Reeve Marz called the meeting to order Requests were made to add the following items to the agenda-- 27a R. R Vickery item PRESENT ADD TO AGENDA Mr Wagstaff moved approval of the agenda with addition of APPROVAL AGENDA the above noted items CARRIED Mr. Boake moved approval of the June 8th, 1993 council meeting minutes APPROVAL CARRIED MINUTES Mr Marz left the meeting - time 9:05 A M Mr. Hoff, acting as Chairman, continued the meeting Mr Vickery moved approval of the accounts presented for payment today, subject to further review by the finance APPROVAL ACCOU committee of Richard A Marz, Otto Hoff, Richard M Vickery and James Hanger CARRIED Mr Jeffery's report was reviewed and various items discussed Mr Jeffery noted that the price for crushing 5/8" gravel at the Schmautz Pit would be $1 88 /yard and the price for crushing 3/4" gravel would be $1 75 /yard Because of the poor quality of the pit run Mr Haskell, the Public Works Superintendent, is recommending 5/8" gravel be crushed. Mr Hoff moved that Linden Contractors be authorized to crush 5/8" gravel at the Schmautz Pit CARRIED 1 J C JEFFERY REPORT �79a� l,�e�rrdi . . c K?uv riac�'Er� f 3 j 3 a I� i COUNCIL MEETING JUNE 22nd, 1993 Mr Wagstaff moved that a plaque be presented, by the Reeve, to both Mr Kevin Haller, a Stanley Cup medal winner 7 10O and Mr Brian Tutt, an Olympic medal winner, at the Kevin Haller Golf Tournament, to be held July 17, 1993 at the Three Hills Golf Course CARRIED Mr. Marz re- entered the meeting and reported that he had spoken with Ms Carol Haley, M L A for Three Hills regarding the SR 836 road project - the ten miles of base course from SR 575 north to Highway 27 The province is willing to contract the project for $1 million A discussion followed on the cost for the M.D. workforce to undertake this project and the feasibility of completing the project this year It was agreed that, given the lateness of the construction season, more manpower and equipment would be needed if the project had to be completed this year Mr. Bud Haskell entered the meeting - time 9.30 A M v s(c '36 The SR 83 was discussed with Mr Haskell who noted that this project would require approximately 50,000 yards of 1 1/2" gravel and 25,000 yards of 3/4" gravel Gravel for this project has been crushed and stockpiled at the Canning Stockpile, 35,458 yards of 1 1/2" at $8.16 /yard, 21,580 yards of 3/4" at $8 56 /yard. In addition, gravel is available at the Garson Pit; 20,000 yards of 1" at $2 80 /yard and 10,000 yards of 3/4" at $2 90 /yard Total gravel costs for this project would be approximately $474,000.00 Mr Jeffery reported that both Mr Leon Root and Mr Jim Bussard from Alberta Transportation were aware that the M D had gravel in place for this project Mr Jeffery compared costs of the SR 582 road project, undertaken last year. Costs to do the base course amounted to $93,356 58 for the eight mile project These costs included engineering of approximately $100,00.00 It was also noted the costing was at government rates, not actual M D costs Mr Vickery raised some concerns that, over the last few years, the secondary road projects were taking priorities over divisional gravel needs. It was generally agreed that Mr Marz should speak to Ms Haley again and determine if the contract price included using M D gravel. Mr Marz left the meeting - time 9.55 A M Item #3 on J C Jeffery report was next discussed Mr. Jeffery reported that Alberta Traffic Supply was awarded the bid for the township and range signs L & M Signs had offered a discount after learning they had lost the bid and that the M D would receive a discount when dealing with Alberta Traffic Supply because they were a member of the AAMD &C Mr Larry Goodhope, Director of AAMD &C, had advised the association would be paying any legal fees if any action was taken as a result of this tender award Mr Jeffery noted that a recent court case had decided the phrase 'lowest tender not necessarily accepted' did not cover Council's tender decisions and recommended this phrase should deleted from future tenders and replaced with a prepublishment of AAMD &C member discounts 2 SR 836 BASE COURSE - 10 mi i 4 L r r-I C COUNCIL MEETING JUNE 22nd, 1993 Mr. Marz re- entered the meeting - time 10 00 A M Item #4 on J.0 Jeffery report, Three Hills Main Street sidewalks was next discussed For the benefit of the new councillors, Mr Marz gave a brief background on the sidewalk outside the M D. office When the