Development Appeal Board Hearing - 4.30 P M Linden Farms Ltd 2 C. v COUNCIL MEETING JUNE 8th, 1993 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Council Chambers, M D Office Three Hills, Alberta, on Tuesday, June 8th, 1993 commencing at 9 00 A M The following were present for the meeting: Reeve. CARRIED Mr Boake moved approval of the May 25th, 1993 council meeting minutes CARRIED Mr Wagstaff moved approval of the accounts presented for payment today, subject to further review by the finance committee of Richard A. Marz, Otto Hoff, Richard M. Vickery and James Hanger CARRIED The bank reconciliation statement for the month of May, 1993 was reviewed and discussed APPROVAL MINUTES APPROVAL ACCOUNT`. BANK STATEMENT Mr Boake moved approval of the bank reconciliation statement CARRIED Mr Jeffery's report was reviewed and various items J C discussed JEFFERY nrnnnT Mr. Boake moved approval of Mr 1 Jeffery's report CARRIED N Ln COUNCIL MEETING JUNE 8th, 1993 The Executive Committee report was reviewed and various items discussed. Mr Hoff moved approval of the Executive Committee report. EXEC COMM CARRIED REPORT There was discussion about the St Ann Ranch road The section of the road within the town requires considerable work and the drainage coming from the town should be ST ANN corrected in order to stop on -going damage to the road south RANCH of the town boundaries ROAD It was noted that a committee of councillors had met with a committee from the Town of Trochu and discussed this road and various other matters It had been suggested the town should look at up- grading their portion of the road and perhaps the M.D. could take the high hoe up and clean out the east ditch Mr Wagstaff noted Mrs Frere would like the approach into ST her property widened as it is too narrow for buses, etc ANN RANCH ROAD Mr Wagstaff moved the M.D. extend the south approach into APPROACH St. Ann Ranch property, (next to the bridge) with one length of culvert, and further moved the M D would be agreeable to paying the cost for fixing that portion of the road within the M D of Kneehill if the town proceed with fixing their portion of the road AND CARRIED DITCH CLEANING Mr Boake moved the M.D proceed with cleaning the ditch on the east side of the St. Ann Ranch road from the south boundary of the Town of Trochu south to the bridge CARRIED It was noted during committee discussions with the Town of Trochu, the town had verbally offered the M D. $30,000 00 P 8 plus interest for P -8, with payment to be spread over a 3 can ",A year period. SCJ Mr Vernon Haskell entered the meeting at this time ► v The town would pay $8000.00 on July 1st, 1993, a second mP� payment on July 1st, 1994 and a third payment on July 1st, w,A 1995 -., a It was noted to date no official letter regarding this has been received The Town also asked the M D to do the annual maintenance checkup on the grader prior to the sale They would also like the M D to do regular maintenance work on the grader on a on -going basis at government rates Mr Haskell suggested if the M D sell the grader on an as is, where is basis, it would be a reasonable deal. Mr Vickery moved the M.D. sell P -8 1985 Champion Motor Grader, Model D740 A to the town of Trochu on the following terms: $ 8,000.00 payable on July 1st, 1993, $11,880 00 payable on July 1st, 1994 and $11,440 00 payable on July 1st, 1995 2 t r t Im COUNCIL MEETING JUNE 8th, 1993 for a total price including interest of $31,320 00, and the M.D. agree to change the oil and filters prior to delivery of the machine to the town, and further moved the town be advised the M.D. would be willing to undertake negotiations with the town regarding regular maintenance of the grader CARRIED There was discussion about cost sharing arrangements with the town for garbage disposal and fire protection. Mr Wagstaff moved a committee of Otto Hoff, Robert E MEET WITH Boake, Marylea Lowen and John Jeffery meet with the Town of TROCHU Trochu to discuss the transfer box /waste disposal agreement RE and the joint fire protection agreement FIRE CARRIED AND GARBAGE AGREEMENT Mr. Haskell's report was reviewed and discussed. —7- The need for hot mix for the approach leading on to the Gorr north road was discussed Mr Haskell noted he was HASKELL advised using SB 90 on the approach would likely be RE— P�- satisfactory instead of using hot mix. � ted He also noted SB 90 has been put on the Grainger Road