DEVELOPMENT APPEAL BOARD HEARING• E )a4,`� L �1 COUNCIL MEETING APRIL 26th, 1994 A meeting of the Council of the Municipal District of Kneehill #48 was held in the Council Chambers, M D Office, Three Hills, Alberta, on Tuesday, April 26th, 1994 commencing at 8.00 A M The following were present for the meeting Reeve. Mrs Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Reeve Marz called the meeting to order Requests were made to add the following items to the agenda- 5C Fire at Trochu Waste Disposal Site Mr Vickery moved approval of the agenda with addition of the above noted item. CARRIED Mr Wagstaff moved approval of the minutes from the April 12th, 1994 meeting CARRIED Mrs Lowen moved approval of the accounts presented for payment today, subject to further review by the finance committee of Richard A Marz, Otto Hoff, Glen Wagstaff and Richard Vickery CARRIED Mr Jeffery's report was reviewed and various items discussed Mr. Boake moved that if an employee who plans to retire prior to December 31st, 1994, advises the Administrator prior to June 30th, 1994, the 5% rollback in wages will not be implemented CARRIED The request from the Trochu Elks for a donation of gravel for the Trochu Fairgrounds was discussed Mr Hoff moved the M D. donate a maximum of 50 yards of screenings from the Torrington Pit, on condition the club arrange to obtain the screenings when our crew is at the pit and they arrange for hauling the gravel 1 )11�� DDCCCWT ADD TO AGENDA APPROVAL AGENDA APPROVAL MINUTES APPROVAL ACCOUNTS J C JEFFERY REPORT RETIRING EM 5 ROLLBACK I DONATION GRAVEL TROCHU ELKS Memo 13,,d A 41w C A COUNCIL MEETING APRIL 26th, 1994 CARRIED APPROVAL Mr Hoff moved approval of Mr Jeffery's report v J C CARRIED JEFFERY REPORT The Executive Committee report was reviewed and discussed It was agreed a budget committee meeting be held on May EXEC COMM REPORT ' 6th, 1994 commencing at 9.00 A M if the information about the 1994 school requisition has been received from Alberta BUDGET Education MEETING The request from Alberta Transportation for the M D to consider spraying the primary highway rights of way ALTA for the Province was discussed There was some concern TRANS expressed about the rates Mr Thomas had indicated for SPRAYING the spray truck and the pilot vehicle which would be ROADS required p�To Mr Vickery moved Mr. Thomas check the uoted rates for the Cl� spray truck and the pilot vehicle and bring a report back to the next meeting of council CARRIED The recommendations from Alberta Bridge Branch on various BRIDGE bridges was briefly noted It was agreed each councillor BRANCH should review the report in detail and the matter be REPORT discussed at the next meeting of council Mr Boake moved the report from Bridge Branch and the recommendations from Executive Committee be tabled and the entire matter be discussed at the next meeting of council CARRIED Mr Wagstaff moved approval of the Executive Committee EXEC report with the exception of these items dealt with by COMM separate motion APPROVAL CARRIED Mr. Marz reported on a joint meeting which Lonnie McCook had with Oliver Parry, Wilf Evans and Bruce Toews last week regarding the need to purchase a rod of land for up- grading of SR 583 Mr Evans was not interested in selling his land for the price offered Mr. Parry also indicated he was not interested Bruce Toews considered the matter and agreed he would discuss the matter further with Mr. McCook later Mr. Marz then met with Mr Evans on Monday Mr Evans asked for $2000 00 an acre and noted he was trying to set a prescedent to bring the value of land up. Otherwise the M.D. would have to take him to arbitration The M D cannot arbitrate with regard to purchase of land, but has several choices including: 1 Pay what he is asking 2 Stop the project 3 Leave the 3 miles which involves Mr Evans and Mr. Parry's land as is and rebuiild the rest of the road 4. Expropriate the land required which is a very expensive and lengthy process 5 If possible purchase additional land on the other 2 ftlll'� JOINT MEETING RE SR 583 IN t• 0 a COUNCIL MEETING APRIL 26th, 1994 side of the road from Mr Evans' and Mr Parry's land, which likely would require moving the bridge Mr. Marz reported he will meet with Oliver and Brian Parry to discuss the matter further and see what price Mr Parry has set for his land It was noted most of the ratepayers concerned have agreed to sell the land and arranged backsloping borrow pit agreements Unfortunately the 3 miles which involve Mr Evans and Mr Parry's land is the worst 3 miles of the road Whether this stretch of road could be rebuilt within the existing road allowance and was discussed but it was suggested due to topography this might