EXECUTIVE COMMITTEE REPORT DECEMBER 15th, 1994 0
The Executive Committee of Richard A Marz and Richard M
Vickery met on Thursday, December 15th, 1994 at the M D of
Kneehill office in Three Hills, commencing at 10.25 A M
John C Jeffery, Municipal Administrator was present and Mrs
Jean Wilkinson, Assistant Administrator was present and recorded
the minutes.
The following items were discussed
1 Acting Public Works Superintendent Position
Discussions were held with Mr McCook prior to the Executive
committee meeting
Executive Committee recommend-
Mr McCook be offered the position
Superintendent effective January 1st, 1995,
of $40,000 00
The sum of $2000.00 be provided for in
allocation to this position after July 1st,
an increase in salary is appropriate
Mr. McCook be provided with an M D radio
vehicle and if he is called out after hours
be paid mileage at the regular mileage rate

Mr Marz noted Mr Toews had contacted him again He suggested
as the M D has a caveat on the Swalwell property owned by Mr.
Boese and if the M D acquire the property under the tax
forfeiture act and is able to sell the property for more money
than is owing for legal fees, taxes, etc , would the M D then
repay him his $10,000
Mrs. Wilkinson noted the only person who can claim back any
excess funds from a tax sale is the owner of the land and
any encumbrance filed against the property is cancelled
if the land is acquired under the Tax Forfeiture Act.
Executive Committee recommend once the file on this matter has
been closed by our solicitor and the balance of the monies held
in trust are forwarded to the M D to be applied against the
M D legal fees, Mr Toews be written a letter advising him of
the M.D.'s decision to use the excess trust funds to offset the
M D legal fees, and he be advised it would be best for him to
discuss any options he may have with a solicitor.
(It was agreed that any M.D. letter sent to Mr Toews is to be
signed by Reeve Marz)
3 Topeka Energy - Tax Situation
The letter from Mr Ed Cunningham of Topeka Energy was
reviewed. Mr. Dunay had reviewed the tax situation and
the outstanding taxes were made up of $559 73 for 1993,

$556.57 for 1994 and penalties of $146.30. He had inspected
the site and all equipment has been shut down so there will
be no assessment on the equipment and building for 1995
He will reinspect the site later to ensure the site has not been
put back into production The tax levies would appear to be
correct.
Executive Committee recommend a letter be sent to Mr Cunningham 1skwe
advising him the assessment and tax situation had been reviewed
and were assessed in accordance with provincial regulations
4 Radio System Assessment
It appears Mr Cunningham and Mr. Ehmann have reviewed the M D
radio system with the fire department members and_. had a-n � LA se
independent person review the system Feed back appears to L111
indicate the system is working better now W

5 Gaetz Cemetery - Section 12- 33 -27 -4
The office reviewed the easement which the M.D. has across the
S W 12 to gain access to the cemetery The access route is 14
feet wide on the north boundary of the S W quarter
Mr Clare Herron owns the land It was suggested perhaps
someone should discuss the matter with him and his tenant (if
any) as it is necessary to maintain reasonable vehicle
access to the cemetery. Perhaps the access road should be
re- seeded or gravelled

6 Lorne Wagstaff Proposed Subdivision
Mr. Wagstaff has now submitted to Palliser Planning a sketch of
how he proposes to subdivide the land he ownes in the N E 8
just to the south of the Town of Trochu.
He will provice a 66 foot internal access road to service
Parcels 1, 5, 6, 7 & 8 and Parcels 2, 3 & 4 would have access on
to the M D road immediately to the east of this land.
It was noted there is a hill and also the road curves so the
sight distance for approaches into 2 3 & 4 might not be good
Perhaps he should create a service road along the east side of
his property as well as the internal road.
Executive Committee recommend Mr Cunningham inspect the site
to determine if sight distance could be obtained for these three
proposed parcels and if not, Palliser Planning be requested to

require a service road along the east boundary of the property
as well as the internal access road
Executive Committee further recommend once this information is 59-2 ..
available, third reading to by -law 1313 be considered by council
Note Alex indicates it would not be possible to get sight
distance for approaches into sites 2, 3 & 4 and Palliser has
discussed with him the need for a service road to provide
access out to the one location where sight distance will comply
with M D requirements.
7 Village of Linden - Approach on to SR 806
Village of Linden has written advising Feed Rite has agreed to
sell the Village a northwesterly portion of their land in order
to extend First Avenue N W out to SR 806 They therefore would
request permission from the M D to access SR 806 from this
location and ask that the M.D consider constructing the
approach and the road on a contract basis. Time frame would be
- approach in late spring or early summer of 1995 and balance
of the road by late fall of 1995
No mention was made of making a joint approach with Feed Rite SPeNNs

Executive Committee recommend Mr Marz meet with Mayor Joyce
McDonald and representatives of Feed Rite to discuss the entire
SR 806 access situation
8 Alberta Labour - Fire Investigation Costs
County of Grande Prairie received a letter from Alberta Labour
regarding costs for undertaking fire investigations and
forwarded a copy of this letter to all municipalities
It appears Alberta Labour is moving in the direction of a user
pay concept If a municipal fire chief is unable to determine
the cause and or orgin of a fire he may call in a fire
investigator from the province and there likely would not be a
fee. However if requests for assistance became routine a fee
would likely be charged. If a municipality does not undertake
investigations and requests the fire investigator to provide the
service there will be a charge for the assistance provided
Executive Committee recommend a copy of this letter
each fire chief and the issue be discussed with
departments at the annual fire department meeting

9. Alois Stern - Proposed Subdivision - Need for Approach

Office has now received a copy of the approval for Mr Stern's
subdivision in the S E 21- 29 -23 -4 There are two approaches
into the proposed subdivision but no approach to access the
balance of the quarter section
The parcel is adjacent to SR 836 (paved road) and the road on
the south side of the quarter is not accessable
Executive Committee recommend Mr Stern be advised to extend the
existing approach which is used to access the N E 21
and create a joint approach for the two quarters, the costs for
such extension to be at his expense, and the approval for
extension of this approach would be subject to the location of
the existing approach meeting M D sight distance requirements
and if the existing approach is immediately north of the quarter
section line of the S E 21
Note • Discussed the matter with Alex today - December 15th - «"^ °Y�l
and the approach into the N E 21 (Dale Hecktor s land) is
likely about 50 feet north of the quarter section line so
recommendation from Executive Committee will not work v
Alex also noted Mr Hecktor has two approaches off of SR 836
into the N E 21
10 Senior Housing Management Act
Mr Marz requested the M D send a letter to Steve West,
Minister of Municipal Affairs requesting an amendment to the
act to allow municipalities to negotiate their own funding
arrangements for senior housing facilities. It is presently
legislated by the provincial act Mr West should be sent
copies of the ambulance and Golden Hills Lodge requisitions to
show the M D pays 75% of the requesitions but only has one vote
on these boards and can be outvoted by smaller jurisidications
who do not contribute much financially towards the costs of
operation of these facilities Mr. West should also be advised
some areas receive back more in per diem pay from these boards
that they pay in requisitions and they are therefore reluctant
to make any change to the existing system
This system is contributing towards smaller inefficient
jurisdications continuing to exist while the Province is
encouraging everyone to become more efficient and amalgamate to
cut costs
Executive Committee recommend such a letter be drafted and
reviewed by Reeve Marz prior to being sent to the Minister.
