COUNCIL MEETING APRIL 26th, 1994
A meeting of the Council of the Municipal District of
Kneehill #48 was held in the Council Chambers, M D Office,
Three Hills, Alberta, on Tuesday, April 26th, 1994
commencing at 8.00 A M
The following were present for the meeting

Reeve Marz called the meeting to order
Requests were made to add the following items to the agenda-

Mr Vickery moved approval of the agenda with addition of
the above noted item.

Mr Wagstaff moved approval of the minutes from the April
12th, 1994 meeting

Mrs Lowen moved approval of the accounts presented for
payment today, subject to further review by the finance
committee of Richard A Marz, Otto Hoff, Glen Wagstaff
and Richard Vickery

Mr Jeffery's report was reviewed and various items
discussed
Mr. Boake moved that if an employee who plans to retire
prior to December 31st, 1994, advises the Administrator
prior to June 30th, 1994, the 5% rollback in wages will
not be implemented

The request from the Trochu Elks for a donation of gravel
for the Trochu Fairgrounds was discussed
Mr Hoff moved the M D. donate a maximum of 50 yards of
screenings from the Torrington Pit, on condition the club
arrange to obtain the screenings when our crew is at the
pit and they arrange for hauling the gravel

The recommendations from Alberta Bridge Branch on various BRIDGE

Mr Boake moved the report from Bridge Branch and the
recommendations from Executive Committee be tabled and the
entire matter be discussed at the next meeting of council

Mr Wagstaff moved approval of the Executive Committee EXEC
report with the exception of these items dealt with by COMM

Mr. Marz reported on a joint meeting which Lonnie McCook
had with Oliver Parry, Wilf Evans and Bruce Toews last
week regarding the need to purchase a rod of land for
up- grading of SR 583 Mr Evans was not interested in
selling his land for the price offered Mr. Parry also
indicated he was not interested
Bruce Toews considered the matter and agreed he would
discuss the matter further with Mr. McCook later
Mr. Marz then met with Mr Evans on Monday Mr Evans asked
for $2000 00 an acre and noted he was trying to set a
prescedent to bring the value of land up. Otherwise the
M.D. would have to take him to arbitration
The M D cannot arbitrate with regard to purchase of land,
but has several choices including:
1 Pay what he is asking
2 Stop the project
3 Leave the 3 miles which involves Mr Evans and Mr.
Parry's land as is and rebuiild the rest of the road
4. Expropriate the land required which is a very expensive
and lengthy process
5 If possible purchase additional land on the other

side of the road from Mr Evans' and Mr Parry's
land, which likely would require moving the bridge
Mr. Marz reported he will meet with Oliver and Brian Parry
to discuss the matter further and see what price Mr Parry
has set for his land
It was noted most of the ratepayers concerned have agreed
to sell the land and arranged backsloping borrow pit
agreements Unfortunately the 3 miles which involve Mr
Evans and Mr Parry's land is the worst 3 miles of the
road
Whether this stretch of road could be rebuilt within the
existing road allowance and was discussed but it was
suggested due to topography this might not be possible
Mr. Boake moved to accept the report from Mr Marz, the
M D not accept the counter offer from Wilf Evans of
$2000 00 an acre, and Mr. Marz be authorized to continue to
negotiate, in accordance with existing M D policy, with
the land owners who have not yet signed

Mr Jeffery noted his report regarding the meeting with
various provincial deputy ministers is quite extensive It
was a very worthwhile meeting, he received some good
information, and he would like the report to be reviewed by
the Statute Review Committee
Mr Wagstaff moved to refer this report to the Statute
Review Committee

and Marylea Lowen and one of R A Marz or Otto Hoff meet
with the local fire chiefs and the Public Works
Superintendent to work out a proper protocol for the M D
to respond to disasters and or fire situations. ON13"As

Mr. Hanger moved R A Marz and Mr Haskell meet with
Lawrence Hogg, Roy Enzie, Gary Adam and Lonnie McCook to
discuss the incident which occured at the recent fire at
the Trochu Waste Disposal Site

