Report from Torchinsky re Ben Schmidt Project - West 3 & 10 in 34 -24 -4 2 COUNCIL MEETING TUESDAY, JULY 25th, 1989 A regular meeting of the Council of the M D of Kneehill #48 was held on Tuesday, July 25th, 1989, commencing at 9 00 A M The following were present for the meeting Reeve Otto Hoff Division 2 Councillors J Finlay Code Division 1 Robert E Boake Division 3 Richard A Marz Division 4 Harold Mueller Division 5 Lawrence Hogg Division 7 J. C Jeffery, Municipal Administrator. PRESENT Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes. Reeve Hoff called the meeting to order and requested approval of the agenda Mr Marz requested item 16A - Crop Insurance be added to the agenda Mr. Boake moved approval of the agenda with addition of the above noted item CARRIED There was a request to clarify a motion made at the last council meeting regarding rental of equipment - page 5 of the minutes. The motion stated no equipment should be rented to a non - ratepayer The motion was dealing with A.S.B. rental equipment not public works equipment, which cannot be rented out It was agreed the motion should be corrected to make reference to A S B rental equipment APPROVAL AGENDA CLARIFY AND APPROVAL OF MINUTES Mr Mueller moved approval of the July 11th council meeting f minutes, subject to the above noted correction CARRIED Mr. Mueller moved approval of the accounts presented for APPROVAL OF payment today, subject to further review by the finance ACCOUNTS committee of 0. Hoff, R. A. Marz, Harold Mueller and J Finlay Code CARRIED Mr Jeffery reviewed the bank reconciliation statement for BANK the month of June, 1989 STATEMENT Mr Mueller moved approval of the bank statement for the month of June, 1989 CARRIED Mr Jeffery reviewed his report and various items were J C JEFFERY discussed REPORT 1. The projects which were listed for ditch cleaning /backsloping projects in 1989 were reviewed and there was discussion as to whether these projects should now DITCH CLEANING be done as there is no policy or standards established for PROJECTS these kinds of projects and each one must be referred to council on an individual basis There ws discussion as to whether this is a logical policy as ditch cleaning can usuallyl only be done in the fall after harvest and there may not be time to get the project approved by council 1 COUNCIL MEETING TUESDAY, JULY 25th, 1989 Mr Marz moved as follows 1 Policy 13 -16B passed at the last meeting of council be cancelled 2. Any backsloping or ditch cleaning project which can be undertaken by one or two divisional motor graders and which does not involve any utility lines, may be authorized by the divisional councillor 3. A backsloping/ ditch cleaning agreement must be arranged with the landowners involved 4. If there are utility lines involved, the project must be referred to council for approval before any work is done CARRIED It was agreed that there would be no compensation payable by the M D to a land owner for crop damage, fence removal, \,aright of entry etc for these types of projects. Mr Jeffery noted the public works department would like to (�Qc- keep the old A.S.B 1974 spray truck for use as a steamer �O truck Mr Hogg moved the 1974 old A S B spray truck be retained 1 for use by the Public Works Department, the old steamer bus b d d f at a later date and the two A S R s ra ers 0 • V_; ispose o , p y and tires from the Public Works Department be advertised for sale in the local paper. CARRIED It was agreed the safety committee would meet on August 1st, 1989 at 9 00 A.M. The architect hired to review possible office ideas would like to meet with the committee in final report could be presented to Council in September. It was agreed the committee should set a date possible renovation August so his early as soon as Mr. Code moved acceptance of Mr Jeffery's report CARRIED The plans for the Carbon shop were reviewed as well as the costs for hiring an engineering firm to draft the plans call for tenders and supervise construction as a turn key project of DITCH CLEANING POLICY Po1��J KEEP OLD A S B SPRAY TRUCK FOR P W DEPARTMENT Q,.S�P�t asp SAFETY MEETING OFFICE RENOVATIONS �- J MEETING W \ ,r 0 GV CARBON SHOP PLANS Mr Hoff moved the M.D. authorize construction of a new shop BUILD in the