M.D. office was renovated two years ago the M.D paid for the sidewalks outside its building with the understanding a portion of MAIN STREET the costs would be refunded by the town No monies were SIDEWALK refunded Now the town is replacing, as a local improvement, the portion of the sidewalk on their property. The M D will have the option to pay for total costs immediately or elect to pay costs over a number of years Mrs Lowen recommended the M D pay for the sidewalk over a number of years Item #6 on J C Jeffery report, shop robberies, was discussed Mr. Jeffery noted that the insurance coverage is $1,000 00 deductible for each incidence He has SHOP ROBBERIES discussed this with Mr Larry Goodhope in an attempt to revise the policy /procedure Mr Marz left the meeting - time 10.15 A M Mr. Vickery moved to accept Mr Jeffery's report CARRIED The Executive Committee report was reviewed next Item #1, Lowen /Andrew access road was discussed It was noted that 'exhaustive negotiation' had to be reached before any expropriation steps could be taken It was suggested a letter be obtained from Mrs. Lowen outlining her conditions for sale Mr. Marz re- entered the meeting - time 10.20 A.M. Mrs Lowen moved that legal advice should be obtained to determine the costs for expropriation. CARRIED Mr Hoff reported that Alberta Transportation will be funding the Earl Paget Service Road and will advise as soon as funds available. Due to a prior commitment, Mr Boake requested Mr Rick Vickery attend the Palliser Regional Planning meeting about building inspections on June 28th, in Hanna at 11:00 A M Mr Boake noted that under item #17, June 14/93 power pole accident, the accident occurred in the Linden Church Road and not the Linden Home Road, as recorded in the Executive Committee report Mr Boake moved the Executive Committee Report be accepted CARRIED EXEC COMMITTE REPORT LOWEN /ANDREW ACCESS RD �t 9 /rJ,tG /-woe O.K The June 10th, 1993 Budget Comparison Report was reviewed BUDGET COMP by Mr. Jeffery RFPORT Mr Marz moved to accept this report. CARRIED A short coffee break was held from 10.15 A M. until 10 40 A M and Mr Marz did not return to the meeting when it resumed 3 )Z4/n� N rq • N COUNCIL MEETING JUNE 22nd, 1993 It was noted that item #7 on the agenda, township and range signs, had already been covered when Mr Jeffery had verbally added to his report that the AAMD &C would cover any legal fees resulting from the tender decision Mr Boake moved to accept and file this information CARRIED Mr Bud Haskell, public works superintendent, gave his report He noted that the Doug Goodine Road, located W of 15 & 22 - 28 -22 -W4 had been gravelled sometime in the past and would be alright for re- gravelling and the ditches cleaning Mrs. Lowen moved that the Doug Goodine Road be gravelled and the ditches cleaned out. CARRIED Mr Haskell recommended that prior to chipping the SR 587 patching with hot mix be done at the Hoppins corner, west of the Bigelow Dam, Gary Tetz and at the bridge between Hastie and Gelinas. This project is scheduled for next week, weather permitting Mr Marz re- entered the meeting - time 10.48 A.M Mr. Haskell was requested to bring a report to the next meeting on winter work gravelling Mr. Vickery moved to accept the public works superintendent's report CARRIED Mr Marz reported that he had spoken again to Ms Haley about the SR 836 project and advised her that the M D had crushed and stockpiled all the gravel required for this project Ms Haley advised that should the M D. undertake the SR 836 project all gravel would be paid by the province and also all contractor criteria must be met Mr Marz suggest that, due to provincial budget cuts, in future, should the M D undertake any road projects for Alberta Transportation, a written commitment should be obtained before any crushing or stockpiling of gravel be done Mr Marz noted that he had expressed concerns to Ms Haley that, if the M.D undertake the contract, it may take two seasons to complete He noted that Ms Haley seemed willing to work with us and sounded most accommodating P W S REPORT SR 836 BASE COURSE - 10 mi Mr. Marz moved that the M D accept the SR 836 base coyrs -!O �#6N,GN�Ay Z -7 project, for the ten miles from SR 575 north to('Highway 11' ,,5,,. for the contract price of one million dollars prdv3aed the province grants flexibility that, in the event the project is not finished this year, it can be completed the following year CARRIED It was