HomeMy WebLinkAbout1993-09-07 Council Minutesa • EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 The Executive Committee of Richard A Marz and Otto Hof f met on Wednesday, September 7th, 1993, at the M D of Kneehill office in Three Hills, commencing at 9.00 A M Mr. John Jeffery, Municipal Administrator and Mr Bud Haskell, Public Works Superintendent, were also present Mrs Jennifer Deak was present and recorded the minutes The following items were discussed. 1 Gravel testing at Megli Pit Testing for more gravel will be undertaken at the Megli Pit. The west side, legal N E. 9- 30- 25 -W4, belongs to H.M Toews and the east side, legal N W 10- 30- 25 -W4, belongs to Fred Esau Testing will be done at both legal locations Both Mr Toews and Mr Esau currently have gravel lease agreements with the M D., Mr Esau a three year lease and Mr Toews a one year lease It is normal practice for the M D to file a caveat on the land where it excavates gravel A caveat was filed on Mr Esau's land. Executive Committee recommend that a letters be sent to Mssrs. Esau and Toews advising them that the M D will be conducting gravel testing on their land and also that a caveat be filed on Mr Toews' land 2 Pavement Inspection SR 583 Alberta Transportation recently completed an inspection of SR 583 from Highway 21 to SR 836. It reported several large patches near the middle of this section of highway and two or three smaller patched breaks elsewhere In addition, there is also some moderate wheel -path rutting Overall, they report the road is in reasonably good condition The sealed surface is now eight years old and Alberta Transportation will continue to monitor its condition Executive committee recommend to accept and file as information this letter 3 Request for road approach N W 31- 31 -22 -W4 Sent a,A{ Or- G tea J Maverick Land Consultants, on behalf of their client, Canadian 88 Energy Corp , have requested consent/ conditions for a road approach for an oil lease at the above noted location. They are proposing a road approach be constructed from the oil leaseIex north to SR 583 dp Executive Committee recommend that Maverick Land Consultants be ✓ advised that an access for a road approach be approved to the west, onto the gravel road and not north onto the secondary light surface road 4 Rocks, stucco and cement dumped into ditch west of 29- 34 -24 -W4 On the August 24th, 1993 Public Works Superintendent report, Mr Haskell reported that he and Mr Wagstaff had checked the rocks, 1 ,n 1�1 0 EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 stucco and cement that had been dumped in the ditch west of 29- 34 -24 -W4 and advised that this could be a potential hazard should someone drive off the road and hit them No formal motion was made concerning this matter Executive Committee recommend that Mr Haskell be authorized to oversee the removal of construction debris at this location and also that all costs incurred to clean up the site be recorded 5 Earl Paget Service Road Access to Highway 21 Mr Peter Trynchy, Minister of Transportation and Utilities has sent a letter advising that funding for the Paget Service Road in N E. 36- 29 -24 -W4 will be provided in 1993 Alberta Transportation will be formalizing details and an agreement with the M D Mr Jeffery also noted that Mr Andy Brown, from Alberta Transportation, has advised that the existing approach is to be removed Executive Committee recommend to accept and file as information. 6. Seminar - How to Supervise People A one day seminar, hosted by Fred Pryor Seminars, on how to supervise people, has been scheduled for December 1, 1993 at the Marlborough Inn, Calgary Mr Jeffery noted that most of the foremen had previously taken this course and had found it very beneficial. Mr Haskell had missed the course when the other foremen took it Cost for the seminar is $99 00 plus G.S T Executive Committee recommend Mr Bud Haskell be authorized to attend this seminar Enviroclean Filter Recyclers Inc. - Reznor waste oil heater Enviroclean is the distributor for the C.S.A approved Reznor waste oil heater By using this heater waste oils can be utilized to heat buildings /shops. Executive Committee recommend to accept and file as information 8 SR 836 Road Proiect Mr. Jeffery reported that the SR 836 road project should be completed by November 1, 1993 to ensure funding from Alberta Transportation Mr Haskell noted that, given the lateness of the season, the crews would have to work twelve hour shifts to attempt to complete