Village of Carbon an engineering firm be hired have SHOP soil testing done, draft plans, call for tenders and supervise construction of the building and a committee of Otto Hoff, J. Finlay Code and Harold Mueller be appointed to G work with the engineering firm and further the committee be �, authorized to spend up to $80,000.00 for construction of the shop CARRIED The plans for up- grading SR 836 through Sharples was discussed SR 836 thr Mr Code moved SR 836 from SR 575 through Sharples to SHARPLES Highway 9 be added as Priority Number 12 to the M D ,/ 6,,e,d(' }� priority list of secondary roads. CARRIED The map and report prepared by Mr Jeffery showing the status of all secondary roads in the M D was then discussed i n d e t a i l SECONDARY Mr Jeffery noted Alberta Transportation want to have a ROADS priority list from Council for all secondary roads in this STATUS area 2 COUNCIL MEETING TUESDAY, JULY 25th, 1989 It was agreed this matter would be discussed later today with Andy Brown from Alberta Transportation There was discussion such traffic counts traffic counter regarding traffic counts, the value of and whether the M D should purchase a Mr. Mueller moved Mr Jeffery obtain prices for traffic counters and bring a report back to the next meeting of council CARRIED The Town of Three Hills would like to have a 50 KM ahead sign put up on SR 583 just outside the west entrance to the Town \eVk IX �e Mr Boake moved the M D agree to put up a 50 KM ahead sign on SR 583 to the west of the Town of Three Hills, if Alberta Transportation will provide the sign CARRIED Mr Jeffery read a letter from Gerald Leonhardt with regard to the proposal to close an unused road in SW and SE 32 of 32- 27 -20 -4. Mr. Leonhardt does not wish to pay $905 00 for the land taken from his quarter section. He offered the sum of $495 00 for the 2.14 acres. It was noted the formula used to calculate the price for the land to be returned to Mr Leonhardt and Mr Lowen was the same as is used when the M D must purchase property for road widening purposes. Mr Hogg moved Mr Leonhardt be advised the M.D. will not accept the offer of $495 00 for the 2 14 acres I/ CARRIED Mr Jeffery read a letter from Alberta Transportation in which they provide information about an address system which would be appropriate for use throughout rural Alberta. There was discussion of the costs and time involved and whether there is a real need for such an address system in the M D • Mr Marz moved to accept and file as information CARRIED V le PRICE FOR TRAFFIC COUNTER SIGN FOR SR 583 TOWN OF THREE HILLS PURCHASE OF CLOSED ROAD G LEONHARDT ADDRESS SYSTEM Mr Jeffery reviewed a budget comparison report to the 11th BUDGET of June COMPARISON Mr Mueller moved to accept and file as information. NQ REPORT CARRIED Mr. Jeffery noted Mr Ron Ahlstrom, Municipal Advisor from Alberta Municipal Affairs wishes to meet with Council on a MEETING August 11th, 1989 at 9 00 A M / ��\R WITH It was agreed as many councillor as possible would be V-1, MUN present for this meeting. AFFAIRS Mr Jeffery read a letter from Agriculture Canada in which AG CANADA they request rural municipalities assist their department by DROUGHT accepting appeals for the Canadian Crop Drought Assistance PROGRAM Program It appears appeals will be based on township data, and not on an individual quarter or section basis Mr Code moved to accept and file as information / CARRIED Mr. Marz asked if the Council would forward a letter to the CROP Minister in charge of the Alberta Crop Insurance program INSURANCE with regard to adjustments being made by their adjusters. CONCERNS There is a concern these adjustements are unfair when compared to adjustments being made by private insurance 3 COUNCIL MEETING TUESDAY, JULY 25th, 1989 companies Mr. Boake moved the M D forward a letter to the Minister in charge of the Alberta Crop Insurance and copies be sent to the local M L A's outlinging council's concerns CARRIED ` The meeting adjourned for dinner between 12 00 Noon and 1 00 DINNER P M Frank Wesseling entered the meeting at this time and reviewed various subdivisions with council 1 M Rector - N.W 36- 34 -25 -4 18 3 acres for an SUBDIVISIONS Intensive Horse Operation Mr Hogg moved the M D recommend approval of this subdivision