Doug Hazelton entered the meeting at this time and reviewed
with council a new machine for doing crack filling and
filling pot holes on paved roads He showed a video about
the machine and discussed the concept with council. The
cost for a 5000 pound hopper machine is $131,000 and for a
2500 pound hopper machine is $118,000.
The machine can be used for either hot or cold mix
He also showed a video about a machine called Roto Grind
which can be used to grind up garbage or used tires Use of
this type of a machine can reduce the volume of waste being
buried in landfill sites Cost of this machine is $160,000
U S funds He left a copy of the brochures for the
information of council
Mr. Hazelton asked if the M D intend to take pit run from
his gravel pit this year
Mr Marz noted the M.D. is presently pumping water from the
pit area in order to expose the pit run and the crusher
will be removing the pit run starting at the south end and
working north towards the pumps The M D intend to
remove about 300,000 yards of pit run from the Hutterian
Brethren, Hazelton and M.D. pit areas this year once the
water level has been lowered sufficient to get the pit run

There was discussion about whether Mr Hazelton would be
interested in selling the M D his land once all the gravel
has been removed and he indicated he likely would be
interested in discussing the idea 3U
Mr Hazelton was thanked for coming and he left the meeting
Mr Hoff moved the brochures about the crackfilling machine
and the roto grind machine be referred to the Capital and
Budget Committees for their consideration.

The rates quoted by Ben Armstrong and N & B Construction for
contract fencing were discussed.
Mr. Boake moved to table this information, Mr Haskell
obtain some clarification on the quoted prices and also
obtain information about the M D costs for fencing and
bring a report back to a later meeting of council

Mr Jeffery reported a company called Perras Enterprises
would for a price attempt to locate gravel in the M D
The method used is similar to what was done by another
company some years ago
Mr Hoff moved to accept and file as information

There was discusson about the Isaac low level crossing at
ENE 17- 30 -25 -4 The blade grade coming in from the south
has been completed and the school bus can pick up the
children by using that road and does not need to cross the
low level crossing Does Council wish the crossing to be
removed at this time There was discussion about the
crossing repairs and the condition of the crossing and
whether it is safe to use or not

Mr Hanger moved the School Division be advised the school
bus should make use of the road which comes in from the
south to pick up any children in that area, the low level
crossing be left in place until such time as it
deteriorates and becomes impassable and it be removed at Gov ,

Mr. Boake moved to table Item #10 on the agenda - paving
the apron in front of the Acme Shop - pending receipt of
information about paving which may be done by the Village
of Acme this summer

K between 2 & 3 in 35 -24 -4 near Alex Swanson's residence
Mr Wagstaff felt the road should be lifted and widened
through the slough area and the culvert extended A buggy
should be able to do that work in the fall when the water
level is low It will not be possible to drain the slough
area
Mr Wagstaff moved the grade be raised and the culvert
extended in front of Alex Swanson' residence ( a distance
of about 300 feet) at the same time as the McRae project is
undertaken this fall

Mr. Jeffery read a copy of a letter sent by the M D.
insurance adjusters to Randy Kennedy in connection with his
claim for compensation for damages to his basement The
insurance adjusters advised Mr Kennedy the M.D. is not not
responsible for the damage done to his basement and his
claim cannot be accepted
Mr Hanger moved to accept and file as information

Mr Jeffery reviewed Mr. Haskell's report Arjon
Construction will provide a price for baling out 200,000
yards of pit run gravel at the Torrington pit once the
water has been pumped out
Mr Haskell has recommended selling the oldest of the Fort
Garry center dump gravel trailers
Mr Vickery moved the M.D. put the oldest center dump
trailer on the Fort Garry lot in Calgary on consignment
at a price of $10,500 00
Mr Hanger moved an amendment to the above motion as follows
the price be changed to $13,000 00
A vote was taken on the amendment and was DECLARED LOST.
Mrs. Lowen moved an amendment to the original motion to set
the consignment price at $11,500

has been experienced in the last few years.

