A regular meeting of the Council of the M D of Kneehill
was held in the M D Office in Three Hills on Tuesday,
September 8th, 1992, commencing at 9 00 A M
The following were present for the meeting.

Reeve Marz called the meeting to order
Mr Boake moved approval of the agenda

Mr. Vickery moved approval of the August 25th council
meeting minutes
CARRIED
Mr Jeffery's report was reviewed, including the suggestion
to set up a filing cabinet in the Reeve's office for use by
the Reeve and councillors It was generally agreed this
was a good suggestion and would be helpful
Mr. Boake moved approval of Mr Jeffery's report
CARRIED
The Executive Committee report was then reviewed and
various items were discussed The letter received from
Gerald Dube, after the Executive Committee meeting,
regarding his former property in Wimborne was discussed
He suggested he might offer to rent the building from the
M D with the rent applied to the outstanding taxes
Council agreed with the recommendation from the Executive
Committee that Mr Vickery meet with Mr. Dube to discuss
the matter further.
Mr Mueller moved approval of the Executive Committee
report

Mr Boake moved approval of the accounts submitted for
payment today, subject to further review by the finance
committee of R.A. Marz, Otto Hoff, Harold Mueller and J
Finlay Code

Mr Vickery moved approval of the bank reconciliation
statement for the month of August and the budget comparison
report
CARRIED
The report from the committee appointed to review the need
for a by -law enforcement officer in the M.D. was then
reviewed The committee outlined the pros and cons of
having an enforcment officer on staff, including an
estimate of costs which would be incurred, but made no
recommendation to council
It was suggested this decision perhaps should be made by
the new council
Mr Code moved to table this matter for a period of six
months
CARRIED
Council then reviewed the Levi Boese file and there was
lengthy discussion regarding the $10,000 00 deposit put up
by Gladwin Toews for Mr Boese Whether Mr Boese has
complied with the terms and committments made to the M D
about the residence was also discussed and it was noted the
siding has not as yet been put on the house and Mr Boese
has not paid the M D for the legal costs incurred

Mr Code moved the M D return $8500 00 to Gladwin Toews at
this time, the balance of $1500.00 plus interest be kept by U
the M D until such time as the committments made to the
M D by Mr Boese are fulfilled
MOTION WAS LOST
There was discussion regarding the Letter of Intent which
must be signed by the Britestone Colony with regard to BRITESTONE
their development The terms of the letter of intent as COLONY
prepared by Mr Welsh, solicitor for the M D were reviewed LETTER '
and it was agreed the terms were satisfactory. OF
INTENT I
Mr Mueller moved the Reeve and Municipal Administrator be
authorized to sign the Letter of Intent when same has been
signed by the Britestone Colony
CARRIED
The request for relaxation of setback requirements to allow
for boundary adjustments of an acreage on the S W 4- 29 -23 -4 REQUEST
was discussed. The owner of the acreage - Larry Schultz FOR
and the owner of the balance of the quarter - Courtney SETBACK
Gimbel, wish to make an adjustment to the east boundary of RELAXATION
the acreage in order to exclude the existing steel
granaries from the acreage (they are presently within the PT S W
boundaries of the acreage) and leave the barn with the
acreage In order to do this the barn would be immediately 4- 29 -23 -4
adjacent to the boundary line with no setback The sketch
of the site was reviewed
Mr Hogg moved the request for relaxation of the setbacks
be denied, and the boundary of the acreage be adjusted
in such a manner that will ensure the barn is within the
acreage boundaries and the granaries are located on +ho
balance of the quarter section and will comply with exis
M.D setbacks and council would prefer to see the bouni
adjustment done by means of a legal plan of survey

Mr Jeffery noted if a proposal comes to the Municipal
Planning Commission to subdivide out the existing Dunphy
cemetery, the members of the Municipal Planning
• Commission should be aware only a municipality, a religious
order or a church may own a cemetery
Mr Hogg moved to accept this report as information
CARRIED
There was discussion about the guidelines which are to be
taken into consideration by the Municipal Planning
Commission when making a decision on whether Section 78 of
the Provincial Planning Act should be waived and a second
residence allowed on a parcel of land less than 80 acres
in size. These guidelines were put in the policy book under
Policy 5 -2 -A
Mr Code moved that Policy 5 -2 -A be confirmed

