COUNCIL MEETING JANUARY 12TH, 1988
A regular meeting of the Council of the Municipal District
of Kneehill Number 48 was held on Tuesday, January 12th,
1988, commencing at 9 00 A M
The following were present for the meeting

Mrs Jean Wilkinson, Assistant Administrator was present and
recorded the minutes.
Reeve Hoff cal 1 ed the meeting to order and requested a APPROVAL OF AGENDA
motion to approve the agenda for today's meeting
Mr Mueller moved approval of the agenda as drafted.

Mr Marzr moved approval of the December 16th Council APPROVAL OF
meeting minutes. MINUTES

Mr. Jeffery reviewed the bank reconciliation statement and
after discussion Mr. Hastie moved approval of the first bank BMNK STATEMENT
reconciliation for the month ending December 31st, 1987
CARRIED
Mr. Boake moved approval of the accounts presented for APPROVAL OF
payment today, subject to further review by the finance ACCOUNTS
committee of Mr. Hoff Mr Mueller, Mr Marz and himself.

Mr Jeffery reviewed a budget comparison flow sheet report
with council and a budget comparison report as at December BUDGET REPORT
15th, 1987. He also reviewed a budget comparison report
which showed all accounts which were over revenued and or
over expended during 1987
The year end gravel report submitted by George Rempel was
briefly reviewed and there was lengthy discussion of the
amount of gravel moved during 1987, the year end gravel
inventory figures, as well as an apparent shortage of 4500
yards in the gravel inventory figures.
Mr. Rodger entered the meeting at this time - 9 35 A M.
Mr Boake moved approval of the budget comparison reports

Mr Bulych discussed with Council the work their firm has
done for the M.D. in 1987. He also noted they are
discussing with the Province of Alberta the possibility of
• getting funding for secondary road program engineering a
1987 & 1988

year in advance of the construction of the road being
undertaken This would allow them to have the engineering

work done and plans prepared well in advance and

construction work could be undertaken right at the start of

CONSULTING
In order to further pursue this idea with the Province and

if the M D was agreeable, he would like to know the M.D
priorities on secondary roads so his firm could do the�k

engineering work if funding is provided by the Province
It was noted that portions of SR 582 and SR 836 may be re-
constructed in 1988 and SR 575 - 6 miles west of Acme - will
be done in 1988
There was also brief discussion about the engineering work
his firm is doing on SR 841 Mr Bulych noted he does not
know at this time if the Province will pay the engineering
• fees for this road, but if the road is re -done in co-
operation with the Province, the engineering costs would be
covered by the Province It will be a benefit to the M D
to have the engineering work done in advance.
He also noted his firm has automatic traffic counting
equipment available for rent should the M D wish to
undertake traffic counts on its local roads
Mr Bulych was thanked for corning and he left the meeting at BULYCH OUT
this time - Time 10 00 A.M.
There was discussion about whether the M D should be TRAFFIC COUNTS
undertaking more traffic counts on local roads, but no
decision was made
Mr Jeffery reviewed his report covering the period December J C JEFFERY
16th, 1987 to January 12th, 1988 and various items in the REPORT
report were discussed
It was noted if any councillors wish to attend the Energize ENERGIZE
Recreation Convention a motion is required Mr Muel Ier CONVENTION
moved Mr. Marz and Mr Hastie be authorized to attend the ATTENDANCE
Energize Recreation Convention in Edmonton on behalf of the
M D

Mr. Jeffery reviewed the report prepared by the M D auditor AUDITOR
in connection with a review he did of various aspects of the REPORT
operation of the M D , including accounts payable, payroll
purchase of parts, etc J C�
The suggestions made by the auditor were discussed along --o
with comments made by office staff and Mr Jeffery noted
which suggestions will be implemented..r� her
Mr Marz then moved approval of Mr Jeffery's report

Mr Hastie noted he heard on the radio today there is no LINDEN RUBBLE
contamination coming from the Linden Rubble Pit, but the PIT
Government will continue to monitor the test wells drilled
at the pit N
Mr Jeffery noted to date nothing in writing has been
received from Alberta Environment about this matter

