ADC - Otto Hoff 15 Further Ed - Bob Boake 16 PAWN - Finlay Code 17 Surface Reclamation Board 26 Review request from Orkney Group for assistance from the M D in connection with their water well co- operative project ,�i COUNCIL MEETING TUESDAY, AUGUST 8TH, 1989 A regular meeting of the Council of the M D of Kneehill #48 was held on Tuesday, August 8th, 1989, commencing at 9 00 A M The following were present for the meeting Reeve Otto Hoff Division 2 Councillors J. Finlay Code Division 1 Robert E Boake Division 3 Richard A. Marz Division 4 Harold Mueller Division 5 Bruce Hastie Division 6 Lawrence Hogg Division 7 Mrs. Jean Wilkinson, Assistant Administrator was present and recorded the minutes. Reeve Hoff called the meeting to order and requested approval of the agenda Mr Code moved approval of the agenda as presented CARRIED Mrs Wilkinson reported a motion made at the July 25th meeting was missed when the minutes were typed. The minutes should be corrected by adding the following motion on Page 2 after the motion regarding ditch cleaning policy "Mr Marz moved as follows 1 Keivers Lake Back Road - 3 mile project - South of 29 & 30 in 31 -25 -4 and South of 25- 31 -26 -4 be added to the 1989 main crew program 2. the ditch cleaning projects in Division 7 - Knievel - West of 27 , South of 27 and South of 26 in 33 -23 -4 and Meding - West of 16 & 21 in 33 -22 -4 be approved for the 1989 construction season 3. the blade grade project in Division 4 - Old Mill Farm - south of 16, 17, & 18 in 32 -25 -4 be approved for the 1989 construction season and 4. the following projects - Divsion 6 - Smith Project - West of 7- 34 -25 -4 and Division 3 - West of 28 & 33 in 29 -26- 4 be tabled and discussed again at the next meeting of council. CARRIED Mr Mueller moved approval of the July 25th council meeting minutes subject to the above noted correction CARRIED Mr Boake moved approval of the accounts submitted for payment today, subject to further review by the finance committee of Otto Hoff, R A Marz, J. Finlay Code and R E.Boake CARRIED The Executive Committee Report dated August 3rd 1989 was reviewed and several items were discussed in detail The problem with an A.G.T. pedistal being too close to the travelled portion of the Gorr Road was discussed. AUGUST 8TH. 1989 1 Mr Hogg moved approval of the Executive committee report CARRIED Mr. Jeffery's report was reviewed and discussed J C JEFFERY Mr Hastie moved approval of the report. REPORT CARRIED There was discussion regarding the existing M D road approach policy, the number of approaches which should be M D ROAD allowed on a secondary road and whether approaches on secondary roads should be paved APPROACH POLICY Mr. Code moved the office get information from other Municipal Districts and Counties about their road approach ley '1"" policy and the matter be discussed again at a later date. do CARRIED The drainage problem at the Ben Schmidt Road Project - West of 3 & 10 in 34 -24 -4 was discussed Torchinsky Consulting advise it would cost about $8000 00 to install two granular DRAINAGE drainage ditches. It was agreed this matter be discussed PROBLEM later today with Mr. Rodger. West 3 & Mrs Wilkinson noted Alberta Municipal Affairs require some 10- 34 -24 -4 information from the M D concerning the 1989 election procedure and the number of voting stations the M D plan on having. It was noted these matters have not been ELECTION finalized as yet jt INFORMATION Mr. Mueller moved Municipal Affairs be advised Mr Jeffery \e����' FOR MUN has been appointed as Returning Officer for the M D and the number of voting stations has not yet been decided. AFFAIRS CARRIED Mrs. Wilkinson reviewed the FCSS renewal agreement which now has been signed by all municipalities except the M D i The agreement extends participation in the program until APPROVAL March 31st, 1990 FOSS Mr Boake moved the Reeve and Municipal Administrator be AGREEMENT authorized to sign the FCSS renewal agreement, which will cop�F *o authorize M D participation in the program until March 31st, 1990 eGCr CARRIED Ori s Rodger entered the meeting at this time 10 00 A.M. ORIS RODGER There was discussion regarding the FCSS Community Resource IN Worker program and whether the program is of any help to the communities. Mr Hogg moved Jennifer Deak be authorize to take two courses and Lori Wildeman be authorized to take one course CARRIED The lease of the farm land at the Schmautz Pit was discussed Mr. Code moved the M.D. advertise for bids to lease the Schmautz Pit farm land for a 3 year term from November 1st 1989 to October 30th, 1992 on a cash rent basis plus payment of any taxes assessed against the land, with the bids to be received no later than October 15th, 1989, and the highest or any bid not necessarily accepted. CARRIED The price quoted by Torchinsky Consulting for traffic counters was reviewed as well as whether the machines would be of any value to the M D. These kind of counters cannot tell what kind of vehicles are using