HomeMy WebLinkAbout1993-04-08 Council Minutes11 11 EXECUTIVE COMMITTEE REPORT APRIL 8th 1993 The Executive Committee of Otto Hoff and James Hanger met on Thursday, April 8th, 1993 at the M D of Kneehill office in Three Hills, commencing at 9.00 A M John C Jeffery was present and Mrs and recorded the minutes The following items were reviewed 1 M D Building Permit By -Law Jean Wilkinson was present The suggestion that the M D cancel its building permit by -law was reviewed by Mr Cunningham as requested by Council He listed the pros. Province would be responsible for all building inspections Developer would receive a building inspection M D liability for lack of inspection could be eliminated M D. would gain financially as $1 00 fee does not cover cost of forms and processing applications If M D did inspection would cost more money Cons. Building permit cost to developer would increase from $1 00 up to $150 00 minimum cost Longer time for the developer to get approval for the development (" ke. Executive Committee recommend the M D obtain planning and legal tG advice about this idea before proceeding with cancellation of the by -law M chat we \sh 2 Aerial Photographs Alberta Municipal Affairs has confirmed to Red Deer Planning Commission it will contribute 25% of costs of obtaining new aerial photographs for the various areas if same are directly related to completion of a general assessment and certified as such by the Municipal Administrator Cost for the M.D of Kneehill to fly the area and obtain one set of enlargements would be $3450 82 made up as follows One Quarter of flying costs of $4523 26 = $1130.82 plus cost of 145 prints for $2320 00 - total cost more or less of $3450 82. Palliser Regional will pay one quarter of the flying costs Alta Municipal Affairs would pay one quarter as per note above and group is still waiting for confirming that Alta. Environmental Protection will pay one quarter of the flying costs Executive committee recommend Palliser Planning be advised the M.D would be willing to proceed with the aerial phtographs on condition Palliser pay for one - quarter of the costs, AMA pay for one - quarter and Environmental Protection pay one - quarter and the total cost to the M D not exceed $4000 00 1 Y\_/�l a LM EXECUTIVE COMMITTEE REPORT APRIL 8th 1993 3 1993 Municipal Census Palliser Regional Planning Commission have advised they would be prepared to assist any municipality with a census in 1993 Council has already decided it will do a census in 1994. Executive Committee recommend Palliser Planning be advised the 11kk' M D plan to do a census in 1994 and would require their Sent assistance at that time V 4 Alberta Environment Shallow Groundwater Observation Well Network Alberta Environment are establishing a province wide observation well network Purpose is to detect contamination entering the shallow groundwater from airborne pollution They would like to drill two test holes and if locations are suitable will install two permanent wells in the following locations- At Kevier's lake Park in N E 25- 31 -26 -4 west end of park near located gate right hand side against the trees 2 In unused road allowance between SW 30- 30 -25 -4 and S E 25- 31 -26 -4 west boundary of road allowance just north of entrance to the Bethel Church Camp Shallow test well will be drilled 15 to 30 feet deep Soil and Water samples taken and if site suitable a stainless steel permanent well will be installed and monitored every two years for water quality. Wells will be monitored indefinitely No compensation will be paid to the M D for the two sites Executive Committee recommend the Reeve and Municipal Administrator be authorized to sign the agreement with d Alberta Environment with no compensation payable to the M D for use of the two sites 5 New Culverts - Will M D sell them? A request was received for the M D to sell a ratepayer a new culvert recently. He was unable to obtain the size he required from local supplier He needed the culvert right away M D. agreed to lend him one if he would purchase a new one and return it to M D He agreed and is buying one from U F A and will return to M D when same is delivered Does Council wish to sell new culverts or not Previously unable to sell new culverts as M D purchased sales tax exempt Now no sales tax and we can sell as long as we pay G S T when purchasing same. Executive Committee recommend in view of the M D mission statement, the M D not sell new culverts 6 Wayne Stankevich - Gravel from M D Road 2 )11�1� k- ��OrvmPtZ, \ce �ha c.