COUNCIL MEETING JULY 7th, 1987
A regular meeting of the Council of the M D of Kneehill Number 48 was held in the
M D Office, Three Hillls, Alberta, on Tuesday, July 7th, 1987, commencing at 9 05 A M
The following were present for the meeting.

Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes
Reeve Hoff called the meeting to order and requested approval of the agenda for
today's meeting
Requests were made to add the following items to the agenda.

Mr Code moved approval of the June 18th, 1987, council meting minutes
CARRIED
Mr. Jeffery reviewed his report covering the period June 18th to July 7th, and
various items were discussed
Mr Boake moved approval for first time gravel for the road West of 21- 30 -25 -4
- Isaac Low Level Crossing and Road
CARRIED
There was discussion about Policy 3 -4 (Convention rates) and the fact
that a policy passed by Council last meeting, which stated the M D would not
pay registration fees for wives attending the 1987 A S B Provincial
Convention, conflicts with Policy 3 -4
It was also noted Policy 3 -4 deals only with payment of registration fees }rJ
for wives of councillors and does not mention the wives of the A S B ratepayer
members who may attend the A S B provincial conventions
Mr Maerz then moved the policy regardingr/lopnyment of registration fees for wives
attending the A S B Provincial Conference in 1987 which was passed at the
last meeting be rescinded, and further moved Policy 3 -4 be amended to provide 41'W
the M D will also pay registration fees for wives of the A S B ratepayer
members who attend any of the A S B conventions and seminars
CARRIED
There was discussion about paying a sub foreman rate to someone on the small
crew while the crew foreman was away on holidays Mr Hastie then moved the
employee contract be amended to provide for payment of a 30 cent per hour
sub foreman rate to the employee appointed to take charge of any public work
crew during the time the foreman and or sub - foreman are away on holidays
during the summer construction season
There was discussion about the public utility board hearing which has been
scheduled in connection with the application made by Canadian Western Natural
Gas Mr Boake moved a committee of Otto Hoff, J Finlay Code, J C Jeffery
and himself be appointed to attend the Public Utility Board hearing on behalf
of the M D

Mr Code moved a water tandem truck driver classification be approved for

Mr Maerz advised Council of his concerns about the proposed amendment
to the M.D land use by -law, which would allow creation of a local
rural commercial district anywhere in the M D He suggested Council
might consider restricting this district to the Red Deer River Valley only
There was lengthy discussion about this matter
Mr Jeffery also reviewed the Shadlock situation and noted Mr Cunningham
has a Stop Work Order prepared The M D solicitor, Mike Welsh
suggested the M D consider using a consent stop work order, rather
than the stop work order, and Mr Cunningham is proceeding on that basis
Mr Boake moved to accept and file this report

Mr Hastie moved acceptance of Mr Jeffery's report

Mr Jeffery reviewed the budget comparison report and after discussion
Mr Hogg moved approval of the budget comparison report

~ Mr Jeffery reported on the recent incident where some M Drgfic were
removed and or reversed He noted the R C M P will be laying charges
Mr Mueller moved to accept the report as information
CARRIED
Oris Rodger entered the meeting at this time - 10.00 A M
Mr Maerz advised Council of an incident he and his wife were involved
in at Keivers Lake Park Park regulations require all dogs at the
park to be on a leash, but the owner of a Doberman dog allowed it to
run loose even though he had been warned at least three times by the
attendant to keep it on a leash The dog came at Mr and Mrs Maerz
but finally backed off After lengthy discussion about this matter, Mr
Maerz moved as follows:
1 A $20 00 deposit must be paid by any person bringing a dog with
them into the Keivers Lake Park
2. The person is to be advised the dog must be kept on a leash at
all times
3 If the dog is not kept on a leash as required, the person and his
dog will be evicted from the park inmdiately and the person will not
be allowed to make use of the park facility for the remainder of the
season
4 If the dog is properly restrained on a leash at all times while in
the park, the $20 00 deposit will be refunded when the person and the
dog leave the park
Mr Rodger reported the Carbon Fish Dam requires about six loads of
rocks hauled in, otherwise the dam is not in bad shape It will also
require installation of an approach
Mr Code moved the M D install an app -ro:-Ich in to the Carbon Fish
Daml and also proceed with repair of the dam spillway as time permits