agreed a letter be faxed to Ms. Haley conveying G& a,cd� Council's decision on this project Mr. Hoff returned the Chair to Mr Marz - time 11.00 A M The 1993 road program was reviewed and each councillor listed his /her division priorities - 4 fxl- Y�l a a i i' I s, ra COUNCIL MEETING JUNE 22nd, 1993 Division #1 1. Jim Radomske North - West of 17 & 20 in 34 -24 -4 - 2 miles regrade and regravel 28 foot top A discussion followed on current transportation policies Mr. Marz requested that an overall priority list be made and that secondary roads be kept separate from local roads. Mr. Wagstaff requested 72 hour road counts be taken on all divisional first priority roads and the results be reported at the next meeting. Mr Hoff moved to table the road program until the next meeting, that all councillors prioritize and evaluate their road priorities, that traffic counts be taken on all 5 1993 ROAD PROGRAM COUNCIL MEETING JUNE 22nd, 1993 priority roads and the results presented at the next meeting CARRIED Mr Jeffery read a letter from the Town of Trochu listing the offer and conditions to purchase P -8 A discussion followed reviewing that, in light of the proposed SR 836 contract just received to -day, it maybe beneficial to keep the grader Mr Vickery moved that, due to information received this morning regarding SR 836 road project, his motion made at the last Council meeting to sell the P -8 grader to the town of Trochu be rescinded and the M D keep this grader for its own use CARRIF�D The meeting adjourned for lunch from ]2.45 A M until 1:00 P M Mr. Boake moved the meeting proceed 'in camera' CARRIED Mr. Hoff moved the meeting now continue. CARRIED Time 3.55 P.M Mr Vickery moved to table agenda item #11, Division #7 operating hours, until the next meeting CARRIED The request from Mr. Dan Worobec for grader work to level a 50' wide strip of land for development of an airstrip was reviewed. Mrs Lowen moved that Mr Worobec be sent a letter informing him of the M D policy regarding grader work on private property CARRIED A discussion followed on the Linden Home road and the need for dust control Mr McCook, the grade foreman, has recommended the road be left as gravel this year and base coursed next year Mr Boake noted there are fourteen residences, a nursing home and a school on this road and that the traffic volume is high. Mr. Hoff moved that prices be obtained for calcium chloride and LS2000 to be applied on the Linden Home Road from the Linden Road pavement north past the school and the least expensive of these products be applied to the road at a cost not to exceed $6,000 00 CARRIED Mr Haskell noted that the work at the Landymore drainage ditch located in N W 22- 32 -26 -W4 will proceed as soon as the hi hoe is available. Toews to discuss the necessary acquisition of land in WNW 16- 30 -25 -W4 S.E. 17 30 -25 W4 to provide access out from the south of LOW LEVEL the low level crossing in WNW 16-30-25-W4. CROSSING 6 ra�lly� N N COUNCIL MEETING JUNE 22nd, 1993 Mrs Lowen moved to accept and file the information LEONHARDT WATEF concerning the Leonhardt water drainage problem at DRAINAGE PROBL.E 6- 29 -21 -W4 CARRIED Mr Wagstaff reported that he and Mr Haskell had inspected the E Riep road approaches The work could be done in fall with the traxcavator Mr Wagstaff moved the two approaches, one located on the north road at the boundary between SW & SE 6- 34 -22 -W4 and E RI EP APPROAC the other located in the south east portion of the east road if S E 6- 34- 22 -W4, be brought up to standard, as per -T,,g inoin-Z" & policy CARRIED Mr Haskell reported that he had inspected SR 836 south of SR 575 There appeared to be a lot of heavy traffic using the road to get into the Sharples plant The divisional grader operator had bladed the road Mr. Hoff noted he had SR 836 south travelled on the road last Sunday and it was fine of SR 575 REPOF Mrs Lowen moved to accept and file this information. CARRIED The Louis Sich rock problem was discussed. It was noted that the main crew had ripped and picked rocks a least L SICH ROCK twice last year on this land PROBLEM Mr Wagstaff moved that the M D do one final rock pick on this land. MOTION LOST Mr Jeffery reported that Alberta Transportation had agreed to sell the small "V" parcel of land, beside the Meston property, in S.W. 34- 29- 21 -W4, where the roads meet Mr Boake moved the M.D. purchase Pt S.W. 34- 29 -21 -W4 0 05 acres) for the purchase price of $1 00 (one