Finlay Code Division 1 Otto Hoff (Reeve) Division 2 Robert E Boake Division 3 Richard A Maerz Division 4 Harold Mueller Division 5 Bruce Hastie Division 6 Lawrence Hogg Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator, was present and recorded the minutes Reeve Hoff called the meeting to order and asked for a motion approving the agenda for today's meeting There were requests to add the following items to the agenda 14a Road Approach - Robert Park Sw 17- 32 -24 -4 15a Application of chemical Edge to roadsides 37. Air Conditioner for Water Truck 39 Request from A S B for summer help to attend one day weed seminar in Olds Mr Hogg moved approval of the agenda with the above noted additions CARRIED Mr Boake moved approval of the May 12th council meeting minutes, subject to the following corrections Page 3- second paragraph - Oris Rodger entered the meeting at this time Page 8 - second paragraph - reference to provision of hot mix - should be $50,000 00 worth, not $60,000.00 CARRIED Mr Jeffery reviewed his report covering the period May Is V1 q...O A 12th, 1987 to May 26th, 1987, and after discussion of J C several items, Mr Mueller moved acceptance of Mr. Jeffery's / JEFFERY report REPORT CARRIED Mr Hastie moved approval of the accounts submitted for APPROVAL payment today, subject to further review by the finance ✓ ACCOUNT'S committee of Mr Maerz and Mr Boake. CARRIED Mr. Hoff noted the County of Wheatland has met with the Palliser Regional Planning Commission to discuss the possibility of joining Palliser Commission or alternatively creating a separate commisson with the County of Newall and the County of Vulcan. The commission felt there would be no objection to the County of Wheatland joining Palliser as long as there was no reduction in service to the other ✓ areas Mr Maerz moved acceptance of Mr Hoff's report CARRIED Mr. Jeffery reviewed discussions held with Ernie Walters in Edmonton recently with regard to the pipeline road crossing agreement situation Mr. Walters suggested the M D change its road crossing agreement and have two agreements - one for a low pressure line and one for a high pressure line and in the low pressure line agreement the M D accept responsibility for exposing the line The committee recommend the M D not accept this recommendation and not sign any revised agreement with Canadian Western Natural PAGE 1 PALLISER REG COMM MEETING WITH WHEATLAND ROAD CROSSING AGREEMENT PROBLEM. murz 0 3 r E_ • • • COUNCIL MEETING MAY 26TH, 1987 Gas The committee also meet with Mike Welsh and attended a Public Utilities Board hearing with Mr Welsh in connection with the same type of situation and Mr Welsh recommended the M D not accept the recommendation made by Mr Walters to have two agreements, but did suggest the M.D standardize its road crossing agreement to comply with E.R.C.B. regulations, and also advise Mr Walters the M.D. is not happy with the proposed agreement and does not propose to sign any kind of revised agreement with C W N G After discussion of this matter, Mr. Maerz moved the M D advise the firm of Brownlee Fryett (Ernie Walters) and Alberta Association of M D & C that it is not willing to accept the road crossing agreement prepared by Brownlee Fryett as it makes line exposure the responsibility of the i M D CARRIED Mr. Hastie moved Canadian Western Natural Gas be requested to sign the existing M D road crossing agreement on an individual basis, as they have done in other similiar instances, in order to provide gas service to Mr Emil Ziegler of Carbon and Mr. Robert Barnes of Carbon (if the people still wish to have gas provided to their residences) as the M D is not prepared to accept any responsibility for line moves and or line exposures, and further the M D will present its position on the matter at the Public Utilities Board hearing requested by Canadian Wetern Natural Gas. CARRIED Mr Hastie moved the M.D. hire Michael Welsh, Solicitor, of Edmonton to represent the M D in connection with any Public Utilities Board or Energy Resource Conservation Board hearings or any negotiations with Canadian Western Natural ✓ Gas with regard to the road crossing agreement dispute. CARRIED Mr Jeffery read a letter from AAMD & C in which the Association advise Alberta Community and Occupational Health are reviewing regulations regarding keeping of livestock and poultry The Committee reviewing the legislation wish to know if the local municipalities would agree to deletion of distance separation requirements from Provincial Legislation and include and enforce same in Local land use by -laws Mr.Boake moved to table this matter until after dinner today ✓ so the matter can be discussed with Ross Rawlsuyk from Palliser Commission CARRIED Mr Jeffery read a letter from the Hudson Bay Route Association The assocation are requesting all municipalities pass a resolution which would request the Government and the Canadian Wheat Board to keep open and make use of the Port of Churchill It was noted Saskatchewan Agriculture has ceased to fund the Hudson Bay Route Association as they feel the railway line to the Port is too expensive to maintain for the amount of grain which is shipped from the Port Mr Boake moved the M D contact the Minister of Agriculture for the Province of Saskatchewan and determine their reasons for ceasing to fund the association CARRIED Mr Rodger entered the meeting at this time �_t DISTANCE SEPARATION REGULATIONS HEALTH ACT HUDSON I BAY ROUTE ASSOCIATION e-�_ �-c r- SeC1t, c6OeM_. Mr Boake moved to table item number 9 on the agenda -Thurn TABLE THURN Gravel Pit - until the June 18th meeting of Couunci 1 . 