ADJOURNMENT DEVELOPMENT APPEAL BOARD MEETING: K, tr L �01 E CJ COUNCIL MEETING JULY 27th, 1993 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Council Chambers, M D Office Three Hills, Alberta, on Tuesday, July 27th, 1993 commencing at 9.00 A M. The following were present for the meeting. Reeve, Richard A. Marz Division Four Councillors Marylea Lowen Otto Hoff Robert E Boake James M Hanger Richard M Vickery Glen Wagstaff Division One Division Two Division Three Division Five Division Six Division Seven John C Jeffery, Municipal Administrator Mrs. Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Reeve Marz called the meeting to order Requests were made to add the following item to the agenda. 22a Coin Dispenser - Huxley Water 26a Ken Cunningham Road 26b Gravel - Megli Pit 26c Acme Grader Shop 26d Don Westersund Road Mr Boake moved approval of the agenda with addition of the above noted items CARRIED Mrs Lowen moved council go into camera at this time CARRIED Time 9 10 A M Mr. Jeffery and Mrs Wilkinson left the meeting Mrs Lowen moved council meeting do now reconvene, the in camera session having been completed CARRIED Mr Jeffery, Mrs Wilkinson and Public Works Superintendent Vernon Haskell entered the meeting at this time 10.15 A M Gordon Snell of Carbon also entered the meeting at this time and discussed with council the concerns he has with installation of a culvert across the M.D. road ESE 19- 30 -22 -4 As soon as the culvert was installed the water began running from the west side of the road over to the east side and was flooding Doris Mayes land S W 20- 30 -22 -4 He had discussed the issue with the engineer from Torchinsky Engineering. The engineer suggested Doris Mayes had agreed to installation of the culvert so the dugout on her land would fill with water 1 PRESE ADD TO AGENDA APROVAL AGENDA IN CAN SESSI0 MEETIN RECONV GORDON SNELL STEVE VARGA CULVER S N COUNCIL MEETING JULY 27th, 1993 It was necessary to dig a ditch to the dugout, the dugout is full, the water is still running and now has flooded about 15 to 20 acres of land with 6 to 8 inches of water Was concerned because Doris Mayes had not been contacted prior to the installation The area which was flooded was very wet in previous years, but due to continuous cropping and farming practices the area was drying out and they were able to grow a crop there last year This year due to the rain it was not seeded but the area was drying out and they were going to broadcast barley for green feed They had sprayed the area with Roundup and had things ready to broadcast the barley Now this will not be possible Discussed the matter with Mr Varga yesterday and also requested the engineer to bring out the report they prepared a few years ago It appears Mr. Varga' a land is lower than that of Doris Mayes and all the water will never drain off of Mr. Varga'a land Also noted the natural drainage in that area is south west Mr Marz noted the M D was aware installation of the culvert would only equalize the water on both sides of the road and that the water would not drain away Also that Alberta Water Resources and Transportation had indicated the water should be allowed to be where it would be if the road was not there Mr Snell stated he felt a gate should have been put on the culvert in order to control the flow of water and allow it to equalize more gradually He also noted farming practices can control a certain amount of the water Mr Jeffery reviewed the letter from Alberta Water Resources - Kent Berg - who indicated all the culvert would do would be to share the problem - it would not drain the water away from the area Mr Snell suggested Doris Mayes should not be penalized by allowing so much water to flood her land when they had worked hard to get the area in shape to crop it By installing the culvert this year it has allowed a build up of 2 years of water to flood her land Again stated the water should drain to the south west not to the east It was suggested this area in previous years was a slough and due to the rain a considerable amount of water has accumulated this year Mr Snell suggested the M D should have pumped the water to fill the dugout and pumped the remaining water down the ditch He also noted part of the problem is Mr. Varga' neighbor will not co- operate and allow the water to follow its natural drainage course which is to the south west He felt the M.D. should have dug a ditch to allow the water to drain away to the south west He also noted if the water continues to flow it will go to the north on Doris Mayes' land and therefore will flood more land He had put plywood over the end of the culvert to stop the flow, but it was removed and the water