not be possible Mr. Boake moved to accept the report from Mr Marz, the M D not accept the counter offer from Wilf Evans of $2000 00 an acre, and Mr. Marz be authorized to continue to negotiate, in accordance with existing M D policy, with the land owners who have not yet signed CARRIED UNANIMOUSLY Mr Jeffery noted his report regarding the meeting with various provincial deputy ministers is quite extensive It was a very worthwhile meeting, he received some good information, and he would like the report to be reviewed by the Statute Review Committee Mr Wagstaff moved to refer this report to the Statute Review Committee CARRIED Mr Haskell entered the meeting at this time Mrs. Lowen moved council go in camera at this time CARRIED Time 9.05 A M Mr. Hanger moved council meeting resume, the in camera session having been completed CARRIED Time 9 50 A M METING WITH DEPUTY MINISTERS SGT— ✓ Mr. Wagstaff moved the fire committee of Robert E Boake and Marylea Lowen and one of R A Marz or Otto Hoff meet with the local fire chiefs and the Public Works Superintendent to work out a proper protocol for the M D to respond to disasters and or fire situations. ON13"As CARRIED my rno J Mr. Hanger moved R A Marz and Mr Haskell meet with Lawrence Hogg, Roy Enzie, Gary Adam and Lonnie McCook to discuss the incident which occured at the recent fire at the Trochu Waste Disposal Site CARRIED The meeting recessed for 10 minutes and reconvened at 10.00 A M 3 IN CAMERA SESSION FIRE COMMITTEE MEETING PROTOCOL RE, FIRES 8 COUNCIL MEETING APRIL 26th, 1994 Doug Hazelton entered the meeting at this time and reviewed with council a new machine for doing crack filling and filling pot holes on paved roads He showed a video about the machine and discussed the concept with council. The cost for a 5000 pound hopper machine is $131,000 and for a 2500 pound hopper machine is $118,000. The machine can be used for either hot or cold mix He also showed a video about a machine called Roto Grind which can be used to grind up garbage or used tires Use of this type of a machine can reduce the volume of waste being buried in landfill sites Cost of this machine is $160,000 U S funds He left a copy of the brochures for the information of council Mr. Hazelton asked if the M D intend to take pit run from his gravel pit this year Mr Marz noted the M.D. is presently pumping water from the pit area in order to expose the pit run and the crusher will be removing the pit run starting at the south end and working north towards the pumps The M D intend to remove about 300,000 yards of pit run from the Hutterian Brethren, Hazelton and M.D. pit areas this year once the water level has been lowered sufficient to get the pit run NEW TYPES MACHINES DOUG HAZELTON GRAVEL TORRINGT There was discussion about whether Mr Hazelton would be interested in selling the M D his land once all the gravel has been removed and he indicated he likely would be interested in discussing the idea 3U Mr Hazelton was thanked for coming and he left the meeting Mr Hoff moved the brochures about the crackfilling machine and the roto grind machine be referred to the Capital and Budget Committees for their consideration. CARRIED The rates quoted by Ben Armstrong and N & B Construction for contract fencing were discussed. Mr. Boake moved to table this information, Mr Haskell obtain some clarification on the quoted prices and also obtain information about the M D costs for fencing and bring a report back to a later meeting of council CARRIED Mr Jeffery reported a company called Perras Enterprises would for a price attempt to locate gravel in the M D The method used is similar to what was done by another company some years ago Mr Hoff moved to accept and file as information CARRIED There was discusson about the Isaac low level crossing at ENE 17- 30 -25 -4 The blade grade coming in from the south has been completed and the school bus can pick up the children by using that road and does not need to cross the low level crossing Does Council wish the crossing to be removed at this time There was discussion about the crossing repairs and the condition of the crossing and whether it is safe to use or not 4 )r FENCING RATES C 13 3�-kA � memo PERRAS I ENTERPRISES GRAVEL i SEARCH �-, i (- � ,,' I ISAAC LOW LEVEL CROSSING :q COUNCIL MEETING APRIL 26th, 1994 Mr Hanger moved the School Division be advised the school bus should make use of the road which comes in from the south to pick up any children in that area, the low level crossing be left in place until such time as it deteriorates and becomes impassable and it be removed at Gov , that time CARRIED Mr. Boake moved to table Item #10 on the agenda - paving the apron in front of the