' Mr Jeffery reviewed the report from the July 25th and July 3rd road
tours and several items were discussed

Mr Hastie moved he be excused from discussion and voting with regard
to the Wimborne Sewage Line problems as his sons rent the land and are ✓1
requesting payment from the M D for loss of crop due to the sewage
line leaks

The road committee recommends the M D pay crop damages for eight
acres of crop lost by the renters in 1986 and 1987 on the N2 27-
33-26-4 due to the leak in the sewage line The committee also recommend
-- the line be repaired as soon as possible, and the owner of the trailer
which is located on the old C P railway property be billed for water
and sewer charges effectively July 1st, 1987, and the owner of the
trailer which is located on the NE 27- 33 -26 -4 be billed for water charges
only effective July 1st, 1987
Mr Hogg moved to accept the recommendation of the road committee in
connection with the Wimborne sewage line problem

Mr Hastie returned to the meeting at this time
The driveway constructed for Robert Boese at SE 20- 30 -25 -4 was
discussed and Mr Boake moved approval of the construction of a
driveway for Mr Robert Boese
CARRIED
Mr Mueller moved approval of the June 25th road committee report
CARRIED
Mr Jeffery reviewed recommendations made by the Road Committee in
connection with the road tour held on July 3rd, and after lengthy
discussion of certain items, including the next small crew project
- Vasseur Road Project and Low Level Crossing - Mr Hogg moved approval
of the road committee report of July 3rd, 1987
CARRIED
Mr Boake noted Don Kostrosky Farms are not happy with the clean up of
the borrow pit taken on their land for SR 575 road construction
Mr Boake then moved Mr Kostrosky be advised to finish cultivating
the borrow pit area on his land - NE 21- 29 -25 -4 - and if a considerable
amount of rocks are brought to the surface, the M D agree to pick
the rocks once, and thereafter the M D will accept no more responsibility
for reclamation of the borrow pit area

Mr Jeffery noted the Minister of Transportation wishes to know the
traffic volume on the Wimborne Mobil Gas Plant Road - both to the north
and to the south of the plant. Mr Boake moved the M D undertake a
traffic count on the Wimborne Gas Plant road for two days on the north
side and two days on the south side of the plant during the hours 6-00 A M
and 6.00 P M

Mr McNair has submitted an account to the M D for stripping work done
at the McNair Gravel Pit in the sum of $3,325 00 After discussion
Mr Maerz moved Mr McNair be advised the M D is not prepared to pay
this account, but the M D will later this fall do one day's stripping
work with three buggies at his pit, as previously agreed

There was discussion regarding the need for unleaded fuel and Mr
Maerz moved the M D agree to purchase unleaded fuel for the keylock
system at the shop
CARRIED
Mr Jeffery reviewed the provincial secondary road standards, and
after discussion Mr Hogg moved to accept as information
CARRIED
Mr Hastie moved yield signs be erected on the road west of 1, 12,
13, 24, 25 and 36 in 33 -25 -4 and West of 1 & 12 in 34 -25 -4 - so the
east west traffic is required to yield to the north south traffic
CARRIED
The Town of Three Hills have invited the M D to take part in its 75th
Anniversary Celebration opening ceremonies planned for the July 31st
weekend Mr Maerz agreed he would do this on behalf of the M D as
Reeve Hoff will be taking part in the Village of Carbon anniversary

celebrations planned for the same weekend The Town of Three Hills would
also like the Reeve and Councillors to take part in the parade and also
place an congratulation message in the 75th Anniversary Commerative Booklet
they are having printed 0)U ��rt
Mr Mearz moved the M D put a half page congratulatory message in the '- 'J
Three Hills 75th Anniversary Commerative Booklet, the Reeve and Deputy
Reeve ride in the parade if
Fa possible, and further he be authorized to take
part in the opening ceremonies as a representative from the M D

