Reeve Hoff called the meeting to order and requested a motion to approve the agenda for today's meeting. Requests were made to add the following items to the agenda 35 Weeds 29a. Mt. Olive road 29b Access to Proposed Well Site - Renaissance Energy 29c Fencing - Blair Project Mr Marz moved approval of the agenda with addition of the above noted items CARRIED Mr Mueller moved approval of the September 8th council meeting minutes. CARRIED Mr Marz moved approval of the accounts presented for payment today, subject to further review by the finance committee of Otto Hoff, Lawrence Hogg, Robert E Boake and himself. CARRIED Mr Jeffery reviewed the bank reconciliation statement for the month of August, 1987, and after discussion Mr Hogg moved approval of the bank statement CARRIED Mr Jeffery reviewed his report covering the period September 8th to September 22nd, 1987 and several items were discussed Mr Code moved the M D erect signs on SR 575 in the Kirkpatrick area warning of the possibility of falling rocks. CARRIED Mr Jeffery reported on the recent Rural Administrators Association meeting he attended in Grande Prairie It appears Alberta Municipal Affairs is changing its municipal audit procedures quite radically and will audit each municipality only once every three years Also the Deputy Minister of Municipal Affairs asked if each municipality might consider establishment of a policy which would allow the Province to call on municipal assessors to assist with the required assessment work, at no cost, should a disaster similar to the Edmonton tornado occur again After discussion Mr Mueller moved the M D establish the following as an M.D. Policy if IF requested by the Province of Alberta the M D would DONATE the services of the M.D.'s assessor, for such period PAGE 1 .f APPROVAL OF AGENDA 11 APPROVAL MINUTES APPROVAL ACCOUNTS BANK RECONCILIATIO STATEMENT J C JEFFERY REPORT SIGNS FALLING ROCKS RURAL ADMINISTRATOR MEETING 4 POLICY RE: DONATING ASSESSOR'S SERVICES FOR DISASTERS • COUNCIL MEETING SEPTEMBER 22ND, 1987 of time as determined by Council, to assist with assessment work required after a DECLARED DISASTER in any municipality within the Province of Alberta " CARRIED Mr Jeffery noted R -6 was rolled on Friday, September 18th, ROLLED but no damage to the machine occured and the operator was R -6 not hurt Mr Code reported on the reasons why the Alberta Hospital PRIVATE Association intervened in the A.G.T hearing regarding RURAL establishment of private telephone lines for rural people ' TELEPHONES Mr. Jeffery reviewed other matters discussed at the Alberta Rural Administrators meeting APPROVAL Mr Boake then moved approval of the report given by Mr J C JEFFERY Jeffery ✓ REPORT CARIED Mr Jeffery reviewed the budget comparison report in detail BUDGET and after discussion Mr Mueller moved acceptance of the COMPARISON report. CARRIED It was suggested a budget committee meeting should be held on October 21st, 1987 P Mr Boake reviewed with council disposal conference he attended moved acceptance of this report the recent solid waste in Red Deer, and Mr Code CARRIED Mr. Rodger entered the meeting at this time - 10 00 A M Mr Jeffery noted Linden Contracting is crushing for R Thiessen at the H Thiessen Pit near Linden and wants to know if the M D would like him to crush out the H K Toews Pit It would take two buggies to strip the pit in order to do the crush and it would also be necessary to have Mr Haskell do some testing to see if there is enough gravel to warrant doing the stripping. Mr Hazelton advises he will be moving his crusher to the Hand Hills in about 10 days or so and will not be back until November. He also wishes to know if the M.D. want him to crush at the J Lowen Pit this fall After discussion Mr Code moved Linden Contractors crush 20,000 yards of gravel at the J Lowen Pit prior to moving to the Hand Hills, at a price of $2.35 per yard, and the jaw crusher be used if Mr Rodger feels it is required CARRIED Mr Mueller noted Richardson Contracting is crushing gravel for the government in the government pit next to the Garson Pit and stockpiling it in the Garson Pit, as previously arranged Mr Jeffery noted Ken Lowen has signed a four year access agreement with the M D. to provide access to the J Lowen Pit at an annual rental of $300 00 per year Mr Marz moved the Reeve and Municipal Administrator be authorized to sign the access agreement with Mr Ken Lowen CARRIED Mr Jeffery read a letter from the County of Wheatland in which they advise they would support the M D 's request to re -align SR 836 to the south Carbon road and south into their district Mr Code and Mr Hoff noted the Village of Carbon have verbally agreed to the proposal After discussion Mr. Code moved upon receipt of written approval for the re- alignment from the Village of Carbon, an