Tuesday, April 14th, 1992 !at the municipal administration office, 232 Main Street, Three 'Hills, Alberta iCourt of Revision members present were. He is being penalized because he has reduced his farmland Mr Harold Mueller entered the meeting Time 1 15 P M Mr Dunay advised Mr. Grenier that due to the provincial changes in assessment the first three acres are assessed at market value and the residence exemptions have to be earned Mr Dunay noted that Mr Grenier is still considered a farmer and is not being assessed for his buildings If he were an acreage owner he would be assessed for all the buildings. Mr. Jeffery asked Mr Grenier if, except for the provincial legislature governing assessment calculations, he was satisfied his property was assessed fairly? Mr Grenier responded that he was satisfied Mr Jeffery then explained that the municipality is governed by provincial assessment legislature and Mr Grenier could elect to appeal this Court of Revision decision to the Alberta Assessment Appeal Board Mr Code moved the total as 57 Roll 692010 Andrew, Paul Mr Andrew addressed the court same situation as Mr Grenier except a half section which is 7 sessment be reduced by $14,480. CARRIED Time 2 50 P M There was discussion about the Wimborne Cemetery and the need to acquire land for expansion of the cemetery Mr WIMBORNE Vickery noted he would discussed the possibility of CEMETERY acquiring 50 to 100 feet wide strip from the land on a per EXPANSION acre basis. It was suggested should negotiate for at least a 100 foot wide strip Whether the area would need to be surveyed and the price which could be made for the land was , also discussed Mr Mueller moved Mr Vickery and Mr. Cunningham review the 3 matter further, draft up a possible plan for expansion and G bring a report back to Council as to what costs might be involved CARRIED Mr Jeffery reported Archie Grover, Deputy Minister of A GROVER Municipal Affairs is retiring and a retirement party is RETIREMENT being held for him on Saturday, May 9th, 1992 in Edmonton Mr. Mueller moved one councillor and his spouse attend thei (cc�• �s retirement party on behalf of the M.D. CARRIED It was generally agreed Mr. Hoff would attend if possible Mr Jeffery noted Murray �rq has requested redesignation RE of his land - N W 7- 30 -24 -4 to agriculture DESIGNATION Mr Vickery moved the public hearing be held on Tuesday, May 12th, 1992, commencing at 4:30 P.M. and notice of the ��sn s e public hearing be advertised in two issues of the local S t Paper C ` > CARRIED Mr Jeffery read a letter from Darin Esau regarding the road north of Nick Wiens place He has purchased the S W 17- 31 -25 -4 and would like the M D to construct a road to provide him with access He is planning his yard site for the north west corner of the quarter section The land is located 1 mile west of SR 806 He was advised he could have the road built to M D standards at his cost and that a blade grade standard would be adequate The road would have to be developed for one -half mile from SR 582 north Mr Mueller moved after Mr Esau has constructed a house to a liveable standard, the M D construct a blade grade standard road and gravel same at M D cost for a distance of approximately half a mile to provide the necessary access. CARRIED Mr Jeffery reviewed the Executive Committee report Item No 12 from the Report was discussed Mr Mueller suggested in order to save the costs of re- survying the K ROAD DARIN ESAU EXEC COM REPORT 101, ,I .q r, E COUNCIL MEETING TUESDAY, APRIIL 14th, 1992 road again, Mr Dau be offered a letter of agreement The cost to do the re- survey would be at least $700 00 Mr. Vickery moved Mr. Mueller meet with Mr Dau again and try to negotiate some reasonable settlement due to the cost involved in doing a re- survey of the road widening taken in error CARRIED There was discussion about Item 27 - Alberta Electric Energy Marketing Act It was agreed staff should submit written notice of the intention to submit input regarding the review and proposed act and also submit a written submission Mr Mueller moved approval of the Executive Committee report CARRIED Mr Jeffery advised Council about his recent discussions with Dennis Berdahl Mr Berdahl listed five concerns he has with Dennis Bramley, Division 2 grader operator and he wants some disciplinery action taken against him He wants assurance the M D and or its employees will stay off his property He also wanted to know why the M D had published in the M D. minutes discussions about this situation, feels Dennis has a personal vendetta against him and wants to know what will happen in future if he calls in and advises the office Dennis Bramley is trespassing on his property It was noted it will be necessary to trespass on a corner of Mr Berdahl's land in order