EXECUTIVE COiMMITTEE REPORT SEPTEMBER 8th, 1994
The Executive Committee of Richard A Marz and Otto Hoff
met on Thursday, September 8th, 1994 at the M D of Kneehill
office in Three Hills, commencing at 8 45 A M
John C Jeffery, Municipal Administrator was present and
Mrs Jean Wilkinson, Assistant Administrator was also present
and recorded the minutes
The following items were discussed
1. Carbon History Book
During the recent 50th Anniversary Celebrations Mr Finlay Code,
former M D councillor noted the M D did not have a Carbon
history book in their display He therefore purchased one and
presented it to the M D for their library.
Executive Committee recommend a letter of sincere thanks be sent
to Mr Code for his thoughtful gift to the M D ICt,er

2 1994 Auditor
The M D has not yet appointed an auditor to do the 1994 audit
Executive committee recommend the M D hire the firm of Kangas
Ablett to do the 1994 audit and Alta Municipal Affairs be
advised accordingly
3 1996 Big Country Winter Games
The Recreation Association of Big Country in co- operation with
Alberta Sport, Recreation, Parks and Wildlife Foundation extend
an invitation to all municipalities in the Big Country Zone (2)
to bid to host the 1996 Big Country Winter Games.

4 Fire Protection Review
Alex Cunningham has made a presentation to the local towns and
villages in connection with the fire protection review he had
undertaken
The Village of Acme has written advising their are interested in
seeing the start up of the suggested proposal and would like to
be advised of any meeting dates which may be set up and also
that they would be prepared to host a meeting if needed

5 Provincial Regulatory Review Process
6 AAMD & C Survey re Annual Elected Officials Symposium
The Association received a comment from one member questioning
the value of the annual Elected Official Symposium The
association would therefore like each municipality to comment on
the value of the symposium
Executive Committee recommend the Association be advised the lt��er
M D feel the symposium is an excellent program for new Scat
councillors and any councillor on an individual basis can decide
whether to attend or not based on the content of the agenda
7 AAMD & C - List of New Reqional School Divisions
The Association has prepared and forwarded a list of the new
regional school division areas.

General of P F R A Regina on August 24th Councillor Boake and

Miller and Dave Price were present P F R A is looking for
projects which will improve the quantity of water for the
residents of this area, particular in the south end of the M D

P F R A is going to review the idea and cost of bringing water
from the Dickson Dam into the Kneehill Creek as well as other
alternate ways to improve the supply of water for people and the
agriculture industry in this area The ratepayers indicated
the lack of qood quantity and quality of water was limiting the
future expansion of their livestock industries in this area
Executive Committee recommend to accept and file as information
at this time
10 Ken Stewart - Request for Tax Cancellation
Ken Stewart, owner of N W 31- 29 -22 -4 has requested the M D
cancel a portion of his 1994 taxes He previously was allowing
a commercial use on his property and was taxed accordingly
That use ceased in 1993 but he neglected to notify the M D
He has requested the M D cancel a portion of his 1994
taxes

11 Big Country Tourist Association - Membership Cost and fie} }erg
Appointment of Directors
Big Country Tourist Association has forwarded the M D a bill
for 1995 membership in their association The association is
changing their year end to August 31st The membership fee for
January to August of 1995 is $631 27
They have also divided the Big Country Tourist Zone into regions
and all regions will elect a president and two of the five
regions will elect a vice president to be responsible for that
region and sit on the Executive Those persons will work to
promote tourism in the Big Country area They are requesting
the M D consider nominating someone to run for election as
president of the association and someone to run as vice
president for the north west region of the zone
Nominations must be submitted prior to September 16th.
The Association also wish to know if the M D will put in an
advertisement in the 1995 Tourist Association Visitor's Guide
Cost would be $525 00 for an advertisement the same as in the
1994 guide

Executive Committee recommend the Marketing Manager Virginia gr,Rt
Haahr be requested to come to a meeting of council to advise
council about what benefits the M D obtains from its membership
in the association
12 Countryside Graphics - Gary Hepburn
Gary Hepburn would like to sell the M D entrance signs Cost
for the signs would be $50 00 per square foot plus the cost of
the art work

Executive Committee recommend Mr. Hepburn be advised the M D
recently erected M D entrance signs and due to costs is not
prepared to purchase new signs at this time lq'-

