Mr Cunningham noted OFM.D
this is additional funding and not included in the current
CAESA grant.

held on July 4th, 1995 commencing at 11.00 A M and the PUBLIC DARING

REPORT-

1 Rented Beveridge Lake stock pile site to Capilano International
(258 -0066, 572 -3288 or 572 -3034) Murray Leier or Victor O'Connel
for a camp site at the rate of $1000 00 per month (prorated on a
daily basis) subject to certain conditions Rental likely from
June 5th to August 15th +/- Pt N.E. 23- 29 -22 -4- 3 acres.
Doing seismic work for Pan Canadian There will be 12 to 15
trailers, mostly enclosed - 60 man camp About 20 vehicles
on site Company could not get motel in area because of
stampede, play, etc
They agreed to keep the camp as far back on the site as
possible - away from road Will use east approach and
Hesketh road for access to SR 575 Will keep mud cleared
off the road. Will Pump out sump with vacuum truck and area
will be reclaimed and returned to original condition as soon as
possible after project completed. Lonnie advised will not use
the site until reclamation is done this fall Will pay $1000 00
per month in advance and M D will return any unused portion of
these funds Daily rate of rental is $33 33 per day

2 May 25th, 1995 - Linden Nursing Home now exempt from all
taxation except for residence. Has been named as one of the
government controlled nursing homes in the province

change all mill rates except Municipal at 13 4
4. Received claim from Dave Hervey, employee of A & A Paving
for $30,576 in connection with SR 575 He was fired from
job by A & A and trying to claim money from the M D

5 Discussed Dafoe bridge with Jim Sawchuk We cannot front
end the costs and then collect from them We can do it
at our cost if we wish
6 Rob Penny, Alta Transportation, advsies no highway
dedesignation in our area
7. There will be grants available for approach roads we have
taken over when work required - 1/3 Province, 1/3 M.D.
and 1/3 urban center. All our access roads are into
hamlets for cost sharing will be 1/3 Province, 2 /3rds

1 Told Miles to buy 2,000 cu yd of gravel from Ed
McNair for the south west corner He's willing to sell the
gravel at the cheapest price for the area which is
$3 00 /tonne or $3.99/yd
2. Demoed a 690 John Deere hoe for four days on the water
project and also a Hitachi hoe for two days The 690 out
does our hoe 2 1 in digging I rented the John Deere and
we had two holes on Guzoo Road until it was done We left
the 690 on the water works for production and are using our
hoe for work that is needed on public works projects The
hoe is leased with option to purchase (look at it later)
3. Transfer boxes - scrap dealer won t give us anything
for them He will cut them up and haul them out A
ratepayer is interested in them and will give us $100 00 to
haul them to his place
4 Had a look at two paving outfits (patching) in Acme
and Beiseker the other day I'm getting prices from them
to patch a couple of bad spots on roads and will compare
the difference in quality Will do a couple of spots if
the price is right
5 Flipped T -35 and a belly dump trailer on its side
