Richard A Marz Division Four Councillors: Marylea Lowen , (after 8.40 A M ) Otto Hoff Robert E Boake James Hanger Richard M Vickery Glen Wagstaff Division One Division Two Division Three Division Five Division Six Division Seven John C Jeffery, Municipal Administrator Mrs. Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Reeve Marz called the meeting to order Mr Hoff moved approval of the agenda CARRIED PRESENT APPROVAL Mr Vickery moved approval of the May 24th council meeting APPROVAL minutes MINUTES CARRIED Mr Boake moved approval of the accounts submitted for APPROVAL payment today, subject to further review by the finance ACCOUNTS committee of R A Marz, Otto Hoff, Richard M Vickery and Glen Wagstaff CARRIED Mr Jeffery reviewed his report. Mr. Wagstaff moved to table Items 1 & 2 on Mr Jeffery s report until Mr Haskell is present and moved approval of the balance of Mr. Jeffery' s report CARRIED The Executive Committee report was reviewed and discussed Mrs Lowen entered the meeting at this time - 8:40 A M Mr Wagstaff moved he be excused from discussions and voting on Item #1 on the Executive Committee report due to a personal involvement. CARRIED Mr Wagstaff left the meeting at this time Mrs Jennifer Deak entered the meeting Mrs Deak reviewed the history of the claims which are being considered for discussion about these matters J C JEFFERY PFPnRT EXEC COMM (2FPnPT i W C B CLAIMS Mr Jeffery and APPEAL three compensation appeal There was Mr. Hanger moved the M D proceed with the appeal process J n in connection with the three compensation claims. rJvti5,u4 1 0 COUNCIL MEETING JUNE 14th, 1994 CARRIED Mr. Wagstaff returned to the meeting at this time Mrs. Deak left the meeting The balance of the executive committee report was reviewed and various items discussed. The request from a Seniors Outreach committee to rent office space in the M.D building was discussed at length Mr. Vickery moved the recommendation regarding rental of M D office space to the Three Hills Seniors Outreach Committee be approved but the rental charge be set at $400.00 per month CARRIED It was agreed council might look at negotiation of this figure with the Committee The new bridge being proposed by Bridge Branch for SR 582 at SSW 13- 31 -24 -4 was discussed. There was also discussion regarding the M D road bans on the Linden east and west roads It was suggested Mr Jeffery should find out what the cost would be to purchase a benkleman beam testing machine and also determine if other municipalities have their own road testing equipment Mr Jeffery noted there is a seminar in Calgary which is being put on by Brownlee Fryett on June 22nd There is no registration fee and the seminar will cover several items, including a discussion on what is included in the draft of the new Municipal Government Act Mr Wagstaff and Mr. Hanger indicated they would attend if possible Mr Jeffery is planning to attend The recommendation from the Executive Committee to bill Randy Pliva for the costs incurred as a result of the Drumheller Fire Department responding to a stubble fire on the Pliva farm was discussed It appears Mr. Pliva did not require the services of the fire department as it was a controlled stubble burn However he had not notifed the department of his intentions and someone else called the fire department, so they responded The cost was $430 00 Mrs Lowen moved Mr Pliva not be billed for these costs, but he be sent a letter advising of the costs incurred by the M D as a result of his failure to notify the department of his intention to undertake a controlled stubble burn CARRIED It was noted the practice of burning stubble without notifying the appropriate fire department will likely result in changes to the M D stubble burning by -law being considered by council. Mr Jeffery read a letter received from Mark Andrew of Drumheller Mr Andrew would like the M D to save him and Gulf Oil harmless from any damages or liability which may result from the removal of the texas gate on the M D road allowance west of his land, WSW 28- 29-21 -4 The background E M D OFFICE RENTAL sr- ((, eke"- sev\N BRIDGE SRS $ ROAD BANS Aer maw, j r LEGAL SEMINAR RANDY PLIVA FIRE It��er SPY\ + acct MARK ANDREW TEXAS GATE COUNCIL MEETING JUNE 14th, 1994 on this matter was discussed, particulary with regard to the lack of access for the public to the M D road allowance as a result of the texas gate and other fences erected by Mr. Andrew (or the previous land owner) it appears the texas gate was installed on M D road allowance without the appropriate authority from the M D Mr. Hanger moved Mr Andrews be advised the M.D is not prepared to save him or Gulf Oil harmless from any liability or damages which may occur as a result of removal of