13. Freone Removal - Waste Disposal Sites
In order to remove old fridges and freezers, etc from the
rubble pit sites it is necessary to remove the freone
Earl McRae was contacted and he would be willing to undertake
removal of the freone at applicances at the Linden Rubble Site
at a cost of $25.00 per hour plus mileage at 40 cents a KM on a
trial basis Acme and Linden have indicated they will pay a one
third share of the costs M D will have to separate the piles
so he can get to the applicances, mark the units which have the
freone removed and re -pile them
Also should take more care in stockpiling them in future
Executive Committee recommend Earl McRae be
undertake removal of the freone from applicances

M D 15 copies of the directory at $100 00 per book They will
be printing extra copies and would be agreeable to leaving 10
copies in the office for re -sale at $135 00 The M D
previously agreed to provide seven fire departments and the 2
ambulance offices with copies and it was suggested should also
provide the 3 R C M P detachments with copies Two councillors
also wish to purchase their copies through the M D

additional books in the office for resale purposes
15 Three Hills School Division - 'JO
The Three Hills School Division advises an order in council has
been signed regionalizing Three Hills School Division with the
County of Wheatland school division They also have signed an
addendum to the original agreement to include the Drumheller
Valley School Division

17 Court of Revision - Appeal by Newell Smelski
John Mitchell of the firm of Newell Smelski together with Edward
Dunay, M D assessor entered the meeting There was a lengthy
discussion with Mr Mitchell and Mr Dunay about the blanket
appeal filed by Newell Smelski for the 10 oil companies they
represent Mr Mitchell presented a summary of the sites
which he feels should have received some assessment reduction at
Court of Revision The summary covered 2 sites for Atlantis
Resources, 8 sites for Battle Creek (Strike Energy) 2 for Czar
Resources, 1 for Jordon Petroleum 2 for Kerr McGee and 7 for
Tarragon Oil
This information however was not made available to the Court of
Revision or to Mr Dunay assessor prior to the Court of Revision
and his actual appeal to the Court of Revision was only received
on the day of the court sitting which was past the time for
filing an appeal The Court had agreed to accept the appeal
despite being past the time but Mr Dunay was unable to make any
recommendation to the court because he did not have any
information about which sites Mr Mitchell was appealing He
had filed a blanket appeal for all 10 companies he represents,
but did not provide the specific information required in order
for the court to make any decisions The court therefore
decided there would be no change in any of the assessments
because of the lack of information from the appellant
Mr Mitchell was advised by Mr Marz the time to file an appeal
with the Province has past He also noted because there were
no specifics given to the Court of Revision about the individual
sites being appealed, the only decision the M D court of
revision could make was no change
Mr Mitchell noted he did not receive an answer from the Court
of Revision It was mailed but apparently not received
A copy of the decision of the Court was mailed to him later
Mr Jeffery asked Mr Mitchell if he was aware of the 21 day
time to appeal after Court of Revision He also noted the M D
is trying to be fair, but alot of his requests are based on a
principle He asked if Mr Mitchell was asking for the M D to
allow him to appeal to the Provincial Assessment Appeal Board
and he indicated he was
Mr Marz noted the M D is trying to deal with oil companies on
a fair and equal basis using reasonable principles

Mr. Dunay noted no plant ever operates at total capacity and
does not agree plants should receive functional obsolescence
based on one s year production There are many reasons why a
plant would not produce to its total yearly capacity such as
shut down for repairs, loss of markets, or low market price,
lower production from the wells feeding into the plant, etc
Cannot grant obsolescence based on one year s production record
Machinery and equipment receive the normal depreciation, but
abnormal functional obsolescence based on one year's production
is not reasonable
Mr Mitchell indicated other areas allow for this obsolescence
Mr Dunay noted this has never been done in the M D and he was
not aware if other areas were allowing it
Mr Mitchell again noted he was asking for functional
obsolescence because the plants are not working at full
production
Mr. Dunay again indicated if production goes down over a 2 or 3
year period it perhaps could be looked at, but should not be
considered based on production for only one year Also if using
production should assess the plant at market value
Also noted plant assessment information is always one year
behind and in some years (such as a start up year) the plant
might be in full production but gain a tax benefit because of
lack of total assessment information
Mr. Mitchell noted he is requesting this type of obsolesecence
for Atlantis, Czar, Jordon, Kerr McGee and Tarragon plants
Mr Dunay noted if a plant is old (over 30 years old) it might
be considered for functional obsolescence, but these plants are
not old - some only 15 years old
There was lengthy discussion with Mr Mitchell regarding why the
companies had not requested this type of obsolescence in
previous years - why at this time
Mr Mitchell indicated he was only asking for what he was
getting in other areas. Agreed his timing was not good, but
some of the companies were only acquired as new clients early in
1994 and he was unable to get the request to the court of
revision in time