1 c�le� GRAVEL PIT CARRIED Mr Jeffery noted the Trochu East Road - West of 16- 32 -23 -4 is still part of the M D , but the road will require about 3 days of buggy work before first time gravel could be PAGE 2 I TROCHU EAST ROAD W 16- 32 -23 -4 0 E10 • C COUNCIL MEETING MAY 26TH, 1987 applied. It was noted the road is not required and presently is only a prairie trail Mr. Hogg moved the motion approving first time gravel for the Trochu East road be rescinded until such time as the needed road work can be done CARRIED Mr Hogg noted a small amount of buggy work is required to cut a hill East of 6- 34 -24 -4 (Gerry Walker Project) This project was previously approved to be done by the divisional motor grader, but the grader will not be able to do the work. Mr Hogg then moved the main crew be given permission to work on this project for up to one -half a day, using one V buggy, when the crew is in that area CARRIED Mr Code requested Mr Rempel be advised not to put any gravel on the South Hesketh Hill this year There was discussion about the Linden West road (from the Village to the railway tracks) Mr Maerz moved Oris Rodger be given permission to put on whatever gravel is required, use packers (if necessary) and apply Envirobind Dust Control i product on the road, as a gravel retention experiment. CARRIED Council discussed the backsloping borrow pit agreement and the problems being encountered in connection with fence removal and replacement policy. There was also discussion regarding the request from Alvin Dugdale for an approach on SR 575 He wanted an approach installed at the bottom of the hill but after discussion with him he agreed to locate the approach at the top of the hill further to the east, and this approach will provide at least 1000 feet sight distance. There was discussion as to whether there should be a limit on the number of approaches permitted on a secondary road, and whether the sight distance for approaches on secondary roads should be greater due to the heavier traffic and higher speeds After lengthy discussion Mr. Code moved Mr Alvin Dugdale be given permission to install a second approach from South East 30- 29 -23 -4 on to SR 575 at the location at the top of the east hill as recommended by Mr Cunningham, as long as Mr Dugdale installs the approach in accordance with M.D. regulations CARRIED There was discussion about the need to establish a minimum price to be paid for land required for road widening, and whether there was a need to make other changes to Policy 13- 13 After lengthy discussion Mr Maerz moved Policy 13 -13 be amended as follows Clause 1 add after "the applicable foreman" the words "if possible Clause 2 add at the end of the clause "with a minimum price of $250 00 per acre." CARRIED Mr. Jeffery noted Mr George Robertson of Edmonton has two quarters of land which will be going to in the tax sale this afternoon If Council will agree he will deposit with Mike Welsh of Edmonton, Solicitor for the M D , the amount necessary to clear the taxes to the end of 1986 in cash, and Mr. Welsh will have the funds transferred to the M.D. of Kneehill account in the Treasury Branch in Three Hills. After discussion of this request Mr Hoff moved the M D agree to remove Mr Robertson's quarters from the tax sale as long as Mr Robertson deposits with Mr. Welsh the cash necessary to clear the taxes to the end of 1986 prior to PAGE 3 BUGGY WORK ROAD E 6- 34 -24 -4 HESKETH HILL NO GRAVEL LINDEN WEST ROAD BACKSLOPING BORROW PIT' POLICY CHANGE ALVIN DUGDALE ROAD APPROACH ON SR 575 SE 30- 29 -23 -4 In. r% MINIMUM PRICE TO BE PAID FOR LAND fo k I r j K TAX SALE PROBLEM GEORGE ROBERTSON LAND ma COUNCIL MEETING MAY 26TH, 1987 1 00 P M , today CARRIED Mr. Maerz moved that if Mr Robertson is not able to deposit the required cash to clear the taxes on his land prior to 1 00 P.M. today, the Clerk notify anyone interested in bidding on the land at the tax sale that in accordance with ✓� Section 12 of the Tax Recovery Act, the sale is subject to the rights of any existing tenant lawfully occupying the land during the current crop year and to the 31st day of December, 1987 CARRIED Mr Rodger noted hot mix for patching secondary roads can TABLE be obtained from the Province of Alberta at their Highway HOT MIX Number 42 plant site later this fall after highway 21 has FOR been paved He also reviewed for council the price quoted PATCHING by Border Paving for laying hot mix for various repair jobs SR ROADS The cost to haul and lay the material would amount to BY-LAW $114,000 00 for the fobs planned. He reviewed