HomeMy WebLinkAbout1993-03-19 Council Minutes11 U LM EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 The Executive Committee of Richard A Marz and Otto Hoff met on Thursday, March 18th, 1993 at the M D of Kneehill office in Three Hills, commencing at 9.00 A.M. John C. Jeffery was present and Mrs Jean Wilkinson was present and recorded the minutes. Councillor Boake and Hanger were portion for a portion of the meeting The following items were reviewed 1. Budget Committee - Need to set date for a budget meeting R. E. Boake, James Hanger, Richard M Vickery 2 Capital Committee need to set a date to hold a meeting Richard M Vickery, Glen Wagstaff and James Hanger 3 Minutes from March 9th and 10th council meetings were reviewed and Executive Committee reviewed what should be deleted prior to publication 4 M D Fence Polic The new M.D fence policy 13 -10 was reviewed The rate for compensation under this policy if the farmer removes and replaces his fence is $2500 00 per mile if the fence is useable and will confine cattle. R.A. Marz noted farmers with cattle do not feel the policy is reasonable. He was attempting to get backsloping borrow pit agreements from farmers for the Brosseau road project The farmers object to the charge by the M D of $900 00 if the farmerdoes not remove his own fence They feel it is too high.The M D previously paid up to $1800 00 per mile for compenation for a fence if the farmer removed and replaced it himself The Province charges $450.00 a mile for any fence it has to remove for an individual Lonnie feels the crew could do the work for $450 00 amile Mr Jeffery reviewed the AAMD & C survey results and the compensation ranges from nothing up to $7000 00 a mile It was suggested if the M D has to remove a fence for a landowner the M D should compensate the farmer at the rate of $2000 00 per mile instead of $2500 00 per mile CoQ TQ Executive Committee recommend Clauses C and D in the policy Cu,, NCIAaORs - C The landowner will be responsible for removal of his It existing fence at his cost Co �xtj t o� Ks r D If the landowner is unable to remove the existing fence for any reason, the M.D. will remove the fence at a cost of $900 00 per mile be deleted and replaced with the following. - C. If the landowner does not require his existing fence to be replaced, but requires the M.D. to remove the existing fence for any reason, the M D will pay compensation at the rate of $2000 00 per mile 1 Ca 02 �1 EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 4 Brosseau Road Project Agreements Mr Jeffery reviewed the backsloping borrow pit agreements for this project The agreement with Alton W. Parker is over policy Mr Parker wishes to be charged only $700 00 per mile instead of $900.00 as he will not remove the fence The fence is to be replaced by the M.D. with 4 wires and he requires a berm on the backslope on the hill - see profile of project He also requires a temporary fence as per policy. The Ralph Beeton agreement was also reviewed and it is over policy with regard to fencing. He also wishes to be charged only $700 00 per mile for removal of the fence The fence is to be replaced with 4 wires and he will provided 4th wire Executive Committee recommend approval for the Parker and Beeton agreements subject to council approving the fencing policy change noted above and the request for installation of a berm by Mr Parker be recorded as a waiver to the policy 5 Ralph Beeton Fence Problem NW 23- 31 -24 -4 Ralph Beeton has requested the M D come back and fix his fence The fence has been a problem since 1983 when the M.D. did the road on the north side of his quarter The fence was put on the sideslope of the road and it is continually breaking down He would like the M D to remove the fence and replace it back at least 50 feet from the edge of his property Also the fence going towards his house was not completed. He was advised this work would be done and to date it has not been completed. Executive Committee recommend the fence crew do this fence job first thing this spring as soon as weather conditions permit, on condition Mr. Beeton stake exactly where he wishes the fence located, and he agrees to release the M D from any further claims for the fence. 6 AAMD & C Survey re. Backsloping, Fencing Compensation Etc. Mr Jeffery reviewed the results of the AAMD & C survey regarding purchase of right of way, borrow pits, etc Executive Committee recommend each councillor be given a copy of the survey and the issue be discussed at the next meeting of council 7 Palliser Regional Planning Commission Building Inspection Palliser Regional has forwarded a copy of a letter the commission received from Stockwell Day, Minister of Labour. The Minister has indicated there has been no change in legislation in his department specifically delegating building inspection to the municipal level There is no legislation that requires a municipality to inspect buildings Where a municpality is authorized pursuant to the Uniform Building Standards Act they have always been responsible for the administration and enforcement of the building