Subdivision - NE 23- 29 -21 -4 - Lloyd Denney 29 Review agreement re Westcan development NE 1- 33 -23 -4 6� J f COUNCIL MEETING AUGUST 23RD, 1988 A regular meeting of the Council of the M.D. of Kneehill held on Tuesday, August 23rd, 1988, commencing at 9 00 A The following were present for the meeting J Finlay Code Division 1 Otto Hoff (Reeve) Division 2 Robert E. Boake Division 3 Richard A. Marz Division 4 Harold Mueller Division 5 Bruce Hastie (until 12 00 Noon) Division 6 Lawrence Hogg Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator, was present and recorded the minutes. Reeve Hoff called the meeting to order and requested a motion to approve the agenda for the meeting today. There was a request to add Item Number 30 to the agenda - Garbage at Grainger Mr Hastie noted he would have to leave today at noon Mr Code moved approval of the agenda with addition of Item #30 CARRIED Mr Hogg moved approval of the August 9th meeting minutes CARRIED Mr. Code moved approval of the accounts presented for payment today, subject to further review by the finance committee of Otto Hoff, R A Marz, Harold Mueller and himsel f CARRIED Mr. Jeffery reviewed his report and there was discussion about the costs which are incurred if a berm has to be installed on a fencing project. In most cases there must be a culvert installed as well as the cost for doing the actual di rt work Mr Mueller moved approval of Mr. Jeffery's report. CARRIED Mr Jeffery noted there should be a budget committee meeting held soon to review the budget situation He then reviewed his budget comparison report. There was discussion about the Megli Pit loss of 1400 yards of chips from that pit noted he reviewed the figures with Linden Mr. Hazelton indicated even though he did shortage was caused by his crew, he would share the loss with the M D and the apparent Mr Jeffery Contractors and not believe the be willing to It was suggested sharing the loss half and half would be reasonable Mr Boake moved approval of the budget comparison report CARRIED Mr Jeffery reviewed a request received from some landowners west of Torrington to have their land annexed to the County ANNEXATION of Mountain View REQUEST He also noted an individual cannot request annexation, it WEST OF must come from a local government or the Province TORRINGTON TO MT VIEW SG s 1 PRESENT v` APPROVAL AGENDA APPROVAL AGENDA APPROVAL MINUTES APPROVAL OF ACCOUNTS FENCING BERM COSTS APPROVAL J.C.J REPORT BUDGET COMPARISON REPORT LOSS OF CHIPS MEGLI PIT Ater rr �{ �v APPROVAL OF BUDGET COMPAR. REPORT Mr Larry and Mrs Judy Weimer and Mrs. Debbie Moldendyk entered the meeting. 1 COUNCIL MEETING AUGUST 23RD, 1988 They advised Council their request is a result of the Three Hills School Division refusal to allow a school bus from the County of Mountain View to pick up their children and transport them to school in Olds. The families in that area would like their older children to attend school in Olds because the high school in Torrington was closed and they do not want their children to have to go to Trochu It is 23 miles from that area to Trochu and about 18 miles to Olds. It was also noted that buses from Three Hills School Division pick up children in the County of Mountain View and the County of Red Deer buses come into the M D to pick up children who attend school in Delburne and Elnora They noted they would not have to pay tutition to Mountain View as this requirement has been waived by both areas. Mr Weimer noted his children attend high school in Olds and Mrs Molendyk noted her children still attend elementary school in Torrington, but she wants them to be able to attend high school in Olds. The people in that area do the majority of their business, including seeing doctors and dentists, in Olds and it would be a great inconvenience for them to have their children attending school in Trochu The County has indicated to them a bus would come into this area to pick up their children It was noted the loss of children from the Three Hills School Division area would result in a loss of grant money It was also noted there are children from Mountain View west of Acme who attend school in the Three Hills Division, and the people cannot understand why the Board of the Three Hills School Division are not willing to allow reciprocation for their area. Mr Weimer noted there are at least 6 to 8 children who would attend school in Olds, and possibly more. There was discussion about the number of children in the M.D. who go to school in the County of Red Deer, the meetings held by the people with the Trustees of the School Division, fragmentation of the existing school division area, increased costs, difference in education, and the delegation indicated their major concern was the distance