is still flowing on to her land Mr Snell agreed the dugout on Doris Mayes land was constructed during a previous road construction project, 2 Eiji [A 0 COUNCIL MEETING JULY 27th, 1993 but she was not contacted prior to installing the culvert Reading previous minutes in the paper appeared to .indicate the culvert would not be installed He felt Doris Mayes should not have to pay taxes on this flooded area, he will lose some crop and the M D will now have to take care of the scentless mayweed in that area He was attempting to control it but cannot now as the area is flooded There was further discussion about the history of this matter, the fact the culvert would only equalize the water, that this is a naturally wet area and if there is alot of rain next spring the same situation will arise, and if there are any other options or solutions available to Doris Mayes Mr Snell again indicated they were trying to solve the problem with the wet area by continuous cropping, and now the M D is asking him to accept water from the other side of the road, which has been created partly because of the other land owner's farming practices The area on Mr Varga s land is small - about 4 to 5 areas and to solve his concerns the M D has flooded about 20 acres on Doris Mayes' land He has a 5 year lease with Doris Mayes on a crop share basis and has now lost production from this area He indicated his concerns were - the water flooding Doris Mayes' land and his inability now to control the scentless mayweed Her concerns will be more economic as she will lose income and have to pay taxes on land that cannot be farmed. Mr. Snell also stated he and some of his neighbors feel paving SR 836 with a light coat surface is a complete waste of time and money and will cause problems when farmers have to haul grain, etc , in that area If SR 836 is banned in the spring time because of the light coat surface the other roads in that area will suffer The road should be left as a good gravel road instead of paving it Mr Snell was advised it is not likely the M D. would cancel any portion of the taxes on Doris Mayes land but council would discuss the matter further. The letters on file from Torchinsky Consulting and Alberta Environment were reviewed. It was noted the levels taken by Torchinsky were not available Mr Vickery moved Torchinsky Consulting be requested to h fed provide the shot levels take0in this area in 1988, and this cs�rt der matter be tabled and discussed again when the information I,4 is available. CARRIED Mr Snell left the meeting at this time Mr Wagstaff moved approval of the July 12th council APROVAL meeting minutes MINUTES CARRIED Mr Wagstaff moved approval of the accounts presented for payment today, subject to further review by the finance APPROVAL committee of Richard A Marz, Otto Hoff, Marylea Lowen and ACCOUNTS himself. CARRIED 3 K NO :q COUNCIL MEETING JULY 27th, 1993 Mr Jeffery read a letter from A J Br Engineer, Alberta Transportation regarding SF coat project. The request for funding assistance nas peen forwarded to Edmonton for consideration Mr Hoff moved the letter be accepted as information, and the project be proceeded with if approval for funding is obtained from Alberta Transportation CARRIED Mr Haskell noted the edge of SR 837 by the bridge is sliding away and the area will have to be patched before the seal coat is applied However it appears this area will continue to be a problem as the base is not stable and the problem was not fixed when the road was re -built Mr Jeffery read a letter from A J. Brown, District Engineer, Alberta Transportation regarding SR 836 base course project The grant monies from the Province will be provided on the following basis. $105,000 00 for engineering and $894,969.00 for the base course construction work If the M D is agreeable to assistance being provided in this manner a copy of the letter is to be signed and returned to Mr. Brown at Hanna Mr Boake moved the M D agree to provision of funding from the Province as outlined in the letter and a copy of the letter be signed and returned to Alberta Transportation CARRIED Mr Jeffery reviewed his report. There was discussion about the need to repair or move the trailer dumping station in Swalwell, as well as whether there is a need to have a trailer dumping station there at all The costs for repairs will be betweeen $500 00 and $1000 00 SR 837 83 SEAL COAT PRWFCT lek}� SR 836 BASE COURSE J C JEFFERY REPORT Mr Hoff moved to table this matter and discuss the matter SWALWELL later today when Item Number 17 on the agenda - report on TRAILER Swalwell Community meeting - is discussed DUMPING CARRIED STATION The motion made by Councillor Boake at the last