Appeal Board Hearing - Suggest June 8th, 1993 at 4.30 P.M. ?Circulation distance s �N 11 H COUNCIL MEETING MAY 25th, 1993 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Council Chambers, M D Office Three Hills, Alberta, on Tuesday, May 25th, 1993, commencing at 9 00 A M The following were present for the meeting Reeve. Richard A Marz Division Four Councillors: Marylea Lowen Division One Otto Hoff Division Two Robert E Boake Division Three Richard M Vickery Division Six Glen Wagstaff Division Seven Mrs Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Councillor Hanger was not present for the meeting and Mr. Jeffery, Administrator is away on holidays Reeve Marz called the meeting to order Requests were made to add the following item to the agenda. 25a Blade Grade - Division 3 26b Request for relaxation of setback for pipeline Renaissance Energy Mr Vickery moved approval of the agenda with addition of the above noted items CARRIED Mr Boake moved approval of the May 11th, 1993 council meeting minutes CARRIED Mr Wagstaff moved approval of the accounts presented for payment today, subject to further review by the finance committee of himself, Richard A Marz, Otto Hoff and Richard M Vickery CARRIED Mrs. Wilkinson reviewed Mr Jeffery s report, and various items were discussed There was discussion about whether the local grid road system should be maintained given the direction from the ratepayers at the divisional meetings and today's tight economic situation. Mr Marz moved Poicy 13 -16 - establishment of a local grid road system - be cancelled and the grid road map be filed CARRIED Mr Wagstaff moved approval of Mr. Jeffery's report CARRIED The Executive Committee report was reviewed and various items discussed Mr. Vickery moved approval of the Executive Committee report. It takes about 3 weeks work for the association and there is some question about how useful it is The association wish some input from the members about this issue Mr Wagstaff moved the M D advise the association the M D. of Kneehill would like the survey to be done on an annual basis as the information provided is useful during annual salary negotiations and is also useful in seeing how serious various municipalities are in holding the line or making cut backs in salaries CARRIED The budget comparison report was reviewed and discussed It was noted the budgeted amount for Transportation grant was $493,000 and the actual grant has come in at $442,600 00, which represents a shortfall of $52,400 00 Mr Hoff moved to accept and file as information CARRIED Mrs Wilkinson noted an application has been received to redesignate Part of the S.W. 20- 34 -23 -4 from hamlet residential to agriculture Mrs Lowen moved the required public hearing be held on Tuesday, June 22nd, 1993, commencing at 4 30 P M and notice of the public hearing be circulated to the landowners within a one mile radius. CARRIED Mr Boake moved council meeting adjourn in order to hold a development appeal board meeting CARRIED Time 9.45 A M Mr Vickery moved Council meeting do now reconvene, the development appeal board meeting having been completed CARRIED Time 9:47 A.M. Mr Haskell entered the meeting at this time The road ban situation was discussed in detail Mrs Lowen moved the M D road bans be changed as follows. Heavy paved roads - 100% Light Coat Surfaced roads Mobil Plant Surfaced road SR 836 from SR 583 south t Three Hills Airport Access Keivers Lake Access Road - - 90% - 75% o Highway 27 - 75% Road - 75% 75% CARRIED There was discussion about whether implementation of a speed limit on gravel roads instead of banning them would be a better option 2 AAMD & C SALARY SURVEY SV <- 1,3 BUDGET REPORT APPLICATION REDESIGNATE G �3 HOLD DEV APPEAL BD MEETING ROAD BANS i SPEED LIMITS DURING BAN TIME X)o!4 N 1�q COUNCIL MEETING MAY 25th, 1993 Mr. Haskell reviewed his report Items number 24 and 20 on the agenda were covered by his report He had inspected the culvert WSW 6- 33 -22 -4 Culvert is 4 feet in size and should have extensions put on each end Mr. Wagstaff moved culvert extensions be installed as time permits. CARRIED He also inspected the culvert installed north of Grant McIntosh's residence WSW 6- 30 -22 -4 