HomeMy WebLinkAbout1991-01-23 Council MinutesA [A N r: COUNCIL MEETING WEDNESDAY, JANUARY 23RD, 1991 The Council Meeting which was adjourned on Tuesday, January 22nd, 1991, until 9 00 A M Wednesday, January 23rd, 1991 reconvened at that time with all councillors present Mr Jeffery, Municipal Administrator was present and Mrs Wilkinson, Assistant Administrator was present and recorded the minutes Reeve Hoff called the meeting to order There was discussion about the need to apppoint an auditor to do the 1990 audit due to the resignation of Rhodes and Company Mr Hoff moved Robert Kangas Professional Corporation be appointed to do the M D 1990 audit and if necessary the office apply to the Province for a time extension to complet the audit. CARRIED The request from Elmer Wiebe for redesignation of his land (S E 22- 30 -25 -4) to agriculture was discussed Mr Mueller moved first reading to by -law number 1211, this being a by -law to amend the M D land use by -law 1061 by redesignation of the S E 22- 30 -25 -4 from Agricultural Conservation to Agriculture CARRIED Mr. Marz moved second reading to this by -law CARRIED Mr Code moved third reading be given to this by -law at this time. CARRIED UNANIMOUSLY Mr Boake moved third reading to this by -law CARRIED The proposed amendment to the M D land use by -law 1061 which would change the minimum separation distances for intensive livestock operations was discussed at great length Mr Cunningham entered the meeting and review various items with council. Mr Code moved the amending by -law be changed to provide for a separation distance of five hundred feet from the nearest residence for spreading manure Mr Vickery requested a recorded vote. In favour - J Finlay Code Opposed - Robert E Boake, Otto Hoff, Lawrence Hogg, Richard M Vickery, Harold Mueller and R A Marz MOTION WAS LOST Mr Hogg moved the proposed amending by -law be changed by deleting in its entirity the last paragraph in Section A regarding establishment of a separation distance for spreading of manure Mr Mueller requested a recorded vote In favour Richard M Vickery, Richard A Marz, Harold Mueller, Otto Hoff, Robert E Boake, Lawrence Hogg Opposed J Finlay Code MOTION WAS CARRIED 1 PPFCFNT AUDITOR 1990 AUDIT letEc�s ELMER WIEBE REDESIGNATE SE 22-30- BY LAW NO 171-1 AMENDMENT LAND USE BYLAW Nn 19ig u 11 COUNCIL MEETING WEDNESDAY, JANUARY 23RD, 1991 Mr Marz asked if Council would be willing to check with the Provincial departments and possibly legal sources to see if th M D should be involved in legislating any operational methods farming or if this is within the jurisdication of the M D to so Mr Code moved first reading to by -law number 1212 which is a law to amend the M D. land use by -law number 1061 by deleting Subsection (3a) of Section 44 Part V11 of the General Land Use Regulations of the existing by -law and replacing same with the following a Type of Livestock --------------- - -- Beef Cattle Broilers - Chicken - Turkeys Dairy Hens Hogs Horses Mink Rabbits Sheep Veal Calves Minimum Separation Distance --------------------- - - - - -- 1500 feet (457 m) 900 feet (275 m) 1050 feet (320 m) 1050 feet (320 m) 900 feet (275 m) 1500 feet (457 m) 1050 feet (320 m) 1650 feet (503 m) 1200 feet (365 m) 1050 feet (320 m) 1500 feet (457 m) These minimum distances shall apply to the nearest residence not occupied by the owner /employee of an intensive livestock operation Point of measurement shall be the closest point of a barn, manure storage facilities and / or outdoor confinement areas as determined by the Development Officer/ Municipal Planning Commission CARRIED Mr Hogg moved second reading to this by -law CARRIED Mr Marz moved third reading be given to this by -law at this time � CARRIED UNANIMOUSLY Mr Hogg moved third reading to this by -law CARRIED It was agreed Mr Jeffery should check with government -T C-5- departments regarding whether the M.D should be involved in -r legislating operational farming methods It was also suggested the M D should be putting pressure on the Province to ensure Department of Agriculture maintains control over Provincial farming regulations rather than having the Department of Health or Environment involved It was also suggested this matter be discussed with the M L A's at the combined meeting in February Mr Cunningham left the meeting at this time M D to the towns and villageEc The recreation grants paid by the M D and rural communities was discussed Mr Marz asked for a list of monies paid by the M D towards various joint ventures such as school requisition, ambulance, Golden Hills Lodge, hospitals, fire, etc There was discussion about the share of these requisitions paid by the M D as compared to the towns and villages r� GRANTS N u COUNCIL MEETING WEDNESDAY, JANUARY 23RD, 1991 Mr Hoff moved a committee of J Finlay Code, Richard M Vickery and John C Jeffery review the