COUNCIL MEETING APRIL 19th, 1993
The April 13th regular meeting of the Council of the
Municipal District of Kneehill #48 which was adjourned
until 1.00 Monday, April 19th, 1993 reconvened at that time
in the Council Chambers, M.D Office Three Hills, Alberta.
The following were present for the meeting:

Mrs Jean Wilkinson, Assistant Administrator, was present
and recorded the minutes
Vernon Haskell, Public Works Superintendent, was also
present
Due to the absence of both the Reeve and Deputy Reeve,
James Hanger nominated Richard Vickery to act as Chairman
for this meeting
Councillor Vickery called the meeting to order.
Requests were made to add the following item to the agenda:

Reeve Marz and Deputy Reeve Hoff entered the meeting at
1.05 P M
Reeve Marz took charge of the meeting
Mr Vickery moved approval of the agenda with addition of
the above noted items
CARRIED
The 3 bids received for purchase of the used radios were
reviewed
Three Hills Farms Inc bid $125 00 for one Midland Radio
Jim Huckaby bid $4045 00 in total for the remaining radios
Neil Cameron bid from $5 00 each for 3 speakers and $57 00,
$72 00 and $78 00 for various radios - total of 8

Mr Hanger moved to accept the two higest tenders - Three
HIlls Farms $125 00 for one Midland radio and Jim Huckaby ACCEPT
for $4045.00 for the remaining radios. RADIO
CARRIED BIDS
There was lengthy discussion regarding the 1994 -97 road
program as well as what small projects need to be done, and
the SR roads which need to be re -paved
It was suggested once a list of all the projects is
prepared and submitted by each councillor, the proposed
projects can be inspected and then it will be possible to
prepare a realistic 3 or 4 year program.
Mr Wagstaff moved each councillor bring in a list of their
worst 4 miles of road for re- construction, a list of the
roads which require base course and a list of those
sections of pavement which require revitialization as well
as a list of small projects which need to be done in their
area,
that Bud Haskell prepare what he feels would be a suitable
road program for the entire M D for the next 4 years,
that each divisional motor grader operator list what they
feel are the worst 4 miles in their division
and the lists be reviewed at the May 11th council meeting,
and further moved when the 1994 -1997 road program has been
established it is understood the pavement revitiialization
program would take priority over any other projects if
provincial funding becomes available to assist with
repaving projects

Mr Haskell noted the Torrington pit gravel will not be
suitable for base course on the Fisher Davidson road It
will not pack as it is too clean There is about 15,000
yards of pit run left in one area of the Schmautz pit but
it would mean Mr Hazelton would have to re -set his crusher
three or four times in order to get to the gravel Mr
Hazelton would likely want more money if he had to do this
Mr Marz noted the Hutterian Brethren of Valleyview will
not enter into any land or gravel lease negotiations with
the M D until the Schmautz pit has been cleaned up and
reclaimed.
The gravel stock piled for SR 836 would pack but it is too
far to haul it to the Fisher Davidson road.
Mr Haskell noted there is a source of gravel on Hutterian
Brethren land just to the north of the Schmautz pit
Mr. Haskell advised council it will take about 40 days to
haul the gravel for the Fisher Davidson base course project
which will delay getting gravel on the rest of the M D
roads.
It was suggested to leave the Fisher Davidson base course
project for one more year in order to get the gravel

crushed and stockpiled and to get the reclamation work done
at the Schmautz pit.
It will take some stripping in order to get at the 15,000
yards at the Schmautz pit
There was lengthy discussion about the Schmautz pit, the SCHMAUTZ PIT
amount of gravel which may be left there and the cost of RECLAMATION
removing the gravel and crushing it, if it is necessary to AND CRUSH
re -set the crusher several times.
It was suggested the M.D. buggies could be used to stock
pile the remaining pit run in one spot and work on
reclamation of the pit this spring before starting on the
road program
Mr Haskell noted the product SB 90 had been used in a
gravel pit in Calgary and it seems to control the dust
and provide a surface The product is applied
and mixed in with 1 1/2 inches of gravel Cost is about
$9000 00 per mile if the product is put out to the edge
of the road It the road develops pot holes, it can be
bladed out
Perhaps this product and the gravel from the Schmautz pit
could be used on the Fisher Davidson road and on the Orkney
View Point Road
Mr Hanger moved SB 90 and 1 1/2 inches of gravel be
applied to the Fisher Davidson road and the Orkney View
Point road

Mr Haskell noted the main crew will likely start on the
road program May 1st
He also noted there may be more gravel on another area of
the Schmautz pit and it was agreed it must be determined
how much gravel is there so it can be crushed and removed
and the pit reclaimed as soon as possible
Mr Wagstaff moved the main crew be authorized to take a
cat and up to 2 buggies plus whatever other equipment is
necessary in order to stockpile the remaining pit run gravel
at the Schmautz pit (not to exceed 30POO yards) so the
gravel can be crushed later this fall, and if there is
more than 1 foot of overburden for every foot of gravel
the gravel is not to be removed,
and further moved the crew is to work towards the total
reclamation of the pit

Mr. Haskell asked what council wish to do with the
screenings piles at the Schmautz pit - use them for
reclamation or keep them for use on some of the M D
roads It was suggested the screenings could be used
on the Torrington pit north road, perhaps save one or
two piles of the screenings and use whatever is left
for reclamation of the pit
There was further discussion about the 1993 base
course program Is it necessary to base course the

Linden Nursing Home Road? The Linden west road base course
project must be completed this summer The Mennonite
Church north road will be rebuilt in 1993, but will not be
base coursed in 1993
Mr Hanger moved SB 90 be used on the Linden Nursing Home
Road - 2 miles - instead of base course
MOTION WAS DEFEATED
Mr. Jeffery reviewed the summary of comments and ideas put
forth at the divisional meetings as follows-
1 Derelict building tax
Does council wish to implement a program to clean up old
buildings
It was suggested an advertisement could be put in the paper
requesting people to clean up any old buildings or garbage
sites
Mr Vickery moved the M D not implement a derelict building
tax, council react to complaints as received and the
problems be dealt with on a one to one basis.