Acme Shop - pending receipt of information about paving which may be done by the Village of Acme this summer CARRIED ✓ (,,J j There was discussion about the road K between 2 & 3 in 35 -24 -4 near Alex Swanson's residence Mr Wagstaff felt the road should be lifted and widened through the slough area and the culvert extended A buggy should be able to do that work in the fall when the water level is low It will not be possible to drain the slough area Mr Wagstaff moved the grade be raised and the culvert extended in front of Alex Swanson' residence ( a distance of about 300 feet) at the same time as the McRae project is undertaken this fall CARRIED Mr. Jeffery read a copy of a letter sent by the M D. insurance adjusters to Randy Kennedy in connection with his claim for compensation for damages to his basement The insurance adjusters advised Mr Kennedy the M.D. is not not responsible for the damage done to his basement and his claim cannot be accepted Mr Hanger moved to accept and file as information CARRIED Mr Jeffery reviewed Mr. Haskell's report Arjon Construction will provide a price for baling out 200,000 yards of pit run gravel at the Torrington pit once the water has been pumped out Mr Haskell has recommended selling the oldest of the Fort Garry center dump gravel trailers Mr Vickery moved the M.D. put the oldest center dump trailer on the Fort Garry lot in Calgary on consignment at a price of $10,500 00 Mr Hanger moved an amendment to the above motion as follows the price be changed to $13,000 00 A vote was taken on the amendment and was DECLARED LOST. GRADER Mr Haskell reported Gary Ensminger has requested permission OPERATORS to work from 5 00 A M to 5-00 P . M - 12 hours Also that 12 Robert Gundlach and Gary Ensminger will be taking Fridays HOUR DAYSI off while they are working the 12 hour days Robert ETC Gundlach will start working 12 hour days April 25th and matting to stop the erosion in Gary will likely start working 12 hour days May 1st T\n,�-e At this time they are the only two grader operators who �dv�scc� wish to work 12 hour days. There was discussion about whether the M D should be to stop ditch spraying round up this year on the sides of the gravel SPRAYING roads to try to keep the grass under control Some of the ROUND UP divisional operators do not feel it is necessary. GRAVEL Mrs Lowen moved Round Up may be used to spray the road ROADS sides up to approximately 50 miles per division CARRIED Mr Haskell noted the Canning stock pile site will be CANNING reclaimed this year What does council wish to do with the STOCK reject material on this site. PILE SITE Mrs. Lowen moved the M D advertise in the M D news WASTE section that the material at the Cannings stock pile site MATERIAL on SR 836 may be taken by the local farmers at no cost, on a first come first service basis, on condition they loads s?n� the material themselves C C• ?1 C CARRIED ' 10 v There was discussion about the ditch erosion problems which has been experienced in the last few years. Mr Haskell DITCH noted the ditches along SR 841 are badly eroded and EROSION wondered if the M D. should look at using some sort of PROBLEMS matting to stop the erosion in the ditches Mr. Wagstaff moved Mr Haskell obtain a price for matting material which could be used to stop ditch erosion and — bring a report to council at a later date CARRIED There was discussion about the gravel crushing contract for GRAVEL this year CRUSHING ARJON Mr Vickery moved the M D authorize crushing 5000 yards of 5/8 inch chips at the Esau Pit subject to negotiation of a reasonable price from Arjon Contractors v CARRIED Mr Haskell advised the Horseshoe Canyon, Alex Lowen, e"O Watts, Arthurville and Cannings stock pile sites will not ���an° CANCEL be required after this year The sites will be reclaimed ° ' STOCK PILI this summer and the owners should be advised the agreements (33� SITE are to be cancelled as of December 31st, 1994 tee'" AGREEMENT' Mr Haskell also reported the Hutterian Brethren of Valleyview would not sign a gravel lease with the M D on the N E 20- 32 -26 -4 Mr. Wagstaff moved approval of Mr C Haskell's report CARRIED /41-- GRAVEL LEASE VALLEY VIEW COLONY N [A COUNCIL MEETING APRIL 26th, 1994 Mr. Haskell noted the St Anne Ranch road is eroding again ST ANNE and it may be necessary to put some matting material in the RANCH R0/ ditch area on this road to stop the erosion �3 Mr Vickery moved to table this matter until a price is obtained for the matting material which can be used to stop erosion in the ditch areas CARRIED Mr Haskell noted he will require rocks for various locations to stop erosion around some bridges There ROCKS is a company in Drumheller which will provide and