subject to staff recommendations CARRIED mfr 2. Gary Adam - Isolation of Existing Farmstead - SE 9 -33- 24-4 - 19 1 acres Mr Hogg moved he be excused from discussions and voting on this application as the applicant is a relative CARRIED Mr Wesseling noted the applicant had verbally requested him today to process the application as an isolation of existing farmstead and they would be willing to reduce the parcel size to 450 by 950 which would be 9 8 acres Mr. Code moved the M D recommend approval for the subdivision if the parcel size is reduced to 9.8 acres and compliance with other staff recommendations CARRIED �rUCE' 4' 3 B:" & Marilyn Sept - N E 31- 32 -23 -4 - Isolation of existing farmstead -6 4 acres Mr Code moved the M D recommend approval for this subdivision subject to staff recommendations and on condition a 30 meter service road on the east side of the - proposed parcel be provided for and this be accomplished by filing a caveat CARRIED Mr Jeffery noted the terms of an agreement made with Randy RANDY Seiler in order to get dirt for SR 575 provided the M.D. SELLER fence the borrow pit area in Pt N.E 22- 29 -26 -4 This IS 2,OC BORROW PIT above existing M D policy ��,r1s b ®� AGREEMENT Mr Boake moved the borrow pit area be fenced by the M D I" 1� a 575 CARRIED 1`��0�,�;4 h Mr Mueller moved Council meeting do now adjourn in order to PUBLIC hold a public hearing scheduled for today at 1 30 P.M. CARRIED HEARING Mr. Code moved Council meeting do now reconvene, the public hearing having been completed CARRIED There was discussion about the information provided at the public hearing today in connection with the request submitted by Mrs Mary Clovechuk to redesignate the N E 13- 31-22-4 to agriculture The redesignation is required in order to allow consideration of creation of a 30 acre parcel which she wishes to sell to Tim Doerksen, who presently lives in the house on this quarter Mr Doerksen wishes to start a dairy operation there and continue to live on the proposed parcel. 4 ��w BY -LAW 7 NO 1171 REDESIGNATION NE 13- 31 -22 -4 COUNCIL MEETING TUESDAY. A subdivision applicationn submitted by Norman Tainsh on behalf of Mr and Mrs Levi Boese for Pt N E 29- 30 -25 -4 was reviewed and discussed in detail. Mr Code moved the M.D recommend this application for subdivision be refused for the reasons outlined in the staff rcommendations CARRIED Mr. Wesseling noted the hearings in connection with appeals filed by Mr Jack Hazelwood and Mr A Schneider regarding subdivision decisions will be held on August 31st, 1989 in Hanna at 9 30 A M Mr Wesseling left the meeting - 2 23 P M • Oris Rodger entered the meeting. Mr Andy Brown from Alberta Transportation also entered the meeting and discussed in detail the need for council to establish a priority list for all secondary roads in the M.D. This is required by the Province in connection with their promise to have all secondary roads paved over the next ten years It appears the Province will not likely include in this program funding for up- grading or re- constructing roads which are already paved, unless it is absolutely necessary It appears the Province is looking at having a surface of some type on all secondary roads, but it cannot afford to up -grade and pave all secondary roads Mr Brown suggested council should look at the traffic volume on all its secondary roads and determine what type of surfacing would be required to accomodate the traffic and is then prepare its priority list There was discussion about SR 583 and Mr. Brown noted the west portion of this road from SR 805 east to SR 806 will be done in 1989 but the rest of the road to Three Hills will not be done It appears the Province feels that portion of the road is adequate and will not provide funding for the preliminary engineering or up- grading. He indicated the Province may put a 2 inch overlay on the road �Q LEVI BOESE SUBDIVISION SUBDIVISION APPEALS DISCUSSION WITH ALTA TRANSPORTATION RE. SECONDARY ROADS & PAVING PROGRAM SR 583 M� COUNCIL MEETING TUESDAY, JULY 25th, 1989 He also indicated the Province may continue to provide the M D with some patch material for this road but likely will not provided funding for re- construction of roads which are already paved It was suggested if the M D