The meeting adjourned for dinner between 12.00 Noon and 1.00 P M
Councillor Meerz did not return to the meeting after lunch V,
Mr Code moved approval of the accounts presented for payment today, I
subject to further review by the finance committee of Otto Hoff and himself
CARRIED
Mr Jeffery read a letter from Alberta Agriculture in which the Province
advises It has changed the cost sharing formula for construction of
new seed plants In future the Province will only contribute 30% of the
eligible costs instead of 40% Costs will be shared 50% by the plant,
30% by the Province and 20% by the local government(s) There was discussion
about this matter, and Mr Hogg moved acceptance of the report

Mr Jeffery reviewed a letter prepared by the office in connection with
advice to be given to any new employee of the M D Mr Code moved
approval of the letter as drafted and same is to be given to all new
temporary M D employees at the time of hiring
CARRIED
Mr Jeffery reviewed the A S B minutes from the meeting held June 30th,
and after discussion it was agreed the A S B. weed tour day be held July
29th or July 31st instead of July 30th, which is the date of the M D
auction sale
There was also discussion about the possibile Tordon contamination of a
field belonging to the Hutterian Brethren of Huxley
Mr Boake moved approval of the A S B meeting minutes
Mr Jeffery noted the Public Utility Board have forwarded notice
Canadian Western Natural Gas have requested a hearing to determine
whose responsibility it is to locate, expose and or mark pipelines
He also noted AAMD & C has forwarded a draft of a low pressure gas line
road crossing agreement After discussion of this matter, Mr Hogg
moved to table consideration of this agreement until after the Public
Utility Board hearing has been held
Mr Boake moved the M D discuss with its solicitor, Mr Welsh,
whether the M D should request representatives from other Municipal
Districts and Counties to attend the Public Utility Board hearing

Mr Jeffery noted Mr Cunningham met with the engineer for the Churchill
Water Co-op, and discussed with him the proposal to put the water
line on the travelled portion of the M D forced road in SE 27- 28 -21 -4
as well as their request to open cut at least 10 undeveloped road allowances
Mr Code moved Mr Cunningham meet with the engineer again to further discuss
their proposal to put the water line inthe travelled portion of the road
in Section 27 and also moved the Co -Op be given permission to open cut the
road crossings on undeveloped road allowances on condition the Co-op Sick,
the M.D road crossing agreement
Mr Sam Bulych and Mr Gordon Caldwell from Torchinsky Consulting along
with Oris Rodger entered the meeting at this time The bids received

for SR 587 road project were opened and briefly reviewed Several
of the contractors bidding on the job were present
Mr. Bulych advised the contractors they would review the bids, thanked
them for coming and the contractors left the meeting
Mr Rodger, Mr Bulych and Mr Cauldwell took the bids and left the
meting
Mr Jeffery reviewed the make up of the Rocky View Fire Association
and after discussion Mr Hogg moved the M D enter into a mutual aid
agreement with the Rocky View Fire Association

Mr Jeffery noted Council must pass a resolution setting a time when
Council will consider giving second and third reading to by -law number
1128 After discussion Mr Hogg moved Council consider giving second
and third reading to by -law number 1128 at 1 00 P M on Tuesday,
November 24th, 1987

Mr Mueller moved to table Item Number 23 on the agenda until the
next meting of Council.