deliver (3 FOR graded rocks. It was agreed this matter will have to be 2, BRIDGE discussed at the next meeting"° LOCATIONS The tenders for contract grading in Division One were opened and reviewed Tenders were received from J & G Grading $57 27 per hour, Robert Cranston $60 00 an hour, GRADER Len's Trucking $63 00 an hour, Ken Busby $63 60 an hour, CONTRACT Ketron Construction $65 00 an hour and $69 00 an hour with DIV 1 wing or ripper, Scorpion Contractors $65 00 an hour, Aldale Construction $66 00 an hour. �3u� Mr. Hanger moved Mr Haskell review the bids received and bring a recommendation back to council later today CARRIED Mr Jeffery opened the fuel bids. Bids were received FUEL from Petro Can, Federated Co -Op, Esso, U F A BIDS Mr Boake moved Mr. Haskell review the bids received and bring a recommendation back to council later today ROAD Mr Vickery moved the bans on the M D. gravel roads be BANS removed, with the exception of SR 836 from SR 583 south to 5R 575 CARRIED 'A`a Mrs Lowen moved the bans on SR 583 from Three Hills west to the intersection with SR 806 be removed, and further 3ur'M moved the bans on other secondary and light coat surface roads be 90% CARRIED The meeting recessed for dinner between 11:55 A M and 1 00 DINNER P M r Mr Haskell did not return to the meeting when it reconvened at 1.00 P M Mr Jeffery reviewed a letter received from the Kneehill Community Resource Board. The agreement to operate the KNEEHILL program expired March 31st, 1994 The board is asking the COMM municipalities to continue to operate the program without a RESOURCE formal agreement until December 31st and the board will BOARD discuss with the participating members a more long term committment to the program in September or October Mrs Wilkinson reported Wanda Moar, the resource worker for the Acme, Carbon, Linden area has resigned effective July 31st The board has agreed to advertise for a replacement to start August 1st, 1994 E II 7 �vr RESIGNATION WANDA MOAR r L 11 APPK *r► M COUNCIL MEETING APRIL 26th, 1994 Mr. Jeffery reviewed the letter received from Alberta Municipal Affairs regarding provincial funding for the FCSS program The money is now received as part of the Unconditional Municipal grant The M D will receive $87,769 for the FCSS program in 1994. It appears the unconditional municipal grant will be cut in 1995/96 and again in 1996/97 and will be reduced by more than 5% in total The FCSS money can be received either conditionally or unconditionally He reviewed what would happen if the M D took the grant conditionally If the money is received unconditionally the M D has flexibility in how these funds may be used Mr Wagstaff moved the M D. accept the FCSS component of the Municipal Assistance Grant on an unconditional basis CARRIED Mr Vickery moved to accept the letter from the Kneehill Community Resource Board regarding continuation of the program until December 31st, 1994 CARRIED There was some concern expressed about the decision of the Kneehill Community Resource board to advertise for a replacement worker without the M D. of Kneehill and the Town of Three Hills being represented at the board meeting Mr. Jeffery reviewed a letter received from CMHC regarding reinstatement of their RRAP program They wish to know if the M D will continue to participate and allow Mr Cunningham to deliver the RRAP program in the area There was discussion regarding the program and its value Mr. Hanger moved the Reeve and Municipal Administrator be authorized to sign the agreement with C M H C. on behalf of the M D CARRIED Mr. Hanger moved to table discusison about the proposed joint planning process with Starland, Badlands and the City of Drumheller pending receipt of more information CARRIED Mr. Hanger moved to registration fees for courses for Lisa Paget policy regarding staff :S w FUNDING CMHC RRAP PROGRAM PIG_ Alc-x }v rt � JOINT PLANNING TABLED table discussing payment of the TRAINING the Local Government Certificate COURSES pending review of the existing M D TABLED training courses CARRIED Mr Jeffery noted By -law #1277 which was passed in 1993,provides for payment of the sum of $10,436 00 to the Village of Torrington in 1994 after their 1993 recreationfinancial statement has been received As the Village as phased out their recreation board, an amendment to this by -law is required Mr Wagstaff moved first reading to by -law 1305, this being BY LAW 12i 7 AMENDMENT' ra H IL COUNCIL MEETING APRIL 26th, 1994 a by -law to amend by -law 1277, by deleting any reference to payment of the sum of $10,436.00 to the Village of Torrington, and changing the total to $67,339 00 CARRIED Mr Vickery moved second reading to this by -law CARRIED Mrs Lowen moved