the roads, only the numbers Mr Marz moved the M.D. purchase two traffic counters from Torchinsky Consulting Ltd , at a price of $749 10 CARRIED Mr. Rodger noted he would put the traffic counters on the Acme West Road, SR 587 and the Gorr road initially and would report the results to council at a later date The request from Mr Lawrence Kahler of Trochu for the M D to reimburse him for more than $100.00 for the dust control product he had applied to the road past his residence was discussed Mr. Marz moved the M.D. not exceed its current policy for dust control rebates CARRIED Mr. Mueller noted the road at the Junction of SR 575 and SR 837 along the river to the north west requires some work. The road was scarified some time ago and is in quite bad shape due to the amount of tourist traffic using it He felt there is about a half mile of road which should be scarified and have screenings and LS2000 put on There was discussion regarding this request Mr Mueller moved the divisional motor grader be used to scarify a portion of SR 837 from the intersection with SR 575 north west for about half a mile and LS2000 be put on CARRIED The report from the Safety Committee tour of August 1st was then reviewed and various items discussed. Mr Boake moved a back up alarm be installed on the Case Tractor /hydra post pounder CARRIED There was discussion as to whether it is necessary for employees to have M D radios in their private trucks (which they use when checking roads) It was noted employees are storing personal items in the M.D. grader shops. TRAFFIC COUNTERS PURCHASE �an� d LAWRENCE KAHLE R REQUEST 1 RE DUST I CONTROL REBATE `e�ktr' Sen'v SR 837 1 ROAD IMPROVEMENT NEEDED i SAFETY COMMITTEE REPORT kL P �U 'n khiS 3 F COUNCIL MEETING TUESDAY, AUGUST 8TH, 1989 Mr Code moved acceptance of the Safety Committee report and further moved in future no employees' personal belongings are to be stored in any M.D. shops, with the exception of a reasonable amount of small hand tools which the employee feels he requires in order to work on any M.D. equipment, and a list of these tools be approved by the Public Works Superintendent and placed on file in the the M D Office CARRIED Mr. Code moved Mr Cunningham check into the availability of radios for divisional motor grader operators' personal vehicles for winter months only and report back to council CARRIED The Kientz Bridge Project was reviewed again by council It appears that the existing creek channel will not be filled in as Fish and Wildlife have requested the channels be kept open for wildlife habitat It appears Mr Kientz will not be suffering any loss of access to water and the financial compensation arranged with him should be reviewed Mr Hogg moved, as the existing water channels will not be filled in and access to the water will still be available to Mr. Kientz, and the terms originally agreed to with Mr. Kientz would not be applicable, the motion passed by Council at the July 25th meeting of Council be rescinded and Mr. Marz be authorized to enter into further negotiations with Mr Kientz for purchase of the required land and for the required backsloping borrow pit agreement. CARRIED Mr Rodger requested council ask Bridge Branch to remove a bridge which is located West of 21- 34 -25 -4 and replace it with one of the large culverts removed from the SR 575 Acme West project This would eliminate an on -going problem with the bridge which is too narrow and is continually being damaged by farm machinery Mr Mueller moved this suggestion be forwarded to Bridge Branch for their consideration and comments CARRIED Mrs Wilkinson noted the backsloping borrow pit agreement arranged with Al Seward on NW 19- 28 -23 -4 is somewhat over policy. Mr Marz moved the agreement as arranged be approved CARRIED Establishment of priorities for secondary road construction projects was briefly discussed Mr Boake moved this matter be tabled until the next meeting of Council. CARRIED There was discussion about whether two projects which were put on the ditch cleaning blade grade program should be done One project was in Division 6 and the other one was in Division 3. CARRIED Mrs Wilkinson noted the new M.D. pins have been received PRICE FOR and setting a price for the new pins was discussed NEW M D. PINS Mr. Marz moved the M D sell the pins for the following i p r ces P $2 50 for the plain pin $3 00 for the resin top pin ©�Q- and if the pins are to be mailed out add $1.00 for mailing and handling charges CARRIED Mr Hastie reported a contractor hired by A.G.T is A G T installing pedistals on the M D base course project by Jack CONTRACTOR Christie's and is obstructing traffice as well as creating a traffic hazard TRAFFIC It was agreed Oris Rodger and Otto Hoff should go out and HAZARD discuss the matter with the contractor. Otto Hoff and Oris Rodger left the meeting at this time Time 2 04 P M Deputy Reeve Marz took charge of the meeting. B SCHMIDT ROAD The report prepared by Torchinsky Consulting with regard