N E 1- 32 -24 -W4 Go -Cart Redes.ignation LJ 0 0 COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 A regular meeting of the Council of the M D of Kneehill was held in the M D Office in Three Hills on Tuesday, August 11th, 1992, commencing at 9.00 A M The following were present for the meeting Reeve Richard A Marz Division Four Councillors: J Finlay Code Division One Otto Hoff Division Two Robert E Boake Division Three Harold Mueller Division Five Richard M Vickery Division Six Lawrence Hogg Division Seven J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Reeve Marz called the meeting to order. PRESENT Requests were made to add the following items to the agenda. ADD TO Af,FNDA 28a Blade Grade - North of Roger Wei.gum 28b Review need for intersection sign 28c Washout on SR 575 near Grainger 28d Need for Stop Sign - Vern Crawford intersection Mr Vickery moved approval of the agenda subject to addition of the above noted items. APPROVAL CARRIED AGENDA Mr Hoff moved approval of the July 28th council meeting APPROVAL minutes ACCOUNTS CARRIED Mr Jeffery's report was reviewed Mr Jeffery reviewed the possibility of changing the alignment of SR 836 from SR 583 to Highway 27 one mile east of its present location He noted there may be problems with purchase of the necessary land for the new route, and reviewed the agreements which have been signed, one of which is over policy There was lengthy discussion about the terms of the various agreements and the request from one ratepayer for double payment for the 2nd acre of land required for the road widening, as well as request for a permanent exemption from road bans by one landowner, as he has large equipment which he has to move from his residence and if the paved road is banned he will not be able to get out There was lengthy discussion about the possibility of establishment of an exemption policy which could be applicable to any person living on any parcel of land adjacent to a road which may be subject to bans It was suggested the policy might include not exceeding legal axle limits, speed limits, obtaining a yearly permit from the M D and agreeing to the specific route to be used, and that the exemption would not apply if the residence was adjacent to a primary or access road under control of the Province or if the M D gravel roads were banned. 1 J C JEFFERY REPORT ROAD BAN 'EXEMPTION POLICY COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 Mr Code moved a policy be drafted to provide for a road ban exemption policy which would be applicable to any S« person living in a residence which is adjacent to a paved P.I1 j secondary or local paved to allow movement of an undivisable load from that residence to the nearest gravel road in accordance with the above noted suggestions and the draft policy be reviewed again later today CARRIED Mr Jeffery noted the Guzoo would like to have some M D. pins on hand for sale Existing policy indicates pins may SALE be given away at no cost as a public relations gesture M D PINS Mr Code moved the M D. agree to supply M D pins, at cost, iQrbPr Sent- G,,,4oa1 j to any private business in the area for re -sale purposes "" Cl�.,h, -k CARRIED Po bs r Mr Mueller moved approval of Mr Jeffery's report APPROVAL T C CARRIED JEFFERY The Executive Committee report was then reviewed and .items REPORT number 5 and 4 discussed in detail EXEC Mr Hogg moved approval of the Executive Committee report, COMM REPORT with the exception of the recommendations regarding item number 5 and item number 4, and further moved with regard to Item Number 5 the M D not participate in sending anniversary greetings to the City of Edmonton on their 100 "`�-,A birthday at a cost of $100.00, and with regard to Item number 4 the survey regarding funding for seed cleaning C m plants be completed to indicate the M.D supports provincial funding for replacement of seed plants, but not for upgrading of plants. CARRIED I Mr Boake moved approval of the accounts presented for payment today, subject to further review by the finance APPROVAL committee of R A Marz, Otto Hoff, Lawrence Hogg and Harold ACCOUNTS Mueller CARRIED Mr Jeffery reviewed the bank reconciliation statement for the month of July as well as a cash flow comparison and BANK MMMMw AT budget comparison report. -STATEMENT Mr Vickery moved approval of the bank reconciliation statement and the other reports. CARRIED Mr. Rodger entered the meeting at this time Mr Jeffery reviewed the August 7th road committee report ROAD and various items were discussed COMMITTEE The requests for gravel for the Tatro and Magnuson roads, REPORT as well as the request from E J Gibbs for gravel for two roads in the Acme area were discussed at length, FIRST TIME particularly if putting gravel on these roads is a waste GRAVEL due to their condition FOR ROADS 2 i COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 Mr. Vickery moved one time gravel be approved for the Tatro road - through 4 and west of 3 in 34 -22 -4 and west of 34- 33 -22 -4, for the Magnuson road - west of 1- 34 -22 -4, and 4 for the two roads in the Acme area - ENE 10- 30 -26 -4 and ENE i 34- 29 -26 -4, on condition the landowners requesting the I gravel are willing to pay one -half the costs for the gravel and application of same CARRIED Earl Paget of Carbon and Ivan Perich and A J Brown from Alberta Transportation entered the meeting at this time They discussed with council the proposed plans to eliminate the unsafe road access used by the Pagets