the texas gate, that he is to have the texas gate removed no later than July 31st, 1994 at his own expense, the road is to be returned to a reasonable and safe driving condition and left open and available for public access, and the condition of the road is to be inspected and approved by the M D public works superintendent once the gate has been removed CARRIED Mr Wagstaff moved Item #22 on the Executive Committee - disposal of surplus assets - be tabled and discussed with the Public Works Superintendent later today CARRIED The request for permission to plant trees at the Linden Transfer site and at the north end of the Torrington pit site was discussed. Mr Hoff noted there are some dead trees in the hamlet of Swalwell which also need to be replaced. Mr. Boake moved approval of the bank reconciliation statement. It will require a buggy, packer and other equipment to repair the holes and will take at least 2 days Mr. Wagstaff moved Mr Haskell be authorized to hire a contractor with the necessary equipment to repair the problem areas on the Tolman Hill or to make use of the M D. crews if time permits. CARRIED Mr Jeffery reviewed the Canada Alberta Infrastructure Program and noted he requires a motion to approve making a second application for the balance of the grant funds available The cost for the pavement overlay was estimated at $856,230 The M.D.' share is $285,410. and the support requested from the Province and the Federal Government was $570,820 which leaves a balance of grant funds available of $57,387 They require a second application to make use of these funds Mr Hoff moved the Administrator be authorized to sign a second accelerated application under the Canada /Alberta Infrastructure Program to make use of the remaining funds available to the M D under this program CARRIED 4 ..........: INSPECT ROAD 1�8, CI'- M DIRT F R WROACHES �a C --J ,-0 ROTO TILLEI RENTAL L \`e 1{� RAILWAY CROSSINGS TOLMAN HI CAN ALTA 7-C -:T- N 11 low, %W A COUNCIL MEETING JUNE 14th, 1994 Mr Jeffery reported the Carbon Access road from Highway 21 in to the Village of Carbon is now deemed by the Province to be a municipal responsibility Therefore this portion of SR 575 should be included in the M D. secondary road program In the past the Province has accepted responsibility for access roads into urban centers, but this appears to be changing Mr Boake moved a letter be sent to Rob 'Penny of Alberta Transportation in Red Deer requesting a determination of which of the towns and villages' access roads are considered to be the responsibility of the M D CARRIED There was discussion regarding the gravel access roads in the Town of Three Hills - on the west boundary of the town and the elevator road These roads are not in very good shape and should 'be maintained by the Town more often The road north of the Town of Trochu cemetery is also gravel and is very often in bad shape It was suggested the M D could maintain these roads for the towns on a charge basis Mr Hanger moved the Reeve be authorized to discuss this idea at the next Mayors and Reeve's meeting CARRIED Mr Jeffery reviewed a letter received from Alberta Transportation with regard to the M D secondary road program He also reviewed a report which he have prepared after consultation with Torchinsky Engineering The report outlines the cost and work required to up -grade and maintain the M D secondary roads over the next 15 years However this report does not include the Carbon access road from Highway 21 in to the Village It was suggested a committee should be looking at the report to determine how the road projects should be priorized and how much the M D can afford to spend each year in order to maintain the secondary road system Mr Wagstaff moved the road committee review this report as soon as possible and bring a recommendation back to council. CARRIED Mr Marz noted A. Frere's house was built close to the Three Hills Creek in N.E 30- 32 -24 -4 The creek banks are becoming unstable as a result of springs in the banks and it appears his house may be in danger Alberta Environment had looked at the problem in June of 1993 and given him two options, one of which would involve the M D Mr Frere believes the problem has occured as a result of work done further upstream on the creek Mr. Marz moved this matter be referred to the Road Committee and he be notified of the date the Road Committee plan to inspect the location with Mr Frere so he can be present CARRIED Mr Jeffery read a letter from the Town of Trochu regarding the Trochu waste disposal site and reviewed the agreement 5 CARBON AND OTHER ACCESS ROADS TO URBAN CENTERS GRAVEL ACCESS ROADS THREE HILL! TROCHU SEC ROAD PRIORITIES R Ccn— / C_ ►3 A FRERE CREEK BANK PROBLEM NE 30- 32 -24 -4 