code in their jurisdication, even if provincial inspectors provided assitance 2 C 0 fJ n- � G e.v artA ems✓ n I;q N EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 A new process is being put in place by the Province under the Safety Codes Act. This is intended to ensure a reasonable level of safety for citizens at a minimal cost to the taxpayer Various issues were addressed by the Minister and he noted the safety code act provides for accreditation of more than one municipality to admnister the act jointly The planning commission would seem a natural body to promote and administer this concept for its member mun.icpalities. Executive Committee recommend Mr Cunningham review the M D by -law and determine ifthe by -law should be cancelled and this issue be discussed at the next council meeting 8 Palliser Regional Planning - Public Safety and Sour Gas Palliser Regional Planning Commission advises Calgary Regional Planning Commission prepared a submission to the E R C B Advisory Committee regarding public safety and sour gas Palliser provided some input into the submission as well A copy of the draft submission has been forwarded to the M D. Palliser would like the M D comments on the paper The commission will discuss the paper and any recommendations at its next full commission meeting scheduled for May 6th,1993. Executive Committee recommend a copy of the submission be givena to each councillor and if anyone has any concerns it be discussed at a later meeting of council 9 Town of Three Hills Annexation Hearing Alberta Local Authorities board advises the public hearing scheduled for Tuesday, March 16th was cancelled The hearing will be rescheduled for a later date An interested party has requested the delay Executive Committee recommend to accept and file as information. 10 M.D Starland Anniversary The Drumheller Mail will be publishing a tabloid supplement commemorating the M D of Starland's 50th anniversary A congratulatory advertisement can be placed in the supplement at a cost of $375 00 for a 1 page down to 1 /8th of a page at $80.00. A toY �Sl' S C a f J w� G" Sec�� _rato �% -. t4 Executive committee recommend the M D put in an advertisement for a cost not to exceed $80 00 11 Resolutions for Sprinq Convention AAMD & C has forwarded a copy of the resolutions which will be considered at spring convention Executive Committee recommend a copy of same be given to each councillor 12 SR 837 3 pljv/,/ N N L N EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 A J Brown from Alberta Transportation called re. the bad spot on SR 837 He had it checked out and it appears there is in fact only a thin layer of hot mix at the location It is cracking However Transportation cannot go back on the contractor as the contractor did not do any work on this part of the road. There was some work done on the shoulders but not in the middle of the road. He recommends the M D use some instant road repair to fix the spot Executive committee reocmmend the M D repair this spot with 'dud instant road repair 13 SR 583 East of Hiqhway 21 Alberta Transportation has asked their office in Edmonton to prepare an evaluation of this road It has not been received as yet, and likely will not be done until later on when the snow has gone Executive Committee recommend to accept and file as information. led v 14 Alberta Municipal Financing Corporation Annual General Meetina - Thursday, April 22nd, 1993 in Edmonton The M D can appoint W R Gartner to represent their Class B shares for this meeting. to �tp` Executive Committee recommend W R Garntner be appointed to represent the M D. shares at the annual meeting. 15 Revised Land Buying Agreement and Backsloping Borrow Pit Agreements Mr Jeffery reviewed the revised agreements The only change to the land buying agreement was to add G S T is included if applicable. ` lc� s t-g � t The backsloping borrow pit agreement was revised in several areas including the removal and or replacement of fences and a ✓ statement added to indicate G S T. is included in compenstion if applicable Executive committee recommend the revised agreements be approved 16 Truck Train Accident - Grainger A copy of the police report has been received As previously advised C.N. had complied with all regulations Executive committee recommend to accept and file as information v 17 Enhanced Level of Police Service Mr. Jeffery reported a meeting with the Department of Justice has been arranged for April 19th, 1993 at 10:30 A M here in the M D Office to discuss this concept He has invited Delburne Elnora and Trochu to attend the meeting if they so wish \01 N EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 Executive committee recommend the committee of James Hanger and Robert E. Boake attend this meeting on behalf of the M.D. q 18 Marigold Library Responses have been received from some of the libraries in this area about the number of M.D. ratepayers using libraries, but there has been no response from Carbon or Three Hills Executive committee recommend Mr Wagstaff review the file and "as P� the responses received and if he wishes to pursue the idea of the M.D. belonging to Marigold he bring the issue up at a later ✓ meeting of council. 