The culvert was installed across the road by the M D a few years ago However Mr McIntosh put in a water stop in order to fill his dam Mr Hoff moved the Public Works Superintendent discuss the situation with Mr McIntosh and ensure the water stop is removed from the culvert CARRIED It was noted the ditch along this road should be cleaned out but it can not be done until this fall because there is seeded land on the west side of the road The cost to have a contractor install the chain link fence for the Lions Campground was discussed M D crew is not set up to install chain link fence D & M Steel and Fencing of Drumheller will put up 570 feet of fence at a cost of $1710 00 but they would like the M D to drill the post holes. This cost is for labour only, the fence which was removed can be re -used and the Lions had agreed to provide new fencing for the area going south east towards the river. Mr Hoff moved the M D cover the cost for labour for erection of the chain link fence for the Lions Campground at a price not to exceed $1750 00, and the M D drill the necessary post holes for the contractor CARRIED Mr. Haskell had inspected the road WSW 26- 31 -23 -4. It is narrow and there is some brushing which should be done If the road is widened a culvert would have to be extended also It would require more than just a grader to do this work Mr Vickery moved to refer this matter to Councillor Hanger and if he wishes the road considered For re- construction he should bring a request to council at alater date CARRIED There was discussion about who would do spray the roads in Division 5 with Roundup to stop the grass growth Should the contractor be doing this work? Mr. Haskell noted the divisional grader operators are shutting down and spraying the roads in their divisions. It takes about 2 days to do a division It will be necessary to have the spraying done within the next week or it will be too late. Brian Sowerby is presently spraying in Division 2 3 P W S REPORT CULVET WSW 6- 33-22-4 CULVERT WSW 6 -30- 22-4 DITCH ('I FANINr, CHAINK LINK FENCE LIONS FAMPAPmIND i.GV"r a a d � lei ROAD WSW 26 31 -23 -4 :` 40 fATr` DIV 5 SPRAY ROADS ROUNDUP 11 L L N COUNCIL MEETING MAY 25th, 1993 It was generally agreed Mr Haskell should ensure the roads in Division 5 are sprayed by M D staff within the next week as the contract grader operator should not be doing this type of work Mr Haskell also suggested the 6 miles of the Fisher Davidson road should be sprayed, not just the first 2 miles. It was agreed this should be done Mr Boake moved to accept the Public Works Superintendent's report CARRIED The bids received for supply and erection of township and range signs were reviewed Bids were received from Hi Signs, Alberta Traffic and L & M Signs The bid from Alberta Traffic Supply Ltd for 9 inch x 32 inch high intensity sign, 10 foot U Flange posts and brackets, and including installation, appears to be what the M.D. requires and to be the most reasonable given those requirements. The company indicated they would provide all the signs in 1993 and negotiate a financing fee for half of the costs which would be paid in 1994. Mr. Boake moved Mr. Jeffery call Alberta Traffic Supply and determine what financing fee they would require and a decision on the bids be tabled until next meeting CARRIED Mrs Wilkinson noted no bids were received for P -8 Mr Wagstaff noted he was advised the bid from the Town of Trochu still stands - $24,000 00 payable in 3 equal annual installments Mrs Wilkinson read the letter from the Town of Trochu regarding their bid Mr Hoff moved the M.D. not accept the bid from the Town of Trochu and P -8 not be sold at this time. CARRIED Mrs. Lowen moved the annual road tour be held on Monday, June 7th, 1993, commencing at 8:00 A M CARRIED It was agreed all the councillors would meet at the office Mrs Wilkinson noted A G T. is holding the M D responsible for a cable cut at the Valleyview colony SW 16- 32 -26 -4. It appears from office records no cable locate was done, however the area was flagged The grader operator advised the Hutterites may have cut the cable when they were working in the area scraping up gravel. Further investigation determined the Grade