TROCHU WASTE DISPOSAL SITE COUNCIL MEETING JUNE 14th, 1994 which was arranged between the town and the M.D regarding use of the site It appears there was unrestricted access to the transfer box site allowed except for the times when their attendant was looking after the rubble site. The M D paid 50% of the wages for their rubble pit attendant for 1991, 1992 and 1993 - a total of $13,990 36 During that period, under the terms of the agreement, M D residents were not allowed to make use of the rubble pit, and the transfer box site was largely unsupervised There was discussion about the need to have the transfer boxes supervised when the site is open to the public Mr Marz moved a letter be sent to the Town of Trochu # 14 on the agenda - need for more signs requesting a refund of the $13,990 36 paid by the M D for at the intersection of SR 575 and SR 837 has been addressed supervision of the transfer site, as the Town did not in the road committee report comply with the terms of the agreement to provide site Mr Marz noted he supervision when it was open to the public, the agreement with the Town be 'changed to provide the transfer site will cU not be supervised and left open on a 24 hour a day basis, �,'� and the M D pay for half of the costs of supervision of �09e the rubble pit commencing April 1st, 1994 which is the date TORR REC the joint use agreement for both sites was signed the M D recreation committee is to CARRIED reserve the 1994 recreation It was noted Item # 14 on the agenda - need for more signs SR 575 INTERSECTION at the intersection of SR 575 and SR 837 has been addressed in the road committee report SIGNS c� Mr Marz noted he and Councillor Boake had met with the Torrington and District Recreation board recently to discuss the idea of disbanding the Torrington Recreation Board As a result of these discussions their TORR REC recommendation to the M D recreation committee is to BOARD reserve the 1994 recreation dollars (previously allotted to GRANT the Torrington and District Recreation Board) for Re�rrc� kb recreation uses within the Torrington and District le Recreation area Any group within that area may make Cc application to the M.D for a portion of these funds. The meeting recessed for dinner between 12.00 noon and 1 00 DINNER P M Alex Cunningham entered the meeting Mr. Jeffery and Councillor Hanger did not return to the meeting at this time. Mr Vickery moved council meeting do now recess in order to hold a public hearing scheduled for today at 1.00 P M PUBLIC CARRIED HEARING Mr Wagstaff moved council meeting do now reconvene, the public hearing having been completed. CARRIED Time 1.05 P.M. AMEND LAND USE The results of the public hearing were discussed The BY LAW proposed amendment to the land use by -law will allow for use of a form to more clearly define what is planned for any intensive livestock operation The form was drafted OWN .�. [It C COUNCIL MEETING JUNE 14th, 1994 by Alberta Agriculture and Alberta Environment and will allow them to determine what recommendations they should make in connection with any intensive livestock operation planned for this area Mr. Vickery moved first reading to by -law number 1311 this being a by -law to amend the M.D. land use by -law 1061 by deletion of Part VII General Land Use Regulations Section 46 Confinement of Livestock subsection (4) and replacing it with new paragraph 4 which will provide for Form F to be completed for intensive livestock developments. CARRIED Mrs Lowen moved second reading to this by -law CARRIED Mr Wagstaff moved third reading be given to this by -law at this time CARRIED UNANIMOUSLY Councillor Hanger returned to the meeting at this time 1.05 P.M. Mr Boake moved third reading to by -law 1311. CARRIED Mrs Wilkinson read a letter received from the Drumheller Hospital Board regarding the resignation of four members from their Foundation society as a result of their appointment to the new regional hospital board They felt there would a conflict of interest if they remained as a member of the society as well as being a member of the new regional board Councillor Hoff was one of the members who resigned and the hospital is therefore asking council to appoint a new member to sit on the Drumheller Hospital Foundation Board The foundation was formed to look after money which was raised locally to buy special equipment and items for the Drumheller Hospital Mr Hoff moved Marylea Lowen be appointed to sit on the Drumheller Hospital foundation society board as a representative from the M D of Kneehill CARRIED Reeve Marz on behalf of council extended congratulations to Councillor Hoff on his appointment to the Zone 5 regional hospital board. Mr Jeffery returned to the meeting at this time Mr Jeffery