meeting regarding the Keyano College was not voted on The motion reads "that Keyano College be authorized to put on a week base course operating only course (not including safety and service) and try to work in grading if time permits" A vote was taken today on the motion and it was DECLARED CARRIED Mr Hoff moved approval of Mr Jeffery's report CARRIED The meeting recessed for dinner between 11.50 A M and 1:00 P M The meeting reconvened at 1:00 P.M. Mr Haskell returned to the meeting Councillor Boake did not return to the meeting at this time 4 KEYANO COLLEGE COURSE DINNER rte" N N COUNCIL MEETING JULY 27th, 1993 Mr Jeffery reviewed the report prepared by Mr Haskell and various items were discussed. All the gravel has not been removed from the Megli pit There is still some gravel there and should be enough for another crush More stripping will be required Mr Allen Toews has requested the M D take out the south approach into his yard, fill the ditch, use dirt from near his trees to spread over the driveway, haul in pit run and then hot mix the driveway for about 450 feet This is more than what council had agreed to do to correct the approach problem. Mr Hoff moved Mr Toews be advised the M D is only prepared to construct a service road /approach and remove the existing south approach subject to Mr. Toews entering into a no compensation agreement with the M.D and he is willing to provide the dirt for the service road and approach at no cost to the M D. CARRIED Linden Contractors have offered to buy the M D. 16 wheel jeep Fort Garry and another company indicated its value would be between $16,000 and $18,000 M D does not use the jeep much now since the Fiat Allis cat was sold Councillor Boake returned to the meeting at this time FWINIRM I Mr Haskell would like to hire Orbit Construction of Westlock to install the guard rail on SR 836 2400 feet of guard rail has to be removed and then replaced after the base course project has been done. M D forces will remove but do not have proper equipment to replace it Cost would be about $7500 00 to hire Orbit Construction and the company has indicated they would be available in the fall to do the work Mr Hoff moved Mr Haskell be authorized to hire Orbit Construction to replace the guard rails on SR 836 at a maximum price of $7500.00, and further moved if any material is required the M D supply same from inventory CARRIED Mrs Lowen moved Mr. Victor Garson be advised the M.D. is not interested in purchasing rocks from his land for rip rap. CARRIED The request from Alex Swanson for the M.D to drain a slough on his lands S E 3 and SW 2- 35 -24 -4 was discussed Alberta Environment indicated there is no funding in their budget to assist him with this kind of a project and before any work could be done by anyone to drain the slough a drainer's licence would be required The slough does have some affect on the edge of the M D road, widening the road and putting rip rap on the sides would protect the road, but it would not get rid of the water It was suggested the M D should not be involved in draining sloughs on private land 5 P W SUPERINTEN DANT REPORT I ALLEN TOEWS APPROACH lettrprAa ev- w1�� 16 WHEEP JEEP O l3 ORBIT CONST GUARD RAIL INSTALL r- ° P.J ►11 �' I e V GARSON RIP RAP 44,r V1C- ALEX S AANSON SLOUGH 1C, C P�l C7 1�q D� COUNCIL MEETING JULY 27th, 1993 Mr. Wagstaff moved Mr Swanson be advised the M D will not be involved in draining the slough, that he would require a drainers licence from Alberta Environment before the the slough could be drained, and if he has any other solutions or ideas as to how the problem could be solved he should contact him CARRIED The cost for renting a tractor for the SR 836 project was discussed A local farmer would work on the project with his tractor for $55 00 per hour, but likely would not be able to work on the project once harvest is underway Cost to rent a tractor from a dealer ranged from $25 00 per hour to $36 00 per hour and the M.D. would have to provide an operator, fuel, etc Mr Hoff moved Mr Haskell be authorized to rent a tractor at a rate not to exceed $36 00 per hour for this project and if necessary hire a temporary employee to operate the tractor CARRIED The need to widen the doors on the truck shop was briefly discussed Mr Vickery moved this matter be referred to the Capital Committee for their consideration and a recommendation be brought back to council in due course CARRIED There was discussion about the SB 90 project on the Fisher Davidson road. Cost of the oil went $9500 00 over budget as the product was put out to the edge of the road Mr Haskell also reported the G Friesen approach on to SR 583 appears to have tightened up and