PAGE 2 SOLID WASTE CONFERENCE RODGER IN G RAVEL CRUSHING Le-t be r scr• t, M11-5 KEN LOWEN ACCESS A/G SW 16- 29 -21 -4 RE- AIGNMENT SR 836 \ � A COUNCIL MEETING SEPTEMBER 22ND, 1987 application be submitted to the Province of Alberta for permanent employees rather than a definite set wage rate requesting the re- alignment of SR 836 as previously chi. ea n discussed CARRIED laeg Mr Jeffery reported there is no gravel on the E. CARRIED Mr Hogg also noted Alberta Transportation had opened a pit RECLAIM on Mr. E Riep's land some years ago when Highway 21 was PIT ON LAND constructed and the area was never properly reclaimed SE 32- 33 -22 -4 discussion After r moved e Alberta Transportation �es��� andrequestthem toreclaimothec old gravel '' pit area on the SE 32- 33 -22 -4 CARRIED Mr Hoff requested permission to construct a blade grade road south of 29- 28 -24 -4 - about half mile in length - and he noted Mr. Norman Thurn would remove his fences in order to allow proper completion of the road After discussion Mr Hoff moved a blade grade road about half mile in length be constructed on M D. road allowance south of 29- 28 -24 -4 and first time gravel be approved for the road, using Y' screenings if suitable CARRIED Mr Marz moved the road committee inspect a location south of 25- 32 -25 -4 and determine if there is a need for construction of a blade grade road CARRIED Mr Jeffery noted there has been a complaint received regarding the dust on SR 805 and SR 587 Road Project and Councillor Hastie has requested some form of dust control be put on the road immediately After discussion Mr Boake moved to table this matter until this afternoon CARRIED Mr. Jeffery noted Maurice Robinson complained the natural drainage was diverted when SR 841 was re- constructed and water now drains on to the NE 17 28 -20 -4 rather than going through the road approach culverts Mr Code moved this matter be referred to the road committee for inspection and a report be brought back to council at a later date CARRIED There was discussion about a retirement gift for Karl Gundlach and Mr Marz moved a committee of Harold Mueller and Finlay Code be given authority to purchase a retirement gift for Mr Gundlach at a price not to exceed $300 00 and Mr Gundlach also be presented with a retirement plaque. After discussion Mr. Mueller moved approval for blade grade work to be done on portions of the road West of 18, 19 and 30 in 32 -23 -4 (total of about two miles) and first time gravel be applied, using screenings if suitable CARIED Mr Jeffery noted the M.D. re -built about one - quarter of a mile of road on a road diversion in the North West Quarter of Section 10- 30 -25 -4 A survey of the road construction was done and it appears the road as constructed goes off the actual road diversion on to private property After discussion of this matter, Mr Boake moved to accept and file this report CARRIED BLADE ( ROAD W1 13, 19 in 32 ROAD OFF ROAD D- YV:ERSION NW 10- 30 -25 -4 Mr Boake also moved as the south portion of the road CANCEL diversion in the North East Quarter of 9- 30 -25 -4 as shown on PORTION OF Road Plan 4736 E Z , is no longer required for public ROAD ROAD DIVER - access, that portion be cancelled and the land be returned SION to the balance of the quarter section Mueller moved Renaissance Energy Ltd , be given permission NE 9- 30 -25 -4 1C plan with only 500 foot site distance as the site distance � CARRIED problem will be corrected when the road is re- constructed I eL-ter d_ C_ Mr. Boake moved he be excused from discussion and voting on BOAKE EXCUSE Item Number 28 on the agenda FROM DISC CARRIED ITEM #28 Mr Jeffery noted Mrs Wendy Boake wishes to purchase four large rocks from the Megli Pit for landscaping purposes in REQUEST her yard After discussion Mr Hogg moved Mrs Boake be TO PURCHASE given permission to purchase four large rocks from the Megli ROCKS Pit at the price of $1 00 per yard and the rocks be FROM MEGLI considered equivalent to a five yard load of pit run gravel, ✓ PIT as long as the rocks are loaded by M.D. equipment WENDY BOAKE Adv�s�d R c-i� CARRIED c4phy c a {ACCTS Win _1� —_ s V'r Mr Jeffery noted the Province of Alberta has set up the PEP Priority Employment Program again this year and after PROGRAM discussion Mr Mueller moved to accept and file as ✓ PROV ALTA information CARRIED Mr Marz noted there is a soft spot on the Mt Olive road north of the William Davis residence and moved Mr Rodger INSPECT inspect the location, determine what can be done to correct MT OLIVE the problem and report back to council at a later date ROAD CARRIED SOFT SPOT Mr Mueller noted Renaissance Energy Ltd have requested permission for a road approach leading to a well on 14 -22- ROAD 33 -22 -4 but the location for the approach does not meet site APPROACH distance requirements There