DEVELOPMENT APPEAL BOARD HEARING• 40 Development Appeal Board Hearing - Rod Wiebe - 4.00 P M 2 COUNCIL MEETING MAY 10th, 1994 A meeting of the Council of the Municipal District of Kneehill #48 was held in the Council Chambers, M D Office, Three Hills, Alberta, on Tuesday, May 10th, 1994 commencing at 8.00 A.M The following were present for the meeting Reeve. Richard A Marz Division Four Councillors. Marylea Lowen Division One Otto Hoff Division Two (after 8.10 A.M ) Robert E Boake Division Three Richard M Vickery Division Six Glen Wagstaff Division Seven John C Jeffery, Municipal Administrator Mrs. Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Reeve Marz called the meeting to order Mr Vickery moved approval of the agenda CARRIED Mr Jeffery noted a correction is required to the April 26th minutes On page 11 in the discussions regarding the backsloping borrow pit agreements arranged with Mr and Mrs Richard Marz, the request to rent the M D high hoe should read - Mr Marz had requested permission to rent the MD high hoe with an M.D operator to do three hours work for him at government rates. Mr Wagstaff noted the Swanson road project is not a blade grade project and the reference to blade grade should be deleted Mr Boake moved approval of the April 26th minutes subject to these corrections CARRIED Mr. Wagstaff moved approval of the accounts submitted for payment today, subject to further review by the finance committee of R A Marz, Otto Hoff, Marylea Lowen and Richard M Vickery CARRIED Mr. Jeffery reviewed his report There was discussion about the request from J & G Contracting to purchase fuel from the M D tank in Carbon A letter of agreement would be required from the contractor if the M D agreed to do this The request from the Linden Benevolent Society for gravel for their seniors' lodge in Linden was also discussed 1 y r� PRESENT APPROVAL AGENDA APPROVAL MINUTES APPROVAL ACC— OUNTS J C JEFFERY REPORT REQUEST FOR GRAVEL A. COUNCIL MEETING MAY 10th, 1994 Mr Vickery moved, if screeings would be suitable, the M D would haul 5 loads to the lodge site in Linden at no cost CARRIED The request from the Linden Fire Department for the M D to haul away a pile of dirt and cement from the vacant lot next to the Kneehill Ambulance building was discussed. The `.r volunteers have cleaned up the lot and the Ambulance Society arranged an agreement with the owner, Mrs Pearl Penner, to use the lot for parking purposes for a two year period in exchange for the lot clean up Mrs Lowen moved the Department be advised the M D is not able to do this work for them CARRIED Mr Jeffery noted he attended a meeting with the M D. of Starland and the M.D. of Badlands yesterday to discuss possible amalgamations and or shared services He indicated to the meeting the M D would be willing to discuss possible sharing of services with either area. Mr Boake noted the Village of Acme will be getting some paving done in the village and he has asked them to look at CW paving the apron at the M D shop and the corner of the road near the Acme cemetery There was further discussion about whether the M D should sell fuel to either of the contract grader operators Mr Vickery moved the M D would be willing to rent J & G Grading the new fuel tank which is not presently being used rather than selling fuel from the M D tanks �e�EPr CARRIED s +nf Mrs Lowen moved approval of Mr Jeffery s report. r CARRIED The Executive Committee report was reviewed and various items discussed The copy of the letter from the Village of Carbon to the Three Hills School Division regarding their wishes with regard to school division amalgamations was discussed at length The Village has indicated they feel the Three Hills School Division should amalgamate with the Wheatland School Division Mr Vickery moved the M D send a letter to the Three Hills School Division expressing the opinion, based on information received from various ratepayers, that the area approximately south of Highway 27 and east of Highway 21 should be amalgamated with the Drumheller or Wheatland school divisions, and the remainder of the Division should look at amalgamation with the County of Mountain View CARRIED Mr Marz reported that Councillor Boake is putting in an application for possible appointment to the new Regional Hospital board for Region 5 Mr Haskell entered the meeting at this time - 9.00 A M. 2 le LINDEN FIRE DEPARTMENT REQUESTi sir } v MEETING WITH BADLANDS PAVING APRON ACME SHOP ETC FUEL FOR CONT APPROV EXEC COMM REPORT SCHOOL I DIV AMAI f,AMATF r- Sm� R E BOAKE REG HOSPITAL BD 1 APPLICATION COUNCIL MEETING MAY 10th, 1994 It was agreed a copy of the M. The colony would like Mr Vickery moved to