should now be satisfactory Mr Vickery moved Mr. Haskell contact Linden Contractors to see what they would be prepared to pay for the 16 wheep jeep CARRIED There was discussion about the recommendation from the Executive Committee to hire up to 3 trucks for the SR 836 base course project Mrs Lowen moved the M D hire up to six body fobs for the SR 836 project at 10% less than government rate CARRIED Mr Haskell reported one of the new gravel trucks had to be sent back to Calgary The vibration in the truck may be coming from the motor Cat is now checking it out. The shop is putting a 5th wheel on T -25 and T -19 is being used now on the gravel crew while the other truck is down Mr Vickery moved to accept the report from Mr Haskell CARRIED Mr Marz noted Almer Weisenburger has requested the M D. install guard rails on the road E /SE 13- 32 -26 -4 His fence is on property line, but due to the terrain the property line is down on the slope of the hill Poplar trees have C SR 836 PROJECT TRACTOR RENTAL � Copes N,c,�u4r�2, laer -�� f �V' TRUCK SHOP DOORS 13 Mew�o �o SB 90° �e PROJECT FISHER DAVIDSON ROAD G FRIESEN APROACH 16 WHEEL JEEP HIRE TRUCKS SR 836 PROJECT REPORT NEW GRAVEL TRUCK b C� GUARD ' RAILS ESE 13 36-4 >-r- W9 COUNCIL MEETING JULY 27th, 1993 grown up in the area It is not possible to get to the fence to repair it due to the terrain and the trees He feels the road is a definite safety hazard and there should be guard rails put up for a distance of approximately 200 feet If the M D puts up guard rails would they allow him to put connectors on the guard rails so he could attach a wire to the guard rails and also allow him to move his fence up on to the edge of the road. There was discusison about this request as well as the cost which would be incurred to put up the guard rail There is some used guard rail available It was noted there has been no accidents on this road to date and it would cost about $3 00 per foot to install guard rail Mr Wagstaff moved Mr Haskell check into the amount of material required and the cost to purchase used material (if necessary) as well as the cost for installation and bring a report back to the next meeting of council CARRIED The notice of motion made by Richard M. Vickery in December of 1992 was discussed This notice of motion was not dealt with but was tabled until now Due to other motions passed since that time regarding economic restraints, etc , Mr Vickery withdrew his notice of motion The suggestion to have a write off clause incorporated into any M.D agreements such as backsloping, borrow pit, culvert installation, etc , was discussed The landowner would be required to sign an acknowledgement that the project is completed and he has no complaints or concerns about the project prior to any compensation owing to him being paid by the M D It was suggested the Grade Foreman would have to see each of the landowners once the project had been completed to review same with them and obtain the written acknowledgement Mr. Vickery moved a write off clause be drafted for inclusion in all M.D. agreements to indicate that the grade foreman will contact all landowners involved to review the completed project and obtain their written acknowledgement that any work done on their land has been completed to their satisfaction and until such such written acknowledgement has been received from the land owner any compensation owing to him by the M D will not be paid and the draft clause be brought back to council for their review at the next meeting of council CARRIED It was suggested the landowner might be paid some of the compensation and only the general land damages be held back until the written acknowledgement from the landowner is obtained Czar Resources had requested permission to install a texas gate on M D road allowance north of Highway 27 west of the South West of 4- 33 -25 -4. The company had signed the necessary agreement accepting responsibility for the gate and any liability for same A by -law is required to authorize installation of the gate 7 R M VICKERY_ NOTICE OF MOTION WRITE OFF CLAUSE M D AGREEMENTS T� TEXAS GATE CZAR RESOURCES SW 4- 33 -25 -4 �C, t � �0 C COUNCIL MEETING JULY 27th, 1993 Mr. Boake moved first reading to by -law number 1287, this being a by -law to authorize Czar Resources to .install a texas gate on M D road allowance West of the SW 4- 33 -25 -4 approximately 60 feet north of the north shoulder of BY LAW Highway 27 CARRIED TEXAS GATE Mr Hanger moved second reading to this by -law CARRIED Mr. Hoff moved third reading be given to this by -law at le�Lee this time se « } CARRIED UNANIMOUSLY Mr Vickery moved third reading to this by -law CARRIED ✓ n 1 O"n cis w The 1993 