�.c1 v Se 11 Iq 0 EXECUTIVE COMMITTEE REPORT APRIL 8th 1993 Mr. Haskell reported the M D bladed the Fisher Davidson road recently and an inspection shows a ratepayer removed gravel from the road and used it in his yard Evidence is quite visable on the road of where the gravel was removed and where it was taken to Executive Committee recommend a letter be sent to Mr Stankevich .d GT advising removal of the gravel from the M.D road is illegal, ReP� Council anticipate this will not happen again and further a bill c be sent to Mr Stankevich for the gravel removed 7 Ace Vegetation Control Permission to Cut Trees Mr Al Luey of Ace Vegetation Control has a contract with Alberta Power to cut down trees under their power lines. He would like to cut down the trees at the back of the Swalwell Park to a height which will provide a 9 to 12 foot clearance from the power line Lines are about 18 feet which would mean the trees would be cut down to 6 or 7 feet There are two other locations N W 1- 31 -25 -4 and N E 28- 30 -25 -4 where the poplar needs to be cleaned out of the ditch area. There are willow clumps at N E 28- 30 -25 -4 which will be left, and only the poplar removed from the clumps Executive Committee recommend Ace Vegetation be given permission G,bSe A to cut down the trees as required in the ditch areas and at the Swalwell Park, but the Swalwell Park trees be left at least 9 feet high. wpm p5 8 Town of Three Hills Main Street Program Rita Main and Marily Voytechuk had been asked by the Town of Three Hills to review with main street businesses various options put forth by the town in connection with the main street improvement program The options were- 1 Just new cement sidewalks 2. New sidewalks using interlocking blocks 3 Whole program as advertised 4 Whole program but using cement sidewalks and bullnoses 5 Cement sidewalk with interlocking blocks in some areas, but no bull noses 6. Other Options - storm sewers, benches, trees, narrower streets and wider sidewalks Needed an answer right away Council and Mr Jeffery away Jean advised Rita the M D first option would be no disturbance of the area in front of our building and Option 1 would be their second choice Executive Committee recommend to accept and file as information 9 Occupational Health and Safety Demonstration Mr. Doug McNeely from Occupational Health and Safety Department of Labour, Red Deer asked if the M.D would like his department to put on a demonstration on the hazards of overhead power lines Would take about half a day - 2 hour presentation and half hour plus talk on safety C J'� :1 M Ln EXECUTIVE COMMITTEE REPORT APRIL 8th, 1993 Executive Committee recommend this be considered as a possible presentation for employee day in 1994. 10 Grant McIntosh - Drumheller Health Unit The M.D was sent a copy of a letter the Drumheller Health Unit sent to Grant McIntosh regarding possible health concerns because of pig manure running on to his land Health Unit tests shows a very low probably number of fecal coliforms in the samples taken Therefore do not feel this particular incident would be a public health nuisance. They suggest he contact the M D or Alberta Agriculture and Environment re possible contravention of Development Permit conditions Executive committee recommend to accept and file as information 11 Grainger Railway Crossinq W 21- 29 -24 -4 Transport Canada has inspected this crossing Sightlines are adequate for motorists, but there should be large advance warning signs put up by the M D The M D. is requested to advise them when the signs have been installed C N is to impose a speed restriction if they plan to store any equipment on the siding which is stub ended west of the crossing Executive committee recommend the M D erect the necessary warning signs and advise Transport Canada accordingly 12 Alberta Action on Waste Program Minister of Environmental Protection has forwarded some information about the provincial program to reduce the amount of waste by 50% by the year 2000 They have provided some posters and other information Executive Committee recommend to accept and file as information. 13 Alberta Action on Waste Department Manager of Alberta Recycle Information Line has forwarded information about the government program to reduce the amount of waste going into Landfille sites by 50% by the year 2000. They have produced a fact sheet to minimize waste in the workplace. M D would have to do waste audit and council would have to be committed to program and have employee involvement to reduce waste at M D level Executive Committee recommend to accept and file as information at this time. 14 Dust Ain't Us Conservation 2000 Club Letter 0 \16 a Q �J \*4 r } e whP A E EXECUTIVE COMMITTEE REPORT APRIL 8th, 1993 The Trochu Conservation club have forwarded information regarding their feelings on the M D burning by -law They encourage establishment of a by -law that discourages full scale burning of crop residues Executive committee recommend to accept and file as information as this issue will be dealt with by the A S B shortly and will be making a recommendation to council 15 Bob Davidson - Portable Toilet Rentals Mr Davidson received the M D letter which indicated the M.D. was not prepared to change their policy regarding renting out toilets to local people He felt this was a definite infringement on his right to make a living Two farmers indicated to him they would rent toilets from the M D rather than pay to rent his Starland rents out their portable toilets, Special Areas does but Wheatland does not He asked Council to reconsider their decision Executive Committee recommend the M D discontinue their policy (� }� of renting out the portable toilets as this is a service which Sort .