reviewed the plans formulated to date for the M.D anniversary celebrations and the letter drafted to send to former councillors and wives about the July 16th parade in Three Hills. The plans for the rest of the day were discussed. Should there be a luncheon for those taking part in the M D. entry in the parade? After discussion it was agreed for those taking part in the M D entry in the parade the M D would provide coffee and donuts prior to the parade, provide a light lunch for them in the M D office after the parade, (which will give former councillors and wives time to see the new of f ice and visit) Reeve Marz is to put a letter in 7 i BY LAW TT"— DRUM HOSPITAL FOUNDATION NEW MEMBER SPA CONGRATULATE OTTO i HOFF M D ! ANNIVERSARY CELEBRATION d r COUNCIL MEETING JUNE 14th, 1994 the Capital regarding the M.D anniversary tribute to present and past councillors, arrange for two wagons for the parade, one to have M D flags, the other to have two signs indicating 50 years of progress and service to the ratepayers of the area and the Mayors of the towns and villages be invited to the luncheon after the parade It was noted Carol Haley, M L A will be riding in the parade and there was discussion about inviting Stan Schumacher and the two M P Mr Thompson and Mr Ramsay No final decision was made about this suggestion Alex Cunningham and Gerald Haller entered the meeting this time Mrs Lowen moved council meeting recess in order to hold a public hearing scheduled for 2.00 today CARRIED Time 2.05 P M Mr Wagstaff moved council meeting do now reconvene, the public hearing having been completed There was discussion about redesignate the South East conservation to agriculture for a 60 acre subdivision. CARRIED the request from Mr. Haller to of 26- 33 -23 -4 from agriculture in order to allow him to apply Mr Vickery moved first reading to by -law 1312, this being a by -law to amend the land use by -law 1061 by redesignation of the S E 26- 33 -23 -4 from agriculture conservation to agriculture CARRIED Mr Hoff moved second reading to this by -law CARRIED Mrs Lowen moved third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Wagstaff moved third reading to this by -law CARRIED Antelope Land Services has requested permission from the M D to locate a wellsite in 10- 8- 29 -21 -4 over an existing road diversion which goes through the N E 8. This is necessary because the land falls away into coulees and the road goes through the only reasonably flat piece of land in that quarter This is where the company wish to drill a well They would keep the actual well off the road but the well site would encroach over the road diversion Mrs Lowen moved Northstar Energy Corporation be authorized to establish a well site in 10- 8- 29 -21 -4 in the location shown on their survey plan, which will overlap on to a portion of the road diversion as shown on Plan 1157 E Z on condition the company guarantee and agree in writing as follows: 1 the actual well and or any other equipment or 8 G HALLER REDESIGNATI N U 2F -11- BY LAW 1312 � j 1614 WELLSITE 10- 8 -29 -21 FNFRrY r_111� COUNCIL MEETING JUNE 14th, 1994 structures related to the well or production of will not be located on any portion of the road diversion 2 they understand the road diversion must be kept for public access and 3. the company agree it will not deny the public access through that portion of their well site which is located on the road diversion CARRIED same open Mrs Lowen reported the crack filling crew was working on the roads recently without suitable work clothing and shoes CRACK and also were not wearing the red and yellow warning safety FILLING vests Also there was only one sign on the road to advise CREW traffic of their presence on the road SAFETY CON Mr Hanger moved the Safety Committee investigate this CERNS report and discuss the safety work practices of the employees on this crew with the Public Works Superintendent and foreman of the crew as soon as possible. CARRIED The Road Committee report was reviewed and various items were discussed including the recommendation to add 4 miles of road from the Arthurville Community Association corner a west to the road construction program It was agreed ADD TO this recommendation should be - this project be looked at ANNUAL by the entire council during its next road tour rather than ROAD having it added to the existing road construction program TOUR The recommendation not to do the a blade grade project West of 5 & 8 in 34 -24 -4 project was also discussed It DELETE -"G appears the traffic using this road is insufficient to BLADE justify doing the blade grade and there are alternate GRADE access routes available W 5 & 8 34 -24 -4 Mr Vickery moved 'one time screeings" be applied to the 1 1/2 