at a cost of about $8800.00 a mile for the product for a 28 foot SB 90 surface Total cost was $14,956 and 1080 yards of gravel was used Will be putting SB 90 on the Fisher Davidson road starting today The SB 90 on the Grainger road looks good at this time. Mr Haskell noted the Linden Home Road should not be base coursed this year It is too soft. Mr. Boake noted at least one mile from the Linden Access LINDEN road up tp and past the nursing home must be based and HOME ROAD chipped or some type of dust control put on It was suggested LS2000 be put on the road to allow it to tighten up for a year There was discussion about this LS2000 road Mrs Lowen moved to accept the report from Mr Haskell and MONITOR further Mr Haskell monitor the condition of the Linden CONDITION Home Road on an on going basis and report back to council at a later date CARRIED Mr Haskell reported about using Roundup on the sides of the roads to stop the grass growth 250 miles were done, ROUNDUP cost of $4752. for 54 ten liter jugs of chemical. The miles COST of roads done were: Division 1 - 57 miles, Division 2 - 50 miles, Division 4 - 49 1/2 miles, Division 6 - 43 miles,eC�rrd Division 7 - 47 miles and no miles were done in Division 3 tr or Division 5 C- C,04 � .L If the experiment works it will save the grader from having to make 3 passes to keep the grass off the road surface. There was discussion about the contract grader in Division 5 CONTRACT He appears to be doing a good job Mr Hanger noted there GRADER is a crown now on some of the roads The grader has been over the entire division now Mr Haskell reported the grader shop door was damaged GRADER yesterday It will be necessary to replace the bottom SHOP DOOR panel Cost about $500 00 DAMAGED 3 lV �q ra WWI COUNCIL MEETING JUNE 8th, 1993 The road committee report was discussed The road committee feel the second approach on the Allen Toews land - S E 8- 31 -25 -4 - should be removed and a service road constructed for safety reasons There may be a problem getting dirt for the service road. Mrs Lowen moved a service constructed at this time and the removed on condition Mr. Toews is the necessary No Compensation willing to provide the dirt approach at no cost to the M D. road ESE 8- 31 -25 -4 be second (south) approach be willing to enter into Agreement, and is also .or the service road and CARRIED The road constructed by an oil company ESE 14- 29 -22 -4 was not built to standards It is very poorly constructed and the company should be contacted There was discussion about the Meding Blade grade road The road committee had recommended it not be done despite the recent motion to proceed with construction The road WNW 2- 33 -24 -4 was discussed. The side slopes need some work before the the M D accepts responsibility for the road Mr Vickery moved he be excused from discussions and voting on Item #20 on the road committee report due to family involvement CARRIED Mr Vickery left the meeting The road committee had met with Ben Schmidt regarding the drainage problem from the M D road into his sewage lagoon He would be willing to allow the M D to use the high hoe to dig a deeper ditch to the north of his lagoon to divert the water away from the lagoon The committee recommend this be done only if Mr. Schmidt would sign an agreement indicating he was in agreement with this solution Mr Marz moved the M. D. allow the high hoe to dig a ditch on the north side of Mr. Schmidt lagoon on S W 10- 34 -24 -4 in order to allow the excess water coming from the springs on the M D road allowance to bypass the lagoon, on condition Mr Schmidt will allow access to his land at no cost and he agrees the M D will have no further responsibility for the drainage ditch on his property in future CARRIED Mr Vickery returned to the meeting at this time. Mr. Wagstaff moved the June 4th report from the road committee be accepted excluding the recommendations about Item 15 - Varga culvert and Item #17 - Meding Blade Grade and these recommendations not be accepted. CARRIED The annual road tour which was held yesterday was discussed The following roads were inspected during the road tour 4 ROAD COMM REPORT SW 8- 31 -25 -4 SERVICE ROAD ROAD ESE 14- 2-27 -4 MEDING BLADE rRADF ROAD WNW 2- 33-24-4 BEN SCHMIDT SEWAGE F ArnnN APPROVAL ROAD COMMITTE ANNUAL ROAD TOUR -'T-° O C [A COUNCIL MEETING JUNE 8th, 1993 Division 4 - 1 Old #21 - from SR 582 north 2 miles - re -grade and re- gravel