the project on time He advised that the road crew on this project had agreed to these hours Mr Jeffery also reported that he had contacted Councillors Wagstaff, Vickery, Lowen and Boake and advised them of the funding restriction for completion of the project this year All councillors contacted had agreed to go along with the executive committee recommendation It was also reported that the quality of the 1 1/2 gravel at the Canning Stock Pile is very poor and has no compaction, three quarter inch gravel will have to be used No compaction tests were made on this gravel when it was crushed Mr Haskell has obtained prices to re -crush the 1 1/2 to 3/4" gravel Lowest 2 K �.a a�v4``� a b� �o G� ' 10 <'y re 7 �1 El EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 price is $1.60 /yd from Richardson Linden Contractors is currently crushing out of the municipality and can schedule a re -crush of this gravel in October 1993 Executive Committee recommend that effective immediately the crew on the SR 836 project commence twelve hour shifts and the crew be authorized to work Saturday to make up for any down time during the week Mr Haskell left the meeting - time 9 45 A M 9 August 24, 1993 Council Minutes Mr Jeffery reviewed the August 24th, 1993 minutes for publication in The Capital. Both Mr Marz and Mr. Hoff agreed to leave in the edited version the paragraph and motion, on page two, dealing with the civil claim Mr Hogg has filed against the M.D. l i►Z°' Executive Committee recommend the edited version of the August d °"S 24th, 1993 minutes be accepted and forwarded to The Capital for ✓ publication. Mr Collin Stroeder, Torchinsky Engineering and Mr Bud Haskell entered the meeting 10. Tenders - SR837/SR838 Chip Seal Project (see also item #20 Mr Jeffery proceeded to open the tenders received for the SR837/SR838 chip seal project The bids were as follows. McAsphalt $116,488 65; start date Sept 13/93, completion date Sept 15/93 Precision Surfacing $121,617 00, completion date by Oct /93 Westcan Seal Coating $137,606 25 start date Sept 13/93, completion date Sept 20/93 Carmac $121,202 00 start date May 15/94; completion June /94 It was also noted that an addendum was added to the Carmac tender with a bid of $130,185 00 if the project was to be completed by Oct 15/93 Mr Stroeder and Mr Haskell left the meeting to review the I' bids Time 10.15 A M 11 City of Lloydminister - EEMA review Previously the M D. of Kneehill had supported the Joint Municipal Intervenors" in the Electrical Energy Marketing Act (EEMA) Review Panel Hearings The City of Lloydminister is now requesting a further motion of support from our council to participate in a Joint Municipal Intervention at the TransAlta Utilities Network Access Public Utilities Board Hearings, 3 �1 EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 Y currently in progress This is a joint concern of municipalities as TransAlta's proposals could result in a transfer of costs from large industries to residential customers Shared municipal costs to participate in a Joint Municipal Intervention would be pro -rated on the basis of population of those participating and it is anticipated that 95% - 100% of the costs could be recovered and reimbursed through a cost hearing with the Public Utility Board Total costs are estimated at $25,000 - $30,000.00 with the M D share at approximately $1,000 00 Executive Committee recommend that the M D of Kneehill give a motion of support to participate in a Joint Municipal ` Intervention at the Trans Alta Utilities Network Access Public s "x Utilities Board Hearings and also that a contribution, not to exceed $1,000 00, be made towards costs providing a portion can be rebated back 12 Letter from R W Brown re. township and range signs Mr Ralph Brown, Acme had written a follow up letter to his July 16/93 letter and our reply of August 13/93 concerning the township and range signs Mr Brown is concerned with maintenance costs for such signs. He also feels that most people do not understand our legal land description system and that the fire and ambulance departments are the parties that would benefit the most from the sighs Executive Committee recommend to accept and file this letter as died information II13. Letter from Ralph and Josie Kientz re Torrington Landfill Mr & Mrs Ralph Kientz have written a letter concerning a recent incident at the Torrington Dump Apparently, Mr Anhorn, the transfer site attendant, was not going to allow the Kientz's to use the site because he