was willing to put their own • money and resources into getting some of its secondary roads re- graded so they would be ready for pavement, the area likely get its secondary roads done sooner than the year 2000 Mr Brown indicated if there is more than 200 vehicles per day on a road it should have heavy pavement, but under that number the roads will likely get a light coat surfacing Imput from the local areas will be required to establish which roads wil require heavy or light surfacing There was discussion regarding SR 837 Orkney Hill project as well as about roads which were built to government standards of the day, but now do not meet current standards Whether these kind of roads will have to up- graded and widen before the government will pave them may depend on the volume of traffic using the road. The government like to see a road built to their 209 standard before paving it Mr. Brown noted that the government may pave SR 587 without widening the road if the council was willing to accept the narrower road without shoulders. He also noted the program is not very definitive at this time, and all secondary roads throughout the Province may not be constructed or paved to the same standards The Province has not establishehd a minimum standard for the program, and the council must decide if they can live with a lessor standard of road Mr Brown also noted this program will likely be discussed at the Fall Convention. It was suggested a 209 provincial standard should be the standard to aim for, which is a 9 meter finished top, 9 1/2 meter sub grade and an 11 meter base It appears there is a difference in definitions - what council deem to be base course may not be what the Province call base course. Council must advise Transportation which of its secondary roads will require heavy pavement and which will only require light surfacing. Mr Brown noted Council has established a priority for 11 roads in its letter June 18th, 1989 and should now establish its priorities for the remaining secondary roads SR 837 SR 587 Mr Brown also noted the fracture count on the Bl acki e BLACKIE GRAVEL gravel barely meets their standards As more fracture counts NOT makes better gravel, it was suggested going to a 1 inch SUFFICIENT crush at this pit for base course gravel would be better. FRACTURES The Province will prepare a report so all areas will be aware of what their 10 year proposed plans for this program will be Mr Brown noted he has no information to date about the Buffalo Jump Park Road but will be discussing same with Parks and Recreation soon There was further discussion about SR 583 and it was again indicated that the west end will be done, but SR 583 east from SR 806 will not No funding for grade widening will be provided by the Province for this road. Mr Brown also indicated the SR 806 Road & Bridge Project south of Linden has been put on hold as the M D will not 6 BUFFALO JUMP PARK ROAD SR 806 ON HOLD • COUNCIL MEETING TUESDAY, JULY 25th, 1989 purchase the land required for the right of way There was discussion with Mr Brown about the Horseshoe Canyon View Point and the letter received from Ivan Perich and it was noted the access road coming off Highway 9 and going past the site is in fact an M D road The M D is therefore responsible for maintaining it. Mr. Brown left the meeting at this time - 4 17 P.M Mr Code moved the M D forced road up to the entrance of o RCS the Horseshoe Canyon View Point be up- graded by the M.D. using hot mix CARRIED Mr Code moved a copy of the letter from Alberta Transportation be sent to Alberta Parks and Recreation with a copy to Alberta Tourims and the Province be requested to pave the view point parking area. Mr Jeffery noted the Province has forwarded the sum of $10,000.00 to assist the M D with construction of a shed at PESTICIDE the pesticide container site CONTAINER There was discussion about this matter and whether there was SHED a need to proceed with construction of the shed. AUTHORIZED Mr. Boake moved a committee of Robert Boake, Bruce Hastie l and Art Thomas be authorized to have a moveable pesticide f' W container shed erected at the Three Hills containerer site a cost not to exceed $10,000.00 CARRIED Mr Jeffery reviewed the road committee report from the July 19th tour