is only 500 feet site 14-22 - distance He also noted the road will be up- graded by the 33 -22 -4 M.D. either this fall or next spring. After discussion Mr Mueller moved Renaissance Energy Ltd , be given permission for a temporary approach at the location indicated on their 1C plan with only 500 foot site distance as the site distance � problem will be corrected when the road is re- constructed this fall I CARRIED Mr Hogg noted Ken Maxwell owner of SW 34- 34 -24 -4 took his TEMP fence out when the Blair Road Project was started. He needs FENCING to use his pasture this fall and requests temporary fencing SW 34-34 - be put up, as the project has not been completed as yet ✓ 24 -4 PAGE 4 COUNCIL MEETING SEPTEMBER 22ND, 1987 Mr Hogg then moved the M D put up temporary fencing for Mr Ken Maxwell where required on the SW 34- 34 -24 -4 CARRIED Mr Boake noted old roofing material in the Linden Rubble Pit is burning and creating a very bad smell It was agreed LINDEN the fire at the pit should be put out and Mr Rodger should v RUBBLE PIT inspect the pit and have it cleaned up if necessary BURNING Mr Rodger noted he provided culverts for road approaches on the blade grade road constructed South of 15- 29 -24 -4. Mr Rodger asked for permission to hire three trucks for the chipping work on the South Carbon road. It would take about one week After discussion Mr Code moved Mr Rodger be given permission to hire three trucks for the chipping work on the South Carbon Road. c CARRIED Mr Hoff noted the railway crossing on the Linden East Access Road must be repaired this fall The meeting then adjourned for dinner betrween 12.00 Noon and 1.00 P M Mr Mueller left the meeting at this time Mr Rodger also left the meeting at this time Alex Cunningham, Development Officer for the M.D., and Mike Bennett from Alberta Environment entered the meeting at this time ` Mr Cunningham noted he and Councillor Code inspected a hog operation recently which is operated by Ken Stewart on NW 31- 29 -22 -4, as a result of a complaint from Grant McIntosh The land and hog operation was formerly owned by David Stewart However his hog operation was closed down and the land was sold about a year or so later Mr Ken Stewart purchased the land and buildings and started up a new hog operation without obtaining the rquired development permits It appears liquid manure from the barn is being pumped into an area behind a dam located on a natural water course which runs through the 40 acre parcel. The owner does not have sufficient land on which to spread manure from the operation The water course eventually drains into the Kneehill Creek. Mr Bennett advised his office received a complaint from Mr Grant McIntosh also and he had inspected the site. Mr Bennett noted there was a licence obtained for the two dams located on the property, and these were to be used for domestic water purposes However the lower dam is being used as a storage lagoon for manure It is creating a very ordorous situation in the area as the manure is being pumped into the dam area constantly and no crust is being formed on the surface of the manure storage area Also as the area slopes to the south the water drains away from the manure and leaves it exposed to the air Mr. Frank Wesseling from Palliser Regional Planning Commission entered the meeting at this time 1 25 P M ® Mr Bennett noted eventually the dam area will fill up with manure and the manure will also spill over into the water course He noted he could see no evidence of dead pigs being disposed of in the dam area Mr Cunningham read a letter which the M D received from Mr and Mrs Grant McIntosh and Mrs. Sylvia Cannings about the condition of the pig operation. RECONVENE CARRIED Time 2 20 P M Council then discussed in detail the request for REDESIGNATE redesignation of the S E 15- 31 -23 -4 to agriculture in order to allow for a subdivision of the quarter into two - SE 15-31 - eighty acre parcels 23 -4 Mr Boake moved first reading to by -law number 1130, this being a by -law to amend the land use by -lalw no 1061 by BY-LAW redesignating the SE 15- 31 -23 -4 from agricultural 1130 conservation to agriculture. CARRIED Mr Hogg moved second reading to this by -law CARRIED Mr Hoff moved third reading be given to this by -law at this time MOTION NOT CARRIED UNANIMOUSLY THIRD READING TO THIS BY -LAW WILL BE DISCUSSED AGAIN AT THE NEXT MEETING OF COUNCIL. There was discussion about the request to redesignate the North West of 15- 31 -23 -4 to agriculture in order to allow REDESIGNATE subdivision of a 18 4 acre parcel of land There is an NW 15 intensive turkey operation located on the proposed parcel of 31 -23 land Mr Marz moved first reading to by -law number 1131, this being a by -law to amend the M.D land use by -law 1061 by By LAW redesignation of the NW 15- 31 -23 -4 from