table this matter until later today CARRIED can be done Mr Jeffery noted Alberta Transportation has indicated they SR 583 will only pay for paving a 9 meter width on SR 583 as that pA ING is all that is required The road is being reconstructed with a wider top and therefore it would be M D cost to pave the extra width Mr Marz suggested the M D should try to meet with Mr Mot`n� Sawchuk of Alberta Transportation to further discuss this decision Mr Jeffery left the meeting to make a phone call at this Mrs Lowen noted the Gatine siding hill needs time Mr Haskell' s report was discussed Mr Haskell noted VALLEYVIEW ditch levels had been taken north and west of the Valleyview COLONY Colony. Water would flow to the north with a small amount DITCH of ditch cleaning north of the intersection However to the LEVELS south of the intersection the ditch is lower and would have to be filled in and the road culvert blocked off in order to force the water north It would require a buggy to to Cr�� �e�K fill the ditch area. The colony would like the M D do this work right away. The ditch cleaning can be done by a motor grader, but there is no time to do the buggy work �lG until fall. It was agreed the ditch cleaning could be done, the colony Mot`n� may close off the road culvert and the work required to fill in the ditch area be looked at this fall Mrs Lowen noted the Gatine siding hill needs grading DIV 1 There was discussion about the new contract grader operator CONTRACT and there has been concern expressed about a new operator GRADER who is not familiar with the hills or the grader working on the steep hills in that area Mr Haskell noted the owner of the company will be working in the area with his 3 K V COUNCIL MEETING MAY 10th, 1994 employee until the operators learns more about the grader, the area and how to grade the steep hills The operator is Mr Wagstaff moved third reading to this by -law CARRIED Mr Jeffery advised council about the vandalism which occured at Keivers Lake Park on the weekend Allan Mills has moved to the park but his duties as park attendant KEIVERS do not start until the May long weekend Mr Thomas has LAKE suggested Mr Mills be hired as attendant effective May 12th so there will be some control and hopefully the ATTENDANT vandalism will not be repeated AND VANDALISM Mrs Lowen moved the employment contract with Allan Mills RT -Do �� be approved effective May 12th, 1994 CARRIED 0 9 1 4 1 somewhat inexperienced Mr. Jeffery returned to the meeting at this time Mr Haskell noted he will be checking the grading work ® being done in Division 1 every day for the next while There was discussion about the policy regarding changing GRAVEL oil in the gravel trucks Policy indicates every 15,000 KM TRUCKS the trucks are to be brought to the shop for the oil change CHANGING so the mechanics can look for other problems which may be OIL arising The gravel foreman was changing oil on the job POLICY site in an attempt to cut down the operational costs for his crew It was agreed the foreman must adhere to the policy APPROVAL Mr Boake moved approval of the Public Works PWS Superintendent's report REPORT CARRIED Mr. Jeffery noted he has arranged a meeting with Mr Sawchuk in Edmonton on Thursday, May 12th, 1994 at 11 00 MEETING A M and is waiting for a call back from M L A Carol Haley EDMONTON ® WITH Mr Wagstaff moved Reeve Marz or an alternate and Mr TRANS Jeffery meet with Mr Sawchuk and if necessary with Carol DEPART Haley, M L A on Thursday CARRIED Mr Jeffery reviewed the proposed 1994 mill rate by -law and the draft 1994 budget The municipal mill rate will remain 1994 at 13 9 mills and the supplementary school mill rate will MILL be 9 585 There was lengthy discussion RATE BYLAW Mr Vickery moved first reading to by -law number 1306, this being a by -law to approve the 1994 budget and set the #1306 1994 mill rates. CARRIED Mrs. Lowen moved second reading to this by -law. The price ranges from $180 00 for an 8 20 foot sheet guaranteed for 5 years, to $330 00 foot by 83 foot sheet and the material would last or 3 years,to $102 00 for a 2 meter by 25 meter rc would last about a year matting MATTING foot by MATERIAL for a 7 PRICES about 2 11 which He noted the erosion problem on the St Anne Ranch Road has EROSION been corrected with rocks, but the time and cost to do this ST fob is not yet available The matting material would ANNE RANCH definetly help to keep erosion under control until the RD grass gets well started — It was suggested the cheaper material would help on a very steep grade or perhaps the use of flax bales held in place with a piece of rebar would be helpful Mr Hoff moved Mr Haskell be authorized to purchase some �'x\eA of the cheaper matting material and use it on one or two erosion problem areas to see how it works CARRIED STOCK PILE Mr Haskell noted he needs a stock pile of clean rocks at ROCKS least 10 inches in size to stop erosion around some of the bridges It was agreed to discuss this matter at the next meeting when more information is available as to where they may be obtained and price for same Alberta Transportation has requested a five year program outlining council's secondary road priorities There was FIVE YEAR lengthy discussion about this request PROGRAM SR ROADS Mr Vickery moved the following be the M D priorities for up- grading secondary roads for the next five years IeLrs �rt t 1994 - Up- grading SR 583 and paving SR 575 1995 - Resurface SR 575 from Acme to Highway 21 - Resurface SR 583 west of Three Hills 1996 - Resurface SR 841 and SR 583 from Three Hills east 1997 to 1999 - Upgrade and resurface SR 806 and 805 (Bridge South of Linden may need up- grading) 2000 - SR 587 from Highway 21 west 12 miles and SR 585 for safety reasons, may have to be addressed sometime in that time frame if the slumps on both sides of the river get worse CARRIED Mr Jeffery left the meeting to take a phone call - 10.35 A M GRAVEL Mr Haskell discussed with council crushing some chips at CRUSHING the Esau pit this year There is 4000 yards there now and 5 -- - _l= rr C :3 COUNCIL MEETING MAY 10th, 1994 should do another 5000 yards this year It was agreed 5000 yards be crushed this year Mr Haskell reported Arjon will crush up to 300,000 yards at the Torrington Pit for $1 80 a cubic yard for 3/4 inch gravel. He suggested should have some chips done there also as the Wimborne street, Buffalo Jump Park road and others in the area will require chipping next year. Will likely require at least 7500 yards Mr Jeffery return to the meeting 10.45 A M Mr Wagstaff moved Mr Haskell be authorizied to have an additional 7500 yards of chips done at the Torrington Pit this year CARRIED The fencing rates provided by Ben Armstrong Fencing and N & B Construction Services were discussed as well as the M D costs There was discussion about whether the M.D should be doing fencing work or should contract it out, or should the M D do custom fencing work for others It was agreed the M D costing figures should be looked at again in more detail It was also noted the fencing crew do a number of other jobs, such as patching pavement, etc Mr Hoff moved to accept and file this information CARRIED Mr Jeffery read a letter from Mrs Frank Kettenbach of Rockyford She asked the M D ensure the road allowance between the east half of 28 and west half of 27 both in 28 -21 -4 is not closed to public access. It was noted to date there has been no request to close this road allowance If a request was received it would require approval from council and public advertising before the road alowance could be closed either for sale or lease purposes. Gulf Canada has requested permission to put in an approach from 12- 9- 34 -26 -4 out on to SR 587 Mr Vickery moved permission be granted to Gulf Canada to install an approach on condition the location meets with M D sight distance requirements CARRIED Gulf Canada has requested permission to put in an approach from 12- 36- 30 -22 -4 on to SR 837 After review of the looation it was felt it would be best to have the approach going on to the gravel road north of the well site. Mr Vickery moved permission be denied for an approach from 12- 36- 30 -22 -4 on to SR 837 CARRIED Mr Jeffery reviewed with council some backsloping borrow pit agreements and a land buying agreement for the SR 583 road project which are over policy The agreements were with Oliver Parry, Dale Leslie, Gus and Violet Marz, W. Bender, 2 B Farming, Betty Ann Toews and Wilf Evans 6 c op FENCING RATE REPORT KETTENBACH CONCERN RE, ROAD ALLOWANCE PF tP r Sr n t ,• GULF APROACHES tevv"�- J�<--11( BACKSLOPING PIT AGREEMENTS ETC 5R--583 COUNCIL MEETING MAY 10th, 1994 Mr. Marz moved he be excused from discussion and voting on the G & V Maerz backsloping borrow pit agreement due to a family member involvement with this land CARRIED Mr Hoff took charge of the meeting and there was further T° discussion about the over policy agreements Vr Mr Vickery moved approval of the Gus and Violet Maerz backsloping borrow pit agreement CARRIED Mr. Wagstaff moved approval of the remaining backsloping borrow pit and land purchase agreements which are over policy. CARRIED Reeve Marz took charge of the meeting again at this time BRIDGE Mrs Lowen moved the report from Alberta Bridge Branch be BRANCH tabled to the next meeting of council. REPORT CARRIED There was discussion about whether the M