road tour report was reviewed and discussed as well as the results of the raffic counts taken on the suggested number 1 priority oad project in each division 1993 ROAD It was suggested putting side slopes on some of the OUP- R secondary roads would be cheaper than doing a complete REPORT rebuild Also suggested SR 805 and 806 do not have sufficient sight distance to dust put side slopes on--ar should be rebuilt It was noted there must be two road programs established - one for the secondary road program and one for the local road program Only 2 secondary roads were suggested as priorities during the 1993 road tour - 7 miles of SR 575 from Hesketh corner to the Carbon Cemetery corner and 9 miles of SR 583. Mr Hanger moved the M D first priority for secondary road improvement be SR 583 from Three Hills to SR 806 (shoulders and slopes on 6 miles and a 3 mile complete rebuild) and the second priority be 7 miles of SR 575 from Hesketh corner to Carbon Cemetery corner CARRIED The M D local road program was then discussed As one buggy will be taken away from the main crew the approximate number of miles of road which could be built in a year would drop from 12 to about 8 miles. CARRIED Council took a short recess at this time and the meeting reconvened at 3.35 P M Mr Haskell returned to the meeting after the coffee break He was advised by Reeve Marz that the meeting he and Deputy Reeve Hoff had with him on June 24th was reviewed with council today Mrs. Lowen moved the comments and concerns as discussed with Mr. Haskell during the June 24th meeting be typed up, the typed report be reviewed by Mr Haskell, any comments or concerns he may have be added to the report, his signature to acknowledge he had been advised of the contents of the report be obtained and the report be filed in his personnel file, and further moved the matter be discussed again at the August 10th meeting of Council kil VERNON HASKELL P W S t COUNCIL MEETING JULY 27th, 1993 CARRIED There was discussion about the M D fuel tank which is located at the Leo Brietzke farm The grader operator has a vehicle with a fuel tank and the 500 gallon overhead fuel tank is not being used Mr Jeffery noted all M D tanks which must be have been registered Anything over 500 gallons requires a registration certificate Most of the overhead and underground tanks are reasonably new It was agreed the fuel tank should be brought to the shop yard as it will not be required by Division 4 motor grader operator The low level crossing at WNW 16- 30 -25 -4 was discussed Mr Boake noted he had reviewed the area with Doug Hannah and worked out a possible route out to the south, but to date had not been able to see Harvey M Toews Mr Boake moved to table this matter until the next meeting of council CARRIED Mr Haskell noted the carragana north of P B I near the railway tracks does cause a sight problem when travelling north on the road Mr Hanger moved to table this matter until he is able to discuss the possible removal of the caragana with the owner of the land CARRIED Mr Vickery noted Victor Leischner has requested the M.D. undertake some backsloping on the West half of 11- 33 -26 -4 There is an 8 foot straight cut bank and the power company has an easement 60 feet inside property line He is unable to spray around the power poles due to the straight cut bank and he would like the M D to backslope the area Mr Boake moved the M D do the backsloping work on this land as time permits CARRIED There was discussion about the request for additional street lights in Wimborne Mr Vickery noted there should be two additional lights put up - one by the grocery store and one by Dube's garage - both on main street Mr. Jeffery noted Mr Gordon Snell returned to the office this afternoon and indicated if the threat of legal action would make council change their mind about the culvert installed in the M D road West of the SW 20- 30 -22 -4 then he certainly was doing that The report from the meeting with the Swalwell residents was discussed Mr Vickery moved C N Rail be sent a letter requesting them to clean up their right of way in the hamlet CARRIED Mr Haskell noted he received a call today There are 8 trees on the M D street across from Wes Gore's property 10 FUEL TANK AT LEO BRIETZKE LOW LEVE CROSSING WNW 16 -30- 25-4 CARRAGANA NORTH P B I VICTOR LEISCHNE REQUEST RArvr,i naTNr ADDITIONAL LIGHTS IN WIMBO N —: I PbA q ,j vrd G SNELL VARGA C L ERT SWALWELL RESID NE MEETING CLEAN UP CN RIGHT WAY TREES l� I" Iq �1 COUNCIL MEETING JULY 27th, 1993 which need to be cut down The trees are old and rotten He will have them inspected Mr Vickery moved the report from the hamlet meeting be referred to a committee of Robert