Mr. Haskell noted the St Anne Ranch road is eroding again ST ANNE
and it may be necessary to put some matting material in the RANCH R0/
ditch area on this road to stop the erosion

Mr Vickery moved to table this matter until a price is
obtained for the matting material which can be used to stop
erosion in the ditch areas

Mr Haskell noted he will require rocks for various
locations to stop erosion around some bridges There ROCKS

opened and reviewed Tenders were received from J & G
Grading $57 27 per hour, Robert Cranston $60 00 an hour, GRADER

Ketron Construction $65 00 an hour and $69 00 an hour with DIV 1
wing or ripper, Scorpion Contractors $65 00 an hour, Aldale

Mr. Hanger moved Mr Haskell review the bids received and
bring a recommendation back to council later today

Mr Haskell did not return to the meeting when it

Mr Jeffery reviewed a letter received from the Kneehill
Community Resource Board. The agreement to operate the KNEEHILL
program expired March 31st, 1994 The board is asking the COMM
municipalities to continue to operate the program without a RESOURCE
formal agreement until December 31st and the board will BOARD
discuss with the participating members a more long term
committment to the program in September or October
Mrs Wilkinson reported Wanda Moar, the resource worker for
the Acme, Carbon, Linden area has resigned effective July
31st The board has agreed to advertise for a replacement
to start August 1st, 1994

Mr. Jeffery reviewed the letter received from Alberta
Municipal Affairs regarding provincial funding for the FCSS
program The money is now received as part of the
Unconditional Municipal grant The M D will receive
$87,769 for the FCSS program in 1994. It appears the
unconditional municipal grant will be cut in 1995/96 and
again in 1996/97 and will be reduced by more than 5% in
total
The FCSS money can be received either conditionally or
unconditionally He reviewed what would happen if the M D
took the grant conditionally If the money is received
unconditionally the M D has flexibility in how these funds
may be used
Mr Wagstaff moved the M D. accept the FCSS component of
the Municipal Assistance Grant on an unconditional basis

Mr Vickery moved to accept the letter from the Kneehill
Community Resource Board regarding continuation of the
program until December 31st, 1994

There was some concern expressed about the decision of the
Kneehill Community Resource board to advertise for a
replacement worker without the M D. of Kneehill and the
Town of Three Hills being represented at the board meeting
Mr. Jeffery reviewed a letter received from CMHC regarding
reinstatement of their RRAP program They wish to know if
the M D will continue to participate and allow Mr
Cunningham to deliver the RRAP program in the area
There was discussion regarding the program and its value
Mr. Hanger moved the Reeve and Municipal Administrator be
authorized to sign the agreement with C M H C. on behalf of
the M D

Mr Hanger moved the recreation committee be authorized to
make a decision on the disposition of the $10,436 00 to any
or various community organizations or urban centers in the
M D of Kneehill.

Mr. Jeffery noted the AAMD & C has identified a number of
concerns with regard to the recommendations made by the
Provincial Tax Reform Commission The association would
like input from the individual municipal councils about
these concerns by May 11th, 1994

Mr Vickery moved to refer this matter to the Executive REPORT

The Town of Three Hills has written regarding the increase
in their cost to provide R.C.M.P. service to the town and
area The town council has suggested the municipalities POLICE
in this area which do not contribute towards the cost of SERVICES

occur in their areas There was discussion about this
issue and the fact the M D contributes to the Kneehill TOWN
Ambulance Service and the Golden Hills Lodge on the basis THREE

assessment base requires the M D to contribute between 75
and 80 percent of the Kneehill Ambulance and Golden Hills

supervision for the transfer boxes, only for the rubble pit
area The transfer boxes are open 24 hours a day.
However the town had been charging the M.D for half of the
wages for the attendant looking after the rubble pit even
thought the M D ratepayers were not able to use the rubble
pit until the new agreement was arranged this spring
Mr Vickery moved no further money be paid to the Town of
Trochu until this issue is resolved, the previous agreement
be checked, the amount of money paid by the M D. towards
the attendant's wages be determined and Mr Boake and
Mr Jeffery discuss the entire matter with the Town at
one of their council meetings