Crew foreman had the location flagged by A.G.T., although no information was provided to the office. Mr Boake moved A.G.T. be advised the M.D will not accept responsibility for the cable cut CARRIED Mrs Wilkinson noted John Beekman had requested council consider imposing a speed limit on the road going south by St. Ann Ranch There is alot of traffic using the road and 4 TOWNSHIP AND RANGE SIGNS SALE P 8 NO BIDS ANNUAL ROAD TOUR CABLE CUT VALLEYVIEW COLONY SW 16- 32 -26 -4 le��0k SPEED LIMIT ST ANN RANCH ROAD .nuTH a N COUNCIL MEETING MAY 25th, 1993 it is very dusty. Also the big trucks hauling in and out of the Town of Trochu use the road and when they reach the bridge they are going quite fast Mr Wagstaff noted he was asked to consider putting a speed limit on SR 585 to cover the first mile east of town A review of the M.D. map shows the mile in question is in the town limits. Mr Wagstaff moved the Town of Trochu be advised of the concerns about this stretch of road CARRIED There was further discussion about a speed limit on the road past St Ann's Ranch It would be necessary for the town to limit the speed on the road in town as well SPEED LIMIT EAST OF TROCHU Mr Wagstaff moved the Town of Trochu be asked if they ST ANN would be willing to impose a speed limit on their section of RANCH ROAD this road and the matter be discussed again when their response is received. CARRIED Mrs Wilkinson noted Czar Resources would like to install a cattle guard on the road WSW 4- 33 -25 -4 Mr Vickery moved the M D approve this request in principle and once the signed agreement from the company is received the necessary by -law be considered by council CARRIED Mrs Lowen moved she be excused from discussions and voting on the next issue due to a family involvement CARRIED Mr Cunningham entered the meeting and discussed with council the problem which has arisen between Mr Gerald Leonhardt and Mr Ralph Lowen with regard to an M.D. road Some years ago the forced road which was taken from the S.W. and the S.E. of 32- 27 -20 -4 was closed 600 feet south of the north boundary of the S E 32. The land in the S E of 32 was purchased by Mr Leonhardt and the area of land in the S W was retained by the M D as Mr Lowen did not wish to purchase it The fence was moved back on to Mr Lowen's property line and since then Mr Leonhardt has been farming the area formerly used for the road diversion. However during cultivation operations last fall he worked into the 600 foot strip left open as public access Mr Lowen had expressed concerned about this and because Mr Leonhardt was cultivating right up to the property line, his fence would fall over Mr Cunningham had discussed the matter with Mr Leonhardt and he had agreed to leavethe area in question undisturbed in future and will spray it for weeds until the grass is re- established. Mr. Cunningham also noted Mr. Lowen has left some old bales and some machinery on the road allowance just south of his driveway There was also discussion about a dam which Mr Lowen has installed on his property The spillway is quite high and as a result the water is backing up through the culvert and on to Mr Leonhardt' land The spillway should be lowered so the water will not back up through the culvert as that could result in damage to the M D road There was also discussion about the ditch along the north 5 TEXAS GATE WSW 4- 33 -25 -4 LOWEN LEONHARDT PROBLEM N N A COUNCIL MEETING MAY 25th, 199 boundary of the N E of 32 It may need to be cleaned out to allow for proper water drainage in that area Mr Vickery moved both parties be advised the road �e�k 6 diversion is to be left open and clear of any obstructions, such as machinery, bales, etc , and Mr Leonhardt be requested not to cultivate any portion of the road diversion CARRIED DINNER The meeting adjourned for dinner between 11.45 A M and 1 00 P M Mrs. Wilkinson reviewed a brochure received about a frost penetration probe Cost is $250 00 each There was discussion about the value of this in determing whether road bans should be removed. Mr Vickery moved to accept and file as information at this time CARRIED Mr Boake moved item 22 on the agenda - report from Jim Hanger re. creek crossing ENE 30- 30 -23 -4 be tabled to the next meeting of council. CARRIED Mrs Lowen noted she had discussed the James texas gate situation with Mr. Clarence Colberg Mr Colberg does not feel he should have to clean the gate out and Mr James is not going to clean it out Mr Vickery moved the M. D. remove the texas gate and cancel the agreement with Tyler James, unless the texas gate is cleaned out by June 15th, 1993 or the dispute between Mr James and Mr Colberg is settled CARRIED Mrs. Lowen noted she has not yet had the opportunity to discuss the drainage situation with Mr Leonhardt and Mr Tchir Mr Wagstaff moved to table this matter until the next meeting of council. CARRIED Mr. Boake noted Gunther Neufeld had moved a mobile home on to the S.W. 16- 29 -29 -4 and he would like a blade grade constructed on the road WSW 16- 29 -25 -4 for about 400 to 500 feet to provide access to the mobile home. It may require installation of a culvert across the road near the intersection and will need a cable locate done Mr. Boake moved construction of 400 to 500 feet of blade grade road on the road WSW 16- 29 -25 -4 be authorized and first time gravel also be approved CARRIED Mrs Wilkinson noted Renaissance Energy has requested relaxation of the setback requirements for a pipeline They wish to install the pipeline within 15 meters (50 feet) of the south edge of the gravel road north of the N.W. 25- 32 -22 -4 It is not possible to install the pipeline on the north side of the road due to a feedlot 6 FROST PENETRATION POMP ENE 30 -30 -23 CREEK CROSSING JAMES TEXAS GATE �'5'wrs t, LEONHARDT DRAINAGE PDAM FM BLADE GRADE WSW 16 -29- 25 SET BACK PIPELINE ✓v � COUNCIL MEETING MAY 25th, 1993 facility which is located 100 feet back on the N W an existing farmyard. on that quarter 25 would restrict Mr Boake moved the M D allow Renaissance Energy to install the pipeline 50 feet south of the south edge of the gravel road NNW 25- 32 -22 -4 on condition the company agree in writing to lower the line at their own expense at any future time if required for any reason by the M D CARRIED Mrs Wilkinson noted Ken Busby, the contractor for Division 5 motor grader operations, has requested council consider the following He would like to do private work after hours or on Saturdays and bill people directly He does private work in the area now for Pan Canadian and others The terms of the contract with Mr Busby were reviewed and it is stated the grader must work regular hours per day as directed by the Public Works Superintendent There was discussion about control, and the fairness to the people in Division 5 as opposed to other divisions Mr. Vickery moved Ken Busby Grader Services Ltd. be allowed to do private motor grader work as long as the work is done after the regularly defined M.D. working hours, and if he does work for a ratepayer during the regular working hours, blading and or snowplowing driveways as outlined in the M D policy, the billing must be done through the M D CARRIED The request from Mr Busby to have his grader work on a Saturday if it rained during the week was also discussed Mr. Busby noted he does not work his grader operator on Sundays except in emergencies There was discussion about whether our grader operators should be allowed to do this also Mrs Lowen moved Ken Busby Grader Services Ltd be allowed to work on a Saturday in the summer season only, if necessary due to rain during the regular work week, and the M D operators also be allowed this option on condition their pay for any work on a Saturday be at their regular rate of pay, and not at at an overtime rate for the entire day CARRIED Mr. Wagstaff noted he felt it was unfair to expect the motor grader operators to provide their own transportation to their alternate headquarter field site. The M D provides transportation for all the other crews from the main shop in Three Hills to their work site He suggested Division 7 grader operator be paid mileage from the Trochu shop to the alternate location Mr Marz noted Brian Plant will work from the alternate location in Division 4 all summer Mx Haskell noted it would likely cost about $800 00 a year for mileage for the Division 4 operator to get from Three Hills to his