felt they were not residents of the municipality The Kientz's reside within the municipal boundaries at N.W. 23- 32- 27 -W4s Executive Committee recommend that a letter be sent to Mr Sent- Anhorn advising him that Mr. & Mrs Ralph Kientz do reside within the M D of Kneehill boundaries and as residents are entitled to use the transfer site 14 1994 Census Review i Mr. Jeffery reviewed the information being asked on the M D 's 1994 census The census information will be used for regional distribution and planning Questions include dwelling type, dwelling occupancy, tenancy status, number of occupants, marital status, employment status, type of household, type of occupational industry and occupation I Executive Committee recommend that council be advised of the census I 15. Atlantis Resources - letter re- driving in the M D 4 i EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 ti Mr. Jeffery reported on a letter that had been sent to Atlantis Resources requesting their staff to observe traffic rules when driving within the M D and also that concerns had been received from ratepayers about dogs riding in the back of trucks and encouraging other dogs, with their barking, to run onto the road Following this letter, Mr Garth Olsen, an employee of ® Atlantis, telephoned the office requesting a retraction to the letter or he would take legal action This matter was referred to the M D. solicitor, Mr Mike Welsh Mr Welsh has advised that the letter does not identify any specific person and is a qualified privilege In Mr Welsh's opinion, Mr Olsen has no grounds for legal action Mr Jeffery noted that no further communication has been received from Mr Olsen Executive Committee recommend to accept and file this information Mr Collin Stroeder re- entered the meeting - time 10 45 A M Mr Stroeder reviewed the tenders and expressed some concerns on how the tenders had been completed Some of the unit prices had not been written on the tender, only the total price and Tochinsky's contract states that the written unit price prevails Mr Stroeder was requested to contact Torchinsky's legal advisers to ascertain the validity of the tender and report back to the committee Mr Stroeder left the meeting - time 10.55 A M 16 Council Meeting Minutes - August 10/93 Mr. Jeffery reviewed the August 10th, 1993 minutes for publication in The Capital Both Mr Marz and Mr Hoff agreed on the edited version of the minutes Executive Committee recommend the edited version of the August 10th, 1993 minutes be accepted and forwarded to The Capital for publication 17 ALARIE - Statement of Participation ® Mr. Jeffery reviewed the Alberta Local Authorities Reciprocal Insurance Exchange (ALARIE) statement of liability insurance coverage and levy for the period Sept 1/93 to Sept 1/94. The M D has three layers of coverage to a maximum of $17,000,000 00 for an annual levy of $44,399 00 Executive Committee recommend to accept and file as information. 18 Letter re Regional Planning Commissions The M D has received a copy of the letter sent to Mr Stephen West, Minister of Municipal Affairs, from Mr James D Andrew, Chairman of the Palliser Regional Planning Commission The letter expresses concerns over future funding of the ten regional planning commissions in the province The planning commissions play an important role in the implementation and participation of provincial policies and projects, are responsible for census data analysis; environmental studies; 5 a • i • • EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 economic development and planning Mr Hoff noted that in rural areas local governments would probably not be able to afford the services of a planner should the regional planning commissions be eliminated Executive Committee recommend the M D write a letter of support kW r for the rural regional planning commissions to the Minister of s<< Municipal Affairs, emphasizing that regional planning is an integral part of long term planning and also that financial .� restraints would be placed on rural municipalities should they be responsible, in the future, for hiring their own planners. 