ROAD Various items were discussed including COMMITTEE 1. Purchase of land from Ralph Kientz for the Kientz Bridge REPORT Project and the backsloping borrow pit agreement arranged with Mr K i e n t z KIENTZ BRIDGE It was noted Mr Kientz sold the land to the M D for the PROJECT sum of $1 00, but wanted compensation for loss of access to water as the creek will be diverted off his land. Mr Marz noted the M D should create an access road to the new creek channel so there will be public access to the water. Mr Marz moved the land arranged with Mr Ralph be approved. C' 0 y'� agreement and backsloping agreement \e Kientz for the Kientz Bridge Project,/ CARRIED Mr Hoff moved Item Number 18 and 20 from the agenda and item number 1 of the Road Committee Report regarding lease of the Schmautz Pit land be tabled until the next meeting of,,,.,' Council CARRIED s TABLE ITEMS Mr Jeffery noted the M D policy prohibits hiring anyone under the age of 18, but Randy Davis has found it necessary AMEND to hire some students to manually pick rocks on the SR 575 POLICY RE project He suggested an amendment to the policy 7 -17 be HIRING made to cover this situation AGE Mr Marz moved Policy 7 -17 be amended to include a provision that persons between the ages of 16 and 18 may be hired for general labour such as rock picking for short periods of time not to exceed 10 working days at a time, and no medicals will be required to be submitted to the M.D. by such persons, but these persons may under no circumstances drive an M.D. vehicle 7 CARRIED vJ\ C, COUNCIL MEETING TUESDAY, JULY 25th, 1989 Mr Boake moved approval of the road committee report with the exception of the item regarding leasing the Schmautz Pit,,, crop land • CARRIED Mr Mueller moved this meeting continue until 5 30 P.M. r CARRIED • Mr Jeffery reviewed the situation regarding establishment of a tranfer site at the M D Torrington gravel pit to be used by the M D and the Village of Torrington residents Torrington advises they would be willing to share costs on a 50/50 basis as long as Alberta Environment will cover the capital cost of the transfer box They cannot afford to share the capital costs for a box They would also like to use the M D. rubble pit on a user pay basis and not share in the maintenance /operating costs for it They would also like to file a caveat against the transfer site area. Mr. Boake moved the M D will agree to a cost sharing arrangement on the following conditions only 1 a 50/50 cost shared arrangement for the operating costs of the transfer site. 2 a 25 %/75% cost shared arrangement for the operating costs of the rubble pit with a capital contribution towards the costs of constructing the rubble pit 3 No caveat to be filed by the Village against the M D land 4 The agreement to be cancelled and no transfer site established if Alberta Environment does not pick up the entire capital costs for the transfer box and site APPROVAL % ROAD COMMITTEE REPORT MEETING CONTINUE TORRINGTON TRANSFER SITE FOR GARBAGE AGREEMENT WITH VILLAGE \e k�-- { G� f ek CARRIED SR Mr Jeffery noted the Linden transfer box site will be locked up and people who wish to use the site will have to get a key from the Village Office. Kientz Bridge Project - Met with Ralph Kientz at 9 30 A.M. ✓ See agreements - need motion to approve as not standard agreement A Council should also discuss rental of the Schmautz Pit crop land -L" 2 Dan Wirch Road - West of 9- 33 -26 -4 - needs two loads of gravel on dirt road through slough area 3 Wimborne South Road LSD 2000 - Committee feel the product did not work and not enough product applied Feel all should be re -done by company except portions we have to repair 4 Met Gordon Cauldwell and Sam Bulych from Torchinsky and Andy Brown from Alberta Transportation and Lawrence Hogg from Division 7. l Reviewed motion of council July 11th, 1989 to advise Alberta o Transportation that Torchinsky hired to engineer project to a standard suitable to Alberta Transportation and Alberta Bridge Branch to be advised of the situation. Noted maximum vehicles per day is 180 Committee recommend to give Alberta Transportation (Andy Brown) a copy of Torchinsky 's letter and benkelmen beam tests and ask for a letter of reply as to what is acceptable for future paving.