Mr. Rodger and Mr Haskell entered the meeting at this time

Mr Jeffery reviewed the backsloping borrow pit agreement
arranged with Mr Len Davies for the SR 836 project Mr
Davies had asked, as a condition on the agreement, for the
I� M D to lower a culvert which had been installed on the
east -west road north of his land It seems one end
of the culvert is not low enough and he would like this
corrected Mr Rodger noted it would take one or two hours
�j with the backhoe to lower the culvert
Mr. Hogg moved the culvert on the east west M D road be
lowered on condition no other landowner will be affected by
such lowering, and the agreement be approved on that basis

There was lengthy discussion regarding the amount of gravel
crushing which will be required this fall for the 1993 road
program Mr Jeffery noted until council decide on their
1993 paving program it is difficult to decide how much
gravel should be crushed
Miles Maerz, gravel foreman, had prepared a report for
council regarding the amount of gravel used on SR 582
In 1991 they used an average of 5488 yards of 1 inch
gravel to the mile on the 9 miles through Sunnyslope
In 1992 they used an average of 5242 yards to the mile
In 1991 they used an average of 2974 yards to the mile of
3/4 inch gravel on this road and in 1992 an average of
2630 yards to the mile.
The preparation work done in 1992 saved an average of 246
yards of 1 inch gravel to the mile and 344 yards of 3/4
gravel to the mile
Mr. Maerz also asked if council would allow him to put 1
1/2 inch gravel on the Nacmine road to try to seal it so
it will hold a surface

It was generally agreed 1 1/2 inch gravel should not be put
on this road
There was also discussion about the apparent lack of a crown
on some of the light coat surfaced roads There appears to
be a trough down the middle of some of these roads which is
holding water There was also discussion about the length
of time it is taking to prepare a road prior to applying
the surfacing and if it rains while doing the prep work the
problems which result because the road surface is opened up.
It was suggested the M D should have a temporary stock
pile site somewhere on SR 836 so the gravel for the base
course can be stock piled this winter
It was agreed to discuss the amount of gravel crushing
required later today
Mr and Mrs Harry Tatro entered the meeting at this time
11.00 A M and discussed with council the need for gravel

Mr Tatro noted when the weather is rainy the road is HARRY TATRO
barely passable, particularly if someone uses the road to
haul grain after a rain Traffic using the road is usually RQUEST FOR
local people, and hunters in the fall, and a farmer who GRAVEL
hauls grain from the land he rents in that area FOR ROAD
It was suggested 1 1/2 inch gravel or screenings might be
used on the road Due to the very limited amount of
traffic using the road there does not seem to be a need for
a blade grade road at this time.
Mr Tatro noted the grader operator keeps the road plowed in
winter time and getting out in the winter is not as much of
a problem as getting out during rainy weather
There was discussion about .increased traffic if the road is
built up, the request from Mr Wayne Magnuson for gravel on
the road he uses for access to his residence in the same
area, and the cost for gravel
Mr Rodger suggested using about 300 yards to the mile
which would cost about $6000.00 for the 2 miles used by Mr
Tatro.
Mr Tatro noted he would not be adverse to contributing a
minimual amount of money towards the cost of the gravel, but
wanted to know what would happen if others use the road
during bad weather and the gravel was lost, would he have
to pay again If he was guaranteed the other people would
stay off the road when it was wet, he would be agreeable to
paying for a portion of the cost of the gravel He noted
he had previously agreed to contribute the sum of $800 00
towards spot gravelling on the road, but the gravelling was
never done He wanted to know if this charge would be for
first time gravel or one time gravel
It was suggested council might work out a flat rate per mile
for gravel requested under certain circumstances for roads
which have minimual traffic and very limited use

Mr and Mrs Tatro were thanked for coming and they left
the meeting.
Mr Jeffery noted that Mr Wayne Magnuson and Mr E J
Gibbs had both been advised the roads they wished to have
gravelled would be gravelled if they were prepared to
contribute to the costs.
There was further discussion about these requests
Mr Mueller moved the M D put first time gravel on the
roads used by Mr Tatro and Mr Wayne Magnuson to gain
access to their residences, and by an oil company to gain FIRST TIME
access to their well in that area, but Mr. Tatro and Mr GRAVEL
Magnuson nor the oil company involved be billed for any TATRO
share of the gravel used AND
MAGNUSON ROAD
Mr Code advised the Chairman he felt this motion was out
of order as it changed the intent of the motion just passed.