to DRAININAGE the Ben Schmidt Road Draininage Problem was briefly discussed PROBLEM Mr Hogg moved this matter be tabled until the next meeting of Council CARRIED Jubilee Insurance have forwarded a questionnaire regarding RECRIPICAL the Reciprocal Insurance Agreement They would like to know INSURANCE if the jurisdications feel the limit per loss for the reciprocal pool should be increased and if the available CHANGE excess funds should be added to the reciprocal pool to increase these limits Mr Mueller moved Jubilee feasibility of increasing investigated as long as t and that the excess funds pool be advised the M D feel the �eP the reciprocal pool should be PyE he insurance rates do not increase, to be combined with the reciprocal Sub CARRIED The need to pass a by -law to authorize the M.D. to formalize its participation into the Drumheller Solid Waste DRUM SOLID Management Association was discussed WASTE ASSOC Mrs Wilkinson ��t t �G� s c�au� e i�g£�� m ��e�i�n here was discussion a u � AGREEMENT 5 6* M COUNCIL MEETING TUESDAY, AUGUST 8TH, 1989 Mr Boake moved first reading to the by -law to authorize the Reeve and Municipal Administrator to sign the new agreement with the other participating municipalities in the Drumheller Solid Waste Management Association AS THE VOTE WAS A TIE, THE MOTION WAS LOST. There was further discussion about the time required to opt out of the agreement / Mr Marz moved the Association be advised the M D. feel the term of the agreement should be three years (not U five) and a municipality should be able to opt out at any time with one year's notice, and also the office is to determine if the Town of Trochu is in fact participating in the association, and when further information is available, the matter of the M.D. participation in the association be discussed again by Council. CARRIED OFFER TO Mrs Wilkinson noted Mr Lawrence Clawes of Crossfield has PURCHASE offered to purchase Lot 24 in Block 8 Sunnyslope for the sum of $150 00 The lot is designated as a public works reserve M D LOT IN 1 of and this would have to be removed if Council wish to SUNNYSLOPE dispose of the property Removal would require advertising the proposed sale of the property and holding a public hearing to see if there are any objections to the proposed sale key Mr. Code moved Mr. Clawes be advised Council would be willing to sell the property to him for the sum of $300 00 on condition and subject to the M.D. being able to arrange for the removal of the public works reserve designation from the property CARRIED Mrs Wilkinson reviewed the prices quoted for having an M.D. M D FLAG flag custom made PRICES Mr. Mueller moved an M.D flag not be made at this time CARRIED Mr Hoff and Mr Rodger returned to the meeting at this time Time 308 P.M. The cost for purchasing a large quantity of some type of PRICES FOR pens with the M D name on them was discussed M.D PENS To purchase a pen worth having would cost nearly as much as the M D pins Mr Hogg moved no personalized M D pens be purchased at this time. CARRIED Reeve Hoff took charge of the meeting at this time. Mr Hoff noted the contractor working for A.G T had a flag person on the project and was stopping traffic until it was safe to proceed The contractor advised they would not be there much longer and did agree they would be responsible for any damage caused to M.D culverts Mr Rodger noted Lawrie Ross has requested more wages He REQUEST is working as a mechanic's helper, but could make more money FROM L ROSS working as a machine operator as he could get more money per FOR MORE hour and would work 10 hours a day instead of 9. WAGES If he is not given a raise he wishes to be transferred to the main crew as a heavy equipment operator COUNCIL MEETING TUESDAY, AUGUST 8TH, 1989 There was lengthy discussion about this request, and whether there is a need to have a full time helper working with the mechanic on the main crew It was also noted Lawrence Ross is a temporary seasonal employee, but has worked for the M.D. each summer since 1986 Mr Hastie moved if the crew foreman can use him as an equipment operator, Lawrie Ross be allowed to work one hour in the morning, prior to crew start up, with the main crew mechanic in order to get the machine servicing done, and be paid at his present rate of pay for this time, and the rest of the day he operate heavy run equipment on the main crew and be paid at an operator's rate of $12 04, and he be (0 authorized to work a 10 hour day. MR. MARZ MOVED THIS MOTION BE TABLED UNTIL THE NEXT MEETING OF COUNCIL CARRIED Oris Rodger left the meeting at this time - 4 10 P M Grant McIntosh of Carbon, Alberta and his brother entered MEETING the meeting at this time WITH GRANT Mr. McIntosh noted the problems he and his family are experiencing because of the Stewart hog operation are not McINTOSH going away He asked that council consider the following requests 1. Provide him with an air conditioner for his home 2. Pay for his hotel accomodations when he has to leave his home because of the smell. 