to access Highway 21 Transportation had prepared two proposals and the costs for each were reviewed Mr Brown indicated the Province may pick up the constructions costs and the survey costs as the approach on to highway 21 is a real safety concern Mr Paget would donate the land and arrange for any necessary fencing. +,T,ri 'sn�olgUgation would be to supply the gravel and c•-e4sts and if a suitable agreement can be worked out between the M D and the Province the M D might be hired to do the construction work with its crew next year Mr Brown also advised funding for the project would not be available until next year L 3Ll -A: ?rN q 'w letters Ser �r PAGET APPROACH HIGHWAY 21 Mr Hogg moved the M D agree to accept proposal 2 as an paved secondary road so close to a paved highway acceptable option and route for the service road, the cost sharing proposals be accepted and negotiations be entered Mr Code moved a letter be sent to the Village of into with the Province later with regard to the actual construction work. alignment of SR 836 from SR 575 south remain as it is. CARRIED Mr Jeffery read a copy of a letter from the Village of RE ALIGNMENT Rockyford addressed to the County of Wheatland The SR —$3�- Village would like to see SR 836 re- aligned from SR 575 THROUGH through Carbon and south to Rockyford The Village had CA R _BO N also sent a letter to Stan Schumacher, M L A asking for ETC this re- alignment the intersection of SR 575 and SR 836 The line was moved GAS LINE Mr Brown noted the Province may have a problem with a paved secondary road so close to a paved highway Ie }s Mr Code moved a letter be sent to the Village of "} Rockyford, Stan Schumacher, M L A , and the County of Wheatland, indicating the M D council wish to see the alignment of SR 836 from SR 575 south remain as it is. CARRIED Mr. Code noted Mr Dale Merkel had expressed concern to him about the height of his approach leading on to SR 837 after DALE the road project has been completed It appears it will be MERKEL quite high. Mr Perich indicated there should not be a APPROACH problem Mr Jeffery reviewed a problem encountered by Rosebud Gas Co -op with regard to SR 836 construction project It was SR 837 necessary to move a gas line to accomodate the change in ROSEBUD the intersection of SR 575 and SR 836 The line was moved GAS LINE to a location which Transportation advised would be suitable It now appears the line will be under the new road Rosebud Gas Co -op feel the Province or the M D should pay for the second line move The M D will have to pay for the first line move in any event There was discussion with Mr Brown about what actually happened at 3 COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 the site when the first relocation of the line was discussed by Transportation, Gas Co -Op and M.D. personnal Mr Vickery moved to table this matter to the next meeting of Council to allow Mr Cunningham time to meet with Mr Roy Herman and Mr Andy Brown from Transportation regarding C this line relocation. CARRIED i Mr Brown, Mr Perich and Mr Paget left the meeting at this time The meeting adjourned for dinner between 12 00 Noon and 1.00 P M i DINNER Mr Hogg requested approval for a blade grade for the road west of 5 and 8 in 34 -24 -4. It was noted there had been BLADE work done on this road previously and it requires some GRADE further improvement WEST 5 & 8 Mr. Hogg moved this road project be put on the M D blade 34 -24 -4 grade program CARRIED Mr Boake noted Bucks for Wildlife would like to proceed HANSEN with development of the Hansen Dam in 24- 29 -24 -4 but have DAM not been able to get funding from the Province as yet — They would like some support from the M D encouraging theProvince to develop the dam area There was discussion about the M D 's position on this matter and it was j suggested if the people in that area would like to see the dam developed, they should provide their input to the Province and the M D Mr Hogg noted there is alot of dead grass in the Buffalo Jump Park coulee areas and there may be potential for a fire However nothing much can be done to eliminate BUFFALO theproblem JUMP PARK The request for gravel from T C Isaac was referred back to Mr Marz for further investigation. ISAAC REQUEST The request from Philip Ward for approaches into the S.E. GRAVEL and S W 17- 31 -24 -4 was discussed at length Mr Mueller moved the M D agree to install one point approach from SR 582 to serve the S E and the S W of 17 in 31 -24 -4 on condition Mrs Pearl Barr will allow the M D to backslope along the S E 17 adjacent to SR 582, and the motion passed recently to install an approach into S E. 17 off SR 582 be rescinded. CARRIED Mr Vickery moved approval of the road committee report CARRIED The policy drafted with regard to a road ban exemption for movement of indivisable loads was reviewed Mr. Code moved the policy be accepted by council CARRIED 4 PHILIP WARD REQUEST FOR APPROACH SR 582 ROAD BAN EXEMPTION POLICY �0k \C, bavl /I � COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 It was agreed the committee continue with negotiations with the land owners along the proposed re- alignment route for SR 836 SR 836 subject to compliance with M D land buying policy ,j "uA6 G Mr Hogg noted he and Mr Cunningham had reviewed the Pl r s cG� �,�`�dRou document from Alberta Labour - Towards a New System of s �-- Public Safety - A Safety Codes Act Transition Paper TOWARDS The document relates primarily to amusement rides, boilers, NOW