� can be obtained by the individual at a reasonable cost without ?o1i` government involvement. (See M D mission statement) car%«k 'A 16 Midas Resources Ltd - Request Blade Grade Construction Approval - W 14- 29 -24 -4. Midas Resources Ltd., request permission from the M D to construct a blade grade in accordance with M D blade grade standards outlined in policy 13 -16 -3A They require this to access their well on 4- 14- 29 -24 -4. Executive Committee recommend Midas Resources Ltd., be given �r permission to construct a blade grade road for approximately sQ ^� one - quarter of a mile West of 14- 29 -24 -4 to access their well on 4- 14- 29 -24 -4 subject to compliance with M D standards 17 Village of Belcarra The Village of Belcarra in B C have forwarded a proposed resolution which they would ask all municipalities pass and forward to the Minister of Justice and the local M P The resolution is encouraging the government to amend the Young Offenders Act to better protect society from young offenders Executive Committee recommend the resolution 1P���t Whereas it would appear the Young Offenders Act of Canada as currently enacted, is inadequate for the needs of modern society And Whereas young offenders in Canada appear to enjoy an extraordinary status under this Act which may not achieve the appropriate balance between the rights of young offenders and those of society as a whole Therefore be it resolved That the Solicitor General of Canada be requested to review 5 N 1�q EXECUTIVE COMMITTEE REPORT APRIL 8th 1993 the current Young offenders Act, with all relevant parties, for the purpose of identifying needed changes to improve the act. be passed and the appropriate letters be sent to the Minister of Justice and the local Members of Parliament 18 March Bank Reconciliation Statement and Cash Flow March bank reconciliation statement was reviewed Cash on hand $118,290 20, General Account $803,316 60, nothing in payroll. $4547.78 in tax sale trust and $3,975,000 00 in terms The cash flow statement at the end of March showed a position of $4,778,317. Executive committee recommended to accept the bank reconciliation statement, and if any councillor wishes a copy he be provided with one 19 Town of Three Hills Letter to the Premier of Alberta The Town of Three Hills provided the M.D. with a copy of a letter they sent to the Premier They are in favour of your government's attempts to provide residents with a more cost effective and efficient government The Town has therefore passed a motion that it will pay a sum not to exceed the amount paid in 1992 for any requisitions received for school and school foundation costs Executive Committee recommend to accept and file as information 20 Application to Change M D land use by -law An application has been received to amend the land use by -law by adding campgrounds - privately owned as a discretionary use in a Local Rural Commercial District. Executive Committee recommend the public hearing be held at 4.00 km`s P M May 11th, 1993, and notice of the public hearing be saw} advertised in two issues of the Three Hills Capital. 21 Application to Change M D land use by -law An application has been received to spot zone the South half of LSD 4 in 31 -21 -4 as a Local Rural Commercial District to allow for establishment of a private campground It will be necessary to deal with this application after Item Number 20 - application to add campgrounds privately owned as a discretionary use in a Local Rural Commercial District- has been dealt with Executive Committee recommend the public hearing be held at 4 30 P M May 11th, 1993, notice of the public hearing be advertised in two issues of the Three Hills Capital and notice of the proposed change to the by -law be circulated to all landowners within a 1 1/2 mile radius of the proposed site 22 Town of Trochu Possible Annexation 6 i I — . Loll D4 N 11 EXECUTIVE COMMITTEE REPORT APRIL 8th 1993 The Town of Trochu has indicated it may some time in the future proceed with an annexation application for the area immediately south of the Town However this likely will not be for a period of three to five years Executive committee recommend another letter be sent to the Town of Trochu asking if they would be willing to share costs for the engineering study which will be required before the Town street s and the M D road can be up- graded 23 Mobil Oil Mr Jeffery noted he gave Wally Bauer of Mobil Oil permission to walk a cat in the ditch approximately 1 mile to get to 6 of 14 in 33 -26 -4 A truck overturned in the ditch and it was necessary to get a cat to that location Executive Committee recommend to information 24 Sanderman Road Damage Bud Haskell is to report on R C M P road damage. accept the report as investigation about the Executive Committee recommend to accept as information pending receipt of a report from Mr. Haskell 25 Gunther Neufeld - Culvert Extensions Mr. Neufeld would like the M D. to extend the culvert and approach into S.W 16- 29 -25 -4. He would like 2 ten feet extensions put on both sides of the approach. C \� Welter Executive Committee recommend the M.D. bring the approach up to sPY,4 current M D standards as per policy on condition the road approach is an approved approach 26. Request from Ed Miller Road Ban Exemption Ed Miller would like an exemption from the 75% gravel road ban for April 12th and 13th He has 10 loads of cattle going out of his feed lot on those two days Would need to use 3 1/2 miles of gravel road to get to pavement. Executive Committee recommend the request not be granted as 0770 these are divisable loads and policy states no exemptions will g°i be allowed if the gravel roads are banned.