the children would have to travel to attend school in Trochu, the inconvenience, the children' inability to take part in after school activities because of the distance, and the fact their parents do not consider Trochu to be their trading and business center Reeve Hoff advised the delegation the M.D. would hate to lose the people and the land to the County of Mountain View and the Council could perhaps discuss the matter with and make a recommendation to the School Division Board, but the M.D. Council has no authority over the board The delegation thanked council for their time and left the meeting at 10 05 A M After discussion, Mr Hastie moved the Three Hills School Divsion be requested to re- consider reciprocation with the County of Mountain View for this area, as has been done in other outlying areas of the M D of Kneehill, and allow a school bus from the County of Mountain View to come into the Three Hills School Division area west of Torrington to pick up those children who wish to attend school in Olds, as the M D. would be opposed to an annexation request from that area. CARRIED Oris Rodger entered the meeting at this time COUNCIL MEETING AUGUST 23RD. 1988 Mr Mueller left the meeting at this time to meet with the F.C.S.S. committee Time 10 40 A M Mr Jeffery reviewed the August 17th road committee minutes ROAD and Mr. Hastie moved the M D policy with regard to control COMMITTEE of weeds on newly constructed roads be amended to include REPORT base course road projects. -ro -1�)r CARRIED WEED CONTROL POLICY CHANGE The road committee recommended arrangements for Envirobind advising be made now for application next spring for the 30 miles of USE of road used in the gravel retention experiment program this ENVIROBIND year c��ba This ' would allow the company to have the product put on 6,- re earlier It was suggested the roads should be packed ''ate- r �3� the product is put on as it appears to work better, and also � Mr. Boake less gravel should be put on newly constructed roads that la� are to have Envirobind put on road and It was also suggested the M D might consider buying a tank e and the railway y for storage and have the M D crews apply the product 1989. MACHINES Mr. Boake moved approval of the August 17th Road Committee ROAD report, with exception of Item Number 17 COMMITTEE CARRIED v' REPORT Mr. Jeffery reviewed an analysis of the capital purchases CAPITAL made to date The need to insulate the main shop was PURCHASES discussed again and Mr. Rodger felt the doors and ceilings MADE TO should as least be done before winter DATE i After discussion Mr Marz moved the M.D. get new quotes for INSULATION insulation of the ceiling and doors of the main shop, with OF M D SHOP the stipulation M D. crews will remove the old insulation and the matter be reviewed at the next meeting of Council CARRIED There was discussion regarding the Fax machines and Mr FAX MACHINES Jeffery noted Minolta will sell the M.D. 8 machines at $1995.00 each with 25% down and the balance payable January 1 st , 1989 ,ke��^ Mr Hastie moved the M.D. proceed with purchase of the 8 Fax PURCHASE machines from Minolta at $1995 00 each payable 25% down and OF FAX the balance to be paid January 1st, 1989. MACHINES CARRIED 88/89 Mr. Jeffery reviewed the existing M.D. fencing policy and REVIEW there was lengthy discussion regarding same It appears FENCING application of the fence replacement policy is not POLICY consistant for all ratepayeers There was also discussion regarding Mr Jerry Penner's 3 i COUNCIL MEETING AUGUST 23RD, 1988 complaint regarding a fence on his land, SE 8- 30 -24 -4, which was removed and replaced by the M D crew The meeting adjourned at this time for dinner. Time 11 55 A.M. Mr Hastie left the meeting at this time. Mr. Rodger also left the meeting. Frank Wesseling and Alex Cunningham entered the meeting at 1 00 P M and the council meeting reconvened. The request from Ken Cunningham for permission to plant a shelter belt within 50 feet of the M D road allowance on SW 11- 33 -24 -4 was discussed Mr Code moved the request for relaxation be refused. CARRIED Mr Wesseling noted he had prepared another draft by -law in connection with intensive operations and he gave each councillor a copy of the proposed by -law Mr. Hoff moved this matter be tabled until the next meeting of Council CARRIED DINNER REQUEST RELAXATION SHELTER BELT SET BACK INTENSIVE OPERATION BY —LAW Mr. Wesseling noted Lloyd Denney, owner of NE 23- 29 -21 -4, SUBDIVISION wishes to subdivide a 5 acre parcel for country residential LLOYD use from his existing 112 acres After lengthy discussion DENNEY of this matter, Mr Code moved the M.D. recommend approval NE 23- for the subdivision subject to conditions as outlined by the 29 -21 -4 staff of