agricultural 1131 conservation too agriculture CARRIED ® Mr Hastie moved second reading to this by -law CARRIED Mr Boake moved that third reading be given to this by -law at this time. CARRIED UNANIMOUSLY il Mr Marz moved third reading to this by -law CARRIED PAGE 6 �i COUNCIL MEETING SEPTEMBER 22ND, 1987 There was discussion about the request to redesignate the South East of 16- 31 -23 -4 to agriculture in order to allow REDESIGNATE severance of a parcel of land on which an intensive turkey SE 16- 31 -23 -4 operation is carried on It was noted there is already a 20 acre subdivision taken out of the quarter section REFUSED No motion were forth coming for first reading to a by -law to redesignate this quarter section to agriculture, and therfore the application for redesignation was refused The request for redesignation of the South West of 10- 29 -25- 4 was discussed in detail and it was noted no intensive hog REDESIGNATE operation has been carried on at this location for some SW 10- 29 -25 -4 years, although there is a barn there, and the house REFUSED has also been vacant for some years No motion was forthcoming for first reading to a by -law to redesignate this quarter section to agriculture, and therefore the application for redesignation was refused ✓ Mr. Jeffery noted a request for certification of legal CERTIFICATION access to a parcel of land which is severed from the balance OF LEGAL ACCESS of the quarter section by a surveyed road has been received. The land is the South West Quarter of section 1, 29, 21, 4 SW 1- 29 -21 -4 and owned by Mrs Janie Jutras After discussion Mr 4° Hastie moved the M D sign the certification of legal v IeEEer- s,rnt access CARRIED Mr. Wesseling reviewed the subdivision application submitted SUBDIVISIONS by Steve Cullum Farms Ltd., and Franca Farming Co Ltd, for a split of the South East of 15- 31 -23 -4 into two 80 acre SE 15- 31 -23 -4 parcels Mr. Hogg moved this application be tabled until TABLEDA the next meeting of Council ✓ CARRIED Mr Wesseling reviewed the subdivision application submitted by Cullum Farms Ltd., for creation of a 18 4 acre SUBDIVISION subdivision on the North West of 15- 31 -23 -4 and after NW 15- 31 -23 -4 discussion Mr Marz moved the M D. recommend approval for ✓ 1 this subdivision in accordance with staff recommendations CARRIED Mr Wesseling reviewed the subdivision application submitted by Cullum Farms Ltd , for a 14 7 acre subdivision on the SUBDIVISION South East of 16- 31 -23 -4 and after discussion Mr Hatie SE 16- 31 -23 -4 moved the M D recommend refusal in accordance with staff REFUSED recommendations 1etter CARRIED Mr. Wesseling noted he did not have the amending by -law ready in connection with changes to the land use by -law regarding fences, and it was agreed this matter be discussed at the next meeting of Council Mr Wesseling noted Bernard Baird had a survey plan done for his subdivision which was approved as an isolation of existing farmstead in SE 33- 30 -22 -4. A relaxation was obtained to allow creation of a parcel of land larger than 10 acres in size However when the survey was completed the parcel turned out to be 19 acres in size rather than 15 acres After discussion Mr Hogg moved the M.D. approve creation of the 19 acre parcel CARRIED Mr. Wesseling left the meeting at this time -3:00 P.M. Mr Cunningham discussed with Council the Swalwell Water Project and noted the water in the Swalwell Reservoir is not suitable to use unless a very expensive water treatment system was installed, and the water might still be colored and smell. He noted he is presently testing the water from a well recently drilled which produces about 20 to 30 PAGE 7 �' TABLE �a 1 c FENCE AMENDINS BY LAW B BAIRD SUBDIVISION SE 33 -30- 22-4 WESSELING OUT SWALWELL WATER COUNCIL MEETING SEPTEMBER 22ND, 1987 gallons per minute A meeting with the Swalwell residents was held and the people feel the M D should send out the required noti, intention to construct the water system using a revers4 osmosis system and the existing wells drilled in the h This system would cost a maximum of $1.60 per front foot After discussion of this matter, Mr. Hoff moved the M D send out the required notices of intention to construct a water system in the hamlet of Swalwell at a cost not to exceed $365,000 00 and the frontage charge to be levied against the properties shall not exceed $1 60 per front foot CARRIED kU Mr Cunningham noted the well at Keivers Lake is pumping and HUTTERIAN monitors have been installed on wells in the area The well KEIVERS is pumping about 50 to 60 gallons per minute into the lake LAKE It was suggested water samples should be taken from the well PUMP TEST as well as from the lake f, Mr. Hoff noted some work is required at the Swalwell Cemtery SWALWELL to remove drift soil away from the cemetery fence.