miles of road west of 5 and 8 in 34 -24 -4 PUT r�P CARRIED SCREENINGS ON INSTFAD The balance of the road report will be reviewed later es3 A delegation of 13 residents from the hamlet of Swalwell entered the meeting at this time John Hamm spoke on behalf of the residents and pointed out the general MEETING concerns the entire hamlet residents have regarding the WITH condition of the hamlet HAMLET RESIDENTS 1 Happy to have the water and sewer systems and roads 2 Council need to have some by -laws which are applicable �(,S to all hamlets 3 Not happy with the general overall look and condition of the hamlet. It is like a junk yard in some areas 4 There are abandoned buildings and abandoned vehicles and something should be done about them 5 There is alot of rubbish on some lots 6 Tall grass is a problem on the vacant lots 7. Trees which were removed when the sewer was put in have never been replaced 8 Should not be allowed to have outdoor toilets in the hamlet as there is a sewer system available 9 Have a concern about the safety of children in the hamlet - because of the junk and abandoned vehicles 0 fl,,,,� COUNCIL MEETING JUNE 14th, 1994 and abandoned buildings 10 The messy condition of the hamlet devalues the property of those who work hard to keep their property looking nice. 11 Very concerned about fire hazards because of the tall grass and abandoned buildings, etc Mr Hamm noted the residents of the hamlet are asking council to bring in some by law which will force people to clean up their property. He presented a copy of the by -law used by the Town of Three Hills He also noted residents are not pleased with the condition of two mobile homes which were moved into the hamlet recently They are old and not in very good condition The other residents then voiced their concerns to council- Karen Shierman - small unoccupied house next to my residence Cannot keep the children out of it and it is a safety concern Also this is a concern of the neighbors on the other side - Ken and Angela Enns House is not boarded up. They try to keep the grass mowed as the owner does not live in this area Cannot the house be condemned and removed? Kay Elliott - perhaps you need a by -law enforcement officer There should be a standard established for residences and trailers which can be moved into the hamlet Council should enforce the by -laws you have When the M D employees do grass cutting in the hamlet they should go right up to the property line where there are no buildings, not just make one pass down the side of the road Sharon Lamb - I have same concerns as Mrs Elliott The south end of the hamlet is a mess. Also I run a business and have no place to expand that business. There is no commercial section established in the hamlet Would like to see some rezoning to allow for commercial development Emma Lammle - property behind our residence - if the lot was levelled we would likely mow the grass and keep it tidy However that is impossible now as there are holes and the ground is so uneven Councillor Hoff advised the owner of this property, who lives in Victoria, has indicated she will pay to have the M D level her lot and reseed it That should eliminate one problem if they are willing to mow the grass Mrs. Lammle also asked to have another street light put up about half way down Alberta Avenue. There is only one light at each end of the street and it is quite dark in the middle of the street Strangers moving around the area and need more lighting Sharon DeLorme - I was promised the M D would remove an old outdoor toilet from my property three years ago and so far this has not been done. Reeve Marz explained the employees have no authority to remove articles from private property but if she would 10 IAI- 7 [A • 0 11 COUNCIL MEETING JUNE 14th, 1994 provide the M.D. will a letter of permission the removal could be arranged Austin Cottier - would like to see some general clean up in the hamlet If there is a concern about costs by the owners of these vacant properties, it would be to the M.D. 's advantage to do the clean up for them It would improve the look of the hamlet and likely increase the M D tax base Garth Olson - concern about the abandoned house next to his residence Bats are living in it - it is unsightly The alley needs to be bladed and gravelled Unhappy with the overall condition of the hamlet - areas needs to be cleaned up. Robert Penner - would like to see hamlet cleaned up and council should follow up on the complaints and concerns expressed here today Edith Penner - another concern is dogs running loose. Councillor Vickery noted council is not ignoring them, but the law does not allow them to do too much without the proper authority either from the landowner or the courts. Mr