Mr Jeffery reminded the councillors about the meeting with
Minister Steve West and Carol Haley, M L A on Friday,
April 29th commencing at 11.00 A M

Mrs Wilkinson noted Gerald Dube has not yet removed all
his personal property from the former Crossroads Gas Co -op
buildings in Wimborne The province wish to ensure the
previous owner has removed same before granting permission
to the M.D. to take clear title to the property
Mr Dube indicated he would clear the rest of the items out
shortly Mr Haskell will check the buildings again in a
week or two

The fuel bids were reviewed Mr. Haskell noted Federated
Co -Op bid was low bid, but cannot supply propane
Mr. Vickery moved, subject to obtaining approval from the
School Division, the bid from Federated Co -Op for supply of
fueld be accepted, and the bid from Esso for supply of
propane be accepted.
Mr Haskell noted the bid from J & G Grading of Edmonton
was low bid for contract grading in Division 1 His price
was $57.27 per hour
Mr Hanger moved the M D. accept the bid from J & G Grading
of Edmonton for contract grading in Division 1 during the
1994 summer time frame only, at a price of $57 27 per hour
plus G.S.T on condition the machine is inspected and
approved by the Public Works Superintendent prior to
execution of a contract with the company.

various backsloping borrow pit agreements arranged with Mr
and Mrs. Marz As a condition on one agreement Mr Marz
had requested permission to rent the M D high hoe with an
M D operator to do 3 hours work for him,, et
There was discussion about this request, the current policy
about renting M.D. equipment, the waiver process if a town
or village wish to rent the equipment, and the perception
people might have as he is a councillor It was felt it
would not be appropriate to grant this request
Mrs Lowen moved the M.D. approve the land purchase
agreements and the backsloping, borrow pit agreements
arranged with Mr and Mrs Marz, with the exception of the
request to rent the M D high hoe

The request for the M.D. to do some backsloping work in the
M D ditch adjacent to land owned by the Hutterian Brethren
of Valleyview was discussed Lonnie McCook was
requested to take levels in that area to see if lowering
the ditch will allow the water to run to the north and
eventually drain into a dugout which the Hutterian Brethren
have on their land.
Mr Boake moved to table this matter pending receipt of
information about the levels in that area

Mr Jeffery reviewed a letter from Alberta Road
Management They are marketing a new product called Spec
Crude and would be interested in applying the dust control
product to roads in the M D The price for the material is
16 cents a liter Cost would be approximately $5800 00 to
$7700.00 per mile They suggest doing one mile of road
with straight crude as a comparison test Straight crude
would cost 13 5 cents per liter

Mr Jeffery also reviewed a letter sent to ARM last fall
regarding a proposed experiment on the Linden Church road
using Tam&k 2 0 Veer CruAv` 01 di-1-1
ARM also indicated they would still apply LS2000 in front
of residences for ratepayers, but as it is very labour
intensive and not cost effective for them, they would like
to do some other work for the M D
Mr. Wagstaff moved the M D ask ARM to undertake the/.dust
control experiment on the Linden Church Road using' Task SPzc
-21—mb as per the letter of agreement dated September 21st, v
1993, and if their product is compatible with SB90, they be
hired to undertake the dust control maintenance of the
Grainger and Fisher Davidson road

Mr Jeffery noted Bob Tetz and George Adams have requested
dust control on the roads in front of their residences due
to the heavy volume of traffic on these roads
There was lengthy discussion regarding use of LS2000 as a
means of controlling dust in front of residences, the cost
for same, the cost of applying straight crude oil and
whether the M D should be subsidizing people who apply
dust control to the M D roads by giving them a $100 00
rebate.
Mr Vickery moved Policy 13 -2 be amended as follows- ((��

Task 2000 to the M D roads in front of their residences at
their cost" and further moved reference to a rebate of
$100 00 be deleted from the policy

road prior to application of the product at no cost to the

Mr Jeffery reported the Valleyview Colony did sign a GRAVEL
lease with the M D for removal of gravel from their land LEASE
South half of the SE 16- 32 -26 -4, but would not sign a lease VALLEYVI
with the M D for the N E 20- 32 -26 -4 COLONY

The need to construct a blade grade road West of 5 & 8 in
34 -24 -4 was discussed It appears council had during their
1993 annual road tour questioned the need for upgrading the BLADE
road due to the limited use and the costs which would be GRADE
involved The need for the road was to be discussed by the W 5 & 8
local councillor at his divisional meeting this spring IN 34 -24
However this was not done Some of the councillors felt it
the location should be reviewed again by the road committee
before deciding to rebuild the road
Mr Hoff moved the blade grade road West of 5 & 8 in
34 -24 -4 not be constructed, the road committee inspect the
road again and bring a report back to a later meeting of

Mr Wagstaff noted Larry Bevel asked if the M D. would
provide him with a key to the Huxley water well shed This
would allow him to get into the shed to turn on the system
rather than paying for water using loonies. He uses alot
of water for his spraying operation and it is difficult to
ensure his operators have sufficient loonies to get water
when they require it They would keep track of the number
of loads of water taken and the M D could bill him for
same
Mr Hanger moved keys to the Huxley water well shed are not
to be provided to any person using the Huxley water system

A request has been received from a resident of Huxley Is
the M.D. going to provide a spring clean up truck to pick
up refuse in the hamlet areas as was done last year

Mr. Haskell noted Arjon had quoted him a price of $1 35 per
cubic meter to remove and stockpile pit run gravel from the
Torrington pit His price for crushing 100,000 yards is
$1 81 per cubic yard
Mr Haskell was requested to see if his crushing price
would be less if he was authorized to crush more
than 100,000 yards
Mrs. Lowen moved Mr. Haskell be authorized to negotiate
with Arjon for crushing up to 300,000 yards of pit run at
the Torrington Pit (up to 150,000 yards to base course
specifications and up to 150,000 yards to road gravel
standards) at a price not to exceed $1 81 per cubic yard and
report back to council at the next meeting

Mr Haskell noted the gravel at the Esau pit was to be
crushed to base specificiations, but now this gravel is not
required He wondered if some of the gravel at this pit
should be crushed for chips. Price is $2 68 per cubic yard
It was agreed this matter would be discussed at the next
meeting
Mr Hanger moved this meeting continue long enough to deal
with Item #30 - Pumping Water at the Torrington Pit

Council Report April 26, 1994
1. Arjon Construction is interested in crushing the extra
100,000 cubic yards of gravel at the Torrington Pit
and could start in July I asked if he was interested
in the bailing of the extra 200,000 yards and to give
us a price.
2 I think we should turn down the request from Emil
Heinrich for chip seal or SB90 as there is not enough
room in the trailer courts for working with large
equipment
3 The last two miles of base work which we did last fall
on 836 has unraveled in places and we may have to redo
it I think it was to cold and the seal coat did not
go in.
4 We have an extra centre dump gravel trailer since we
sold one gravel truck If we are thinkin of selling
it now is the time of year to do it Fort Garry
Industries will consign it or do we want to put it on
public auction or advertise it? Salesman from Fort
Garry says it is worth 10,000 to 11,000 dollars
5 We will need another tractor for pulling disker on
base course again this year Guards will rent us the
case for the same deal as last year. I have rented
the Dyna Pac for the season from Blackwood Hodge again
for $7500.00 per month We will also have to hire
trucks again this year.
6 There seems to be only two of the grader men
interested in working 4, 12 hour days at the present
time. (Robert and Gary)
7 Are we going to do any Roundup spraying this year?
Some of the guys would like to do soma
8. We are going to have to clean up the Cannings
stockpile site this year What will we do with the
material which we pushed up?
9 We seem to be having alot of water erosion the last
few years I am wondering if we should be looking
into some sort of matting to be placed in our water
runs SR #841 ditches are washed very bad as well as
other spots in the M D