the Commission. CARRIED Mr Jeffery noted Mr Bruce Allen of Westcan Farms Ltd., has not been back to discuss the proposed agreement with the WESTCAN M.D. FARMS Mr. Hogg moved Westcan Farms Ltd , be written advising the A/G agreement with the M D with regard to their intensive lelterr operation must be signed within 30 days from the date of the letter of advise and failure to comply will result in sP� issuance of a stop work order CARRIED Mr Hoff noted there is a person living in Grainger who is dumping garbage in various locations in Grainger He is GARBAGER presently p y dum p i n g garbage behind the Grainger hall After GARBAGE discussion Mr Marz moved the owner of the property and the PROBLEM party involved be advised by letter dumping of garbage is not permitted and it must be removed and the areas cleaned up within 30 days from the date of the letter, and failure to do so will result in the M D having the work done and the costs will be charged to the tax roll account. CARRIED Mr Wesseling and Mr. Cunningham left the meeting at this time - 1 50 P.M. Mr Jeffery read a letter from the Three Hills Hospital advising they will be requesting the Province to authorize a THREE HILLS $25,000.00 requisition in 1989 to cover the costs of a HOSPITAL second garage ADVICE RE. Mr. Jeffery noted the garage will be used to store the 89 REQUISIT second Eltrohills van and small grounds and maintenance equipment. After discussion Mr Boake moved the Three Hills Hospital be advised the M D would have no objection to the $25,000 00 S� requisition for the two vehicle garage on condition it will not to be used at any time for storage of the Town of Three Hills ambulance CARRIED G' 4 COUNCIL MEETING AUGUST 23RD, 1988 A letter has been received advising Mr. Otto Hoff has Alberta Agricultural Devel year term. Mr. Marz moved information from the Minister of Agriculture 0 HOFF been appointed as a member to the APPOINTMENT opment Corporation for a three AG DEV to accept and file as CORPORATION CARRIED 1 There was discussion about the Kneehill Guidance Counsellor KNEEHILL Program and Mr Mueller noted the meeting held this morning GUIDANCE was to review what has been done to date by the committee COUNSELLOR and how the administration structure will be set up PROGRAM Mr. Hoff noted he advised the committee the counsellors PURCHASE could make use of a room in the basement of the M.D. office AUTHORIZED if required FOR 1989 There was discussion about how the Town of Three Hills will work in the system as they have their own FCSS program in NOT TO place and they have appointed Ron Leaf to be the director of their program It was also noted an assessment of the ,e< program must be done prior to the council deciding if they rP er will fund the program for another year �v It appears there were 31 applicants for the counsellor positions and interviews will be held with 7 of the applicants After discussion of the funding to be provided by the Province and the agreement required, Mr Mueller moved the Reeve and Municipal Administrator be authorized to sign the CLOSURE agreement for funding for the FSCC Guidance Counsellor OF RAILWAY program with the Province of Alberta, on behalf of itself, LINE the Town of Trochu, and the Villages of Acme, Carbon, Linden EAST COULEE and Torrington, but not the Town of Three Hills as the Town already has an FCSS program and funding in place. AREA CARRIED Mrs. Wilkinson read a letter from the Minister of AG Environment regarding the Province's Agricultural Land Base LAND USE Study Mr Code moved to accept and file as information. STUDY CARRIED Mr. Herman Martens and Mr. Edward Dunay entered the meeting at this time - 2 35 P.M. and discussed with Council the COMPUTERIZED proposed purchase of a computerized assessment program and ASSESSMENT computer hardware PROGRAM Mr Dunay noted he will require one full time person who is PURCHASE capable of doing assessment work and one person will be AUTHORIZED required to fill the position being left vacant by Connie FOR 1989 Etter After lengthy discussion of the costs involved, Mr Hogg NOT TO moved the M D proceed with purchase of the computerized assessment program and the necessary hardware in January of EXCEED $48,000 1989, at a price not to exceed $48,000.00 and Mr. Dunay and Mr Martens be authorized to purchase the computerized forms which will be required for the general assessment work at this time CARRIED Mr Dunay and Mr Martens left the meeting at this time - 3 05 P M Mr Jeffery noted the National Transportation Agency have CLOSURE forwarded a board order which has granted CPR and CNR OF RAILWAY permission to close a section of railway line in the LINE Rosedale East Coulee area. EAST COULEE Mr. Boake moved to accept and file as information CARRIED AREA