D should hold GRAVEL gravel days again this year DAYS Mr Vickery moved the M D. hold gravel days as follows (L ".v- June 21st and 22nd at the Torrington Pit and June 23rd at faepy the Esau pit t-1 CARRIED TABLE Mr. Vickery moved Item #20 - Report from Councillor Hanger GORMAN regarding the Gorman Nakaska road project - be tabled to NAKASKA the next meeting of council ROAD CARRIED REPORT A resident of Huxley has asked if the MD will be providing a truck and loader again to help with spring clean up in SPRING the hamlet CLEAN UP There was lengthy discussion about this request DAYS Mr. Wagstaff moved on June 6th the M D provide a truck and HAMLETS a loader to pick up any refuse which has been placed at the ,"Xc),%ce front of any property in any hamlet, and a notice be published in the paper to advise the hamlet residents about �✓ the clean up day CARRIED Mr Haskell asked what price counil would set for a used USED culvert 10 feet long and 5 feet in diameter The price for CULVERT used culverts under 48 inches in diameter is $1 00 a foot, PRICES but the price for anything over that size must be set byai`� council. There was discussion about whether the price of $1 00 a foot for used culverts under 48 inches was reasonable. Mr Hoff moved Policy 13 -27 be amended to set the prices for used culverts as follows. For culverts 48 inches or less in diameter - the price per foot will be $1 00 times the diameter with the price to become effective January 1st, 1995. 7 z H �401 L J ■ COUNCIL MEETING MAY 10th, 1994 For culverts larger than 48 inches in diameter the price per foot will be $2 00 times the diameter with the price to be effective immediately CARRIED Lorne Reed from Alberta Road Management entered the meeting at this time and discussed with council the cost for the dust control program in front of residences and the cost to put dust control in front of residences on the SR 583 detour road. The cost for putting dust control in front of residences for individual ratepayers will be $1 00 per lineal foot and the cost for doing a full mile for the M D would be $3840 00 He noted Spec Crude is a maintainable oil and a surface application could be done at $1 00 a lineal foot if there was a blade available to cover the product with gravel after application Spec Crude is compactible with SB90 so ARM will be able to undertake the MD road dust control maintenance program LS2000 is a water soluable product but Spec Crude is not ARM is offering individuals the choice of LS2000 or Spec Crude but Spec Crude will require having a grader available to cover it If a group of people got together and wanted to do a full mile the price would likely be somewhat cheaper Mr Reed left the meeting at this time and the meeting adjourned for dinner Time 11.55 A M The meeting reconvened at 1.00 P M Frank Wesseling, Alex Cunningham and Paul Ehmann entered the meeting at this time. Mr. Boake moved council meeting recess in order to hold a public hearing scheduled for 1.00 P M CARRIED Mr Vickery moved Council meeting do now reconvene, the public hearing having been completed CARRIED Time 1.20 P.M. The proposed amendment to the M.D. land use by -law 1061 was discussed as well as the suggestions raised at the public hearing The proposed amendment was to remove a one family dwelling from the permitted use section in the Agriculture, Agriculture Conservation and Country Residental Districts and make them a discretionary use. This would allow the Municipal Planning Commission to impose conditions on one family dwellings which were proposed to be built within the 1 to 100 year flood plain. As a permitted use it is not possible to refuse development of a one family dwelling within the flood plain area. Mr Wesseling had suggested the amendment be revised to leave the one family residences as a permitted use in the three areas excepting those which may be developed within a certain distance of a river, stream or natural drainage course N. v 7 16 DUST CONT ARM vv�k yu DINNER PUBLIC HEARING AMENDMENT TO LAND USE BYLAW M COUNCIL MEETING MAY 10th, 1994 Mr Vickery moved first reading to by -law number 1307, this being a by -law to amend the land use by -law 1061 by making a one family dwelling a discretionary use in the Agriculture Conservation, Agriculture and Country Residential Districts CARRIED Mr Boake moved second reading to this by -law CARRIED There was further discussion about the suggestions raised be Mr Wesseling at the public hearing Mr Wagstaff moved third reading to by -law 1307 not be given at this time, the amending by -law be revised to incorporate the suggestions made by Mr Wesseling and the redrafted by -law be reviewed at the next meeting of