There was discussion about suspended wells and Mr Dunay noted
he had checked the sites and felt as long as the equipment was
hooked up to the well it is subject to assessment and taxation.
Mr Mitchell felt that concept went out 10 years ago
Mr Mitchell noted a suspended well is one that cannot be
produced. Normally a company will suspend a well because it
cannot produce enough to be viable The well would have to be
completely reworked before it could be put back into
production
Mr Dunay noted a well at 6- 6- 30 -24 -4 owned by Tarragon shows on
the report as being capped, but on inspection the well is
pumping He had personally inspected all the well sites
Tarragon also indicated a well at 2- 14- 29 -22 -4 was suspended,
but it is flowing

Mr Mitchell noted the government looks at the condition of the
well as of October 31st and determines its assessment as of that
date
Mr Dunay noted he could agree with some of the concerns raised
by Mr Mitchell, but not all, particularly the request for
functional obsolescence
Mr Marz noted there is some onus on the companies to advise the
M D when a well is shut in They should be aware of the
regulations and work with the M D. to ensure they are fairly
taxed
Mr Dunay noted he gets a list from the Province and at that
time reinspects all the wells and advises the province if he
disagrees with the status of the well If the well is not
operational it is given 50% obsolescence
Mr Mitchell suggested a well's current status should not affect
its assessment which was established 1 1/2 years ago
He also noted he was only asked for tax relief of about $40,000
for the companies
Mr. Dunay noted he did not feel this matter should go to the
appeal board this year Should re- inspect the sites and look at
the situation next year
Mr Mitchell suggested if the M D would agree in principle that
this idea of functional obsolescence should be looked at,
perhaps could look at an adjustment in 1995
Mr Jeffery suggested if Mr Dunay agreed which wells were in
fact suspended or capped, perhaps council could look at a
possible cancellation of taxes for 1994 and review the principle
of functional obsolescence in 1995
Mr Dunay indicated Council can reduce the taxes, he cannot make
any change in the assessment for 1994
Mr. Jeffery suggested to recommend to council to cancel those
portions of the taxes which Mr Dunay agrees were levied
incorrectly, but not deal with cancellation of taxes based on
the principle put forth by Mr Mitchell
There was discussion about having a supplementary assessment
by -law but generally agreed this would make a bad situation
worse
It was suggested should have Ken Shaw from the Provincial
Assessment Department and Mr Mitchell meet with council at a
later date to discuss the principle of functional obsolescence
Perhaps have Rene Kozack come as well
Mr Mitchell noted Battle Creek is being charged with 3 phase
separators and only have 2 phase separators Should receive a
20% reduction for these
Mr Dunay noted the separators are 3 phase and it is the
company's choice to use them as a 2 phase separator

Mr Mitchell noted he did not like to see the appeal process
done away with this year, but the dollars may not be sufficient
to pursue the appeal. However if clients wish to do so, he will
have to pursue the appeal process

Mr Mitchell and Mr. Dunay left the meeting at this time

Mr Dunay reinspected the sites in question in the afternoon of
September 8th and has recommended a tax cancellation for Battle
Creek, Tarragon and Kerr McGee As each site may have a
different mill rate he did not work out the actual amount of wo1
cancellation, but used an average mill rate and the estimated IG
tax reduction would be about $3500 00 It will be necessary to 8
work out the actual tax cancellation for each site if council
approve this recommendation
18 Aqq -con Industries - Supplier of Grader Blades
Agg -Con Industries have written a letter to all municipalities
involved with the AAMD & C The company had made application to
be a member of the Association Trade Division but was refused
The Association felt because they presently deal with 10
companies who offer the same type of supplies, and because
Agg -con is an eastern company and trade barriers prevent Alberta
companies from gaining access to markets in other Provinces, the
association should provide some protection to Alberta owned and
operated companies

Executive Committee recommend the Association be advised the S�h�
M D feel this company should be allowed to become a member of
the Trade Division of the Association as the M D does not
believe in the practice of protection of Alberta business to the
detriment of obtaining the best price available
19 Sharon Lamb - Swalwell Caretaker
Mrs Lamb lives in Swalwell She is presently cleaning up Allen
Kerns lots for him Has applied to the M D to be hired as
Swalwell caretaker It was noted the landowners were given
until September 30th to clean up their property After that
date the M.D will have to decide how they wish to proceed with
the clean up of the various private lots