Mr. Jeffery read a letter received from the Honourable Mr A Adair Minister of Transportation .regarding the government RE rALIGN plans for re- alignment of SR 806. After lengthy discussion SR 806 and in as much as SR 583 is, at this time, considered to be the first priority of the Council, Mr Marz moved the 1e Sew Minister of Trans p ortation be a ain advised this project � s 5 �) COUNCIL MEETING AUGUST 23RD. 1988 not a priority of the M D of Kneehill, and therefore the Council is not prepared to endorse the government's plans for re- alignment and reconstruction of SR 806 south of the Village of Linden. CARRIED Mr Jeffery read a letter from Alberta Transportation regarding the need for information signs to be erected on road projects which are funded in part or totally by the Province of Alberta After discussion Mr. Code moved this letter be accepted and in future when tenders are called for road projects which involve government funding, the signing requirement be included in the tender call. CARRIED Mr. Jeffery reviewed a letter and contract received from R. Angus regarding their offer to buy back the Cat 627 scraper at the end of 5 years After lengthy discussion of this matter, Mr Hogg moved the M.D. agree to enter into the agreement with R. Angus on condition there is no immediate cash outlay required by the M D of Kneehill CARRIED Mr Jeffery noted the grant allotted for SR 841 will not be totally used up and Alberta Transportation must be advised of the apparent overage of grant money. Mr Marz moved to accept and file the report as information CARRIED Mr Jeffery noted Alberta Bridge Rranch has requested the M D provide them with a list of their inspection requirements for 1989 and after discussion Mr. Hogg moved to table this matter until the next meeting so each councillor can review the bridges in their divisions CARRIED Mr. Jeffery noted Alberta Bridge Branch will be doing some work on two bridges - INW 14- 30 -23 -4 - north of Carbon and SSW 5- 32 -22 -4 - East of Three Hills They recommend the M D repair the pavement at the bridge ends to eliminate the bumps. Mr Boake moved the M D accept the recommendation from Bridge Branch. CARRIED Mr Mueller moved consideration of the M.D. fence policy be tabled until the next meeting of Council CARRIED Mr. Gene Tepper has requested permission from the M.D. to develop a drainage ditch north from the equalizer culvert installed in the M.D. road allowance along the west side of his property - West half of 31- 34 -23 -4, around the corner and then east along the edge of the County of Red Deer road in order to drain a slough area on his property After discussion of this matter, Mr Boake moved Mr. Tepper be directed to discuss his request with Alberta Environment and Alberta Water Resources to see if his proposal for draining the slough area would work and if these government departments will grant him permission to develop the drainage ditch, and if he has approved engineering plans prepared, and the County of Red Deer has no objections, the M.D will review his request again. R A Marz, Bruce Hastie, J C Jeffery 1 Envirobind - Trochu West - lst mile going west no good 2nd mile going west not too bad - 3rd mile going west shows worse than 2nd mile 2 Envirobind - South Wimborne Road - all 4 miles look good The 3 packed miles were better than the 4th mile which was not packed Probably too much gravel on Mile 4 3 Envirobind - South Wimborne Road - West end - packing with product looks good - not bladed all year Should we be looking at more of this re- saved gravel and no blading? 4 Stop sign down at SR 805 - South Wimborne Road going East 5 Czar Resources - Texas Gate to 4- 21- 33 -26 -4 - No problem with texas gate to be located 0 35 KM from north intersection of West of 21- 33 -26 -4 6 Recommend we add spraying of base course projects to policy re. spraying weeds on construction jobs for 3 years 7 Paving intersection of SR 805 and SR 587 - and 3 miles going east - okay to write off 8 Envirobind Lindn North - not too impressive - should be bladed - still not too bad considering 9 Mention to Oris re: Joe Friederich blading over bridge 10 Envirobind Linden South - appears okay packing appears to work better 11 Reviewed Jerry Penner complaint - SE 8- 30 -24 -4 - Council must review fence policy before deciding on his complaint. Used existing posts and wires 12 Paving Acme to Highway 21 - On SR 575 - okay to write off Some loose gravel spilled over side of grade 13 Envirobind Pagets - looks okay 14 Envirobind Carbon South - not too good perhaps not enough gravel. 15 Carbon South Pavement - looks good - okay to write off - small patch near south end on West side may have to be patched 16 SR 841- Reviewed Project Work in progress and signing looks adequate.