alternate location Mrs. Lowen moved these motor grader operators who are not provided with an M.D. vehicle, be paid for mileage incurred 7 RENAISSANCE ENERGY RELAXATION REOUEST KEN BUSBY CONTRACT GRADER IP��Pr MOTOR GRADER OPERATORS MILEAGE E ;o 11 COUNCIL MEETING MAY 25th, 1993 from their normal headquarters to their alternate field location CARRIED The idea of the Division 7 motor grader operator working 4 days a week 12 hours a day was discussed Mrs. Wilkinson reviewed the proposed overtime agreement which would have to be entered into in order to comply with labour regulations. There was also discussion about whether an employee would be efficient working 12 hours a day, the concept of flex time for other employees, having the grader sitting for one normal working day a week, and various other issues Mr Wagstaff noted Robert Gundlach was interested in trying it out It would save him the cost of one day's travel to Trochu Mr Wagstaff moved Robert Gundlach be allowed to work a 12 hour day 4 day week under the terms and conditions of the overtime agreement on a trial basis for 2 months starting June 1st, 1993. There was also discussion about staggering the mechanics' and the parts persons days of work but no decision was made Mr Vickery moved to table the vote on this motion until the next meeting of council CARRIED Mrs Wilkinson noted Kelly Eskeland on behalf of Over The Hill Community Association had requested support from the M D council in connection with their application for a grant from the Province under the Community Facility Enhancement Program They need to repair the roof and install a new furnace in their building Total cost is estimated at $24,854 78. The proximity of the Over The Hill Community building to Drumheller, the M.D. present position with regard to funding rural community associations, and the fact that their M D grant had been reduced were all discussed. Mrs Lowen moved the M D send a letter to the Over The Hill Community Association indicating the M D 's support for their application for provincial funding CARRIED Mr Haskell asked about gravel for SR 836 Can they use some of the gravel which was crushed to specificiations at the Garson pit this spring as there is not sufficient gravel at the stock pile site for the entire 10 miles of road From SR 583 south needs gravel - about 3000 yards Mr. Vickery moved the gravel stockpiled at the Garson pit be used for gravelling 6 miles of SR 836 Mr Haskell noted council has approved two locations for gravel but the gravel foreman wondered if they were suitable for gravel Jackson Bridge south - road is too soft and gravel will just disappear The road west of the west half of 35- 29 -26 -4 is also questionable Mr. Boake 8 DIV 7 MOTOR GRADER OPERATOR 4 DAY WEEK TABLED OVER THE HILL COMMUNITY ASOC 1�EQIt GRAVEL FOR SR 836 REVIEW LOCATI GRAVEL Ln 1� N Ca COUNCIL MEETING MAY 25th, 1993 noted the road north of the Jackson bridge should also have gravel and would like that road and the Gibbs road drainage problem looked at during the road tour Mrs. Lowen moved these roads be inspected on the annual road CARRIED Mr Haskell noted the M D may not require the Dyna packer which has been rented from Blackwood Hodge This type of packer is required for secondary roads, but it is not so crucial for gravel roads They are discussing the rental agreement with Blackwood and if they are able to rent the machine out to another party the rental agreement may be cancelled The meeting recessed from 3.15 P M until 4.00 P.M. The meeting reconvened at 4.00 P M Mr Vickery moved council meeting adjourn in order to hold the public hearing scheduled for 4.00 P M today. CARRIED Mrs Lowen moved council meeting reconvene, the public hearing having been completed There was discussion about the request to redesignate the South West of 11 in 29 -23 -4 from agriculture conservation to agriculture to allow for subdivision of a 35 acre parcel for aqua culture purposes Mr Hoff moved first reading to by -law number 1284, this being a by -law to amend the land use by -law 1061 by redesignation of the S W 11- 29 -23 -4 from agriculture conservation from agriculture CARRIED Mr Boake moved second reading to this by -law.