Reeve Marz made a ruling on the request from Mr Code as ^;
follows-
In as much as the second motion was not an amendment to the
first motion, but was put forth after the first motion was
made and voted on, he felt the motion was in order
He asked for an consenus of opinion from the other council
members regarding this ruling and the majority of council
wre in agreement with his ruling
A vote was then taken on the motion made by Mr Mueller and
it was declared to be CARRIED
The meeting then adjourned for dinner between 12 00 noon DINNER
and 1.00 P M
The meeting reconvened at 1.00 P.M. and the discussions
regarding the concept of paying for gravel for poor or
undeveloped roads, particularly the roads requested to be
gravelled by E J Gibbs, continued
It was noted Mr Gibbs has alternate access routes
available to him
As no motion was forthcoming regarding the request for
gravel for these roads the motion made previously will
remain in effect
Council continued with their discussions regarding the
amount of gravel which must be crushed this fall for the GRAVEL
1993 gravelling and paving program and what council's CRUSHING
priorities are for the paving program for the next three
years.
Mr Rodger noted stripping will be required at the Garson
Pit if they propose a large crush for this pit
The amount of gravel required for SR 836 was also discussed

Mr. Mueller left the meeting at this time - 2-00 P M - in
order to attend an FCSS personnal committee meeting
Mr Jeffery noted Mr Rodger and Mr Haskell will now be
able to determine more accurately the amount of gravel
crushing required this fall and will bring a report back to
the next meeting of council
The bids received for lease of the M D land - South half SCHMAUTZ
of 20- 32 -26 -4 - were then opened and reviewed Bids were PIT
received as follows. LEASE
1 Mel Charlton - $5005 00 - price to include land taxes BIDS
2 Ralph Kientz - $4550.00 plus the annual land taxes
3 Don Kimmel - $5100 00 price to include taxes and
rental payable every six months.
Mr Vickery moved to accept the bid of Don Kimmel

Mr. Jeffery asked council if the new blade grade policy
applied to construction of a road by a private contractor
for an oil company or other individual, and more OPINAC
particularly would it apply to the road West of 11- 33 -23 -4
constructed without permission for Opinac Exploration Ltd ROAD
The entire blade grade policy was again reviewed by council WEST 11- 33 -23 -4
Mr. Code moved an amendment to Policy 13 -16 -1 to add the
�i words - or a blade grade - to the end of the second
paragraph of Section G so it reads as follows. POLICY
13 -16 -1
"Type 3 road is minimum standard (major farm) unless the AMENDMENT
�I Road Committee and Local Councillor deem the road to be a
non -thru road because of topography, coulees or creeks in
the area, and council may authorize a Type 3 minor farm
road standard or a blade grade.

Mr. Hogg moved Opinac Exploration be advised the road which
they constructed without consent West of 11- 33 -23 -4 must be OPINAC
improved to a blade grade standard and the apron from the ROAD
road on to SR 585 must be paved.

Mr Jeffery reviewed the recommendation from the Policy
Review committee regarding the M D fencing policy As the
policy was quite a change from the previous policy he FENCING
requested council to ensure the policy was acceptable POLICY
There was lengthy discussion regarding this recommendation AMENDMENT
Mr Hogg moved Policy 13 -10 - Paragraph 4 be replaced with
the following-
Effective January lst, 1993 on any road construction
project which requires removal of fences to properly
construct the road, unless the terms of the agreement
indicate the M D will not be responsible for removal or
replacement of any fences,
1. The M D will erect a fence using new material on any
parcel of land that presently has a fence
2 If the landowner does not require the existing fence to
be replaced, the M D will pay the landowner the sum of
$2500 00 per mile in lieu of erecting a new fence.
3 The landowner will be responsible for removal of his
existing fence at his cost
4 If the landowner is unable to remove the existing
fence, for any reason, the M D will remove the fence r
at a cost of $900 00 per mile
5 Any salvage material from the existing fence will
remain the property of the landowner
6 A fence is defined as one that will keep livestock
confined
7 If in the opinion of the local councillor and Grade
Foreman the fence will not adequately confined animals
the M.D. will not replace the fence and no compensation
will be payable to the landowner.
8 If the landowner disagrees with the decision of the
local councillor and the grade foreman, the Road
Committee will make the final decision
9. If a temporary fence is required by the landowner
in order to confine his livestock during construction
the M D will construct a temporary fence with salvage
material, and the temporary fence will remain the
property of the landowner and will not be removed by
the M.D.
and further moved Paragrah 5 of the policy be replaced with
the following-
If the fence is to be replaced by the M D the general
construction policy will be.
a) The fence will be constructed using new wire and new

b) If the landowner wishes the fence constructed to
a higher standard than the M.D. standards
outlined below, he must supply at his own cost any
extra wire and posts which may be required
c) When rebuilding a barb wire fence the crew will use•
i) 4" treated posts set 13 feet apart
ii) 6" diameter 7 foot long treated corner posts
Ili) 3 strands barb wire
When rebuilding a high tensile fence the crew will
use
i) 4" treated post set 20 feet apart
6" diameter 7 foot long treated corner posts
5 strands high tensile wire
unless the fence which existed prior to undertaking
the construction project was of a higher standard