E Boake and Otto Hoff for review and recommendations to council. CARRIED Mr Hoff reported he had already authorized Denver Eitzen to clean up a portion of a ditch in the hamlet and to bill the M D for that work t �Qncc[° �-C,urre aov lSrd Mr. Marz noted he reviewed the SR 836 project with Carol Haley, M L A for this area It appears the Minister of Transportation is not in favour of funding a municipality REPORT for doing work on secondary roads and this likely will be R A MARZ the last time such an agreement with be arranged with the RE SR 836 M.D. PROJECT Mr Marz moved this report be accepted as information CARRIED Mr. Vickery noted the Ken Cunningham road West of 2 -33 -24 -4 is not in good shape The road from the north was built some years ago and the road from the south was built by Atlantis Resources but there is about 3/4 of a mile in the middle of the 2 mile stretch which has not been built Mr Cunningham has requested this portion of the road be constructed so he can go out to the south to Highway 27 There have been concerns expressed by ratepayers abut the manner in which Atlantis Resources' local employees drive Also there is a problem because some of these employees have a dog in the back of their trucks, these dogs bark at other dogs which entices them on to the road and this has resulted in the death of at least one dog Mr. Vickery moved due to the number of complaints received from local ratepayers, Atlantis head office be contacted to see if they would instruct their local employees to obey traffic rules and speed limits and also to request their drivers not to transport their dogs in the back of their trucks, and a copy of the letter be sent to their local representative, Clay Currie at Trochu CARRIED KEN CUNNINGHAM ROAD W 2- 33 -24 -4 ATLANTIS RESOURCES 1 P�'ta r Mr Vickery moved that portion of the Ken Cunningham road�� which has not been built (about 1 mile) be completed to at least a 28 foot blade grade standard using one or two graders with assistance from a buggy and a cat if necessary as time permits CARRIED It was noted there is a pipeline crossing on this portion of the road Mr Boake noted during gravel days the loader operator should have a gravel checker there to assist with the required paper work. Id d i-his COUNCIL MEETING JULY 27th, 1993 CARRIED The Executive Committee report was discussed The recommendation regarding the entire M D divisional grading operation and the need to establish another grading division and purchase or hire another contract grader was GRADING discussed OPERATION It was suggested a committee should meet with all the divisional grader operators to discuss this matter Mr Vickery, Mr Wagstaff and Mr Hanger agreed to act as a s�ti3 committee and meet with the grader operators Mr Haskell asked if the contract grader operator can be given permission to work longer hours due to the rainy weather Mr Hanger moved the contract grader be given permission to CONTRACT work longer hours as necessary because of weather GRADER conditions. Mr and Mrs Frank Davidson left the meeting at this time There was discussion about the request to redesignate the S E 20- 31 -21 -4 from agriculture conservation to agriculture in order to allow for a second subdivision in this quarter BY LAW Mr. Wagstaff moved first reading to by -law 1288, this being 12 —� a by -law to redesignate the S E 20- 31 -21 -4 from agriculture conservation to agriculture CARRIED Mrs Lowen moved second reading to this by -law CARRIED Mr Hoff moved third reading be given to this by -law at this time MOTION NOT CARRIED UNANIMOUSLY Third reading to this by -law will be considered at the next meeting of council Items on the executive committee report were discussed Item #10 - Town of Three Hills - Transfer site land was EXEC noted Mr Jeffery reviewed item #9 on the agenda which is COMM a report of a meeting held by Robert E Boake and Marylea THREE Lowen with a committee from the Town of Three Hills HILLS regarding the operation of the Three Hills transfer site TRANSFER SITE 12 C� C� • :7 COUNCIL MEETING JULY 27th, 1993 The town wish to change the agreement with the M D in such a manner that would allow them to control and manage the site and to hire a different attendant than the one presently hired They would then bill the M D for their share of the costs based on the revised agreement There was discussion about the changes proposed by the town and their reasons for requesting the change It was also noted that the current attendant, Allen Seimens, has worked for the M D for 8 or more years, has been a good employee and done an excellent job in looking after the site Mr Vickery moved this meeting continue until 5 30 P M.