other CHANGES alternatives and there was discussion about whether the turn out area on SR 583 could be surfaced with light coat TABLE W GORE surfacing rather than hot mix SUBDIVISION Mr Maerz moved that road signs such as - Deposit Litter Ahead, Road Turn Out Ahead etc. be erected on SR 583 SR ✓ LITTER 805 and SR 806 in the appropriate locations SIGNS CARRIED SEPARATION Rawlusyk noted this change has been put through already as RODGER OUT Mr. Rodger left the meeting at this time. The meeting adjourned for dinner between 12 00 Noon and 1 15 DINNER P M The Council meeting reconvened at 1 15 P M following TAX SALE completion of the 1987 Tax Sale Ross Rawlusyk from Palliser Regional Planning Commission and RAWLUSYK Alex Cunningham, Development Officer entered the meeting at & CUNNINGHAM this time. SUBDIVISION CARRIED The letter from the Association regarding including and enforcing distance separation regulations under the local DISTANCE land use by -laws were discussed with Mr. Rawlusyk Mr SEPARATION Rawlusyk noted this change has been put through already as REGULATIONS far as subdivision regulations are concerned, as part of the de- regulation process of the Province of Alberta There was discussion about this matter and noted it would be difficult for a development officer to enforce and it would take alot more work The committee discussing proposed changes for the M D land use by -law in connection with Y intensive operations felt it should not change the by -law �Q until new provincial regulations to protect the farming industry are put in place. It was also noted it likely would put more pressure on the councils to grant relaxation of the setback requirements and lead to a larger number of appeals to the Development Appeal Board Mr Code moved the Association and the Government be advised these kind of regulations should be kept in provincial ✓ (% legislation rather than being dealt with at a local level PAGE 4 L • i� COUNCIL MEETING MAY 26TH, 1987 through a land use by -law CARRIED Mr Jeffery noted more information about the 1986 federal census figures has been received. The count of 4996 is now official and the final dwelling count has been completed. This count is down from 1620 dwellings to 1512 More information will be available later with regard to age breakdown -1C-51, Mr Boake moved the increase in population of 165 people be '-/v allotted to the various recreation areas on a percentage basis until a better breakdown by township and range is madef available CARRIED Mr Rawlsuyk discussed with council the need to establish a policy with regard to municipal reserves on subdivisions, and Mr Hastie moved the M D establish a policy of requesting cash in lieu of dedication of land reserves, when�G�� taking of such reserves is possible under Provincial Planning Regulations Mr Hogg moved Council meeting do hold the Development Appeal Board today Mr. Mueller moved Council meeting developmentn appeal board hearing Time 2 45 P M CARRIED now adjourn in order to hearings scheduled for CARRIED do now reconvene, the s having been completed CARRIED Mr Maerz moved that yield signs be located on the following roads In South West corner of SW 25- 31 -24 -4 in North East corner of North East 23- 31 -24 -4 and in south west corner of SW 26- 31-24-4 so the east west traffic must yield to the north south traffic CARRIED Mr. Rodger entered the meeting at this time. Mr. Rawlusyk and Mr Cunningham left the meeting at this time There was further discussion about obtaining hot mix to repair secondary roads this summer and the costs for same Mr Maerz moved the turn out area on SR 583 and the bump area on SR 806 be surfaced with cold mix unless Alberta Transportation has a hot mix plant available at their Torrington Pit soon, and in that case the areas be surfaced with hot mix CARRIED The required patch work on SR 583 ws discussed at length as well as the large cost which will be incurred in doing this work It was noted there is at least one half mile of road from the bridge to the Machell Hill which requires patching as well as areas on the Schaffer Hill The possibility of using cold mix instead of hot mix was discussed and Mr Hastie moved Oris review the costs of using cold mix as opposed to hot mix and the matter be tabled until the next meeting of Council CARRIED Mr. Rodger advised Council that the Don Reynolds culvert and approach is being installed today There was lengthy discussion about the request from Robert Park to install a second approach with culvert into his land - 40 acres in SW �AG02 -24 -4, and the existing M D policy regarding provision 5 f 1986 CENSUS INFORMATION WWN • MUN RESERVE POLICY RE SUB - DIV3:SIONS ... . Mr Maerz moved the M.D. second approach and culvert into the 40 acre pa Mr. Robert Park in the SW 17- 32 -24 -4 CARRIED Mr Code advised someone had put oil on SR 841 as a form of dust control and noted that use of oil for dust control is not allowed under existing M D policy Mr Hastie noted the chemical EDGE had been put on the South Wimborne road last year as part of an experiment so the grader operator