1994

Mr Rodger noted the brushing work would require a cat

In both above agreements it has been indicated if there
is too much rock involved the project need not be completed
There was discussion about whether there is a need to
establish priorities for these smaller jobs as there are a
number of simil.iar projects still to be done
Mr Boake moved the M D approve the agreement arranged
with Mr Radomske - SE 18- 34 -24 -4 - for ditch cleaning and
installation of a new approach on condition the sight
distance for the approach is adequate

Mr. Hogg moved the M.D. approve the two agreements arranged
with Mr Lawrence and Mr Lang on condition the landowners
are willing to accept full responsibility for any rock
picking which may be necessary.

Mr Jeffery read a letter received from Mrs Pearl Barr
regarding backsloping on her land S E 17- 31 -24 -4 - SR 582
She wished to know what the M.D would pay her for allowing
the backsloping work to be done on her land.
It was noted Mrs Barr had refused to allow the M D to

backslope on her land during construction of SR 582 and

it was only as a result of a request from her renter to

Lorraine Sawdon's quarter - SW 17 - that the matter was

owners consented, to install a point approach subject to
Mrs Barr allowing the backsloping work to be done to

Mr Vickery moved the M.D. advise Mrs Barr the M D will
not pay any compensation for the backsloping work as the
dirt would be used to construct the joint approach
requested by her tenant and if she was not willing the
approach would not be installed

Mr Marz noted he had inspected the location where T C T C
Isaac had requested gravel. He sketch out for council's ISAAC
information where they would like the gravel They REQUEST
presently have an approach which accesses on to SR 582, but FOR GRAVEL
also have an approach which accesses on to the north south M D ROAD
road on the east side of their land, just slightly north of
SR 582. The road is not developed but they would like one
load of gravel put on the road and the M D portion of this
approach to allow them access out both ways from their land
Mr Hoff moved not more than one load of gravel be put on
the south end of the M D road WSW 18- 31 -25 -4

Mr Code asked if the M.D. should publish an advertisement
in the Capital regarding putting up snow fences this fall PUBLISH
There was discussion about this .issue as well as ridging in AD

at various locations throughout the M D as has been done
in past years, unless notified by the landowner(s) that
they do not wish the fence put on their land

The report from the Parks Committee was reviewed Allen
Mills has indicated he would accept the park attendant fob
again in 1993 He is doing a very good fob and council
agreed he should be hired again next year

The Parks Committee was directed to review the Keivers lake
pumping project with Alex Cunningham as soon as possible PARKS
and bring a recommendation back to council as to whether the COMM
pumping project should be continued or not REPORT
Mr Vickery moved to accept the report from the Parks
Committee and the Parks Committee and Mr Cunningham bring
a recommendation back to council regarding the Keivers Lake
pumping project as soon as possible

Mr Jeffery reviewed a letter he has drafted to be sent to

The proposal regarding job sharing in the M.D. work force
was again discussed As the request had been put forth
by one employee who will be taking a maternity leave later
this year, it was suggested no decision regarding the
possibility of job sharing be made until closer to the
time the employee in question will return to work after her
maternity leave
Mr Hogg moved to table this matter and it be reviewed
again by council sometime prior to June 390th, 1993.

Mr Jeffery briefly reviewed the August 25th Municipal
Planning Commission minutes
Mrs Wilkinson reviewed with council a subdivision proposed
for S.W. 33- 28 -22 -4 Access to the proposed parcel will be
provided by means of an easement across the balance of the
quarter section The road on the west side of the land is
not an up- graded road and it is possible to drive off the
road anywhere to access the quarter section
It would not be possible to install a culvert and approach
where the easement accesses the M D road. It is also the
intention of the owners of the subdivided parcel to do away
with the easement right of way some time in future
Mr. Vickery moved the subdivision be allowed to be
completed without the necessity of installation of any
approaches.