19 Alberta Municipal Assistance Grant Program The Honourable Stephen C West has forwarded information about the municipal assistance grant program for 1993 The M D grant will be $624,702 00 He also forwarded information about how the grant is calculated for each area Executive Committee recommend to accept and file as information. 20 AAMD & C Letter re. Fiscal Restraint President Gordon Miller has written a letter to all muncipalities regarding the provincial funds for major grant programs The need for continuing fiscal restraint has been discussed with the Province and as president of the association he indicated to Premier Klein the strong support from the association for the measures announced The association feel there is clear direction from the members calling for decisive action to control and eventually eliminate the provincial deficit He also commended Premier Klein for leadership shown Executive Committee recommend to accept and file as information 21 W MacDonald - Subdivision Appeal - NW 28 & SW 32- 28 -24 -4 Mr MacDonald has filed an appeal against the decision by Palliser with regard to his subdivision application The commission cut down the size of his parcel to 12 acres from about 22 acres. Executive Committee recommend to accept and file as information and no one from the M D attend the hearing 22 Kneehill Historical Society CTAP Application CTAP turned down the society's application for funds CTAP felt the society was not financially viable and had not demonstrated their ability to operate the facility without on going government assistance The Society has filed an appeal and is requesting the M D support their request for a review of this decision The Town of Three Hills has already sent a letter to CTAP expressing 5 V-1 a C7 17� t EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 concern about the refusal and requesting them to reconsider the application Executive Committee recommend a letter be sent to CTAP Sin} requesting them to re- consider the decision in light of the appeal from the society and the new information provided to them. 23 Keyano College Training Course Keyano College has written indicating they will schedule a week program for the M D likely in late July Cost for one week program would be $4000 00 and could vary depending on the number of operators attending and the number of instructors required Executive Committee recommend the M D have the one week training session for the truck drivers, the heavy equipment c�Py operators and motor grader operators and same be held in late,a July if possible. ol'%e s 24 1993 Auditor It is necessary to appoint an auditor for 1993 and advise Municipal Affairs of the appointment Executive Committee recommend Kangas Ablett be appointed as auditor for 1993. 25 Calgary Stampede 8th Annual Historical Brand Promotion The Calgary Stampede is holding another historical brand promotion at the 1993 Stampede and will be using brands registered between 1921 and 1930 The M D has a brand which was registered August 18th, 1922 The International Livestock Auctioneer Competition will be held to sell the cattle consigned for sale Preliminary round will be held at Olds Auction Mart July 16th and the final round on Saturday July 17th at which time the Historical Brand Cattle will be sold Executive Committee recommend to accept and file as information 26 Kneehill Ambulance Rescue Unit Mr Marz reviewed the situation with regard to the rescue unit owned by the Kneehill Ambulance The volunteers who look after the unit feel the board are not supporting their efforts They wish the board to purchase new equipment and eventually a new unit. It has been suggested the unit be sold to the Village of Linden Fire Department as rescue operations are generally operated through a fire department The Village of Linden is not totally in favour of this idea as it would cost the village 25% of the costs for the rescue unit Under the fire agreement with Linden the M D. pays 75% of the costs and the Village pays 25% It appears the rescue unit was used for about 6 calls in 1992, but the volunteers indicated they would have taken it more if better equipment was available Volunteers also have a concern if the unit is turned over to the fire department there may be a problem with fire area boundaries The R C M P call whichever unit is closest to the accident Some of the volunteers wish to specialize in rescue work as they do not have enough work to do as far as actual ambulance calls There are 6 w � }�rs Se *-i' ;�IeI DI-q C7 C3 EXECUTIVE COMMITTEE REPORT MARCH 18th, 1993 presently 40 volunteers involved in the ambulance service and some people only go on 1 or 2 calls a year However some other volunteers feel they are overworked The board has capped the number of volunteers for the service due to the increased training costs Mr Marz recommends the M D support the idea of selling the Rneehill Ambulance rescue unit to the Village of Linden fire department for the sum of $5000.00.