with a 28 foot top 2. SR 583 - 9 miles - need funding from the Province 3 miles should be rebuilt and repaved and 6 miles need side slopes The intersection and the Brietzke corner also need work 3 Mt Davis Road - 2 miles - re -grade and regravel Mr Marz indicated his priorities would be- 1. SR 583 This is also the M D 's top priority as far as getting funding from the Province for secondary roads 2. Allan Hazel Road - 5 miles South of 26, 27, 28, 29, & 30 in 32 -25 -4 3. Mt Davis Road - West of 30 & 31 in 31 -24 -4 He felt this road needs "Keep Right" signs and is not a high priority for re- construction due to the low amount of traffic. Mr Haskell and the grader operator did not feel SR 583 was a very high priority There was discussion about the need to do ditch cleaning to improve some of the roads and do some hill cuts for safety reasons and this might eliminate the need for a total rebuild Division 6 1. Penner West 1 mile South of 29- 31 -23 -4 4 H King South 2 miles West of 26 & 35 in 31 -22 -4 Mr Hanger indicated his priorities would be: 1 G Penner West 1 mile South of 29- 31 -23 -4 regrade and regravel - 28 foot top 2. F. Penner East 1 mile South of 18- 32 -23 -4 regrade and regravel - 28 foot top 3 H King Road South 2 miles West of 26 & 35 in 31 -22 -4 regrade and regravel - 28 foot top 4. Bogner Road 1 1/2 miles South of 5 & 4 in 32 -23 -4 regrade and regravel - 28 foot top. It was agreed council will review the suggested roads in Division 1, 2, & 3 and the King Road south again on the next road tour Mr Hoff moved the annual road tour be completed on Monday, June 21st, 1993, commencing at 8 00 A M CARRIED Mr Marz reported he had met with Walter Landymore about the drainage ditch on their land The water is backing up LANDYMORE and flooding an area of their neighbor's land DRAINAGE DITCH It was suggested the M.D. should not be involved in cleaning out this ditch which is on private land. The meeting recessed for dinner between 12 00 Noon and 1.00 DINNER P.M. Mr Haskell returned to the meeting after dinner Mr. Marz did not return to the meeting at this time Deputy Reeve Otto Hoff took charge of the meeting Mr. Haskell noted the Town of Three Hills would like the M.D. to chip seal about 500 feet of a road in town TOWN OF They are willing to pay for this work at government rates THREE HILLS The road is dirt and they want it oiled and chipped to keep REQUEST the dust down CHIP Mrs Lowen moved the M D undertake this work for the Town SEAL of Three Hills, provide the oil and chips at M D cost and ROAD labour and machinery be charged out at government rates CARRIED <rr� 6 U D�a �q COUNCIL MEETING JUNE 8th, 1993 Mr Jeffery read a letter received from Lawrence Hogg regarding the loss of his dam He was requesting council to reconsider their decision and assist him with well NNE 23- 34 -24 -4. replacement of his dam or compensate him for the cost of allowance and the top repair Council had reviewed the site during road tour on Monday Mr Haskell noted they had opened the culvert one day, the beaver plugged it of f that night and the crew had LAWRENCE again opened the culvert the next day. reasonable manner possible HOGG DAM Mr. Hanger moved Mr Hogg be advised council is not CARRIED"'" prepared to change its previous decision CARRIED Ken DeBeaudrap had requested the M D make some changes in the approaches on Edgar Riep' land The approaches were E RIEP inspected and it appears there is presently four approaches ROAD on the two quarters - S W and S E. 6- 34 -22 -4. APPROACHES Current M D policy regarding the M D 's responsibility for S HALF 6 provision of culverts and approaches was also reviewed 34 -22 -4 Mr Vickery moved Mr Wagstaff and Mr. Haskell inspect the C 3 approaches and the request be tabled to the next meeting of council. ��'``° ° CARRIED '� `. The low level crossing ENE 30- 30 -23 -4 - Item # 18 on the agenda - had been inspected by the road committee and the LOW LEVEL committee recommended 200 yards of pit run be use to build CR 0 S WING up the creek bottom, and the sides of the bank cut down and ENE 30 -30 the approaches to the creek be improved. Mrs. Lowen moved as the Road Committee recommendation has I been approved, this request be accepted and filed CARRIED There was discussion about the flowing well NNE 23- 34 -24 -4. The well is actually located on road allowance and the top FLOWING part of the well casing is rusting out WELL NNE 23-34 - Mr. Wagstaff moved the M D accept responsibility for fixing 24 -4 the well casing in the most reasonable manner possible 3 W CARRIED"'" r Mr Vickery noted the road culvert NW of N.W 11- 33 -23 -4 is either plugged or crushed and the water in that area is not draining away The culvert may need to be replaced with a larger culvert Mr Hanger moved the culvert be inspected and replaced if necessary CARRIED Mr Hoff noted the Swalwell Community Association has requested the M.D. do some buggy and grader work on the east side of the community center. Water is draining into the basement and to prevent this the area needs to be landscaped There is dirt on the west side of the center which could be used It was suggested the community center should be advised to install eavestroughing on the building which would also help keep water away from the building. Mr. Vickery moved the M D undertake a maximum of three hours work for the Swalwell Community Center Association, 7 ROAD CULVERT NW /NW 11 -33 23 -4 P 0,' 6� SWALWELL COMM ASSOC 0- o tj�'j Gos1r % 7tt lek4er 5c(�} �11 L �1 COUNCIL MEETING JUNE 8th, 1993 on a no charge basis, and the work be done when the main crew is working in that area CARRIED Mr. Marz returned to the meeting at this time and took charge of the meeting Mr Wagstaff noted the road between land owned by the Hutterian Brethren of Huxley and John Cranston land west of the west half of 19- 34 -22 -4 going south from the Buffalo Jump Road needs some brushing done Mr Wagstaff moved the M D do whatever brushing work is necessary, either machine or hand brushing, to widen the road sufficiently to allow machinery to move down the road CARRIED Mr Marz discussed with Council his conversation with Mrs Walter Landymore regarding the need to clean the drainage ditch on their land. Mrs Landymore indicated they would be willing to have the ditch cleaned out, but the dirt removed from the ditch is to be taken and spread on a small triangle area on their land N E 22- 32 -26 -4 and the area be seeded to grass She also does not want the work done until fall, which will not solve the problem for Mr. Keintz as he cannot hay his land until the water is drained off. She wanted assurance the extra water will not flood their land and noted there is a flood gate on their land - N E 22 to control the flow of water into their dam Council agreed it would not be possible for the M D to guarantee the extra water would not flood Landymore's land. Mr Hoff left the meeting at this time 1.45 P M Mr. Hanger also left the meeting at this time. Mr Wagstaff moved Mr Vickery, Mr Boake and Mr Marz make an inspection of this site and bring a recommendation back to the next meeting of council CARRIED It was agreed the committee could do this on Monday, June 14th, 1993 at 2.00 P M and Mrs Landymore agreed to meet the committee at that time. Mr Hanger returned to the meeting at this time The bids received for the township and range signs was discussed at length. Mr Hanger moved the M D put up half of the township and range signs in 1993, the administrator obtain prices for provision of half the number of required signs and bring a report back to the next meeting of council MOTION WAS LOST Mr Boake moved all the township and range signs be purchased and put up in 1993 and the lowest bid received be accepted. Mr Jeffery left the meeting to obtain some information about the low bidder and the vote on Mr Boake's motion was not taken at this time 0 K BRUSHING PROJECT W rw 19- T4---2 2 --- 4 LANDYMORE DRAINAGE DITCH co -o n--, N 't � 'r e, C � i TOWNSHIP AND RANGE SIGN BIDS 1, Seri L 11 0 0 COUNCIL MEETING JUNE 8th, 1993 Mr Marz noted all fuel tanks in the Province will have to be registered under the MUST program and he reviewed some of the regulations under this program Mr Wagstaff noted MUST he had obtained a list of approved installers and removers PROGRAM of fuel tanks and a sample of the necessary application FUEL form to get the tanks registered. TANKS Mr Haskell noted the if a fuel tank is over a certain height it must have a 2 hour fire rating on the stand This can be accomplished by using reinforced concrete Mr Cunningham entered the meeting at this time 2.50 P M He discussed the fuel tank regulations further with council and noted the tank which the M.D. recently put up at Leo Brietzke' cannot be registered under this program Mr Jeffery returned to the meeting and noted the low