council CARRIED Mr Jeffery noted an application for redesignation of a quarter section has been received from Gerald Haller He wishes to redesignate the S.E 26- 33 -23 -4 from agriculture conservation to agriculture in order to subdivide the land Mrs Lowen moved the public hearing be set for 2 00 P M June 14th, 1994 and notice of the hearing be circulated within a radius of 1 1/2 miles CARRIED There was lengthy discussion with Mr Ehmann and Mr. Cunningham regarding the M D safety policy and whether the draft safety manual has incorporated all existing M D safety policies Mrs. Lowen moved existing policies 7 -21 to 7 -25 be deleted and replaced with the draft safety policy manual CARRIED There was discussion about the need to appoint a safety co- ordinator for the M D of Kneehill Mr Boake moved the safety committee be authorized to appoint someone as the M D Safety Co- Ordinator CARRIED Mr Ehmann noted copies of the manual and pamphlets which be available for the employees shortly Mr Ehmann and Mr Cunningham left the meeting at this time - Time 1.30 P M. Mr Haskell noted Arjon will be moving out of the M D to do another job - it will take about 10 days and then will be back to finish the M D crushing contract Mr Vickery moved Arjon be allowed to undertake another crushing job before completing the rest of the M D crush CARRIED Mr Haskell asked for clarification as to how many dry approaches a landowner may have on his land After review of the policy and noting the landowner in question has a R1 BY LAW 1307 TABLE HALLER REDESIGNATE LAND PUBLIC } HEARING SAFETY MANUAL (01IC- k SAFETY ! CO ORDINATOR 0 \Px I ARJON CRUSHING DRY ROAD APROACHES I L a C A COUNCIL MEETING MAY 10th, 1994 number of approaches now, it was agreed it would be up to the land owner to install his own approach at his own cost at a location that would meet M D sight distance requirements Mrs. Lowen moved the M D authorize Mr Ward to install a WARD 4th approach into his land - S E 30- 31 -24 -4 - at his own ROAD cost - on condition the location meets M D sight distance APPROACH requirements kett"r n c CARRIED Mr Haskell noted Mr Bramley had replaced the radio in his grader as it was destroyed when the grader touched a power line which was hanging too low The cost for the new radio BRAMLEY was $60 9 3 is lost due to rain GRADER Mr Cunningham entered the meeting at this time. RADIO Mr Wagstaff moved Mr Bramley be refunded the cost for work on a replacing the radio in the M D grader day is lost due PAY WORK CARRIED CARRIED There was discussion about whether the M D. should be replacing a cattle pass for a landowner The landowner time. owns Part N.E. 35- 30 -26 -4 and the South East of 35- 30 -26 -4 CATTLE and uses the cattle passes in the M D road diversions to PASSES move his cattle back and forth between the pastures Should LEWIS the landowner be paying the costs for replacement and KLASSEN repair of the cattle passes? Mrs Lowen moved Mr Boake and Mr Haskell discuss the %' r matter with the landowner, Lewis Klassen, and bring a report back to council regarding what Mr Klassen would be prepared to do towards the cost of replacement and repair of the cattle pass structures. CARRIED Mr Haskell asked for permission for all crews to work a WORK Saturday at regular rates if a day is lost due to rain SAT Mr Cunningham entered the meeting at this time. Main Crew has finished work on Golf Course project and has moved to the Sec 583 We had to rent a D8N Cat for ripping pavement. Cost was $110.00 per hour plus moving time, we will need it again when we get to the east end of the job. 2 The shop has done some repair work on the Towns' traxcavator. We also had to haul it in from the golf course Our gravel trucks has hauled about 250 yards of gravel for the Town of Three Hills 3. Base Crew started working on #836 on May 3/94. The shoulders of the road are fairly wet. 4. We checked the ditch levels west and north of the Valley View Colony and the water will flow to the north with a small amount of ditch cleaning north of intersection But to the south the ditch is lower so it will have to be filled and culvert through road would have to be blocked off. 5 Arjon Construction is crushing in the Garson pit. Also their price for crushing at the Torrington Pit will not change due to the fact they will likely have to use an extra truck for stockpiling 6. Contract grader in Div 1 did a poor job on the first day on the job It had rained and was to wet plus he tried pulling to much in off the edges 7. It has been brought to my attention that Miles has started to change oil in the gravel trucks out at the gravel pits When I approached him about it he got very upset with me.