Executive Committee recommend Mrs. Lamb be advised the M D
cannot make a decison on her request at this time, but she might
advise the M D what kind of equipment she has available to do t

20 Vernon Court - Subdivison of Lots in Swalwell - Block 2
Mr Court has applied to create 3 separate titles for his lots
in Swalwell - Lots 36 to 42 There is an existing house on Lots
40 and 41 The house is sitting right on the front property
line and the eaves extend over the M D street - Railway Avenue
Also there is no ditch along Railway Avenue and therefore there
are no approaches required to access the three parcels being
created Access is gained right off the street
Palliser Planing have requested the M D relax their setback
requirements from the street as the house is sitting right on
property line

Executive Committee recommend council agree to allow the setback 40
relaxation from 25 feet to 0 feet and the M D not require ✓
installation of culverts and approaches for the three parcels
being created
21. Road Bans
Alberta Transportation has now tested SR 837 and 841
They are suggesting a 90% ban on these roads as well as SR 838
and 100% for all other secondary roads
Executive Committee recommend the road bans be changed in
accordance with their recommendations
22 Richard Faulter Subdivision - Pt N E 13- 29 -21 -4
Mr Faulter has requested Council to reconsider their
requirement to widen and pave his approach to provide access to
the two parcels he is creating
Mr Cunningham inspected the approach and it appears it is 18
feet wide at property line and 60 feet wide as it enters SR 575
and the approach is paved
One option proposed by Mr Bunter, the surveyor for Mr Faulter,
was to move the boundary of the new parcel being created (with
the new house) over to the middle of the existing approach
This would provide a 9 foot legal access for both parcels which
likely would be sufficient for the traffic using the two sites

23 Comments from R D Kozack, Director of Regional
Industrial Assessment Branch
Mr Kozack prepared some comments regarding the changes to
provincial assessment department and a copy of these has 1
provided to municipalities Provincial staff has been greatly
reduced and the 25% rebate for general assessment costs will be
terminated January 1st, 1995 These changes would appear to be
just one more reduction in provision of service or funding
provided by the Province to municipalities
Mr Jeffery noted the M D of Kneehill & Starland would require
two full time assessors to do assessment work - Kneehill about 1
1/2 people and Starland about 1/2 to 2 /3rds of a person
Private companies are being set up by former provincial
assessors if they can obtain sufficient work to be economically
viable

Executive Committee recommend the office prepare a list of the SVt.rt-e4
money and or services which local governments no longer receive k\ti`
as a result of the Provincial Government's cutbacks as well as
the added responsibilities turned over to the local areas
24 Bridge File 6517 - N W 12- 31 -24 -4
Mr Jeffery reviewed a recap of this entire bridge file Bridge
Branch have asked the M D to close the road for a 3 month
period during replacement of the bridge If the road is left
open for one lane traffic it will extend the time for
construction and add over $100,000 to the costs

25 1994 Wage and Salry Agreements
Mr Jeffery reviewed with the Executive Committee proposed
changes to the 1994 wage agreement based on the previous motions
of council and changes necessary to clarify certain sections of

26 AAMD & C - Comments Requested re Environmental Protection
Act Changes
AAMD & C has been approached by Alberta Environmental Protection
requesting comments on two proposed changes to the provincial
regulatory requirements

One would remove the requirement to have subdivisions referred
to their department for comments Advice from their department
is advisory only - not compulstory
The other one would be allowing local governments to issue
reclamation certificates
The AAMD & C have prepared a brief survey and is requesting all

27 Assenheimer Engineering Ltd �'G'� ✓
Assenheimer Engineering has been hired by the Province as a
consultant with regard to bridge inspections They would like to
be hired by the M D to do our inspection work as well and would
do this wokr at a cost of $20,000 a year Mr Jeffery noted
Mr Kennedy does bridge inspections as well as being the signman
and various other jobs.
Executive Committee recommend this request be referred to the hGs
long term planning committee for further review
28 C P Rail Railway Crossings
C P Rail intend to upgrade three crossings - Acme, Linden and
Sunnyslope The Road master wishes to close SR 582 Wednesday
September 14th in order to replace the ties Two weeks later
will want to close the Linden Road
Mr Jeffery suggested C.P. Rail should be paying for the costs
of repairing or replacing any pavement which is disturbed as
they are the junior partner in connection with the 3 crossings