Mr Hoff noted Richard Csakany advised him they are not able to find
a machine heavy enough to remove the cement pad from the lots in
Swalwell They therfore would be willing to forego payment of
the $500 00 if the M D would accept the lots back without having
the cement pad removed They will remove the pile of gravel which
is still on the lots

Mr Hoff then moved the M D agree to accept Lots 1 & 2 in Block
10 Plan 7810530 back,with the cement pad left on the property, as long
as Mr Csakany is willing to forego payment of the $500 00 which was to s �}
be paid to him, and he remove and clean up the pile of gravel left on the
lots

Mr Bulych and Mr Cauldwell returned to the meeting at this time - 3 08
P M and noted that Cee Gee Earth Moving of Medicine Hat is the lowest bidder
for the SR 587 road project
Mr Bulych also noted the entire 3 miles of SR 587 from SR 806 east
could be re- constructed for about $300,000 00, not including the cost
of buying the extra right of way and utility moves
Mr Bulych and Mr Cauldwell left the meeting to further review the bids
The Executive Committee report was reviewed and several items discussed
Mr Mueller moved acceptance of the Executive Committee Report

Mr Jeffery noted Joe Kubenic would like to purchase the rest of the gravel
dirt mixture which is stock piled south of the Tolman Park +c
Mr Mueller moved Mr Joe Kubenic be given S�� L
gravel is remaining at the Tolman stock pilees tesatnatprice cofs$1 OOtever
per yard, and he be given a maximum of two years in which to remove the
gravel from the stock pile site

There was discussion regarding the M D policy in connection with widening
of existing culverts and approaches
Mr Mueller moved the M D widen the existing culvert and approach on the
road east of SE 25- 32 -23 -4 for Mr Oscar Kesterke
and Mr Cauldwell CARRIED
Mr Bulych /returned to the meeting and noted Coe Gee EartfiMoving would be
willing to do the extra two miles of SR 587 at the same price per yard as
quoted for the first mile They would be able to start the project in about
10 days
After discussion Mr Hogg moved the M D accept the bid of Gee Gee Earthmoving
of Medicine Hat to construct the first mile of SR 587 and the Intersection

of SR 587 and SR 806 at a price of $131,995 00 and further moved that
Cee Gee Earth Moving be authorized to construct the next two miles of
SR 587 on condition the company is willing to do the irk at the same
unit price as quoted for the first mile of the road
Mr Code moved an amendment to the above noted motion by deletion of the
paragraph which makes reference to construction of the extra two miles
of SR 587
AMENDING MOTION WAS DEFEATED
A vote was then taken on the original motion and the motion WAS CARRIED
Mr Bulych and Mr Cauldwell left the meeting at this time 4.23 P M
Mr Hastie moved this meeting do now adjourn

47 LETTER FROM JIM BISHOP
Council sent Mr Bishop a letter June 25, 1987 advising him that
they did not want to give support for a meeting with the province
and that they would like to hear from Alberta Weather
Modification as a whole not an individual director. Mr Bishop
wrote us back as an individual advising of the problems of
getting a meeting set up. _
Recommend to Accept and file.
48 LETTER FROM ALBERTA PLANNING BOARD
Letter from Alberta Planning Board advising the M D of Kneehill
that the appeal respecting the proposed subdivision of E Stickel
on S.E 7- 32 -24 -4 They request that we notify them as soon as
possible if NO ONE will be attending on the M D.'s behalf
Recommend that Otto Hoff represent the M D of Kneehill at the ✓1
hearing which is to be held at Palliser Regional Planning Comm.
office in Hanna on July 22, 1987 at 10 00 A.M.
49 REQUEST FROM MILTON REMPFER
Request from Milton Rempfer to have a M D radio installed in his
truck so that he can get ahold of M.D. personnel for buring etc. T°

Letter from Palliser advising the M D of Kneehill that the
proposed subdivision for Wesley Gore at N W 8- 30 -24 -4 have been
approved.
Recommend to accept and file
51. REQUEST FROM PLACER CEGO
Request to open cut on undeveloped road allowances between
sections 10 & 11 in 34 -22 -4 and between 14 & 32 in 34 -22 -4 ��ex