2 Stubble Burning by -law
This issue has been handled by council
3 Tax Incentive and Penalty Dates - See also item
#4 on the agenda
It appears the tax incentive program will cost the M D
money due to the low interest rates
Mr Vickery moved a draft by -law be prepared which will
rescind the tax incentive program and change the first
penalty date from October 1st to September 1st with changes
to be effective January 1st, 1994, and the draft by -law be
reviewed at the next meeting of council

4. Enhanced level of police service for this area
Mr Marz reported on the meeting held this morning with
representatives from the local R C M P. detachments and the
Department of Justice In order to provide this extra
level of service for all of the M D it would be necessary
to look at all three detachment areas - Three Hills,
Beiseker and Drumheller It would be necessary to discuss
and negotiate with Rockyview, Starland, Wheatland, Red Deer
and possibly Mt. View and the urban centers in the
3 detachment areas the cost of providing for more personnel
for the 3 detachments, otherwise all of the M D
ratepayers would be paying the cost for providing an
enhanced level of service for the Three Hills detachment
which serves the north end of the M.D. up to the Village of
Delburne
There was discussion as to whether having a by -law
enforcement officer or a special constable would be more
beneficial.

It was noted the Department of Justice determine the level
of police personnel in a detachment from the number of
criminal code charges which are recorded in that area
If an enhanced level of service was to be provided for the
3 detachments there would be a cost for the extra personnel
plus the cost of extra equipment - radar guns, scales, etc
Mr Wagstaff moved a committee of R. A. Marz and Robert E.
Boake discuss with the other municipal districts and
counties and urban centers served by the 3 local
detachments the idea of provision of an enhanced level of
police service for this area and bring a report back to
council at a later date

Mr Marz noted Vern Kientz discussed with him the need to
clean out the Landymore drainage ditch Mr. Kientz was
advised Mr Landymore has not yet given the M D permission LANDYMORE
to go on his land to do this work Mr Kientz was DRAINAGE
concerned about the water washing out a dam DITCH
The comments made at the divisional meetings with regard to
the erection of township and range signs was discussed at
length
The cost of the posts was noted. Mrs Lowen suggested the
M D buy scrap metal to make the posts.
Mr Vickery moved, after an accurate count of the number of
signs which would be required has been done, tenders be
requested for provision of 6 inch and 9 inch signs for all
intersections in the M.D , with the bids to be received no
later than 9 00 A M , May 25th, 1993, and the lowest or any
bid not necessarily accepted.
Various ideas for the 50th anniversary celebration for the
M D were mentioned - glasses with M.D logo, 50th
Anniversary M D pin, official banquet, a float to be put
in various parades throughout the area, display of old
memoriabilia, etc
Mrs Lowen moved a committee of Richard Vickery and Otto
Hoff make plans for the M.D 50th anniversary celebration
in 1994 and the committee bring reports to council about
the plans on a regular basis

Mr Jeffery noted Dennis Kober has accepted the early
retirement package and will terminate his employment as of
April 30th, 1993. He also reported he had met with Robert
Gundlach and indicated to him he would have a job with the
M D even though he is no longer motor grader operator for
Division 5
Mrs. Lowen reported she and Bud Haskell had met with
Dennis Bramley and discussed his work and grading
performance in Division 1 Mr Bramley felt some of the
comments made about his work were not true
Mr Jeffery read a letter received from Brownlee Fryett
regarding termination of employees and the steps which
must be taken before termination of any employee is
considered

The following concerns have been raised about Mr Bramley s
performance in Division 1 - public relations, project left
uncompleted, should be making 3 passes on some roads due to
the width of the road, should make sure the roads are
graded properly and should try not to leave lumps on the
road.
It was suggested he should be given some training in grading
if necessary
Mr Hoff moved a letter be prepared and delivered to Dennis
Bramley personally, outlining the concerns which have been
raised about his performance and work with the M D

The need to have a new grader operator for Division 7 was
discussed
Mrs Lowen moved a notice be posted advising all permanent
employees the position of Division 7 motor grader operator
is open and applications for the position will be
accepted until Monday, April 26th, 1993, and a decision be
made by council on April 27th as to who will replace Dennis
Kober as Division 7 motor grader operator

Mr. Jeffery was directed to discuss this issue with Mr
Gundlach before the notice is posted.
There was discussion about finding a more central location
in the various divisions for the graders to work from in
the summer months This may help to eliminate some high
blading It would be anticipated the grader operator would
get to the central location at his own cost and would not be
paid mileage The M D. would locate a fuel tank at a
central location (likely in a farmer's yard) and the grader
would be left there at night
Mr Wagstaff noted David Hibbs has offered space to locate
a fuel tank in his yard
Mr Marz noted the Allingham Community Center property
might be a suitable location for his division
If council decide to proceed with locating the graders in a
more central location in their divisions it will be
necessary to have overhead fuel tanks at these locations
The tanks must have a pan large enough to hold the contents
in order to get approval for the tanks under the new
Environmental Protection Act
There was discussion about whether individual councillors
should be giving direction to their grader operator and or
the contract grader operator and what lines of authority
should be in place.
Mr Hoff moved the Public Works Superintendent be
authorized to purchase two 500 gallon overhead tanks and
the councillors for Division 4 and Division 7 be authorized
to have their divisional graders work from a more central
location in the division when required during the summer
time frame