would not have to cut off the edge of the road to remove the grass. The chemical appears to have worked well in most areas, but the road should likely be sprayed again to complete the grass kill He also requested the M.D. experiment with some type of gravel retention product on this 7 mile stretch of road Mr Jeffery noted it would likely cost about $3500 00 mile to apply Envirobind. After lengthy discussion of this matter, Mr Maerz moved the M D conduct a gravel retention experiment in 1987 using Envirobind and the chemical Edge if required, on a maximum of 20 miles with a minimum of two miles in each division, and the following roads be used Division 1 - 2 miles on the Nacmine Road from Highway No 9 North Division 2 - 4 miles from the Carbon Elevators south and west to Highway 21 Division 3 - 3 miles from the Mennonite Church of God north Division 4 - 2 miles on the Fisher Davis Road (or one mile of the H. Jesske Road and one mile on the Three Hills Golf Course Road. Division 5 - 2 miles on SR 836 from Highway 27 south Division 6 - 5 miles from Wimborne going east on the South Wimborne Road Division 7 - 2 miles from Trochu West Total of 20 miles CARRIED Mr. Maerz moved this meeting carry on until 5 30 P M CARRIED Mr Code moved Mr.Thomas, Mr Weigum, and the two temporary summer staff be given permission to attend the one day weed seminar in Olds CARRIED Mr. Mueller noted the railway crossing south of Three Hills is in bad shape and there are alot of new railway ties lying around which are a hazard to traffic Mr. Rodger was instructed to check into this matter Mr Jeffery noted the road committee of Otto Hoff and R. A. Maerz would like to go out on Friday, May 29th, 1987 after completion of the Executive Committee meeting, in order to inspect numerous road projects, and it was agreed this would be satisfactory Mr Code asked if Council intend to continue to charge a $20 00 fee for accepting and processing tree applications in 1987 The Province is planning on charging a $25.00 fee as well as a small amount for each tree After discussion Mr. Code moved to accept this report and no change be made in the existing M D policy regarding trees. Other PARKS AND CEMETERIES COMMITTEE MEETING FRIDAY, MAY 22, 1987 Meeting held at Keivers Lake Park and Swalwell Dam Park comencing at 11 00 A M Members Present Richard Maerz Otto Hoff Lawrence Hogg Arthur Thomas Bruce Weigum John Boxma Mr Thomas read the minutes of the March 16 1987 meeting Otto Hoff moved approval of the minutes as read. Carried Business arising from the Minutes, When Dave Pearson was contacted regarding his selection as Park Attendant for Keivers Lake he indicated that he had accepted another position in the mean time John Boxma was then contacted and he indicated that he was still interested in the position and so he was offered the part time position on the same basis Richard Maerz welcomed John to the meeting and wished him well for the summer season New Busines 1 The letter from Eric Vuori, Head of Habitat Management, Fish an Wildlife Division regarding construction of the Grainger reservoir was briefly discussed. Lawrence Hogg moved that it be recommended to council that the M D not become involved in the Grainger Reservoir but that this committee has no objection to Fish and Wildlife proceeding with development as long as the Swalwell Fish Dam would not be phased out in the near future Carried 2 The committee reviewed the Keivers Lake Park Policy and after discussion it was felt that the rates charged should be increased. Lawrence Hogg moved that it be recommended to council that the rates for the 1987 season be as follows, Day Pass $2 00 Bus Pass $2 00 plus 50 cents per person Overnight Camping $6 00 per unit Weekly Camping $30 00 per unit Storage $2.00 per night Seasons Day Pass $15 00 and also that the Check Out time be 11 00 AM Carried 3 The Committee reviewed the upgrading progress at Keivers Lake Park, Highway, Entrance, and Information signs set -up More trees to be planted yet, Fire pits not installed yet, Dedication plaque will be installed soon, Advertisements will be placed in the local paper The Official Opening Day, June 19 is being planned, lunch for the committee and visiting Dignitaries in Threehills followed by coffee and donuts, at the lake for the public Camping stall designations will be added as the stalls are developed PARKS AND CEMETARIES COMMITTEE MEETING (continued) The playground equipment was inspected by the committee and found to be in good repair Lawrence Hogg moved that 2 sets of Horse Shoes be purchased and be available from the park attendant Carried Richard Maerz moved that the M.D. welders cut up 24 -36 inch used culverts for fire pits either at the shop or the job site Carried 4 The committee inspected the upgrading of the new pump out toilets and the other facilities at the Swalwell Dam Park It was noted that new entrance signs would be erected in the near future. 5 The committee was informed that the mowing and maintenance was underway on the cemetaries Richard Maerz moved the meeting be adorned at 3 OOpm Carried u4 L� JOHN C.