Recommend that it is O.K. to open cut these two road allowances

Letter on behalf of General Safety Services Division asking the
M D of Kneehill's opinion on the training of fire service

personnel, investigation of accidents and fires, safety
inspections etc
Recommend that the M D of Kneehill comment that the Fire
Training School should be aimed at Rural and small Town
departments as well as large urban centres

Letter regarding Secondary Road Meeting Palliser Regional
Planning Commission has held this type of meeting in the past and
feel it would be beneficial to provide a forum for htis on a
regular basis

1 ) Bigelow low level culvert South of 3- 34 -25 -4, 0 K to
write off and apply for grant
2 ) Gelinas project - West of 1 & 12- 34 -25 -4 Two mile
project, 0 K. to write off Road is high due to the old road
was mainly black dirt and trees so rather than remove old road
completely, we hauled clay on top & packed it. Requires black
dirt to be moved back, fencing and general clean up
3.) Yield sign down one mile east of Arthurville Hall
4 ) Reveiwed Robert Kerns request for approach S E 8 -34 -25
Cannot allow approach where they wish due to sight distance, but
it is possible to put one on brim of the first hill north of the
house. Road will be rebuilt in approximately two years and
perhaps concerns can be overcome at that time. Recommend have
Oris reveiw this with Mr. Kerns to see if this solution is
acceptable
5.) Have Alex check out open cut in road without permission
by A G T approximately 200 yards north of #587 north of Mobil
Gas Plant at Wimborne.
6.) Reveiwed Wimborne Sewer situation with Leonard Litz and
recommend to council as follows Pay crop damages in the amount
of eight acres for 1986 & 1987 damages on four acres for 1986 &
1987 and recommend to charge water and sewer services for the
trailer or old CP property and water only for the trailer in Len
Litz's yard with no retro payments, only bill from now
7 ) Culvert required at Weigums' West of 2- 33 -24 -4 north of
#27 approximately 200 yards
8 ) Art Thomas to check grass seeding at Bruce Hastie house
and check brushing at Albert Ensminger's driveway toward Gerhart
Schneiders
9.) Checked Quintana at 16- 27- 32 -24 -4. Clean up is good, dry
hole, no christmas tree, will not proceed with road development
10) Small crew now on Gorr Project, project incomplete at
this time
11) Reveiwed Paul Weigum

sloping project only, no road built, only some culverts replaced
and low areas filled in, consider as 1/4 mile project as crew
took approximately one week, general clean up and rock picking
and some fencing yet required
13) Dust control project south fo 30- 30 -25 -5, 112 mile -
seems to do well so far.
14) Issac low level crosisng 112 mile project West of 16 &
21 in 30 -25 -4 Culverts not yet cemented in - Driveway built for
owner Bob Boese not approved by council East end of one culvert
is buried in rocks General clean up required, fencing to be
done on north end west side of road, as per agreement
15) Pavement ends sign to be removed right across from Linden
Nursing Home

2 Vern Bogner - low level crossing - SW 1- 33 -23 -4 - fob satisfactorily completed

3 Gulf Oil Culvert West of 3 - 28- 30 -22 -4 - culvert installed okay to write off
4 Carney low level crossing - S 3- 31 -22 -4 - - requires low level signs to be
installed
5 Reviewed paving crew - Orkney Project - not complete
6 Reviewed Lloyd Dennie - access problem - agreed to phone Mr Braaz for
appointment to see him (Access to NE 23- 29 -21 -4)
7 Looked at SR 575 portion completed by Alberta Transportation - 3 5 Kilometers - okay
to write off
8 Reviewed Blade grade South of 5- 29 -23 -4 - Requires some clean up at west end of
project - south side of road Okay to write off
9 Mildenstein Pit clean up - West of 17- 29 -23 -4 - area has been reclaimed
Check with Art re. seeding has not seemed to catch as yet
10 Reviewed SR 575 project from #21 to Acme all okay to write off
need measurements for land and borrow pit payments Need clean up on
road allowance west of Grainger Bridge - culverts and signs, etc