financial statements submitted by the various towns, villages and rural communities and look at possible ways to redistribute the M D recreation funding, based on the services provided by the various groups and towns and J, villages, and the request from the Town of Three Hills for extra --iv recreation funding be tabled until their recommendation is yo available CARRIED TOWN The letter received from the Town of Three Hills regarding its THREE proposed annexation of land along SR 583 on the north side of the access road was discussed HILLS I Mr Mueller moved the town of Three Hills be advised the M D ANNEXATION would have no objection to the proposed annexation on condition REQUEST the town restrict its application to that area on the north side l( of SR 583 from the east boundary of the Three Hills Hospital to IQ�� Highway 21 and northly to an line drawn easterly from the �e,41 existing north boundary of the Three Hills Hospital property, and on condition the agricultural land in that area continue to be assessed on an agricultural rural basis until there is a change in the use of that particularly parcel of land CARRIED The Environmentaly Significant Area report prepared for the M D - -M was reviewed gkVe ENV Mr Mueller moved the report be referred to the M P C for review and their comments be sent to Palliser Regional Planning commission so the report can be finalized SIGNIFICANT CARRIED AREA REPORT I It was agreed the M P C would meet on Monday, January 28th, 1991 at 9 00 A M MEETING M P C The report from the Grade Crew Foreman regarding the ditch cleaning projects proposed for Division 7 was reviewed and discussed again DIV 7 It appears one or two of the projects would take buggies and DITCH packers to do a proper fob The roads are lower than the CLEANING surrounding fields and at least two the projects should be put on the road program as ditch cleaning will not be adequate PROJECTS Mr Hogg noted the Knievel and Meding projects are ditch cleaning projects and the Haller Road is a blade grade ETC Mr Marz moved the South Huxley Road Project - approximately one ADD mile - South of 17- 34 -25 -4 be added to the 1991 road program, the TO Haller Road be done as a blade grade and the road be improved up 1991 to the slough on both sides and the Knievel and Meding ditch ROAD cleaning projects be deleted from the 1991 ditch cleaning project FROG program r'\� �''rU CARRIED " w.<Y, e r,+c d v 1-&4 The Bridge Crew job description was reviewed briefly BRIDGE CREW Mr Marz moved to table this matter until the next meeting of JOB council CARRIED , / G�\P DESC C t'l The status of the low level crossing at N E 17- 30 -25 -4 was discussed LOW Mr Boake reported he has not been able to make any progress in LEVEL I his dealing with Mr Harvey M Toews regarding purchase of land CROSSING to improve the access through S E 17- 30 -25 -4 out to the south It appears to put in a proper crossing would cost at least NE 17-30 7 �{j 25 -4- A A COUNCIL MEETING WEDNESDAY, JANUARY 23RD, 1991 $20,000 and there would be no guarantee the crossing would stay in because of the depth of the water and curves in the creek at this location It appears a bridge and /or culvert would be the proper solution Mr Marz moved the Road Committee meet with Mr Harvey M Toews and negotiate for the purchase of sufficient additional land to up -grade the road in S E 17- 30 -25 -4 to provide better access to -- O the south, and failing this solution the land owners concerned -pU will have to use the access road to the south as it now exists as the M D will do no further work on the low level crossing ENE 17- 30 -25 -4 and the crossing will be taken out in the spring CARRIED CANCEL Mr Hogg moved the Road Diversion as shown on Road Plan Number ROAD 270 B.M as it affects the South half of 13- 29 -22 -4 be closed as it is no longer required for public access and the land be PLAN returned to title with the balance of the quarter sections r 270 B M involved. k S' 13 CARRIED s`� 29 -22 -4 Mr Mueller moved to table Item Number 20 on the agenda until the_ - ", ,-` February 19th meeting of Council CARRIED TABLE The Executive Committee report of January 17th, 1991 was ITEM discussed The fun brochure which has been printed for inclusion EXEC in the 1991 Big Country Tourist Guide was reviewed and COMM discussed REPORT It was agreed the M D road system should be more clearly and correctly shown on the brochure if it is to be re- printed for use another year Membership in the Alberta Fire Chief's Association was discussed Mr. Hogg noted he attends the association annual convention ALTA C as a Fire Chief and a Councillor As he is now a director on the association board he will also be attending about 4 directors' FIRE meetings in 1991 CHIEF Mr Code moved to table Item Number 2 on the Executive committee ASSOC report until later and the balance of the report be approved.