19. M D of Rockyview Resolution re tax on gravel mining The M.D of Rockyview is considering presenting, at the zone meeting, a resolution to place a tax on gravel mining They feel the transportation of this material results in increased road maintenance and repair costs and therefore municipalities should have the right to tax mined gravel within their jurisdictions They are requesting a response indicating whether the M D of Kneehill is in support or not of this resolution Executive Committee recommend the M.D of Kneehill should respond to the M D of Rockyview that it is not in favour of Y*,* d(4 this resolution ��4P Mr Collin Stroeder re- entered the meeting - time 11 15 A M 20 Tender - SR837/SR838 Chip Seal Project (from item #10) Mr. Stroeder advised that that the bid from McAsphalt was an acceptable bid, at a total of $116,405 00, and was the lowest bid The reduction in total tender of $83 65 was the result of the unit price which is the prevailing price, as per contract Executive Committee recommend that the M D of Kneehill 14sP recommend to the Minister of Transportation that the lowest bid be accepted from the tenders received for the SR537/SR838 Chip Seal Project 21. Water Rates in Hamlets Mr Jeffery reviewed the water system operating costs in the hamlets of Huxley, Swalwell and Wimborne He is recommending an increase in frontage maintenance from $0.10 /ft to $0 30 /ft in the Hamlet of Huxley, an increase in frontage maintenance of $0 29 /ft to $0 45 /ft in the hamlet of Swalwell and an increase in water billing from $13.00 /mth to $17 00 /mth in the hamlet of Wimborne All these increases will increase total revenues in each hamlet by approximately $1,000.00 /yr The increases are required to ensure the systems are self sufficient and a user pay enterprise Executive Committee recommend that Mr Jeffery' s recommendations for increases to the water frontage and monthly fees be accepted and that Councillors Wagstaff, Hoff and Vickery be notified of same 0 \4e d J t� U 1 a 0 "`` EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 22 AAMD &C News Release re new federal farm progra m The AAMD &C has sent a news release about a new federal government farm program aimed at assisting farm families to increase and diversify their incomes Executive Committee recommend to accept and file information and that a copy be given to each councillor. 23 Fire Brigade coverage this C,,td The town of Three Hills has written a letter advising the M.D. that it has increased it's insurance coverage for fire fighters to $100,000 00 accidental death and dismemberment Jubilee Insurance is recommending a province uniform coverage for all municipal firefighters of $100,000 00 The M D currently has coverage of $50,000 00 for its firefighters at an annual cost of $455 00 per annum Premiums to increase the coverage to the uniform rate would be $388 00 per annum Executive Committee recommend that it is in favour of a provincial uniform fire fighter insurance coverage at $100,000 00 and that the M D of Kneehill increase its firefighter coverage to this level 24 Black list The M.D. black list was reviewed. This is the list of all persons that are over six month in arrears for accounts receivable billings. Seven outstanding accounts,totalling $931 43, remain on the current accounts receivable listing All these accounts are over two years old. A request has been made by the administration department to keep these accounts on the black list but remove these accounts from the accounts receivable listing as it is overstating the M.D.'s receivables Executive Committee recommend that the seven accounts on the black list which are still currently included in the accounts receivable be written off but the names and outstanding amounts remain on the black list until paid 25 Budget Comparison Report August 25th, 1993 Mr. Jeffery reviewed the August 25th, 1993 budget comparison report Executive Committee recommend to accept this report and that a copy be given to each councillor 26 Alberta Lake Management Society 2nd Annual Worksho The Alberta Lake Management Society, dedicated to lake and watershed management, has extended an invitation for membership and attendance at the annual workshop at Wabamun, Alberta Executive Committee recommend to accept and file as information 27 Executive Development Seminar 7 V� Ie r �f 1k V J L 0 r� L_J EXECUTIVE COMMITTEE REPORT SEPTEMBER 7th, 1993 Athabasca University Educational Enterprises is hosting a series of one day seminars Of special interest is one scheduled for December 16th, 1993 at the Calgary Convention Centre on Rethinking the Organization Beyond Downsizing The cost for the seminar is $395 00 including G S T if registration is received by Oct 1/93. Executive Committee recommend that Mr Jeffery and Mr Marz be authorized to attend this seminar and Mr Hoff be an alternate for Mr Marz should he be unable to attend.