bidder for the township and range signs is a reputable sign company and has done business with the M D in the past A vote was taken on Mr Boake's motion about township and range signs and it was declared to be CARRIED. Mr. Cunningham noted plans for installation of fuel tanks must be approved by an engineer and submitted to Alberta Labour for their approval before the tank is put up Also the tank must be erected by an approved installer He suggested the entire M D fuel operation should be reviewed and perhaps a different system for providing fuel may have to be considered Perhaps having a fuel truck to fuel up all the crews plus the divisional graders may have to be looked at Mr Wagstaff noted the fuel truck the M D presently has will not meet new regulations which will be in placed by 1995. There was discussion about the possibility of using keylocks Mr Cunningham noted the tank which was purchased and put at Leo Brietzke' cost about $1900 00 In order for a tank to meet current regulations it would cost about $6000 00 All M D fuel tanks will have to be registered by August 31st, 1993 Mr. Wagstaff moved the fuel tank which was to be purchased for an alternate location in Division 7 not be purchased at this time until the MUST regulations can be further reviewed CARRIED It was suggested this entire issue should be discussed with the Province through the AAMD & C as the regulations under this act are not reasonable Mr Boake moved the M D contact other Muncipal Districts and Counties regarding the MUST program and see if a resolution about this matter should be discussed at the zone level and brought forward to the Fall Convention CARRIED 9 TOWNSHIP AND RANGE BID FUEL TANKS AND FUEL OPERATION 3V\P y�, 0 2� Ll COUNCIL MEETING JUNE 8th, 1993 Mr Wagstaff suggested his divisional grader operator be provided with a truck and a slip tank instead of purchasing a stationary fuel tank for the alternate location It was also suggested the M D should look seriously at eliminating some of their existing fuel tanks. Mr Wagstaff moved Division 7 and Division 4 motor grader operators be provided with an M D vehicle with a hitch and a slip tank for use as a mobile fuel storage system CARRIED Mr Cunningham left the meeting at this time. There was discussion about the rate of depreciation and rate of interest being charged for costing purposes Mr. Wagstaff requested and it was agreed the Capital Committee should review the policy regarding depreciation and interest on capital investment for costing purposes and bring a report back to a later meeting of council The 500 gallon fuel tank purchased for the alternate headequarters for Division 4 grader was discussed. It was suggested this tank should be disposed of if it cannot be approved under the MUST program It was noted the trucks with slip tanks will have to be parked in the shop yard at night or the fuel will be stolen. Mr Boake showed council a video he had taken of the low level crossing area at N.W. 16- 30 -25 -4 He feels the low level crossing should be up- graded in order to provide access for the landowners in that area out to the north There was lengthy discussion regarding this matter Mrs Lowen moved Councillor Boake negotiate with Harvey M Toews, the owner of the S.E. of 17 regarding acquisition of additional land in order to provide access out to the south and bring a report back to council at a later date regarding possible cost for this land. CARRIED Mr Boake moved the status of the low level crossing be tabled until he has had an opportunity of discussing acquisition of land with Mr H M Toews CARRIED It was noted the motion made at the last meeting regarding the Division 7 motor grader operator working 12 hours a day 4 days a week was not voted on There was discussion about this idea and Mr Haskell noted it could be done on a trial basis to see how it will work out Mrs. Lowen moved a vote on Mr Wagstaff's motion made at the May 25th meeting of council be further tabled until the next meeting so all councillors can be present. Mr Goodine moved a trailer on to the S.W 22 or S E 21 in 28 -22 -4 and he would like some gravel on the M.D road It was agreed Mr. Maerz should inspect the road and bring a report back to council regarding the condition of the M D road Mr Cunningham entered the meeting at this time. The report regarding the meeting with the Town of Three Hills about the waste disposal site was discussed.