3 Cover the lagoon to cut down the smell 4 Reduce his taxes 5. Provide him with fob re- training or with a job counsellor to help him get re- established in another line of work and he requested Council provide him with a response as soon as possible. He noted his health is bad and his doctor tells him he has to do something right away There was discussion about how far away from a residence manure could be spread and whether there was any regulations to control this Mr McIntosh felt Mr Stewart would likely spread manure right across the road from his residence this fall when he empties the lagoon He also felt council should force operators to inject the manure into the soil There was also discussion as to whether planting trees around a lagoon would help dissapiate some of the smell. Mr McIntosh felt Mr Stewart had not totally complied with about 6 conditions in the M D board order Mr. McIntosh and his brother left the meeting at this time Time 4 48 P.M. P �?y Council directed the office and Palliser Regional look at the by -law with a view to providing a minimum separation distance from a rural residence for spreading manure and this matter be discussed by council at a later date It was also suggested Mr Code and Mr. Hoff request Mr Stewart to stay more than 1500 feet away from Mr. McIntosh's oal residence when spreading manure It was also suggested Alberta Agriculture be requested to consider conducting an experiment with tarps over manure ,. storage lagoons to see if they might contain and reduce the smell C% 7 COUNCIL MEETING TUESDAY AUGUST 8TH 1989 I Mr Marz moved this matter be tabled until the next meeting of Council G CARRIED Mr. Mueller moved this meeting continue until 5 15 P M+� CARRIED UNANIMOUSLY Mr. Mueller noted a group of farmers in the Orkney area have drilled a well and plan on establishing a community water supply It is possible Alberta Environment may fund 100% of the cost of the well if the M.D. applies for the funding The farmers have therefore requested the M D apply for the funding on their behalf There was lengthy discusion about this request Mr Marz moved this matter be tabled until further information can be obtained from Alberta Environment regarding regulations which would be involved and what responsibilities would fall on the M.D. should council agree to apply for the funding. CARRIED Mr Boake moved item number 15 on the agenda be tabled until the next meeting of Council. Oris Rodger advised an A G T pedistal is within 8 feet of the travelled portion of the Gorr road, about 1 112 mile north of SR 583 Land in question belongs to Steven Jerry Maerz. Discussed with A G T. - they advise land owner would not allow them to put the pedestal further back on private property and that where the pedistal is located is in fact the property line Landowner maintains the road bends towrds his land Discussed possible solutions with A G T - they likely cannot put on other side of road because of the power line - but will review and come up with a price to move the pedistal across the road if possible. The motor grader will likely knock the pedistal over with the snow plow wing, and would assume M D would be responsible for costs incurred as the pedistal is on property line One alternative would be to have the road surveyed to determine of if the road is curving towards private property or not. �rec Executive Committee recommend to try to negotiate with the land ��' �L \��c�ci owner involved to see if he will allow A G T to move the /` Go�p pedistal further back on to private property and away from the " road 2 Palliser has provided the M D with 20 new land use by -laws No charge Will up -grade office copy and other copies and there �GP will be 10 copies available for sale What fee do you wish to charge for them - previously sold for $12 00 Executive committee reocmmend the copies of the by -law be sold for $12.00 and when the supply is nearly gone, the office re- order a few more 3 Michael Welsh has forwarded an account for costs incurred in connection with the Pig Improvement matter The interim account amounted to $4136.10. Copy of a letter from the Village of Linden to the Drumheller,�,ea° & District Solid Waste Association asking for help with their garbage problem, either by picking up more often from the r transfer site or having another transfer box installed. ✓ Executive Committee recommend to accept and file 6 Letter from Alberta Agriculture addressed to A S B It appears the Province and the Federal Government has signed a soil conservation agreement for Alberta to deal with the serious soil degradation issues of wind and water erosion, salinization and organic matter depletion Money has been set aside for a three year program and in 1989 the Province will make up to $720,000 00 available to the Ag Service Boards for soil conservation initiatives over and above current programs previously approved under the annual memorandum of agreement.