dollar) CARRIED Mr. Marz requested the dirt road north of Keivers, west of 7 &12 in 32 -25 and also the dirt road west of 17 in 32 -25 -W4 be widened to allow easier accessibility for farm machinery travel The work would entail a cat and possibly a buggy and should take not exceed two days work Mr Mvz�oved the dirt road north of Keivers, located west " of 7 in 32 -25 -W4 and the dirt road west of 17 in 32 -25 -W4 be widened and any culverts extended, if necessary That a cat and operator be allocated to do this work, for a period not to exceed three days and if necessary, a buggy and operator be assigned to the project, for a period not to exceed two days CARRIED The meeting adjourned in order to hold the public hearing scheduled for 4.30 P.M. Mr Vickery moved first reading to by -law number 1285, this being the by -law to remove part S W 20- 34 -23 -W4 (8 00 BY -LAW 1285 acres) from the hamlet of Huxley boundaries and redesignate the parcel to agriculture land. CARRIED Mr Wagstaff moved second reading to this by -law CARRIED Mr Boake moved third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mrs. Lowen moved third reading to this by -law CARRIED Mr Jeffery noted an application has been received from Mr Frank Davidson to amend the land use by -law and redesignate S E 20- 31 -21 -W4 from Agriculture Conservation to Agriculture Mrs Lowen moved the required public hearing be held on Tuesday, July 27th, 1993, commencing at 4 30 P M and the required notice of the public hearing be made CARRIED Mr. Vickery reported that the June 16, 1993 Wimborne ratepayers meeting was very positive. A discussion followed on some of the concerns raised at the meeting - - need to draw up a map for the proposed cemetery expansion - plant trees south of the ball fence - mark roadways in the cemetery - some road repairs necessary - signs requested coming into hamlet and at Highway 27 - water problem on Main Street - more street lighting required - grass west of pumphouse needs mowing - the A.S.B to be complimented on the excellent job of looking after the playground Mr Vickery moved that Alan Meding and the traxcavator be assigned to work with Alex Cunningham and Paul Ehmann to rectify the water drainage problem and the other problems, as per list CARRIED PUBLIC HEARING F DAVIDSON SE 20- 31 -21 -W4 Awmr,s,�z/w CswrroG _n,-f -74 i/P/93 WIMBORNE RATE PAYERS MEETING -:7-d —o- m's"Q 7; ,-o Mr Vickery reported that Mr. Fred Maetche has requested an approach on S.E. 3- 33 -26 -W4 This is conditional for his F MAETCHE subdivision application It was noted that this land abuts APPROACH REQUES Highway #27 on the south and SR 805 on the east and that an S E 3- 33 -26 -W4 approach already exists. CARRIED Mr Hoff moved the required public hearing for the Three Hills Creek Structure Plan be set for Tuesday, August 24th, 1993 at 1 30 P M and the required notice of the public meeting be made CARRIED Mr. Wagstaff requested to discuss item 27b - Ben Schmidt lagoon. PUBLIC HEARING1 DATE FOR THREE HILLS CREEK AREA STRUCTURE PLAN Mr Vickery moved he be excused from discussions and voting R VICKERY on this item due to family involvement. MOTION TO BE CARRIED EXCUSED Mr Vickery and Mr. Cunningham left the meeting - time 5.10 P.M Mr Wagstaff advised the meeting that Mr Schmidt is not agreeable to the M D digging a ditch to the north of the lagoon to divert water away from the lagoon It was noted BEN SCHMI DT the lagoon is located on a creek bed in the bottom of a LAGOON coulee 710 Mr Marz moved to table this item until next meeting; have Mr Haskell go and inspect this site, take any necessary level readings and report back to council next meeting CARRIED Mr Vickery re- entered the meeting - time 5.15 P M Mr Wagstaff moved to supply two loads of gravel, only when the gravel crew is in the area, to the road allowances outside Mr. Wally Rasmussen's and Mr Elmer Wik's residences in Huxley CARRIED Mr. Wagstaff moved to table item 127b - Huxley Streets and place this item on Mr Haskell's report CARRIED Mr. Vickery moved approval for a yield sign placed at the Clarence Martin intersection and also one placed at the Fred Schneider intersection CARRIED Mr. Vickery reported that Mr Bill Strohschein has requested the M D gravel that road allowance between SR 587 and his field approach in an effort to prevent mud coming onto the pavement from his machinery and trucks The approach is one quarter mile east of the sulphur plant corner on SR 587.