to fix an existing problem with the road and a letter of permission will have to be obtained from Mr. Berdahl to do this Otherwise the M D will provide no services to Mr. Berdahl for snowplowing or grading on his land Mr Mueller moved no disciplinery action be taken against Mr Dennis Bramley, he be sent a formal letter advising he must stay off of any land owned by Mr Berdahl unless a letter of permission has been obtained by the M D from Mr Berdahl, and further moved a letter be sent to Mr Berdahl requesting permission from him for the M D to trespass on his land in order to rectify the existing road problem CARRIED Mr Hogg moved the on -going council discussion and motions regarding the Berdahl land situation be published in the Three Hill Capital as part of the regular publication of the M D minutes Mr Code requested a recorded vote. J r- T DENNIS BERDAHL TV �o e U • COUNCIL MEETING TUESDAY, APRIIL 14th, 1992 He suggested that Council not have a general assessment done every year and reviewed his reasons for this opinion It requires a considerable amount of work every year and leaves no time for finding errors before doing another general assessment However it is possible by 1996 every municipality will have to do annual general assessments He recommended council consider doing a general assessment every two years GENERAL ASSESSMENTS Mr Hoff moved the assessment department do a general Ed Gdvis'A assessment every two years CARRIED Mr. Dunay left the meeting at this time Mr Hogg moved item number 18 on the agenda - Finn Hall property - be tabled to the next meeting of Council FINN HALL CARRIED Mr Hogg moved Item Number 19 on the agenda - Ben Schmidt Lagoon problem - be tabled until more information is SCHMIDT available LAGOON CARRIED ab 1P� Mr. Marz noted he had met with Mayor Robertson of the Town of Three Hills and discussed with him the situation with regard to the M D lot in Grantville GRANTVILLE It appears the Town is not very interested in exchanging LOT the lot for the transfer box site A letter has been received from the Town of Three Hills and they offered the sum of $1 00 for the property and would be prepared to keep the lot for park purposes The residents of Grantville offered the sum of $1 00 for the land plus $1 00 for the improvements. If the M D accepted their offer the group would apply for corporate status in order to hold title to the property Mr. Marz moved the M.D. accept the offer of $1 00 from the Town of Three Hills for the lot plus the play park equipment on condition the Town maintain the property as a playground, a municipal reserve designation be registered against the property when transfer of title is registered and the costs incurred for registration of the transfer of title be borne by the Town of Three Hills. CARRIED The survey from the AAMD & C regarding how various councils set up their annual committees was discussed Various suggestions and comments were put forth including the amount of time which is required for some committees COUNCIL and the idea that changing committees would provide all COMMITTEE councillors with a better view of all aspects of the M D SET UP It was also noted on some committees there is a need for continuity Mr Hoff moved to table this matter to the 1992 T organizational meeting and further moved a full day be set ' aside for the 1992 organizational meeting ORGAN CARRIED MEETING Mr. Jeffery noted Mr. Rodger has not received all the information back about whether the barb wire used by the M D last year was defective BARB WIRE REPORT C� 4 r #� fl of s D� :7 v COUNCIL MEETING TUESDAY, APRIIL 14th, 1992 Mr Mueller moved to table this matter until the information is available CARRIED The matter of rental of the M D offset tandum breaking disc was discussed The committee noted they had not been able to finalize the draft policy Mr. Boake moved to table this matter until the committee is able to have the policy drafted. CARRIED Mr. Cunningham entered the meeting at this time Mr Jeffery reviewed the committee's report from the meeting held with the Swalwell residents on April 8th. Mr Cunningham asked for some direction from Council He suggested a similiar meeting should be held with residents of the other larger hamlets It was also suggested there should be a burning by -law in place to stop burning of household garbage in the hamlets, the owners be advised about the M D litter by -law and they be requested to clean up their property Mr Hoff moved acceptance of the committee report and Mr Cunningham be authorized to follow through with the suggestions made as a result of that meeting, and a notice be sent out to all landowners in the hamlets advising them of the terms of the M.D. litter by -law and requesting them to comply with the terms of the said by -law.