third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Hoff moved third reading to this by -law CARRIED Mr Hanger moved the recreation committee be authorized to make a decision on the disposition of the $10,436 00 to any or various community organizations or urban centers in the M D of Kneehill. CARRIED Mr. Jeffery noted the AAMD & C has identified a number of concerns with regard to the recommendations made by the Provincial Tax Reform Commission The association would like input from the individual municipal councils about these concerns by May 11th, 1994 BY LAW 13-0-5— AUTHORITY RE, EXCESS REC FUNDS PROV TAX i REFORM rnMMTgCTnN Mr Vickery moved to refer this matter to the Executive REPORT Committee to make a recommendation to council s CARRIED The Town of Three Hills has written regarding the increase in their cost to provide R.C.M.P. service to the town and area The town council has suggested the municipalities POLICE in this area which do not contribute towards the cost of SERVICES police service allocate a portion or all of the fines they FINES receive from the Province for traffic infractions which ETC occur in their areas There was discussion about this issue and the fact the M D contributes to the Kneehill TOWN Ambulance Service and the Golden Hills Lodge on the basis THREE of equalized assessment and not population HILLS These services are people based services and perhaps should be paid for on a population basis. The equalized assessment base requires the M D to contribute between 75 and 80 percent of the Kneehill Ambulance and Golden Hills requisitions Mr Vickery moved a letter be sent to the Town of Three eV,e� Hills indicating the M D would negotiate with the town TOWN with a view to allocating a portion of the M D fines new and the old agreement indicated received from the Province to the town to assist with the keep the site open a specific number of days costs of police service, on condition the town agree to DISPOSAL support the M D in their attempt to move from using SITE equalized assessment figures to a population basis for calculation of any applicable local requisition shares CARRIED Mr Jeffery reviewed the agreement recently arranged with the Town of Trochu for joint use of the Trochu Waste TOWN Disposal site The new and the old agreement indicated TROCHU the town would keep the site open a specific number of days WASTE each week and the site would be supervised when it is open DISPOSAL to the public It appears the town has never provided SITE AGREEMENT 9 X�v 14 r� qV COUNCIL MEETING APRIL 26th, 1994 supervision for the transfer boxes, only for the rubble pit area The transfer boxes are open 24 hours a day. However the town had been charging the M.D for half of the wages for the attendant looking after the rubble pit even thought the M D ratepayers were not able to use the rubble pit until the new agreement was arranged this spring Mr Vickery moved no further money be paid to the Town of Trochu until this issue is resolved, the previous agreement be checked, the amount of money paid by the M D. towards the attendant's wages be determined and Mr Boake and Mr Jeffery discuss the entire matter with the Town at one of their council meetings CARRIED Mr Jeffery reminded the councillors about the meeting with Minister Steve West and Carol Haley, M L A on Friday, April 29th commencing at 11.00 A M Mr. Jeffery noted AAMD & C has forwarded a copy of the responses from the Province in connection with the rte, -.� �--,�e b= -At Spring Convention ✓ „ �� 5-k P�5k4-e-1 Mr Hoff moved to accept and file as information. Reeve and Administrator be authorized to sign the lease A agreement for the South half of SE 16- 32 -26 -4 on behalf of the M.D. CARRIED L �`" The need to construct a blade grade road West of 5 & 8 in 34 -24 -4 was discussed It appears council had during their 1993 annual road tour questioned the need for upgrading the BLADE road due to the limited use and the costs which would be GRADE involved The need for the road was to be discussed by the W 5 & 8 local councillor at his divisional meeting this spring IN 34 -24 However this was not done Some of the councillors felt it the location should be reviewed again by the road committee before deciding to rebuild the road Mr Hoff moved the blade grade road West of 5 & 8 in 34 -24 -4 not be constructed, the road committee inspect the road again and bring a report back to a later meeting of 12 fil,41� M w council. COUNCIL MEETING APRIL 26th, 1994 CARRIED Mr Wagstaff noted Larry Bevel asked if the M D. would provide him with a key to the Huxley water well shed This would allow him to get into the shed to turn on the system rather than paying for water using loonies.