buildings, electrical, elevators, fire prevention, gas, SYSTEM plumbing and ski lifts and passenger ropeways and does not OF PUBLIC relate to vehicle or transportation matters SAFETY REPORT Mr Boake moved to accept and file as information CARRIED �d Mr Hogg noted he had discussed the Finn Hall property situation with various members of the community, but they FINN HALL have not yet agreed on what should be done with the PROPERTY property Mr Hogg moved to accept and file his report CARRIED The price paid by various other municipalities for gravel royalties was discussed The average price paid is about GRAVEL 50 cents per cubic yard. ROYALTIES i Mr Hoff moved the price paid by the M D for gravel royalties remain at 60 cents for 1993 CARRIED 1de.Mdr, The tenders received for the hydraulic pull scraper were then opened. Tenders were received as follows TENDERS Doug Madsen $4521 00. PULL SCRAPER Brian Lemay $7000 00 • Mr Mueller moved neither bid be accepted CARRIED The bids received for construction of four end dump gravel trailers were then reviewed. Majak Industries $23,709 00 per trailer plus G S T Fort Garry Industries Ltd $17,910 00 per trailer plus G S T Southland Welding Ltd. $18,830 00 per trailer plus G S T Mr Marz moved the M D purchase 4 trailers from Fort Garry Industries for a total price of $76,654 80, including G S T. CARRIED Mr Hoff noted there is a washout on SR 575 from the road back into Beckers land on the north side of the road This washout should be repaired as soon as possible He also asked a letter be sent to another landowner in Swalwell advising him to cut the grass and clean up his property within the next 30 days or further action would have to be taken A request has been received for the M D. to put up an intersection ahead sign on the road West of 9- 34 -23 -4. and it was agreed the request be referred to the road committee for their recommendation 5 TENDER FOR CONSTRUCTION GRAVEL TRAILERS WASHOUT SR 57 SWALWELL LOTS NEED FOR CLEAN UP ROAD COMMITTEE ITEMS 0 L; COUNCIL MEETING TUESDAY, AUGUST 11TH, 1992 The request for a stop stop rather than a yield sign at NW 24- 31 -23 -4 was also referred to the road committee Mr Code noted Len Andrews called him recently as Mrs Helen Lowen is again refusing them access through her land Mr Code moved this matter be referred to committee for a recommendation CARRIED Mr Jeffery read a report from Bridge Branch regarding the low level crossing at N W 16- 30 -25 -4 They provided information as to what would be required to stop the erosion under the crossing Mr Kennedy estimates the cost to do this work will be at least $5500 00 It appears Mr. and Mrs Isaac have sold the land but someone else will be moving in there and will also want to use the crossing Mr. Jeffery noted the School Division will no longer allow the school bus to use the low level crossing He also noted Mr Hogg had made a motion at the October 24th, 1991 council meeting regarding this crossing and to date that motion has not been voted on The motion was read and discussed and Reeve Marz called for a vote on the October 24th,1991 motion LOW LEVEL_ CROSSING NW 1 -30 -25 ISAAC THE MOTION WAS LOST Mr. Boake moved the M D repair the low level crossing in accordance with the recommendations from Alberta Bridge Branch and the M D. apply to Bridge Branch for funding assistance for the project CARRIED Mr. Jeffery reported Dwight Falkner was driving a water truck, backed part way over the railway tracks north of P B I to allow other equipment to move around and was struck by a train The front end of the truck was sheared off The driver was not hurt, but was badly shaken up The accident has been reported to the R C M P and Jubilee Insurance Mr Hogg moved to accept the report as information CARRIED Mr. Rodger noted Cranston Construction will reclaim two gravel stock pile sites - Silver and Penner - for $2400 00 and this is a reasonable price for the work required Mr Code moved the M D. accept the bid from Cranston Construction for reclamation of the two gravel stock pile sites. Mr Boake moved council meeting do now adjourn in order to hold a public hearing scheduled for today at 4.30 P M PUBLIC CARRIED HEARING Mr Vickery moved council meeting do now reconvene, the public hearing having been completed. CARRIED There was discussion about the application for redesignation of Pt of the N E 1- 32 -24 -4 from agriculture APPLICATION to a Local Rural Commercial District and the comments and REDESIGNATION concerns raised at the public hearing PT NE 1 24 -4 No motions were forthcoming for first or any reading to the REFUSED by -law to amend the land use by -law Therefore the application for redesignation was refused Mr Jeffery read a letter from Frank Wessel.ing, Director of Palliser Regional Planning Commission It has been suggested there may be a need for Kneehill, Starland, Badlands and the City of Drumheller to review possibilities URBAN RURAL about joint planning in the urban rural fringe areas The FRINGE commission is willing to participate in these discussions PLANNING and wish to know if the municipalities are interested MEETING Mr Hogg moved if the other areas are in agreement, Mr Hoff attend the meeting on behalf of the M.D CARRIED Mr Davies noted he had drafted up an amending by -law to incorporate into the M.D land use by -law the necessary I changes to create a country residential district zoning and DATE the regulations relating to the Kneehill Creek area FOR '( structure plan.