The report from the December 21st road tour was reviewed and
several items were discussed including the Vasseur low level
crossing and the problem with the encroachment of the
culvert on to Otto Haller's land
Mr Hastie moved Mr Jeffery discuss with the M.D. assessor
whether the area of land involved could be assessed as waste
area and determine if Mr. Haller would accept a reduction in
his assessment for the area of encroachment and provision of
a save harmless agreement from the M D
CARRIED
There was also discussion about the railway crossing on the
Linden East road. The road leading up to the crossing has
been patched and repaired, but because of the curve in the
railway tracks at this location and one track is higher than
the other, it will always be a rough crossing The
possibility of a reduced speed limit at this location was
discussed but no decision was made

Mr. Michael Welsh, M D Solicitor, Mr Alex Cunningham,
Development Officer, and Mr Frank Wesseling representative
from Palliser Regional Planning Commission entered the
meeting a t t h i s time. DELEGATION RE
A delegation of people also entered the meeting to discuss BY LAW NUMBER
with Council the intention of Council to give 2nd and 3rd 1128 ILLEGAL
reading to by -law number 1128 today. The by -law would give NIESTON DEV
authority to the office to charge against the tax roll
accounts for the land in Section 34- 29 -21 -4 all legal costs
incurred by the M D in connection with the illegal
developments which have been located on the said land, and
costs incurred for the removal or demolition of such illegal
developments
Mr Welsh reviewed for the delegation present the situation
with this land, the numerous problems and violations of the
M.D. land use by -law and the Provincial Planning Act and
what has happened over the past 5 years He noted the
M D has gotten no where over the past 3 1/2 years with
regard to removal of the illegal developments on the land
The Council therefore pursuant to provisions of the
Municipal Government Act, the Provincial Planning Act and
the Municipal Taxation Act, intend to proceed with passage
of the by -law, to apply for the necessary court order and if
successful will proceed with demolition of the illegal
developments and charge all the costs incurred against the
property in the same manner as taxes
There was discussion with the people about the matter and
they noted some have placed small sheds on the property for
storage of garden tools They were advised these type of ,
sheds are illegal developments also. It also appears more �J
development has taken place since the development appeal
board hearing was held in 1984

Use of the property for recreational purposes is not
permitted under the existing M D land use by -law
Mr Welsh noted Council wish to be co- oerative in the
matter, but feel they have given people sufficient time and
now must proceed with passage of the by -law
In answer to a question as to why this piece of land was so
important as it was only number 5 soil, Mr. Bruce Beaton
was advised the M.D. is required to have a land use by -law
in place and there are laws in place which prohibit use of
the property for the purposes it is presently being used
for
One of the delegation noted they were advised by the
salesman from whom they bought the land that they did not
need permits for any development on this land as long as
they were not permanent type of development, but were on
wheels or skids
Mrs Eggen noted they only wish to use their property during
the summer time for recreational purposes, and wonder if the
M.D. land use by -law could not be changed to allow this kind
of use She was advised any by -law can be changed if the
• Council feel there is a need to make such a change.

Mr Wesseling noted he had meet with some of the owners some
time ago and suggested they should get together and approach
council with a request to make a change in the existing M.D
land use by -law No such written approach has been made
either to the M.D. or to the Planning Commission
The delegation again noted most people wish to make use of
the land for week end purposes only and would like
permission to put on a cabin or trailer so they could go
there during the summer time.
They again asked if they could get permission to install
septic tanks and a trailer or cabin on the property
It was noted the people have been given three years to clear
up the situation and nothing has been done
Mr Welsh noted the people have not been mislead by the M D
but perhaps were mislead by someone else when they bought
the property
Mr Maleskie noted he owns the house which is sitting on the
property on silts, but he has not moved the house away He
has been advised by his solicitor not to do anything
Mr Welsh suggested all the owners should get together and
try to come up with some solution to their problems
Mr Beeton asked if he could get a permit to burn what he
has located on his property and he was adviswed the M D do
not issue burning permits
Mr Welsh again noted the Council is here today to consider
giving 2nd and 3rd reading to by -law number 1128, and if the BY—LAW NO
Court of Queen's Bench issue an order allowing it, the M D 1128
wi 1 1 proceed to demolish the i 1 1 egal developments which are SECOND READING
located on the land.