Cunningham noted mobile homes must be C S A approved so any trailer built from about 1971 would be approved for residential use in the M.D. including the hamlets. A mobile should be skirted and any addition should be sided with a material similar to the trailer Mrs Lammle noted the trailer which moved in recently is a mess. There was discussion regarding when a development permit must be advertised Also about someone who was living in a converted school bus Mr Hamm suggested the M D should force everyone to hook up to the sewer system and outdoor toilets not be allowed. The smell from these is not pleasant and have enough odour problems with feed lots and pig operations in the area He noted the people are trying to increase the M D tax base as well as improve the condition of their hamlet but 11 P'Y"I"I C COUNCIL MEETING JUNE 14th, 1994 they need help from the M D The trees should be replaced and absent landowners required to co- operate and ensure their lots are cleaned up Dogs can be a problem but their biggest concern is the safety for the children because of the abandoned vehicles and old buildings and fire hazard because of the tall grass There was discussion about the need to get a court order to go on to private property if the landowner is not agreeable to the clean up being done, costs for same, etc It was noted some long term residents as well as absent landowners may be offended if the litter by -law is strictly enforced It was agreed 30 days notice to clean up the lots should be adequate Council agreed to consider whether they could enforce the existing litter by -law and the first step would be providing the owners with a'30 day clean up notice They noted it may be necessary in some cases to spend money on legal fees in order to enforce compliance with the by -law It was noted the recent hamlet clean up day was successful and a considerable quantity of rubbish, etc , was removed by the M D crews Mrs. Lamb again asked about establishment of a commercial zone in the hamlet and she was advise to discuss any ideas she may have with Mr Cunningham. Mr Perrault noted he and likely others would be willing to help older residents with the clean up of their lots and removal of unwanted items Reeve Mar,z thanked everyone for coming and noted the council will be reviewing the situation and decide on what steps could be taken to enforce compliance with the by -law Mr Hamm thanked council on behalf of the delegation and they left the meeting Time' 4.00 P M Edward NcNair of Beiseker entered the meeting at this time MEETING to discuss the gravel royalty price for his gravel WITH ED He noted the M D is the only area which purchases gravel MCNAIR from him on a royalty or yard basis He also noted he recently declined an offer of 80 cents a yard The M D pays him 60 cents a yard and he receives $1 00 a tonne for GRAVEL most other customers and therefore would be subsidizing the ROYALTY M D by about 60 cents a yard if he sells any more at the PRICE price of 60 cents a yard n He discussed with council the fact that some of the gravel in his pit is under water and perhaps the M D could assist him with removal of this gravel as the M D has experience with removal of gravel from under water at the Torrington pit. Also suggested if Arjon comes in and crushes for the M. D. perhaps he could crush an additional 20,000 yards of 3/4 inch gravel for him at the same price He discussed with council the amount of gravel left in his pit and the fact there is quite a bit of sand in the gravel in some areas of the pit 12 1�q [A U C COUNCIL MEETING JUNE 14th, 1994 He indicated he can sell every yard of gravel from the pit at the price of $1 00 per tonne and suggested he would like $1 00 a yard from the M.D He noted the existing agreement with the M D is opened ended and he also has the right under the agreement to have two of his trucks hauling gravel for the M D when the M.D crew is hauling its crushed gravel from his pit There was further discussion about the gravel under water, how it could be removed, the costs which would be incurred to remove it and the enviromental rules which come into play when doing so. They will be crushing there in about 10 days and said we could look at the gravel then if we are interested 2 We have a grade which is starting to slide 1/2 mile south of the Mount Olive corner. When main crew is working near the corner we will take a buggy down And fix it up Likely will need a berm along bottom and culvert extension. 3 When we have to clean the slide area from S H.,837 we Ou- -TO have problems,breaking the edge of road away and C30j nearly getting stuck with loaders We were wondering t3uCke-► if we could get an old bucket for back hoe,-so we could use it as a shovel. 4.