He noted the land is to be used strictly for an agricultura
use and a permit must be obtained for any change in the use
of the land He also noted there is no provision in the
M.D land use by -law for use of the land for recreational
purposes However he noted if all the owners had got
together, agreed to repay the M D for all legal and other
costs incurred, it is possible the M D. Council might have
considered making a change in the by -law to allow for a
temporary camping use of the land for weekend purposes only
but the M.D. has waited long enough and are now looking at
passing the by -law.
Mr. and Mrs Skapin noted they had not received any written
notice of this meeting today and they were advised Council
were under no official obligation to notify them of the
meeting, but were still trying to be fair to those involved
in this matter
Mr Welsh also noted if the court order is obtained people
will be given official notice of the granting of the order,
• and the date upon which the demolition of the illegal
developments will take place
Mr Code moved second reading to by -law number 1128 at this
time

Mr Marz moved Council meeting do now adjourn in order to
hold the public hearing scheduled for today at 1 30 P.M

There was further discussion about the request to
redesignate the South East of 30- 29 -23 -4 and it was noted
there is about 30 acres of cultivated land on the portion of
the quarter south of SR 575
There were no motions forthcoming for 1st or any reading of
the proposed by -law to redesignate this quarter of land
Mr Wesseling reviewed the following subdivisions
1 Estate of A Dugdale - SE 30- 29 -23 -4 - creation of a 55
acre parcel which lies to the south of SR 575 Mr. Marz
moved the M.D recommend refusal of this subdivision as it
does not comply with the M D land use by -law and the land
has not been redesignated to agriculture
Mr Jeffery and Mr Welsh returned to the CARR
at this
time.
There was further discussion about By -law Number 1128 and
Mr. Marz moved consideration of 3rd reading for by -law
number 1128 be tabled until Tuesday, February 9th, 1988

Mr Mueller moved Mr Welsh, Solicitor for the M.D., be
directed to apply for the necessary court order to allow the
M.D. to gain entry to Section 34- 29 -21 -4 and to have the
illegal unauthorized developments located thereon removed
from the land no later than June 1st, 1988.

is an illegal development the Development Officer should
issue a stop work order and require the owner of the
development to apply for the necessary permit

Mr. Haller agreed he would sell us the necessary land
(112 to 3/4 of an acre) that we are tresspassing on his
property for $1.00. He is afraid of legal liability

EXECUTIVE COMMITTEE REPORT JANUARY 8TH, 1988
An executive committee meeting was held on Friday, January 8th,
1988, commencing at 1 15 P.M. The following were present - Otto
Hoff, Richard A Marz and J C Jeffery
1 (Item No. 53) - City of Drumheller sent account for $450 00
Fire Call - on SR 575 - March 1st 1986 - City attempted to
collect account from Alberta Transportation but were refused
as on a secondary road City advises it was a vehicle fire �A,,< �
and they were called to the scene by the R C M P but s
were advised prior to arrival they were not required
Time out - 22 minutes
Executive Committee recommend the account be paid.
2 (Item NO 52) - Letter from Alta. Transportation Harvey
Alton Deputy Minister advising the M D. has responsibility j�le
for maintenance and inspection of bridges on local roads.
Executive Committee recommend to accept and file as N
information.
3. (Item No 51) Canada Post advise they are placing green self
serve mail boxes in Swalwell at the corner east of the post
office
Post office will be closed The boxes will be placed on a ��
piece of unused sidewalk under an existing street light. ^
Executive Committee recommend to accept and file as

4 (Item NO 50) - Mr Dunay requests permission from Council
to attend the assessors annual convention in April and
the Senior Assessors Seminar normally held in June
and also to attend rural assessors meetings held at different
times in the year
Mr Cunningham advises there are two conventions and an
operator's seminar scheduled for 1988 which he would
like to attend
The Executive Committee recommend Mr Dunay and Mr.
Cunningham be given permission to attend these course and
they along with Mr Jeffery and Mrs Wilkinson be given
permission to attend seminars and courses necessary to keep
their training current
